The existing driveway off State Route 96 would remain as is. This application is enable the company to offer retail sales to customers. Mr. Del Re: Will present other plans in the future for an additional build-out on the site. These future plans are not included in the current Preliminary Site Plan application. Mr. Del Re: Materials such as mulch, top soil and loose stone are stored outdoors and are encapsulated on three sides. Most of the materials are for the company s use and are transported by truck to various job sites.
2 Page 2 of 15 Farmington Project Review Committee Minutes FILED WITH TOWN CLERK July 28, 2017 Mr. Del Re: Reported that the issues which were discussed at the previous Project Review Committee meeting have been addressed in a memorandum submitted to the Town. Mr. Morse said that the responses have been forwarded with the application to the OCPB. Mr. Del Re: Said that he has issued an easement for the use of adjacent Parcel B for outdoor storage of materials that encroach from the main Parcel A onto Parcel B. Mr. Brabant explained that this easement must be reviewed by the Town staff, by MRB Group and by the Town Attorney prior to filing in the Ontario County Clerk s Office. He also noted that the ownership of Parcel B must be established. Mr. Brabant: Asked about a vehicle turning template. Mr. Del Re said that the vehicle turning radius on the site is 26 feet, which exceeds the required radius of 24 feet. Mr. Brabant: Noted that the parking spaces must be double striped, per the Town Code. Mr. Del Re said that 15 parking spaces are provided and that there has been no change in the number of parking spaces from the previous discussion. Mr. Morse: Said that the Town would require that vehicular ingress and egress from State Route 96 be right in/right out only as a safety measure. Mr. Trost said that the New York State Department of Transportation (DOT) does not prohibit vehicles leaving the site from turning left (east) onto State Route 96. Mr. Trost also noted that the applicant may install a sign at the driveway indicating a right-turn only to exit the property. Mr. Morse said that right in/right is recommended as a safety measure due to the number and sizes of the trucks entering and leaving the site, some of which are tractor trailers. Mr. Del Re said that he schedules large-truck deliveries after regular business hours. He also noted that there are fewer trucks entering and leaving the site at this time of the year now that the peak season for mulch (April 1 to July 1) has passed. Mr. Morse: A Special Use Permit is not needed. Retail sales are a permitted use in the General Business Zoning District. 2. S. B. ASHLEY MANAGEMENT CORPORATION INCENTIVE ZONING APPLICATION (HATHAWAY CORNERS) Southwest Corner of State Route 332 and County Road 41 Staff Discussion Project Overview: The purpose of this exercise today is to detail everyone s concerns with the development of this mixed-use site and to provide those concerns to the Planning Board for their Report and Recommendation. The parcels currently consist of three zoning districts: R-1-15 (approximately 116 acres), General Business (approximately 13 acres along State Route 332) and Light Industrial (approximately five acres along County Road 41.
3 Page 3 of 15 Farmington Project Review Committee Minutes FILED WITH TOWN CLERK July 28, 2017 The commercial portions of this site would be located along frontage of State Route 332 and a portion of the frontage along County Road 41. The uses are to be determined based upon acquisition of tenants. As of now, there have not been any specific commercial uses beyond those listed in the GB General Business Zoning District. The residential component consists of: two-story apartments for lease (11 buildings with 8 apartments in each building); and two-story townhomes with one-car garage for lease; and one-story ranch townhomes with two-car garage for lease (22 buildings with three to four units per building); and single-family detached villa homes for sale (approximately 10,000- square-foot lots); and single-family homes for sale (approximately 12,000-square-foot lots on a Town-dedicated road) The Town Board has expressed concerns with the density of the apartments shown in the southeast portion of the site. The Board would prefer less density and that this portion of the site be identified for commercial/business types of land use. The future land use map identifies this large area for a mixture of existing commercial zoning along the frontage of State Route 332 and a portion of County Road 41, a small area of Limited Industrial (existing zoned land) along the south side of County Road 41, and the balance of the site for single-family dwellings with a proposed density range of 10,000-square-foot lots to 20,000-square-foot lots. The proposed interior roads would be consistent with the Town s recently adopted Major Thoroughfare Overlay District (MTOD) map. However, the proposed intersection of Access Road A to State Route 332 does not comply with the preferred location for a signalized intersection. The longstanding preferred location for such an intersection is further south on State Route 332 and midway between the two Michigan U-turns located in the median. This issue will need to be discussed in the pending traffic study. One defined concern is the proximity of the current northernmost U-turn to the future signalized intersection with Road A. This closeness raises concerns with motorists safety and their turning movements along this heavily traveled highway to the proposed signalized intersection with Access Road A.
