6 CITY OF CEDAR HILL CITY COUNCIL AGENDA ITEM Public Hearing #1 Agenda Date: March 8, 2016 Agenda Item Wording: Case No CONDUCT A PUBLIC HEARING and instruct staff on the preparation of an ordinance changing the zoning on 6.00 acres of land out of Abstract 1226, generally located south and east of the dead-end of Maplegrove Drive; requested by Jay Childs with Dietz Engineering on behalf of Hillcrest Baptist Church. Summary: This proposed Planned Development will be the third phase of the Cresthaven Village Retirement Facility. The applicant states that they intend to continue with the same type of land use and design standards as they have done in the previous two phases. This phase is planned to include 22 single story detached and 2 single story duplex buildings (4 dwelling units), each with a two-car garage. The proposed development would be limited to retired persons, 60 years of age and older. The facility is shown to be a single 6 acre lot holding individual condominium units. As such, the interior of the dwellings would be owned by individuals, while the exterior, including the entry gates, streets, landscaping, fencing and building exteriors, would be owned and maintained by the condominium management. The private streets in Phase 1 and 2 would be extended into this new phase. The project would be gated and its main access is shown to be through the existing Cresthaven Village development. An emergency access gate is shown at Maplegrove Drive, a public street. Planned Development Districts require at least two public hearings; the first being the establishment of the district including development standards and a concept plan; and the second being the approval of a detailed site plan. The City Council may also require a development plan, which would occur between the establishment of the PD District and the site plan. The applicant has submitted a narrative describing the facility, a concept plan showing the general driveway and building locations, and a request for the City Council to waive the traffic impact analysis and development plan requirements. As with all zoning changes, a public hearing is required prior to being acted on by the Commission. Notice of this public hearing has been published in the newspaper and has been mailed to property owners within 200-feet of the request. The Planning & Zoning Commission conducted its public hearing on this matter on February 16, 2016 (see attached minutes). The Commission, by a vote of 6-0, (one member absent), recommended approval of this request, as presented. Turk Cannady/Cedar Hill Room, 285 Uptown Blvd, Bldg. 100, Cedar Hill, TX. Planning & Zoning Commissioners present: Chairman Theresa Brooks, Vice-Chairman Bill Strother, Commissioners: Timothy Hamilton, Lisa Thierry, Michael Deeds and Gehrig Saldana Absent: Commissioner Adriane Martin City Staff members present: Rod Tyler, Director and Sharon Davis, Executive Secretary. I. Call the meeting to order Chairman Brooks called the meeting to order at 6:00 p.m. declaring it an open meeting in which a quorum was present and the meeting notice was duly posted. II. Approve the minutes of the November 17, 2015 regular meeting A motion was made by Commissioner Deeds and seconded by Commissioner Hamilton to approve the minutes of the November 17, 2015 regular meeting. Case No Review and consider the Preliminary Plat and Layout Plans for JPS Legacy Addition, showing two (2) non-residential lots being 17,194 acres out of Abstract 435, generally located on the southeast corner of E. Pleasant Run Road and N. Joe Wilson Road; requested by Stewart Hoffman on behalf of JPS Legacy, LLC. Mr. Rod Tyler, Director of Planning delivered the staff report by stating the applicant was proposing to subdivide the property into two (2) parcels and dedicate easements and ROW for development. He stated that the property was zoned LR Local Retail and it was staff s

Therefore; Staff recommended approval. Mr. Rodney Zielke with JPS Legacy, LLC, 1111 S. Main Street stated the applicant is planning on developing the property into commercial/ retail and office uses. Commissioner Deeds asked if there were going to be multiple points of egress and ingress to the site and as to the density of the retail that was planned. Mr. Zielke indicated there would be two (2) or three (3) access points, two (2) off of Pleasant Run Road and one (1) off Joe Wilson Road. He said the first phase, which is the back part of the property, is proposed to be medical offices with multiple buildings, the number and size of which would be based on a market study. Commissioner Saldana asked when the market study would be available. Mr. Zielke indicated some components are already complete. The medical office portion is not complete but far enough along to get a Phase I going. Commissioner Deeds made a motion to recommend approval of Case The motion was seconded by Commissioner Thierry. The vote was as follows: Ayes: 6 Chairman Brooks, Vice-Chairman Strother, Commissioners Deeds, Hamilton, Thierry and Saldana. Nays: 0 Chairman Brooks declared the motion carried unanimously. V. Mr. Rod Tyler, Director of Planning delivered the staff report by describing the location of the property and the type of request that was before the Commission. He said that it was the applicants intent to have this be the third phase of the Cresthaven Village retirement facility. He stated the plan was to have a single parcel that will have individual units; the land use and design standards would be the same type as they have done in the previous two phases. The private streets in Phase 1 and 2 would be extended into the new phase. A gate at the end of Maplegrove would be for emergency access. The applicant is asking that the traffic impact analysis (TIA) and the optional development plan not be required as a part of the Planned Development. Mr. Tyler stated that given the size and density of the project there did not seem to be a need for a TIA or a development plan.

