1 THE CORPORATION OF THE MUNICIPALITY OF PORT HOPE BY-LAW NO. 23/2016 Being a By-law to amend By-law 39/2008, as amended, to regulate Traffic and Parking in the Municipality of Port Hope pertaining to various amendments. WHEREAS Section 11.(3) of the Municipal Act, 2001, S.O., 2001, c.25, as amended, provides that a municipality may pass By-laws with respect to highways, including parking and traffic on highways; AND WHEREAS the Highway Traffic Act (R.S.O. 1990, chapter H.8) provides that the Council of the Municipality may pass By-laws with respect to a highway or portion of a highway under its jurisdiction; AND WHEREAS Council has considered a Staff report dated March 7, 2016, regarding various changes to the Traffic and Parking By-law 39/2008, as amended; NOW THEREFORE the Municipal Council of the Corporation of the Municipality of Port Hope enacts as follows: 1. That all references to Ward 1 be replaced with Urban Area and Ward 2 to be replace with Rural Area. 2. That Definitions Section entitled Courtesy parking permit be deleted in its entirety. 3. That Schedule C Designated Parking Spaces for accessible Parking (Handicapped/Disabled Persons (Section 5.1) is hereby deleted in its entirety and replaced with a new Schedule C attached hereto. 4. That Schedule D Parking Prohibited on Specified Streets (Section 6) is hereby deleted in its entirety and replaced with a new Schedule D attached hereto. 5. That Schedule H - No Parking other than Authorized Emergency Vehicles (Section 8.4) is hereby deleted in its entirety and replaced with a new Schedule H attached hereto. 6. That Schedule I Designated Fire Routes (Section 8.5) is hereby deleted in its entirety and replaced with a new Schedule A attached hereto. 7. This By-law shall come into force and effect upon passing for those provisions not requiring signage and all provisions will come into force and effect upon posting of signs in accordance with the Highway Traffic Act and applicable regulations. 2 SCHEDULE "C" DESIGNATED PARKING SPACES FOR ACCESSIBLE PARKING (HANDIAPPED/DISABLED PERSONS) (SECTION 5.1) Designated handicapped parking spaces shall be provided in accordance with the Restricted Area Zoning By-law, site plans or other agreement with the Municipality. Urban Area: 1. First parking space, on the north side of the driveway in the Port Hope Public Library parking lot. 2. First parking space west of Queen Street on the south side of Walton 3. First parking space west of John Street on the south side of Walton 4. First parking space east of Brogden s Lane on the north side of Walton 5. First parking space west of Ontario Street on the north side of Walton 6. First parking space east of the driveway entrance to the TD Canada Trust Bank at 113 Walton 7. First parking space east of the driveway entrance for the building known as Walton 8. First parking space north of Walton Street on the west side of Ontario 9. First parking space south of Brogden s Lane on the east side of Ontario 10. Five (5) parking spaces on the south side of the Jack Burger Sports Complex between the main driveway entrance and Highland Drive being approximately seventeen (17) metres from the front building entrance. 11. One (1) parking space located at the south east corner of the parking lot adjacent to the driveway entrance to the Jack Burger Sports Complex being approximately thirty nine (39) metres from the front building entrance. 12. Four (4) parking spaces located on Mill Street South in front of and to the south of the Ruth Clarke Activity Centre, 81 Mill Street South. 13. First two (2) parking spaces located directly west of the Ruth Clarke Activity Centre on the south-east corner of the parking area within Riverside Park. 14. First parking space south of Walton Street on the west side of John 15. First two (2) parking spaces east of John Street on the north side of Augusta Street (Note: Sunday only). 20. First parking space on the west side of Queen Street between the marquee located at 20 Queen Street and the first rear yard access located north of the marquee. 21. Four (4) parking spaces on Pine Street North in front of St. John s Church. 22. First four (4) parking spaces South of the Town Park Recreation Centre on the east side of the parking lot. 23. First parking space on the west side of Bramley Street North being 12.8 metres from the north edge of Ridout Street adjacent to the east side of property municipally known as 276 Ridout 24. One (1) parking space in proximity to 51 King Street (St. Mark s Church) being located 4 metres northerly from the southerly end of the vehicle lay-by on the east side of King 25. Three (3) parking spaces at the Joint Operations Centre (JOC) the first two being located directly north of drop off parking space on the northeasterly side of the JOC and the third parking space being located in the north parking lot at the easterly end of the parking spaces. 26. Two (2) parking spaces at southern end of the Port Hope Police Facility front parking lot adjacent to the sidewalk on the west side of the building. 27. Two (2) parking spaces located immediately north and south of the east entrance of the Port Hope Police Facility, adjacent to the sidewalk. Rural Area: 1. Canton Municipal Office three (3) parking spaces: 1 in the upper parking lot adjacent to the main entrance; 2 in the lower parking lot adjacent to the lower entrance. 2. In the following areas of the Jack Burger Sports Complex at 60 Highland Drive: 2.1 On both sides of the main driveway, excluding the handicapped parking area from the front entrance off Highland Drive west to the south west corner of the Jack Burger Sports Complex building for a distance of 61 metres. 2.2 On the west side of the Jack Burger Sports Complex building on both sides of the driveway between the building and the eastern edge of the parking spaces for a distance of 34 metres north-southerly. 2.3 On the south side of the Jack Burger Sports Complex from the front entrance to the double exit doors on the south side of the building for a distance of 60 metres. 2.4 On the north side of the Jack Burger Sports Complex from the north west corner of the facility east to the Pine Street extension for a distance of 154 metres. 3. Port Hope Police Services Facility at 55 Fox Road from the Fox Road access easterly to the east side of the rear parking area and southerly on the east side of the parking spaces adjacent to the sidewalk for a width of 6 metres. 4.