4 Page 4 of 15 Farmington Project Review Committee Minutes FILED WITH TOWN CLERK July 28, 2017 The Town residents who attended both the Town Board meeting and the Planning Board s first meeting expressed concerns with the proposed Town Road K becoming a short cut for motorists wanting to avoid the congestion at the intersection of State Route 332 and County Road 41. Nine acres of land located within the northwest portion of the site and along Beaver Creek are proposed to be dedicated to the Town as open space. It must be determined whether this area will become parkland or open space owned by the Homeowners Association. The Town Highway Superintendent has previously expressed his concerns with the need for defined traffic calming along proposed Road A between County Road 41 and State Route 332. A five-food-wide concrete sidewalk an identified amenity is proposed along the south side of County Road 41 and outside the right-of-way of this County highway. This sidewalk is proposed for installation between the Auburn Trail crossing on County Road 41 and the sidewalk at the intersection of State Route 332 and County Road 41. A five-foot-wide concrete sidewalk another identified amenity has been proposed to be constructed along one side of proposed Road A between County Road 41 and State Route 332. In addition, a five-foot-wide sidewalk is proposed along one side of Road B (Carmen s Way) extending to the southern boundary of the site. A five-foot sidewalk would also be required along one side of proposed Road D located in the single-family detached (for sale) portion of the site. The Project Review Committee (PRC) did not see the need for a sidewalk along one side of proposed Road C located in the northwest corner of site, showing a total of six (6) single-family lots. The PRC felt that since there will be a sidewalk along the south side of County Road 41 across this area that a Town-owned sidewalk within the cul-de-sac would not be necessary and that it would be costly to maintain snow removal in the future. The PRC expressed concerns with left-turn movements into and out of the site in the area between Hathaway Drive and State Route 332. The PRC would like the applicant to consider redesigning Access Road K by bringing it south of the adjacent Hansen Steel property and connecting with Access Road A (a four-way intersection). Such a redesign could mitigate concerns for a cut-through road to avoid the intersection of State Route 332 and County Road 41. The PRC noted that when Ontario County reconstructed County Road 41 a few years ago that the width of the culvert for Beaver Creek did not leave room to in-

The applicant will need to take this into account when designing the sidewalk amenity the crossing of Beaver Creek along the south side of County Road 41. The PRC noted that the area around the Town-owned Hathaway Cemetery is being proposed to be maintained with forever-wild green space. It must be determined whether this area would be dedicated parkland or some other form of special open space to be maintained by some party. The cemetery, however, would continue to be maintained by the Town. The PRC discussed the need for the entire area between Road K and Private Roads I and J. If all of this area is not needed by the Town for any defined purpose, perhaps it could be redesigned for a portion of the relocated apartment units. The PRC noted that the Federal jurisdictional wetlands on the property are not to be disturbed. The PRC noted that a homeowners association would be formed to maintain the privately-owned portions (roads, sidewalks, lighting, etc.) of the development. The Water and Sewer Superintendent has concerns about public water lines being located with the privately-owned portions of the development. The PRC noted that the project was previously discussed with representatives from the New York State Department of Transportation and the Ontario County Department of Public Works at the June PRC meeting. They provided favorable comments regarding vehicular access into the site and noted the need for consistency with the Town s MTOD map as for spacing between signalized intersections. The PRC noted that all future access roads to both State Route 332, County Road 41 and lands to the south of this site are to be Town-owned highways. The PRC noted that the name for this planned community needs to be established. Perhaps the Town Historian might have some thought(s) about some historical naming. PRC Staff Discussion: Mr. Brand: The northernmost access point off State Route 332 into the site appears to be too close to the State Route 332/County Road 41 intersection to permit left turn southbound movements from County Road 41 across two lanes of southbound traffic before entering the site, especially since during peak hours there will be competing right turn (southbound) movements along this portion of State Route 332. This proposed access point may need to be moved further south away from the existing signalized intersection. This is something to be discussed as part of the traffic study.