Chairman Brooks closed that portion of the public hearing and opened the floor for anyone wishing to speak in opposition of this request. No one spoke. Commissioner Deeds asked about the surrounding land uses and if it was their plan to extend Maplegrove. Mr. Tyler indicated the property to the north and west are single family detached residential homes and are part of the High Pointe Addition. The property to the south is Phase II of the retirement facility and was a part of the Cresthaven Village retirement facility. He stated that Maplegrove was a public street that dead-ends into the subject property. The Concept plan shows a gate separating the public street from the private streets. Mr. Jay Childs, Dietz Engineering, 209 Main St., Waxahachie, indicated this was just a continuation of Phase 1 & 2 and there would be 24 buildings. However, the church desires to install a solid masonry wall instead of a gate at the dead end of Maplegrove for privacy purposes. Mr. Tyler stated that changing the gate to a masonry wall would eliminate one of the access points into the retirement facility and that such a change would need to be considered by the Fire Marshall. Mr. Bobby Fletcher, Hillcrest Baptist Church, 265 W. Pleasant Run Road, noted that they would address the gate issue in the most convenient way needed. Commissioner Deeds asked if the private streets would be extended from Phase I & 2 into Phase III. Also, he stated his concern about emergency vehicles having adequate access into the community. Mr. Fletcher indicated Cresthaven Dr. would continue through. It was expressed that security is important to this community which is one of the reason for fewer gates and blocking of Maplegrove. Commissioner Hamilton asked how many times the ambulance, fire and police have been out there. Mr. Fletcher indicated they entered the community quite a bit.

Mr. Fletcher indicated it would. Commissioner Hamilton made a motion to recommend approval of Case as submitted. The motion was seconded by Commissioner Strother. The vote was as follows: Ayes: 6 Chairman Brooks, Vice-Chairman Strother, Commissioners, Deeds, Hamilton, Thierry and Saldana. Nays: 0 Chairman Brooks declared the motion carried unanimously. VI. Case Review and consider a Site Plan for a warehouse/storage building on Lot 24R, Blk. 2, Cedarview Addition, generally located on Potter Lane, Between Karen Drive and Topper Drive; requested by Jeff Elseman on behalf of Woodmont Cabinetry. Mr. Rod Tyler, Director of Planning delivered the staff report by describing the properties location and that it was zoned I Industrial. He stated the Site Plan shows two metal warehouse buildings that the applicant intends to house wood material used for his cabinet shop on the east side of Potter Lane. The property was recently replated into a single lot. The landscape and parking shown on the site plan comply with the zoning standards of the I Industrial district. Staff has reviewed the site plan and finds it consistent with the City s plans, policies and ordinances. Mr. Jeff Elseman, Woodmont Cabinetry, 1001 Cedarview Drive expressed the need to expand for a storage facility for their lumber using the four lots and adding a detention pond. Commissioner Deeds made a motion to recommend approval of Case The motion was seconded by Vice-Chairman Strother. These land uses are, or will be, referenced in the zoning code and need to be defined; and Amending the definition of Contractor s Shop with Outside Storage to clarify its intended use. In addition to the changes to the definition section of the code, this ordinance will change the Use Charts by: Deleting from the Use Chart, Building Materials Sales; Modifying the wording and the district Nursery s are allowed in; and Adding Landscape Materials Sales and Contractor s Shop with Outdoor Storage. Before this item may be considered by the City Council the Planning and Zoning Commission must first render a recommendation regarding the proposed change. Outdoor Display See Outside Display. d. Outdoor Storage - See Outside Storage. e. 42 WHEREAS Lot 6 has been occupied as a non-conforming use since the adoption of the 2001 Zoning Ordinance; and WHEREAS, the non-conforming business, which is characterized by the owner as a landscaping business and which operates out of a small office structure on the premises of Lot 6, is used for outdoor storage and sales of rock, sand, dirt and other hardscape materials used is landscaping endeavors; and WHEREAS, Lot 6 has no landscaping and no defined parking areas for employees and customers; and WHEREAS, the City has issued a certificate of occupancy for the nonconforming use on Lot 6; and WHEREAS, primary access to the business on Lot 6 is from the frontage road of Highway 67; and WHEREAS, the business on Lot 6 has expanded to half of Lot 5; and WHEREAS, the City has been engaged in litigation with the owner of the Subject Property for several years over the use of Lot 5, the owner contending that the use of Lot 5 is a lawful non-conforming use and the City contending that it is not; and WHEREAS, the land use charts for the 2001 Zoning Ordinance, as well as for its predecessor ordinance, Ord. No , do not identify a landscaping business as a permitted use in any zoning district, nor is such a use defined in such ordinances; and WHEREAS, recent amendments to the definitions and the land use charts of the 2001 Zoning Ordinance have been adopted by the City Council by Ord. No which amendments, inter alia, define landscape materials sales and classify such use as a permitted, conditionally permitted or prohibited use; and WHEREAS, landscape materials sales is classified as a permitted use in a Local Retail District; and WHEREAS, the business on Lots 5 and 6 fall within the new definition of landscape materials sales, but do not conform to the performance standards of the Local Retail district, including the permitted amount of outdoor storage and Page 2 of 6 ORDINANCE NO

