For informational purposes this property is located approximately.8 of a mile north of Hwy C and one mile south of Hwy 50 on the East side of Hwy MB (160 th Avenue) between 85 th and 87 th Street. A motion was made by Jennifer Blair and was seconded by JoAnn Bolton to conditionally approve the Preliminary Plat such that the division of lots is more in conformance to the Land Use Map going out to 2035, the division of the R-1 and the A-2 would commence at the eastern property line of Greg Andersons parcel # and run due south that adjoins the lot division between Lot 1 and Lot 2 of CSM #2699 south of the proposed subdivision. Also including the comments from the village engineer Strand and Associates dated April 13, 2018 and Graef s Memorandum dated April 19, 2018, with the removal of the Propose Roadway Dedication adjacent to Outlot 1 leading to the south and inclusion of deed restrictions or covenants that would stipulate the responsibility of the maintenance for the out lot, Proposed Roadway Dedication areas, and the proposed five foot median through the extended cul-de-sac. On a roll call vote of 6 Ayes and 0 Nays the motion was carried unanimously. Graef s Memorandum: Based upon the review of submitted materials, GRAEF recommends that the Plan Commission recommend to the Village Board the CONDITIONAL APPROVAL of the following: (1) That the applicant be requested by the Plan Commission reflect the revision items listed in Section V of this memorandum on a Final Plat; a. Proposed lots 1, 2, 3, 4, 5, 8, 9, 10, and 11 are shown to be approximately five (5)
3 acres in size and all appear to meet the dimensional requirements of the R-1 zoning district. Proposed lots 6 and 7 are approximately ten (10) acres in size and appear to meet the dimensional requirements of the A-2 zoning district. Note: The 300 frontage required per A-2 zoning districts for proposed lot 7 is accomplished through a Future Road Reservation identified on the Preliminary Plat. b. Access to the proposed residential lots is provided via a proposed roadway connecting to CTH MB and runs East-West down the middle of the tax parcel. The proposed roadway is approximately 2000 in length and is a cul-de-sac configuration. As shown in proposed roadway drawings, the roadway includes a 5 median that runs about 1200 of the total roadway length. The proposed design includes gaps in the median to allow for access to proposed lots. The Preliminary Plat also identifies three separate Proposed Roadway Dedication areas that will provide future roadway extensions to adjacent tax parcels and other circulation systems. a. Section (a)(2) specifics that maximum cul-de-sac length may not exceed one thousand (1,000) feet in length in rural areas where the lots are greater than two (2) acres in area. The Preliminary Pat shows a roadway with cul-desac. Even though the Developer is identifying future road extension to the north, east, and south, the current proposed cul-de-sac exceeds maximum length and thus requires the Developer to both request and be granted a variation/exception to the maximum cul-de-sac length requirement. The Temporary Street Termination is specifically called out in Section (b) stating that the design must meet the cul-de-sac standards. Said variations/exceptions shall be under the provisions of Section Variations and Exceptions of Title 14: Subdivision and Platting of the Village of Bristol Code of Ordinances. Such variations need to be approved by a majority vote of the Plan Commission and need to be approved by a majority resolution adopted by a majority vote of the Village Board. c. Proposed lots 3, 4, 5, and 6 all contain wooded areas that are currently zoned C-2 Upland Resource Conservancy District and should retain that zoning designation for the portions of the lots that overlap wooded areas. d. Section of the Village of Bristol Land Division and Subdivision Code lists the technical requirements for Preliminary Plats that must be provided. GRAEF recommends that the following additions/revisions be made to the Preliminary Plat and shown on the Final Plat: (1) Setbacks: All required setbacks, shore yard setbacks, wetland shore yard setbacks, and building lines shall be graphically indicated and dimensioned on the Final Plat.(Sec (b)(7). Proposed Lot 1 shall identify required setbacks. Existing wetland setbacks shall be shown on proposed lots 5 and 6. (2) Existing and Proposed Contours: Proposed Lot 1 shall identify existing and
4 proposed contours as specified in Sec (b)(11). (3) Wetland Delineation: The name of the person, agency, or firm identifying, delineating, and mapping wetland boundaries should be noted on the Final Plat and Natural Resource Protection Plan as specified in Sec (b)(13) (4) Existing and Proposed Zoning: (Sec (b)(15) i. Clearly label existing zoning and proposed zoning for all proposed lots. ii. Clearly distinguish C-2 zoning boundaries from other zoning boundaries. Preliminary Plat it not legible. iii. Identify existing zoning for properties adjacent to the proposed subdivision on the face of the Final Plat. e. Natural Resource Protection Plan. (Section ) (1) The Applicant submitted a Natural Resource Protection Plan in the form of a drawing (Sheet EX 1). The drawing identifies existing wetlands and existing tree lines. While the drawing includes text referencing protection of these areas, no details are provided as to what method of protection will be implemented. i. Section (a)(10) Method of Natural Resource Preservation: Graphic illustration and notes relating to how those natural resource features, which are to be preserved, will actually be preserved (conservation easements, deed restrictions, protective covenants, etc.) on the Natural Resource Protection Plan. (2) Any and all technical deficiencies shall be corrected; (3) All applicable Village of Bristol application and review fees shall be paid by the applicant; and (4) The applicant shall address any other issues which are raised by any approving or objecting authority, which the Village Plan Commission and/or Village Board deem necessary for the applicant to address in the application materials, and which have been made, or may be made, by the Village Administrator, Village Attorney, Village Engineer, and Village Planner. 15. Unfinished Business: a. A motion was made by Trustee McCabe and was seconded by Trustee Owens to table the approval for the installation of a street light on the corner of 187 th Avenue and 116 th Street. The motion was carried unanimously 16. New Business: a.