6 Page 6 of 15 Farmington Project Review Committee Minutes FILED WITH TOWN CLERK July 28, 2017 Mr. Brand: The proposed single lane ingress and egress for future Town Road A at the future signalized intersection with State Route 332 will not work well. Mr. Trost said that two lanes in and out of the development are needed. Mr. Brabant: Noted that traffic at the State Route 332/County Road 41 intersection and in the vicinity of this project is already problematic. Traffic conditions would be adversely affected further with the development as envisioned for the northeast corner of the site. Mr. Brand: The 60-foot-wide strip of land between the doctor s office and the Mexican restaurant should not become a third point of access an from the site onto State Route 332. Mr. Brand: A pedestrian bridge across Beaver Creek would be required for the proposed amenity of a sidewalk on the south side of County Road 41 from the State Route 332 intersection to the Auburn Trail connection. It was noted that there is no room along the road crossing of the creek for a sidewalk. Mr. Brand: Said that the ultimate design of the two stormwater facilities shown along the County Road 41 frontage may need to shift further away from the highway right-of-way to provide adequate separation between the sidewalk and these stormwater facilities. Mr. Degear and Mr. Brand: A 12-inch-diameter water line is required to bring water service (both domestic and fire flows) into the development and to connect with the existing 12-inch-diameter water line that extends west to Nettlecreek Road. Water lines within the development could be 8-inch-diameter. Mr. Degear also requests a 12-inch-diameter water line be provided, as an amenity, between the County Road 41/New Michigan Road intersection and the 12-inch-diameter water line along State Route 332. Mr. Brand: A traffic study would be required to identify mitigation measures for turning lanes into and out of the site for the proposed traffic signal at Town Road A and County Road 41. Mr. Degear noted that the traffic study also should include the County Rod 41/New Michigan Road corner, including how a future signal at Town Road A and County Road 41 might help mitigate the turning delays at County Road 41 and New Michigan Road. Mr. Degear: Capacity of the existing sewer transmission line from this site to the sewer plant is a concern that must be evaluated. The routing of the sewer line to and from the development was discussed. Mr. Degear said that the Town must determine the additional capacity that the sewer interceptor may accept. Mr. Brabant said that MRB Group is currently working on this calculation. Mr. Brabant: Said that the major issues of full buildout of this development concern traffic, the capacity of the existing sewer system, the Town Board concerns about additional residential development versus more commercial development, and the Planning Board comments on the density of the residential component.
