6 Jason Afonso, Glen Schnarr and Associates Inc., presented the proposal to amend the Official Plan and Zoning By-law to permit a mixed-use development which includes office, commercial and residential uses at the subject site. He provided details of the surrounding land uses, and the characteristics of the property. Two concept plans have been submitted, one with a 15 storey building with only office uses, and the second with a 20 storey building with office and residential uses. He indicated that 550 parking spaces will be available. David VanderBerg, Central Area Planner, provided details of the current land use designation for the subject lands and confirmed that an amendment to the Official Plan and Zoning By-law is required to facilitate the proposal. He confirmed that the applicant has submitted several studies in support of the proposal which is still under review and available to the public for viewing. Staff has also requested the applicant to provide a Heritage Impact Assessment. All the studies and the comments that are provided at this meeting will be evaluated and a future recommendation report will be presented to Committee. Ian Douglas, 160 Queen Street East, Brampton, stated that the proposal for a 15 or 20 storey building is incompatible for the subject site. He was concerned about the impact on existing traffic volume given that there will be at least an additional 550 cars accessing to and from the site. He expressed concerns with respect to the impact on the Brampton Cemetery lands. He felt that a building in such proximity to the cemetery should be more pleasant. Staff confirmed that the concerns raised at the meeting will be addressed in the recommendation report which will be presented to Committee at a future date. PDD That the report from A. Dan Kraszewski, Director, Planning and Land Development Services, advised that the subject application is before the Ontario Municipal Board. He provided an overview of the proposal and stated that based on staff's evaluation, the proposal meets the intensification criteria in the Official Plan to support high density residential development, as the location is along a Primary Intensification Corridor and its proximity to the Bramalea Gateway Mobility Hub. The technical studies submitted demonstrate that the scale, design and character of the development is compatible with the existing development. The proposed height and density are consistent with the intensification policies and other policy directions. Mr. Kraszewski explained that the issues raised by residents at the public meeting are addressed in the report and the amending zoning by-law will ensure that the development is implemented as proposed and that details will be addressed through the site plan approval process. Shirley Franklin, 1 Avondale Boulevard, Brampton, advised that her home is located directly behind the proposed building. She noted her objection to the proposal. She has not yet seen the plans that are being presented for approval. She felt that her concerns expressed at the public meeting regarding potential noise, building height, density, shadow impact, increased traffic, and privacy have not been addressed. She considers the proposal to be an 'eyesore' and questioned whether residents will be compensated for the loss of value for their property. She also expressed concerns with respect to the notification process for this meeting and stated that the meeting should have been advertised in the local newspaper. She expressed interest in attending the Ontario Municipal Board (OMB) hearing on the matter Page 7 of 19

8 Amin Sajun, Par-Pak Ltd., 26 Victoria Crescent, Brampton, advised that Par-Pak is located west of the proposed development and employs over 500 people. He stated that they are in negotiations with Medallion Developments regarding noise mitigation and suggested that a decision on the proposal be deferred for a month to resolve the issue. He requested that they be allowed the opportunity to further address the matter at the OMB if the negotiations with the applicant cannot be resolved in a satisfactory manner. He noted that a written submission was provided with their comments. Neil Davis, Davis Webb, 24 Queen Street East, Brampton, on behalf of the applicant, stated that Par-Pak did not attend the public meeting that was held on this application and their concerns regarding noise were only expressed recently. He advised that the noise mitigation matter is being handled by engineers and expressed the opinion that Committee should not be expected to intervene in this issue. He stated that the Province has mandated intensification and agreed with staff comments that the proposal is consistent with the intensification policies of the Official Plan. He commented that the proposed building can be constructed to ensure compatibility with the existing community. Leo Gauthier, 33 Athlone Avenue, Brampton, expressed understanding for the residents on Avondale Boulevard who would be impacted by the subject proposal. He commented that properties will be devalued and traffic volume will increase due to the proposed high density. Marielle Manning, 15 Albion Crescent, Brampton, expressed concerns regarding access to the proposed site and questioned whether there are any plans for road improvements to accommodate the additional traffic that the proposed development would generate. She commented that the existing high rise apartment building is not rented to capacity and questioned what purpose this building would serve. She wondered how the nearby industrial units feel about the proposal and whether they have expressed concerns. She believes that existing property values will be reduced and questioned whether taxes would be lowered. AI Franklin, 1 Avondale Boulevard, Brampton, commented that the area residents were advised that there would be no change to the subject site after the original building was constructed. He expressed concerns regarding the traffic impact on Bramalea Road. At present, he has difficulty getting out of his driveway and feels the roads cannot accommodate any additional traffic. He believes that the proposed intensification is inappropriate for the site and the area residents deserve better. Joe Hart, 16 Avondale Boulevard, Brampton, said that the impression he was getting at the meeting was that a decision has already been made on the proposal. He referenced the Heart Lake proposal in which the OMB made the decision and speculated whether it would be same for this development Page 8 of 19