43 sales, the parking requirements, or the landscaping and screening requirements of the Local Retail district; and WHEREAS, the amount of outdoor sales, storage and display existing on the Subject Property and the status of Lot 6 as a non-conforming use render many of the standards for the LR District impractical or ineffective; and WHEREAS, the 2001 Zoning Ordinance, section , authorizes the creation of an overlay zoning district that establishes regulations that combine with the regulations of an underlying (base) zoning district, and which may establish different standards and conditions for a particular use that is otherwise authorized in the base zoning district; and. WHEREAS, following the adoption of such an overlay zoning district, the base district regulations of the LR District remain in effect except as expressly modified for a use or uses within the District; and WHEREAS, the business on Lot 6 is likely to remain as a non-conforming use for the immediate future; and WHEREAS, Lot 5 neither abuts nor takes direct access from the frontage road of Highway 67, but rather has access to Meadow Crest Drive; and WHEREAS, due notice of a public hearing on the overlay district and zoning map amendment was published in the City s official newspaper on February 14, 2016, and mailed to all persons owning land located within 200 feet of the proposed overlay district on February 18, 2016; and WHEREAS, the City s Planning and Zoning Commission duly convened and conducted a public hearing at its regular meeting on March 1, 2016, to take testimony on the establishment of an overlay district and a change in zoning classification for the Subject Property; and WHEREAS, following the public hearing, the Commission considered such zoning amendments and rendered its report and recommendations to the City Council; and WHEREAS, the City Council duly convened and conducted a public hearing at its regular meeting on March 8, 2016, to take testimony on the establishment of an overlay district and a change in zoning classification for the Subject Property; and Page 3 of 6 ORDINANCE NO

44 WHEREAS, the City Council hereby finds that the creation of an overlay zoning district for the existing business located on Lots 5 and 6, which authorizes the business under the newly defined term landscape materials sales and which removes conditions for such business which otherwise are applicable to uses within the Local Retail district, is preferable to classification of the business on Lot 6 of the Subject Property as a non-conforming use and the expansion of the business to Lot 5 of the Subject Property as an unlawful use, provided that such different standards are applicable only to operation of a landscape materials sales business on the Subject Property; and WHEREAS, it is the intent of the City Council that a certificate of occupancy be issued for such land use in accordance with the overlay district provisions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CEDAR HILL, TEXAS, THAT: SECTION 1. OVERLAY DISTRICT CREATED. There is hereby created an Overlay District that combines with the provisions of the Local Retail District, to be applied to Lots 5 and 6 of the River Oaks, section 2 Addition, Cedar Hill, Texas, for the purpose of authorizing a landscape materials sales business on such property, subject to the conditions hereinafter set forth. SECTION 2. PERMITTED USES. The following uses are permitted within the Overlay District: 1. All uses permitted in the base Local Retail District; and 2. Landscape materials sales, subject to conditions hereinafter set forth. SECTION 3. CONDITIONS. The following conditions apply within the Overlay District: 1. The off-street parking standards contained in Section D. and 5.1 of the Zoning Ordinance do not apply within the Overlay District. b. The landscaping requirements for non-single family districts contained in Section E. and 5.2 of the Zoning Ordinance do not apply within the Overlay District; c. The screening standards for nonresidential areas contained in Section F. and 5. 3 of the Zoning Ordinance do not apply within the Overlay District; and d. The open storage areas requirements contained in Section of the Zoning Ordinance do not apply within the Overlay District. e. The outdoor sales, storage and display standards contained in Section of the Zoning Ordinance do not apply within the Overlay District. f. The Site Plan Requirements contained in Section G. of the Zoning Ordinance do not apply within the Overlay District. SECTION 4. CHANGE IN ZONING CLASSIFICATION. The zoning classification of Lots 5 and 6 River Oaks, Section 2 Addition, is hereby changed from LR to LR with Overlay District for landscaping materials sales. The City Secretary hereby is directed to change official zoning map of the City to so designate the property so described. SECTION 5. SAVINGS CLAUSE All provisions of the Ordinances of the City of Cedar Hill, Texas, in conflict with the provisions of this Ordinance are hereby repealed, and all other provisions of the Ordinances of the City not in conflict with the provisions of this Ordinance shall remain in full force and effect. Mr. Morado also briefly explained the methodology used to conduct the survey, using a combination of mailouts, phone calls and online to capture responses. He remarked that the survey results revealed Cedar Hill consistently ranked higher than not only our neighboring cities, but the national average in multiple categories used to rate citizen satisfaction. Dr. Fritsch stated the data contained in the report is provided by the Cedar Hill Police Department and noted that Cedar Hill collects much more data than is required by law. He reviewed the stop data information, which was broken down by race. He stated that in better than ninety percent of instances, documentation shows the officer was unaware of race prior to the stop.