7 Page 7 of 15 Farmington Project Review Committee Minutes FILED WITH TOWN CLERK July 28, 2017 Mr. Brand: Said that the requested amenities to be provided by the applicant to the Town may have to be prioritized if all of the currently discussed amenities could not be provided. A detailed list of all of the proposed amenities, their dollar values and the requested incentives must be reviewed as part of any decision by the Town Board whether to consider the rezoning request. Mr. Brand: Will request that the applicant s traffic engineer justify the location of Connector Road A with State Route 332. He said that this connection as shown on the plans should not remain in its current location as it is not in agreement with the location shown on the MTOD Official Map. Mr. Trost agreed, noting that the MTOD Official Map is to be complied with. 3. FARMINGTON GARDENS II AND OFFICES (HOME LEASING) PROJECT West side of State Route 332 Staff Discussion Mr. Brabant: Provided the following information from Gregory McMahon, P.E., the applicant s design engineer: Mr. McMahon is preparing a revised design to modify grading, to widen the Beaver Creek culvert and to re-configuring the placement of the apartment buildings on the parcel to points farther from Beaver Creek and from the backyards of the residential homes on Hanover Drive and Creek Pointe. Following completion of these revisions, Mr. McMahon will submit the plans to Fisher Associates for completing the HEC-RAS hydraulic study on the impact of the development upon Beaver Creek. 4. REDFIELD GROVE INCENTIVE ZONING PROJECT, SECTION 1 West side of Hook Road, south of Collett Road Mr. Hewings Mr. Hewings: Will submit the Redfield Grove Final Subdivision Plat mylar to Mr. Morse who will arrange for the Town Department Heads, the Town Engineer and Planning Board Chairperson Scott Makin to sign it. When signed, Mr. Hewings will file the Final Subdivision Plat mylar in the Ontario County Clerk s Office. Mr. Brabant: The MS4 form and the five-acre waiver will be issued on Monday (July 31, 2017). Mr. Hewings: The applicant s bank is conducting an appraisal of the property which will be completed next week. Following completion of the appraisal, the bank will issue the Letter of Credit which will be filed with the Town. Mr. Morse said that a pre-construction meeting could be scheduled during the second week of August based upon the completion of the appraisal and the Letter of Credit.

Mr. Hewings said that he did not have a timeline for construction because Mr. DiFelice has not yet awarded the contracts. 5. DIFELICE INDUSTRIAL COMPLEX (COLLETT ROAD AT HOOK ROAD) Southwest corner of Collett Road and Hook Road Mr. Hewings Mr. Hewings: Said that Primo DiFelice would be informed of the issues that were raised by Planning Board members on July 19, 2017, during the discussion of the Final Site Plan application (see Planning Board minutes, July 19, 2017, pp ). He said that it is his intention to take no further action upon the application until authorization is received from Mr. DiFelice regarding the Planning Board s requested revisions. 6. COBBLESTONE ARTS CENTER BUS GARAGE 1622 State Route 332 Mr. Laber (via telephone) Project Overview: A 4,096-square-foot bus garage and parking area to the southwest of the existing Cobblestone Arts Center, 1622 State Route 332. The purpose is to provide a maintenance space for the Center s buses. The additional outdoor asphalt area will provide parking for the buses and their drivers vehicles. A 1,000-gallon gasoline tank is proposed for an area southwest of the garage. Water service and sanitary sewer lateral for the proposed garage with a sanitary force main would be connected to the internal plumbing of the existing facility. All stormwater runoff from the new construction will be directed to the existing stormwater management pond. The project will disturb less than one acre of land, therefore preparation of a SWPPP and coverage under SPDES General Permit GP are not required. The garage is planned for completion to be available for use this winter. The site is located within the Major Thoroughfare Overlay District (MTOD). All regulations of the MTOD will be followed. Upon completion of the work associated with this application, the existing driveway will continue to be a means of vehicular access into the parcel from State Route 332. The future connection across the Cerone property to the north is intended to be used primarily by the buses and for special concert events at the new center.