9 Committee discussion on this matter included the following: o Provincial Growth Plan legislation on intensification and recognition that the subject proposal is a result of the legislation o whether there are any benefits to residents regarding the number of parking spaces per unit being proposed o the appropriateness of the proposal at this location and the impact on existing residents given the scale, design and character of the proposal o possibility of an amendment to Provincial policies to have regard to existing residents in a community where properties may be devalued by this type of intensification o improvements and enhancements to Bramalea Road to reduce the impact of the proposal on residents o acknowledging that the decision on the subject application rests with Ontario Municipal Board o suggestion that the report be received and the staff recommendations not be approved With respect to the concerns and comments raised by Committee and delegations, staff explained that based on a complete Planning analysis, the proposal meets the intensification criteria contained in the recently adopted Official Plan to support high density residential development. On the issue of parking, staff is satisfied that the parking rates adopted for the residential and retail components of the proposal are acceptable. Improvements and enhancements to Bramalea Road and the surrounding area will be undertaken to reduce the impact on residents as outlined in the staff recommendation. Staff confirmed that the amending zoning by-law will ensure that the development is implemented as proposed and that details will be addressed through the site plan approval process. With respect to the Ontario Board Hearing, staff explained the process and clarified that a hearing date has not yet been scheduled. On the issue of notifying the residents that the report was being presented today, staff advised that a meeting notice was sent to all residents who spoke at the public meeting and those who requested to be kept informed. A motion was put forward to receive the staff report and not approve the staff recommendations. This motion was voted on and lost. The following motion was considered: PDD That the report from K. That the applications be endorsed in principle and staff be authorized to appear before the Ontario Municipal Board in support of these applications to amend the Official Plan, Zoning By-law, and Site Plan approval, subject to the conditions set out in Recommendations 3 through 7; 3. That prior to the adoption of the official plan amendment and enactment of the amending zoning by-law, the Urban Design Brief prepared by Gagnon & Law Urban Planners Ltd., in association with Page & Steele IBI Group Architects and Alexander Budrevics & Associates Limited shall be finalized to the satisfaction of the Director, Community Design, Parks Planning and Development Division; 4. That prior to the adoption of the official plan amendment and enactment of the zoning by-law, the application shall receive development cap allocation for the 254 residential units; 5. That prior to the adoption of the official plan amendment and enactment of the zoning by-law, a functional servicing report shall be finalized to the satisfaction of the City and the Region of Peel; 6. That prior to the adoption of the official plan amendment and the enactment of the amending zoning by-law, the applicant shall enter into an agreement with the City, which shall include the following: 6.1 Prior to the issuance of a building permit, a site development plan, landscaping, grading and storm drainage plan, elevation and cross section drawings, a fire protection plan, and engineering and servicing plans shall be in accordance with the approved Urban Design Brief and shall be approved by the City, and appropriate securities shall be deposited with the City, to ensure implementation of these plans in accordance with the City s site plan review process; 6.2 The applicant shall pay all applicable Regional, City and educational development charges in accordance with respective development charges by-laws; Page 10 of 19

