All responses to the subject solicitation must be received no later than 3:00 P.M. (ET) on March 2, A response received after the exact time specified will not be considered. Failure to file a protest within the time prescribed in Section (3), Florida Statutes, or failure to post the bond or other security required by law within the time allowed for filing a bond shall constitute a waiver of proceedings under Chapter 120, Florida Statutes (F.S.). Written notices, formal requests and proceedings must conform with the requirements set forth in Chapter , Florida Administrative Code (F.A.C.). Protests must be filed with the Purchasing Office, Fish and Wildlife Conservation Commission, Suite 100, 2590 Executive Center Circle, Tallahassee, Florida within the time prescribed in Section (3), Florida Statutes and Chapter , Florida Administrative Code. 2 Page 2 ADDENDUM NO. 1 Item #1: Questions and Answers Question #1: What is the cost estimate/budget? Answer #1: $40, Question #2: Which buoy design did you want, there were 2 shown on the bid sheet? Answer #2: As described in Attachment C: Standard Technical Specification and Other Requirements, 9 Diameter x 61 High Buoys equipped with a swivel eye and a 3 wide reflective high intensity orange band around both the top and bottom will be installed. The 9 diameter buoy is depicted on page 3 of Attachment D. Question #3: What is the depth of water on average were buoy's are going? Answer #3: All buoy markers are to be installed between -3 and -6 feet NAVD88. B001 and B022 are to be installed between -3 and -4 feet NAVD88. B002 through B016 are to be installed between -4 and -5 feet NAVD88. B0017 through B021 are to be installed between -5 and -6 feet NAVD88. Bathymetric data can be provided to the selected contractor on request. Coordinates are provided in Attachment B. Question #4: Is the contractor responsible for supplying the materials or will they be provided? Answer #4: As stated in Attachment C, FWC will provide all sign panels, aids to navigation and/or buoys associated with the project (with the exception of hardware associated with buoy installation such as mooring system, anchor system, clamps, eyes and thimble as well as the piles, cross members and hardware associated with sign panel installation). This work is for installation of waterway markers only. Specifications for the hardware provided by the contractor and used to install FWC provided waterway markers are listed in Attachment C. Question #5: I read in the packet that if the bid exceeds $100, then a Security Deposit is required. Does this stand for the Performance Bond as well or is that required per any amount of the bid? Answer #5: If your response exceeds $100, then a bid bond or bid guarantee is required to accompany your response. A Performance and a Labor and Materials Bond is required after award but before you start work regardless of bid amount.
3 Page 3 Question #6: What documents need to be submitted with the bid? Answer #6: Bid submittal Documents are: Acknowledgement Form Completed References Form Copy of Contractor s License Bid Bond if Bid exceeds 100K Question #7: How many copies of the bid need to be submitted? Answer #7: One Question #8: Clarify the transaction fee. What is the transaction fee? How does the transaction fee affect payment to the contractor? Does the contractor need to add money to the bid to cover the cost of the fee? Answer #8: As stated in the bid document: Transaction Fee. Pursuant to Section (22), F.S., all payments, unless exempt under Rule 60A-1.030(3), F.A.C., shall be assessed a Transaction Fee of zero point zero seven percent (0.07%), which the Contractor shall pay to the State. For payments within the State accounting system (Florida Accounting Information Resource, FLAIR, or its successor), the Transaction Fee shall, when possible, be automatically deducted from payments to the Contractor. If automatic deduction is not possible, the Contractor shall pay the Transaction Fee pursuant to Rule 60A-1.031(2), F.A.C. By submission of these reports and corresponding payments, Contractor certifies their correctness. All such reports and payments shall be subject to audit by the State or its designee. The transaction fee described above is added to your account at the Vendor Information Portal and is to be paid separately from your bid amount. You do not have to build in the transaction fee cost to your bid as it is not considered in the criteria of award. Question #9: Is bid bond only required if bid is over $100k? Answer #9: Yes Question #10: Is there any demolition or disposal work? Answer #10: There will be no demolition and disposal will only be necessary if some part of the installation is done incorrectly. All cases where disposal will be necessary are listed in Attachment C. Question #11: What is the water depth where buoys are to be installed? Answer #11: See answer #3
4 Page 4 Question #12: What is the water depth where pile mounted signs are to be installed? Answer #12: Pile markers are to be installed at 0 feet NAVD 88. Bathymetric data can be provided to the selected contractor on request. Coordinates are provided in Attachment B. Question #13: Can concrete, dead weight, anchors be used as the anchoring system for the buoys? If so, is the 100 lb concrete anchor weight acceptable? Answer #13: Please refer to Attachment C: Anchoring Systems. Question #14: Does the buoy anchoring system need to be tested? If so, what is the desired method for testing? Answer #14: No Question #15: Attachment C in the technical specs indicates that the FWC is supplying material. Specifically, what material is the contractor responsible for providing? Answer #15: See Answer #4 Question #16: If the project is to be awarded on February 27, 2017, when is the anticipated NTP? Does FWC already have in their possession the buoys required for this project? And if not, what is the anticipated lead time for the buoys to arrive at the Contractor's facility? Answer #16: Procurement of waterways markers will be completed after contractor selection so that said markers may be delivered directly to the contractor selected to complete installation. A NTP will be issued as soon as waterway markers have been procured by FWC. This is tentatively anticipated by April 1, Question #17: What buoy size and type will be utilized for this project? Answer #17: See Answer #2 Question #18: What is the approximate low tide water depth where the buoys are to be installed? Answer #18: See answer #3 Question #19: Is a performance bond and labor and materials bond required if the project is under $100, Answer #19: Yes Question #20: What mooring system in the specifications is to be used? You show four systems that have substantially different costs associated with them: -"Traditional" Buoy Mooring System with stainless steel chain -Chain/Elastic Buoy Mooring System -Elastic Buoy Mooring System -"Traditional" Buoy Mooring System with stainless steel cable
5 Page 5 We assume the "Traditional" Buoy Mooring System with stainless steel chain would be the best application for this project. If we are to use the "Traditional" buoy system with stainless steel chain, will the Suncor brand stainless steel chain be required for longevity or will import stainless steel chain (China, etc) be allowed? (While the Suncor chain is more expensive, it s been proven to last in salt/brackish water applications for much longer time than the import chain. The import chain tends to corrode in half at the welded part of the chain link. But its much cheaper for the Contractor to use the import even though its inferior, so unless you specify Suncor, Contractors will typically choose the less expensive product to be price competitive for low bid purposes) Answer #20: Please refer to Attachment C: Mooring Systems. Question #21: What type anchor system is required for this project? Answer #21: Please refer to Attachment C: Anchoring Systems. Item #2: Revised Attachments: Due to the clarification of Technical Specifications and Drawings, the Commission has revised both documents (Attachments C and D).