Theresa Brandon 1054 Suffolk Ln., Cedar Hill, Ms. Brandon, representing the Cedar Hill Pet Memorial Park, wanted to inform the City Council of a program called Shadow Fund. She stated the program s purpose was to provide financial assistance to owners/handlers of retired police and military dogs, covering such things as ongoing medical expenses. The program also provides for free memorial services to all active and retired police and military dogs who serve or reside in the Dallas/Ft. Worth Metroplex. Ms. Brandon also invited the City Council to an upcoming event on March 13, K9 Veteran s Day. IX. Consent Agenda: Mayor Franke introduced the Consent Agenda and stated the Consent Agenda includes routine items that may be acted upon with a single vote. Any City Council member may remove items from the Consent Agenda for separate discussion and consideration. There were none. PUBLIC IMPROVEMENTS: Sidewalks: The Subdivision Ordinance requires sidewalks along all roadways, except for Highway 67 frontage and Industrial zoned districts. The subject property is within a local retail zoning district and; therefore, the applicant is required to construct sidewalks. Hike & Bike Trails: The Parks Master Plan shows an 12 Hike and Bike Trail along both Pleasant Run Road and N. Joe Wilson Road. The City constructed the Hike and Bike trail along most of Pleasant Run Road when it was constructed. Therefore, the applicant has no obligation to construct this trail. A 5 Hike and Bike Trail exist along Joe Wilson Road which should be expanded to 12 in width. Road Improvements: The Subdivision Ordinance requires the applicant to improve the existing substandard road or construct a new road for lots not have frontage on dedicated streets. The proposed preliminary plat shows no unimproved roads adjacent to the property. Since, all lots have direct access to a publically dedicated road; the applicant is not responsible in constructing any roads at this time. The Thoroughfare plan shows both Pleasant Run Road and N. Joe Wilson Road as a 4-6 land divided roadway with 112 of right of way. The proposed preliminary plat shows the necessary right-of-way dedication to comply with this requirement. Utilities: The Subdivision Ordinance requires every platted lot has access to adequate water and sewer utilities. The proposed lots have access to public water lines and sewer lines and will extend them throughout the project. 73 West Single Family / zoned SF 8.5 Discussion: The proposed plan complies with the lot size requirements within the Local Retail District. PUBLIC IMPROVEMENTS: Sidewalks: The Subdivision Ordinance requires sidewalks along all roadways, except for Highway 67 frontage and Industrial zoned districts. The subject property is within a local retail zoning district and; therefore, the applicant is required to construct sidewalks. Hike & Bike Trails: The Parks Master Plan shows an 12 Hike and Bike Trail along both Pleasant Run Road and N. Joe Wilson Road. The City constructed the Hike and Bike trail along most of Pleasant Run Road when it was constructed. Therefore, the applicant has no obligation to construct this trail. A 5 Hike and Bike Trail exist along Joe Wilson Road which should be expanded to 12 in width. Road Improvements: The Subdivision Ordinance requires the applicant to improve the existing substandard road or construct a new road for lots not have frontage on dedicated streets. The proposed preliminary plat shows no unimproved roads adjacent to the property. Since, all lots have direct access to a publically dedicated road; the applicant is not responsible in constructing any roads at this time. The Thoroughfare plan shows both Pleasant Run Road and N. Joe Wilson Road as a 4-6 land divided roadway with 112 of right of way. The proposed preliminary plat shows the necessary right-of-way dedication to comply with this requirement. Utilities: The Subdivision Ordinance requires every platted lot has access to adequate water and sewer utilities. The proposed lots have access to public water lines and sewer lines and will extend them throughout the project. The submitted preliminary plat complies with this requirement outlined in the Subdivision Ordinance. DRAINAGE: The proposed drainage plan shows the subject property drains towards two detention ponds which are to be located on either side of the development. After reviewing the proposed drainage area map, the City Engineer Department has concluded that it complies with pertinent ordinances, polices and design criteria. ACCESS/CIRCULATION: The submitted preliminary plat shows each of the proposed lots have access to a publicly dedicated street. The proposed plat shows mutual access easements internally serving access.