9 Page 9 of 15 Farmington Project Review Committee Minutes FILED WITH TOWN CLERK July 28, 2017 Mr. Degear: Expressed concern about the proposed force main connecting into an existing four-inch lateral along State Route 332 and about the one-inch water service to the garage. He asked if this would be large enough. Mr. Laber said that he also expressed concern about this to the applicant. Mr. Degear said that he has serious concerns and that this must be changed. Mr. Morse: Asked about lighting on the building. Mr. Laber discussed the wall-mounted lighting fixtures on the south, east and west sides of the garage. Mr. Brabant: Has been reviewing the drainage on the site and will have an MRB Group engineering comment letter next week. Mr. Brand: Reported that the application has been submitted to the Ontario County Planning Board for review. Ms. Sousa said that there seem to be no major concerns at this time. Mr. Brand: Reviewed the various land transfers from the owners of the Cobblestone Arts Center and from the adjacent Farmington Country Plaza and forthcoming Cerone Incentive Zoning Project to the Town for the Auburn Trail and for construction of Carmen s Way, a new Town-dedicated road. He wanted to alert Mr. Laber to these transactions and to make sure that Mr. Laber was aware of them and how they might affect the applicant s southwest boundary. Mr. Brand: Referred to Page C-7 of the plans and discussed the adjacent lands of the Farmington Country Plaza and the site of the former Auburn Railroad station. He said that the Town would be working with Fisher Associates on the location of where the trail section would intersect with State Route 332 and to complete the boundary line. Mr. Laber asked if this would have an impact upon the Cobblestone Arts Center s driveway off State Route 332. Mr. Brand said that it would have no impact upon the existing driveway from State Route 332 or from the proposed driveway across the Cerone project, and would not affect the existing berm in the area. Mr. Brand: Explained how the property transfers would provide access to the signalized intersection at State Route 332 for vehicles leaving the Cobblestone Arts Center. Mr. Brand: Discussed the installation of another future traffic signal on State Route 332 located at the southeast corner of the site. He noted that this signal would not impact this project but that he wanted to make Mr. Laber aware of it. Mr. Brand: Asked Mr. Laber to review carefully the MRB Group engineering comments and the concerns of Mr. Degear regarding the water and sewer service. 7. FINGER LAKES HOTEL PRELIMINARY SITE PLAN 6108 Loomis Road Mr. Barry
10 Page 10 of 15 Farmington Project Review Committee Minutes FILED WITH TOWN CLERK July 28, 2017 Mr. Brabant: Requested that the total number of parking spaces on the site be provided and shown on the site plans. Mr. Brabant: Requested that revised elevations be provided. Mr. Barry said that these would be submitted on Monday (July 31, 2017). Mr. Brand and Mr. Brabant: Discussed fire equipment access and clearance at the existing underpass between the motel, the bar and the banquet facility. The driveway profile changes as it rises past the underpass. They expressed concern that fire apparatus may not have adequate clearance. Mr. Barry s architect indicated by letter dated July 27, 2017, that To address the concern over the height clearance brought up at the last meeting, the addition s supporting structure has been designed to eliminate the unneeded additional steel cross beams that decreased the overall clearance by 16 inches. This will compensate for the grade of the road to allow a consistent height clearance for the building, to allow fire equipment to drive under the structure as they have always been able to since the original construction. Mr. Brand: Suggested that Mr. Barry contact Highway Superintendent Don Giroux (who also is a member of the fire department) on Monday (July 31, 2017) to arrange for the fire department to bring their largest piece of fire apparatus to the site to test and assure that there is adequate height coverage. Mr. Brand also suggested that photographs be taken of the test and that they be provided to the Planning Board to confirm that the fire apparatus would have adequate and consistent clearance at the underpass and on the driveway. Mr. Barry said that he would contact Mr. Giroux regarding this. Mr. Brabant: Summarized the information to be provided by Mr. Barry and/or his architect: 1. Fire equipment access 2. Total number of parking spaces on the site 3. Revised elevation drawings 4. Itemized calculations of the square footage of the restaurant, banquet room, and parking areas. 5. Architect s color rendering of the addition. Mr. Barry: Asked about receiving Preliminary Site Plan and Final Site Plan approval at the Planning Board meeting on August 16, Mr. Brand said that this could be possible but that it is contingent upon all information and details having been provided by Mr. Barry and his architect by the meeting deadline. Otherwise, Final Site Plan approval would be considered at a subsequent Planning Board meeting.

