REZONING REQUEST PUBLIC HEARING: Request to rezone from R-1, Low Density Residential District, to AB, Areawide Business District, an approximately 0.25 acre portion and an approximately acre portion of an approximately 2.31 acre parcel of land known as Ryan Bennett Center Horizontal Property Regime; located at 1311 and 1321 Chuck Dawley Boulevard, near its intersection with Melvin Bennett Road; and identified by TMS Nos , , , , , , , , , , and The parcel will remain part of the UC-OD, Urban Corridor Overlay District. 4 PREVIOUS APPROVALS ASSOCIATED WITH CURRENT REQUEST Annexation Rezoning One acre portion of parcel zoned AB. HISTORY A acre Lot 9 was created by a plat dated , approved in Charleston County. The subject parcel was annexed in In 1990, Lot 9 was divided onto Lots 9-A and 9-B. In 1997, a one acre portion of Lot 9-A was rezoned from R-1 to AB (Ord. # 97047). The ordinance includes a subdivision plat as Exhibit A that was never recorded. This plat shows a one acre portion being rezoned AB and the remaining portion as R-1. By plat dated and recorded in PB ED-290, Lot 9-A was re-surveyed and erroneously identified as being zoned AB in its entirety by zoning line delineation and in Note #3 on the plat. Also in 1999, plat ED 684 was recorded with the RMC Office. This plat subdivided a 0.25 acre portion of Lot 9-B and incorporated it into Lot 9-A. Note #3 on the plat erroneously indicated AB zoning for the property. In 2000 the property was developed into The Ryan Bennett Center, a professional office building complex. Both plats referenced above (ED-290 and ED-684) are included at the end of this staff report. RELATIONSHIP TO THE COMPREHENSIVE PLAN The Comprehensive Plan Future Land Use Map (shown below) recommends Urban Corridor. The proposed zoning is in compliance with this land use recommendation. 5 STAFF COMMENTS 1. The zoning error issue came to our attention through an inquiry from the owner of Lot 9-B, whose property comprised of a single family home was erroneously indicated as having AB zoning on the zoning map. 2. Only one acre of this property is zoned AB Areawide Business District. A 0.25 acre portion and an approximately acre portion are currently zoned R1 Low Density Residential District, according to staff research. It appears that the zoning map error may be the result of misinformation on the recorded plats. The R1 zoning does not allow for the current use of the property, a professional office building complex. 3. The proposed rezoning would make the entire parcel AB.
