All references to the Department shall mean both the County and the Department of Transportation. The English System of units shall be used on this project. Page - 3
4 Background: Mercer County Bridge 1416 (BMS# ) is a one lane steel I-beam bridge with a span of 25 feet. The bridge consists of one I-beam span. The bridge was built in 1901 and the superstructure was replaced in 1979 with used I-beams. The bridge carries vehicular traffic on Redfoot Road across Otter Creek in Delaware Township. The bridge replacement project will consist of a bridge replacement on an alignment as determined during the preliminary engineering phase. General Prepare all necessary designs, calculations, plans and documents for the listed items necessary to secure final P.S.&E. approval of the project. All tracings, plans, specifications, drawings, studies, computations, models, mosaics, maps and all other materials, supplies and designs prepared, developed or obtained to complete the project shall be delivered to and become the property of the County. The original survey books, notes, sketches, records, charts, computations, computer programs, test results, and other data prepared or acquired to prepare the project shall be delivered to and become the property of the County without limitation or restrictions on their future use. All plans prepared for this project must be supplied to the County on reproducible mylar and on computer media in AutoCAD TM 2002 or later format. The major tasks are listed below: -Part 1 -Preliminary Engineering Services This work will consist of preliminary engineering services to supplement Mercer County s inhouse design effort for the replacement of the structure which include, but are not limited to the following: Wetlands Investigation and Report, Subsurface Boring, Sampling and Testing Contract, Preliminary Right of Way Activities. Level 2 Categorical Exclusion Evaluation It is anticipated that a Level 2 Categorical Exclusion Evaluation (CEE) will be needed to obtain the required environmental clearance for the proposed bridge replacement. Prepare the following for inclusion in Mercer County s document: Identify, inventory, classify and analyze the physical and biological elements of streams and waterways within the project study area and the quantification of potential stream impacts. Title 25, Chapter of the Pennsylvania Code will be used to identify wetlands and determine the impact of the proposed alternatives. Page - 4
5 Subsurface Boring, Sampling, and Testing Contract: Prepare and administer the Boring Contract in accordance with DM-4M pp Preliminary Right of Way Activities: Prepare a limited amount of surveying to prepare a preliminary right of way plan for the project. Perform this work in accordance with current Design Manuals and policies. Strict adherence will be required in following the Department s guidelines in sending out the Intent to Enter letters. -Part 2 -Final Design Services This work will consist of final design services for the replacement of the above structure which include, but are not limited to the following: Final Right-of-Way Plan, Foundation Report, Right of Way Appraisals and Review of Appraisals. Final Right of Way Plan: Prepare a right of way plan as required for parcels acquired any temporary easements for construction purposes. Include the services of a state approved appraiser and review appraiser as required. Submit appraisal documents to the Department and obtain acceptance. Mercer County will conduct negotiations for easements. All appraisal and negotiation functions, as well as preparation of the plan will be in accordance with the Local Public Agency Guide, PennDOT's Right of Way Manual, and Design Manual Chapters 3 and 5. Submit the final right-of-way plan to the District Right-of-Way Administrator for review. Department provided deed, temporary easement, agreement of sale and settlement statement forms will be used. Foundation Design: Prepare and obtain acceptance of the foundation submission to include only the boring logs with boring layout, scour computations and the QA forms in accordance with DM-4M, pp and current department publications DM-4M, Pub. 293M, Pub. 222M, SOL, etc. Resubmit until accepted. Terms, Conditions, and Provisions The Consultant agrees to comply with and to provide the required work and services in accordance with the provisions listed below, which are to be incorporated into the AGREEMENT by reference. a) Commonwealth Contractor Responsibility Provisions, dated April 16, 1999 b) Consultant Integrity Provisions, dated December 20, 1991 c) Commonwealth Nondiscrimination/Sexual Harassment Clause, dated June 30, 1999 d) Federal Nondiscrimination and Equal Employment Opportunity Clauses, dated January 1976 e) Offset Provision for Commonwealth Contracts, dated April 16, 1999 f) Pennsylvania Election Code, dated February 22,2001 g) Publication No. 442, Bureau of Design Specifications for Consultant Agreements, dated 3/13/2001 Page - 5
6 h) Provisions Concerning the Americans With Disabilities Act, dated 01/2001 The Consultant will be required to certify their compliance with the following requirements: a) Consultant's Certification of Non-Collusion, dated February 1990 b) Certification Regarding Debarment, Suspension and Other Responsibility Matters, dated August 1990 c) Certificate of Restrictions on Lobbying, dated August 6, 1990 d) Consultant's Acceptance of PA Workmen's Compensation Act, dated August, 1999 The Consultant agrees to comply with and to provide the required work and services in accordance with the Department's Standard Agreement Special Requirements, dated April 26, 2001 and the following standard method of payment special provisions: Method of Payment -Cost Plus Fixed Fee, dated 5/16/2001 Method of Payment -Specific Rate of Compensation, dated 2/28/2001 The scope of work and services, as set forth in the Consultant's technical proposal, is to be performed in conformance with the requirements of the applicable provisions of the current Department Publications, Manuals, Handbooks, Policies and Procedures. The Department and the Consultant shall confer at any time when the Department issues an amendment, revision, amplification, increase, and/or change to any Publication, Manual, Handbook, Policy or Procedures to determine whether there is a change in scope and/or accepted work and services completed by the Consultant which is ordered changed. The Department, with the approval of the Federal Highway Administration (FHWA) when applicable, where there is such a change, will issue a Supplemental Agreement. Preparation of Technical Proposal Technical proposals will be required from the three firms that are short listed by the review committee. Submit five (5) copies of the technical proposal to the County by the date that will be established at the scope of work meeting. Include this scope of work in the technical proposal. Direct any questions to Mr. Mark A. Miller, P.E. at Include a detailed schedule of all work items in the technical proposal. Identify controlling milestones. The Consultant shall attain the Disadvantaged Business Enterprise goal of 10% of the total cost, excluding non-professional costs, including all supplements. Costs included in a DBE firm's price proposal as direct cost of work and services by others shall not count as DBE participation. In the alternative a showing of good faith effort shall be made. 7 Preparation of Price Proposal A price proposal will be required from the firm recommended by the committee after review of the technical proposals. Prepare the price proposal in three parts as defined above. Payment method for Part 1 and Part 2 will be Cost plus Net Fee. Payment method for Part 3 will be Specific Rate of Compensation. Prepare the proposal in accordance with the "Guide for Preparation of Engineering Agreements." Use the specific subcategories as defined in this scope to tabulate man-hours and costs. Submit five (5) copies of the price proposal to the County by the date that will be established at the scope of work meeting. Negotiations will be conducted by the Department of Transportation.
