1 Municipal Register of Cultural Heritage Resources Listed Heritage Properties Last Updated: September 2018

2 Background Section 27 of the Ontario Heritage Act requires each municipality to keep a Heritage Register of property that is of cultural heritage value or interest. The City of Brampton maintains two Heritage Registers: 1) A register of properties that have been designated under either Section 29 (individual property) or Section 41 (properties within a heritage conservation district) of the Ontario Heritage Act. This register is known as the Municipal Register of Cultural Heritage Resources Designated under the Ontario Heritage Act. Refer to Section 27 (1.1) of the Ontario Heritage Act. 2) A register of properties that have been identified or listed but not yet designated. This register is known as the Municipal Register of Cultural Heritage Resources. Refer to Section 27 (1.2) of the Ontario Heritage Act. The Municipal Register of Cultural Heritage Resources is an administrative and documentation tool used to assist in identification and ongoing preservation of significant heritage resources within the land use planning and permit application process. It is also used to set priorities for subsequent heritage designations under Part IV of the Ontario Heritage Act. As such, the Register represents basic public acknowledgement of the contribution of specific heritage resource to the rich cultural history of Brampton. Listed Properties and Demolition Control The Ontario Heritage Act helps protect Section 27 (1.2) listed properties through interim demolition control. Section 27(3) of the Ontario Heritage Act states that the owner of a property included in the Heritage Register under Section 27 (1.2) shall not demolish or remove a building or structure unless the owner gives Council at least 60 days notice in writing of the owner s intention to demolish. Section 27(5) states that the notice of intention to demolish shall be accompanied by such plans and shall set out such information as the Council may require. Under this provision, the City requires a Heritage Impact Assessment and/or mitigation plan. This provision is used to ensure appropriate due diligence is completed prior to the approval of demolition permits. The provision can also be used by the City to determine if heritage designation is warranted. The other key form of demolition control is the city-wide Demolition Control By-law, which applies to all residential building stock including heritage residential buildings. The Heritage Evaluation Process Every potential heritage resource holds certain attributes and characteristics that reflect a degree of cultural heritage value or interest. Before being added to this Register, the cultural heritage value of a given property must be assessed, using a set of provincially regulated criteria, that determines overall merit and significance within the following categories: 2

3 Design or physical value; and/or Historical or associative value; and/or Contextual value. Based on the criteria, the heritage attributes and overall cultural heritage value of each resource is evaluated and assigned a grade score: Points Category Significance 70+ points A Most significant: Municipal designation under the Ontario Heritage Act will be pursued points B Significant: Worthy of preservation; municipal designation under the Ontario Heritage Act will always be considered points C Contributing: Contributes to an area, streetscape or neighbourhood; some noteworthy heritage attributes are present; designation may be considered on a case-by-case basis. Contributing properties are not listed in this Register The evaluation process for "listing" purposes is preliminary in nature. Thus, a "listed" property may be subject to periodic re-evaluation and regrading by the Heritage Coordinators, as additional information is uncovered or as properties undergo future restoration or alterations. Properties may also be evaluated in greater depth as a result of a heritage impact assessment, a cultural heritage study associated with block plans and secondary plans, and with heritage designation. The Approval Process Properties can only be listed in the Register after undergoing: a) field assessment; b) research and documentation; c) criteria evaluation; d) formal review by Brampton Heritage Board; and e) endorsement of Planning, Design and Development Committee and City Council, usually through approval of the monthly minutes of the Brampton Heritage Board. Removal from Heritage Register Properties that have been lost due to fire, demolition, or removal are denoted by a strike through. Properties are also removed from this Register upon completion of the heritage designation process. These properties are added to the Municipal Register of Cultural Heritage Resources Designated under the Ontario Heritage Act. Please refer to that document for further information. 3