11 The applicant shall grant easements to the appropriate authorities as may be required for the installation of utilities and municipal services to service the lands; The applicant shall pay cash-in-lieu of parkland dedication in accordance with the Planning Act and City Policy or make other arrangements to the satisfaction of the City for this payment; The applicant shall be responsible for all road improvements along Bramalea Road that may be deemed necessary by the City which shall include, but not be limited to, exclusive turning lanes, centre median islands and pedestrian improvements. All costs associated with these road improvements shall be at the applicant s expense; Arrangements satisfactory to the City and the Region of Peel for the provision of all matters and works relating to residential waste collection and disposal; The applicant shall agree to implement the approved Design Brief; The applicant shall comply with the architectural control policies of the City; The owner shall agree to supply, install and maintain a central mail facility (mailroom with lock panel) for the provision of mail service to the apartment suites within this development proposal to the satisfaction of Canada Post; The owner shall agree to contribute financially to the following works: a) Upgrading the kill strip (build a sidewalk) on the west side of Bramalea Road south of Steeles Avenue, across the Bramalea frontage to the first entrance to the GO station site; b) Tree planting along the boulevard on the west side of Bramalea Road from the subject property to the GO station site, at a size of approximately 70 mm calliper and 15 metres on centre; and, c) Upgrading the kill strip/sidewalk along the entire frontage of the subject property Page 11 of 19

12 6.11 The owner agrees to design and construct improvements within Barclay s Buffer, north of the property, coincidentally with the construction In recognition of the TTMP and if supported by an Environmental Assessment, the owner agrees to not object to and gratuitously dedicate, when requested by the City, a 2.5 metre road widening across the entire frontage of the subject lands at both 64 and 70 Bramalea Road to the City; and, 7. That the subject application be approved and staff be directed to prepare the appropriate documents for the consideration of City Council, subject to the following conditions: 1. The City of Brampton Official Plan be amended to redesignate the lands located at 64 and 70 Bramalea Road from Office to Residential permitting a density of 342 units per net residential hectare and a floor space index of The Avondale Secondary Plan Area 20 be amended to include site specific policies with respect to density, urban design and improvements to surrounding infrastructure within the current, Mixed Use Commercial/High Density Residential designation on the subject property. That only in conjunction with an apartment dwelling a maximum of 750 square metres of commercial shall be permitted. 3. The subject properties at 64 and 70 Bramalea Road shall be rezoned with the following provisions: (a) The lands shall only be used for the following purposes: (1) an Apartment Dwelling (2) only in conjunction with an apartment dwelling, the following uses to a maximum combined gross commercial floor area of 750 square metres: i) a retail establishment; ii) iii) a personal service shop; a bank, trust company or finance company; Page 12 of 19

13 iv) an office, other than the office of a physician, dentist or drugless practitioner; v) a dry cleaning and laundry distribution station; vi) a dining room restaurant; and a convenience restaurant not including a drive through facility vii) a printing or copying establishment; viii) a custom workshop; and, ix) a recreation facility. (3) Purposes accessory to other permitted purposes. (b) Shall be subject to the following requirements and restrictions: (1) Minimum Lot Area: 1.8 hectares; (2) Minimum Lot Width: 167 metres; (3) Minimum Lot Depth: 100 metres; (4) Minimum Front Yard Depth: 17 metres; (5) Minimum Interior Side Yard Width: i) to the southerly side yard: 13 metres ii) to the northerly side yard: a) 15 metres where the maximum building height is 19 metres b) 21 metres where the maximum building height is 25 metres c) 35 metres where the maximum building height is 39 metres d) 42 metres where the maximum building height is 45 metres (6) Minimum Rear Yard Depth: 18.5 metres; Page 13 of 19

14 (7) Maximum Floor Space Index: 2.73; (8) Parking spaces shall be provided as follows: i) 1.0 spaces for each dwelling unit; ii) 0.2 visitor spaces for each dwelling unit; and, iii) 20 spaces for retail. (9) Minimum Landscaped Open Space: 30% of the lot area; (10) A minimum 3.0 metre wide landscaped open space area shall be provided along the easterly property boundary except at approved access locations; (11) Maximum Number of Units: 614 units; (12) Maximum floor area per dwelling unit: i) 47 square metres for a one bedroom unit; ii) 70 square metres for a two bedroom unit; iii) 84 square metres for a three bedroom unit. (13) Maximum Building Height: 14 storeys for the northerly building and 19 storeys for the southerly building; and, (14) Maximum Lot Coverage: 20 percent. (c) For the purposes of the amending by-law, 64 and 70 Bramalea Road shall be treated as one lot. 8. That the following delegations to the Planning, Design and Development Committee Meeting of February 7, 2011, re: Application to Amend the Official Plan and Zoning By-law Gagnon Law Urban Planners Ltd.
