3 ADJACENT USES & ZONING North South East West Marshes of the Wando River The Gates at Dunes West residential neighborhood (PD) Marsh / Egret s Walk Townhomes residential neighborhood (PD) SC Highway 41 and Planters Pointe subdivision residential neighborhood (PD) HISTORY The Dunes West PD, Planned Development District ordinance was adopted in 1990 establishing permitted uses, development standards and a Master Land Use Plan (MLUP) map on approximately 4518 acres of land known as Dunes West. In 1996 an approximately 1250 acre portion of the land was conveyed to a different development interest for a development now known as Park West. An agreement was recorded portioning out the approved residential dwelling units and commercial acreage to the two different master Developers. 4 The 1990 Master Land Use Plan map conferred DW-R-1, Dunes West Low Density Residential District zoning on the subject property pursuant to the permitted uses and development standards of the PD. The PD ordinance specifies that the MLUP map is intended to be a conceptual design plan illustrating tentative development uses and facility locations that are subject to change. Revisions of the location of zoning areas were not deemed to be ordinance amendments provided the overall density and permitted uses were not increased. The MLUP map was considered to be the plan map in effect at any given time. This essentially allowed the zoning district boundaries to be whatever the master Developer at the time wanted them to be. This concept was in effect for a number of years; however, the Town has recently revisited its interpretation of this zoning scheme and determined that it did not reflect applicable provisions of state law regarding zoning and rezoning property. The current Town position is that deviations from the zoning areas illustrated on the 1990 MLUP map are zoning amendments and must accordingly follow prescribed procedures for amendment. The DW-PD has been amended on occasion since 1990, but not as it specifically applies to the zoning district classification of this property. An Impact Assessment was approved in 2010 for a self-storage facility comprised of 118,878 square feet with 495 storage units and 63 boat storage spaces known as Monster Self Storage. The project was not built. A condition of approval of this Impact Assessment was to have a 50-foot Natural Roadside Buffer abutting Highway 41. RELATIONSHIP TO THE COMPREHENSIVE PLAN The Comprehensive Plan Future Land Use Map recommends Commercial land use for the property. The following list of applicable Comprehensive Plan goals and strategies is provided so that they may be considered along with this zoning request: Promote the growth of existing businesses and the recruitment of new businesses that are compatible with the Town s future vision. Continue to develop and implement redevelopment plans for older and underdeveloped areas of Mount Pleasant that are well served by public infrastructure. Encourage appropriate commercial development to increase the property tax base and minimize the tax burden on homeowners. Ensure the services provided by the Town match the needs of the community and accommodate the changing population. Staff Report Dunes West (Wood Park Drive & Highway 41) Page 4 of 5
5 STAFF COMMENTS 1. According to information provided by the master Developer of Dunes West, as of August 21, 2014 the remaining R-1 zoning allocation is 186 dwelling units. 2. Requested in this application is 8.13 acres of TC district zoning and 8.21 acres of C district zoning. The entire parcel size is acres. 3. A total of 100 acres of TC, Town Center zoning was approved for the entire 4518 acres. Of this, Dunes west was apportioned 10 acres, which remain available. If approved, 1.87 acres of TC zoning will remain. 4. A total of 52 acres of C, Commercial zoning was approved for the entire 4518 acres. Of this total amount, Dunes West was apportioned 15 acres, which remain available. If approved, 6.79 acres of C zoning will remain. 5. Attached to this report are copies of the applicable permitted uses for the TC and C zoning districts. (Note that permitted uses of the DW-OP district are allowed as permitted uses in the TC and C districts, so those uses are included also.) 6. Because the rezoning request is compatible with the Comprehensive Plan Future Land Use plan map recommendation for commercial use, no Impact Assessment is required at this time, but will be required prior to development, if necessary. 7. Please see the attached letter from the applicant regarding rezoning of the property should the Town revise its current position regarding the same.
