6 LPA RESPONSIBILITIES The following are utility coordination and utility relocation coordination tasks that are the responsibility of the LPA or the LPA s consultant: 1. Contact the Ohio Utilities Protection Service (OUPS) to request field markings of the existing underground utility facilities. 2. Provide the District Utility Coordinator with a copy of the OUPS ticket and request contact information for the listed utility owners. 3. Field survey the locations of all visible utility facilities and the marked underground utilities to incorporate into the project plans. 4. Prior to submittal of the Stage 1 plans, conduct a field review to ensure that all existing utility facilities are being correctly shown and labeled. 5. Provide each listed utility owner with a set of Stage 1 plans, informing each owner of the areas of potential conflicts with their existing facilities and request that each utility; A. Review the plans and respond to either confirm that their utility facilities have been shown correctly and completely or to provide information otherwise. B. Advise if the utility will require additional right of way to be acquired for relocations. C. Advise if the utility has property rights that would make any part of their relocation work reimbursable.

7 LPA RESPONSIBILITIES- CONT. 6. Provide copies of all utility responses/information to the District Utility Coordinator. 7. Provide each listed utility owner with a copy of each subsequent plan submittal. 8. Schedule and meet at the project site with all affected owners. 9. Request utility relocation plans, work schedules and estimates, if applicable, to be submitted one month prior to the project file date. 10. Review and approve utility relocation plans and provide District Utility Coordinator with relocation plans for ODOT review. 11. Prepare Utility Note and provide to District Utility Coordinator for review. 12. Monitor utility relocation work progress.

8 ODOT RESPONSIBILITIES The following are utility coordination and utility relocation coordination tasks that are the responsibility of ODOT: 1. Provide utility contact information. 2. Review plan submissions. 3. Provide guidance to LPA to assure compliance with ODOT policies. 4. Attend utility meetings, if requested. 5. Review utility relocation plans. 6. Process utility estimates and billings. 7. Review and post Utility Notes.

9 UTILITY NOTES BRO , PID Bidders are advised that the following utility facilities will not be cleared from the construction area at the time of award of contract. These utilities facilities will remain in place or be relocated within the construction limits of the project as set out below. All station locations are based upon the proposed centerline of SR 763, as shown on the construction plans and are approximate unless otherwise stated. AMERICAN ELECTRIC POWER / FRONTIER COMMUNICATIONS The companies have existing joint aerial power and communications facilities through the project that will remain in place and active during construction, which are located as follow: Pole Location Station 48+75, 80 feet left Station 53+45, 71 feet left Station 58+00, 142 feet left Disposition Remain Remain Remain

10 UTILITY NOTES The contact person for American Electric Power is Ms. Caroline Irion, The contact person for Frontier Communications is Ms. Dena Martin, BROWN COUNTY RURAL WATER ASSOCIATION The company has multiple existing underground water facilities through the project, which are located as follow: The first existing water facility is a 4 inch PVC line, which enters the work area at station 56+30, 42 feet right and continues northwardly, along the right side of SR 763, to station 56+80, 34 feet right, continues to station 57+00, 34 feet right, continues to station 58+00, 62 feet right and continues on to exit the work area at station 58+70, 66 feet right. The second existing water facility is a 6 inch PVC line, which enters the work area at station 56+60, 42 feet right and continues northwardly, along the right side of SR 763, to station 56+80, 38 feet right, continues to station 57+00, 38 feet right, continues to station 58+00, 65 feet right and continues on to exit the work area at station 58+60, 72 feet right.

11 UTILITY NOTES Both the first and second existing water facilities will remain active during construction, however both facilities will be deepened by 2 feet to 3 feet along their current horizontal alignment from station through station to clear the proposed excavation. The third existing water facility is a 3/4 inch service line, which enters the work area at station 54+37, 65 feet right and continues westwardly, to end at an existing meter at station 54+12, 29 feet right. This third existing water facility will be abandoned in place. The existing meter will be removed. Brown County Rural Water Association will have this relocation work completed by December 15 th, The contact person for Brown County Rural Water Association is Mr. Gary McKenzie, , ext GENERAL COMMENTS Bidders are advised that the utility relocation plans are on file and may be reviewed at the District 9 Utilities Office.

12 UTILITY REIMBURSEMENT- WHEN ARE UTILITIES ELIGIBLE? Private or publicly held utilities are eligible for reimbursement when existing facilities are affected by the project and located on property where the utility has a compensable property right as follows: A. On property owned by the utility B. On private property where the utility has a valid easement from the owner C. On private property where the utility has a valid prescriptive right (affidavit required) D. On public road right of way where the utility has a valid easement which predates the rights held by the city/state