Long" <danlong315@gmail.com> Subject: Fwd: Clearance for Fingerlakes hotel Mr. Brand I m sending you the pictures from last night. We drove the truck under and found we have a 10¾-inch clearance when the truck has pulled all the way to the edge. After reviewing the grade, we found there to be a 6- to 8-inch increase in grade at the very end of where the addition is, which would give us 4¾-inch to 2¾-inch clearance. We have designed the addition to be up 8 inches from where the existing steel beams set now. This gives us a 12¾- to 10¾-inch clearance on the new addition all the way through. This allows for sufficient clearance and allows the Fire Department full access. I have also invited the Fire Department out to do a walk through to familiarize themselves with the property. I ll will be sending over the parking and interior calculations later today or tomorrow morning. Please let me know who else you would like me to include in our s or if I should just run everything through you. Thank you, John Barry 8. OTHER TOPICS Mr. Brand discussed the following additional projects: Nory Construction Co. has purchased Lot #1 of the Mercier Incentive Zoning Project. The lot is south of Aldi s Supermarket on the west side of State Route 332. Development plans have not been disclosed. Passero Associates is working with Morgan Management which is considering a proposed apartment development on a parcel of land west of Farmington Gardens
12 Page 12 of 15 Farmington Project Review Committee Minutes FILED WITH TOWN CLERK July 28, 2017 Apartments on the west side of State Route 332. Single-family homes on 10,000- square-foot lots were originally proposed for this site as part of the Mercier Incentive Zoning Project. A zoning change would be required. Mr. Brand said that related to the apartment project, there is a public perception that many apartments have been built recently within the Town. The Town Assessor reports, however, that a total of 58 apartment units have been constructed in Farmington in the past 10 years. Other developments that may have been thought to be apartment projects have been owner-occupied or rental townhouse developments which are not classified as multi-family or apartments. Conifer Realty representatives contacted the Victor Central School District regarding school-bus service into the proposed Pintail Crossing residential multifamily development proposed for approximately 16 acres of land south of County Road 41 and west of Running Brook Road. This project involves the dedication of a portion of Quentonshire Drive to the Town. The school buses will travel into the development to a defined site. Final Site Plans are expected to be submitted in August for the Cerone Incentive Zoning Project on State Route 332 opposite Farmbrook Drive. Mr. Brabant said that the applicant s Stormwater Pollution Prevention Plan (SWPPP) and signed Preliminary Site Plans are required prior to acceptance of a Letter of Credit for site clearing. He also explained that the original Letter of Credit estimate may require modification if the applicant s site clearing plans have been amended from previous discussions. Mr. Brabant said that the applicant also must delineate and protect from disturbance the Federal wetland located on the site and that an NOI from the New York State Department of Environmental Conservation is needed for the acreage that would be disturbed. Mr. Brabant reported that the State Historic Preservation Office compliance letter has been received and that the Town is awaiting the Revised Preliminary Site Plans for signatures. All but one landowner has signed easements to allow the Auburn Trail to cross a portion of their properties. No further information has been submitted from the developers of the Farmington Market Center on State Route 96 (Tops Supermarket site). Canandaigua National Bank has a proposed site plan and a set of drawings ready for construction of a new bank structure on the site. Mr. Brand said that the delay may involve the New York State Department of Transportation-required improvements to State Route 96 from Mertensia Road to the State Route 332/State Route 96 intersection. The Town of Victor has received a grant from the Genesee Transportation Council for a highway safety study of State Route 96 from the Perinton town line to the Victor/Farmington town line on State Route 96. The owner of the Farmington Country Plaza on State Route 332 has just deeded property to the Town for construction of the Auburn Trail between County Road

Donations of land for this project also have been received from the Cobblestone Arts Center, from A&D Real Estate Development Corporation and from Michael Cerone. Only an approximate 200-foot-long easement along the State Route 332 frontage remains to be acquired from one property owner prior to preparation of bids for construction of this trail segment through Farmington. The $1.9-million grant proposal for Phase 1 development of Beaver Creek Park will be submitted today (July 28, 2017) to the New York State Empire Development Corporation and the Finger Lakes Region Economic Development Council for review under the State s Consolidated Funding Application (CFA). Approximately 280 letters were sent to residents of the Auburn Meadows, Estates at Beaver Creek and Monarch Manor subdivisions requesting support for the grant. Mr. Brand reported that 193 letters of support were returned and that only one letter in opposition to the grant was received. No further information has been received from LeFrois Builders regarding plans for development of a parcel of land on the south side of State Route 96 east of the Farmington Market Center. Mr. Morse reported that an open house is planned in September at the New York State Police facility on State Route 332. He said that a tour of the facility for Town staff would be arranged. 9.
