1 June 24, 2015 Council Chamber 4:00 pm MIDDLESEX CENTRE COUNCIL MINUTES The Municipal Council of the Municipality of Middlesex Centre met in Regular Session in the Council Chamber on June 24, 2015 at 4:00 pm. COUNCIL PRESENT: Mayor Edmondson - Chair presiding, Deputy Mayor Bloomfield, Councillors Brennan, McMillan, DeViet and Berze. REGRETS: Councillor Harvey. ALSO PRESENT: Members of the public and press. 1.0 CALL TO ORDER Mayor Edmondson called the meeting to order at 4:00 pm. 2.0 ADOPTION OF THE ADDITIONS TO THE AGENDA R Motion by Councillor Brennan and Deputy Mayor Bloomfield THAT the Additions to the Regular Agenda of Council dated June 24, 2015 be added to the Agenda as printed In Closed Session 12.3 Application for Zoning By-law Amendment Owner: Aaron Construction Limited 12.4 Application for Zoning By-law Amendment Owners: Jefferies/ Basacco-Jefferies 3.0 BUSINESS FOR WHICH PREVIOUS NOTICE HAS BEEN GIVEN 3.1 None scheduled 4.0 DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF The Municipal Conflict of Interest Act requires any member of Council declaring a pecuniary interest and the general nature thereof, where the interest of a member of Council has not been disclosed by reason of the member s absence from the meeting, to disclose the interest at the first open meeting attended by the member of Council and otherwise comply with the Act.

Consent items are received in one motion. Council members may request that one or more item be removed for further action. R Motion by Councillor DeViet and Deputy Mayor Bloomfield 1. THAT the May 2015 Building Permit Report be received for information. 2. THAT the Planning and Development Services Division report, TARION Home Warranty Corporation Pilot Project, be received as information. 3. THAT the Planning and Development Services Division report entitled, Commissionaires Appointment as By-law Enforcement Officers, be received as information. 7.0 READING OF THE REPORT 4:00 pm 7.1 Rennie Drain 2015 The Drainage Superintendent noted that proper notice had been given. Mike Devos of Spriet Associates, Municipal Engineering provided an overview of the Report. The purpose of the drain is to provide a sufficient and legal outlet for this area. Councillor Berze asked if the petitioners are satisfied with this report and the Engineer indicated that the land owners are satisfied with the report. Councillor McMillan asked staff how these assessments are budgeted each year and staff noted that it is usually an estimate of costs each year. R Motion by Councillor DeViet and Councillor Berze THAT Council having considered the Engineer s Report dated April 24, 2015 for the Rennie Drain 2015 approves Provisional By-law Number being a By-

3 Council Minutes 3 June 24, 2015 law to provide for a drainage works known as the Rennie Drain 2015 and that this constitutes the first and second reading of By-law Number ; and FURTHER THAT Council appoints July 29, 2015 at 4:00 p.m. for the Court of Revision; FURTHER THAT the following persons be appointed to the Court of Revision: Clare Bloomfield Sharon McMillan John Brennan 8.0 DELEGATIONS 4:30 pm 8.1 Christene Scrimgeour Presentation of 2014 Financial Statements R Motion by Councillor Berze and Deputy Mayor Bloomfield THAT Council approve the 2014 Draft Financial Statements as prepared by the municipal auditor, Scrimgeour and Company and; FURTHER THAT Council accepts the declaration of independence by Christene Scrimgeour, CPA. 8.2 Carol Small Middlesex Centre Historical Society Carol appeared before Council to provide an overview of Middlesex Centre Celebrations that are upcoming. In cooperation with Council, they are hoping to obtain grants and they are looking for people as well as organizations to help co-ordinate those events. The group is hoping to install historical plaques to recognize these celebrations. The events include: 2017 Canada 150 years, 2018 London Township Bi-Centennial, 2019 Delaware Township 225 years, 2020 Lobo Township Bi-Centennial. Staff noted that they will work with Carol to complete a joint application for funding to help support the 150 th celebration of Canada Day in Delaware. 8.3 Bridget Welton ACE Partnerships Solar Projects 5:00 pm R Motion by Councillor DeViet and Councillor Brennen WHEREAS the Province s FIT Program encourages the construction and operation of renewable fuel such as solar (PV and rooftop) generation projects; and WHEREAS one of more projects may be constructed and operated in Middlesex Centre; and WHEREAS pursuant to the FIT Rules, Version 4.0, applications whose projects receive the formal support of Local Municipalities will be awarded priority points,

4 Council Minutes 4 June 24, 2015 which may result in the Applicant being offered a FIT contract prior to other persons applying for FIT contracts; NOW THEREFORE be it resolved that the Council of Municipality of Middlesex Centre supports the construction and operation of the Projects anywhere in Middlesex Centre (as per the FIT program, this resolution shall expire twelve months after its adoption). R Motion by Councillor McMillan and Councillor Brennan THAT the Municipality make application with consultant ACE Partnerships for solar projects on the following properties; it being noted that all other actions related to this project are also approved: Arva Fire Station Medway Road Bryanston Fire Station and Community Centre Plover Mills Road Coldstream Fire Station (New) Ilderton Road Delaware Fire Station Longwoods Road Ilderton Fire Station Hyde Park Road Municipal Office and Coldstream Community Centre Ilderton Road Coldstream Salt Shed Ilderton Road Denfield Operations Centre Denfield Road Delaware Operations Centre 805 Gideon Drive Abandoned Delaware Landfill Miller Road Komoka Community Centre 133 Queen Street Delaware Community Centre 2652 Gideon Dr. Ilderton Community Centre Ilderton Rd Komoka Wastewater Treatment Facility Komoka Road 9.0 STAFF REPORTS 9.1 Report # Letter of Understanding Herm s Sport Exchange R Motion by Councillor DeViet and Councillor McMillan THAT Council approve the Letter of Understanding between the Municipality and Herm s Sport Exchange for skate sharpening services at the Wellness Centre. 9.2 Report # PWE Ross-Moir Municipal Drain R Motion by Deputy Mayor Bloomfield and Councillor Brennan THAT the Drainage Works for the Ross-Moir Municipal Drain proceed; and FURTHER THAT staff be directed to notify the affected landowners and appropriate agencies of Council s decision to proceed with the drainage works; and

5 Council Minutes 5 June 24, 2015 FURTHER THAT following the notice to the appropriate agencies, Bradley Bunke, of GM Blue Plan Engineering be appointed to prepare a Drainage Report for a new Municipal Drain, all in accordance with the Ontario Drainage Act. 9.3 Report # PWE Rehabilitation of Bridge B-306 on Heatly Drive & Contract Administration Services Project Award R Motion by Councillor Brennan and Councillor Berze THAT the Rehabilitation of Bridge B-306 on Heatly Drive & Contract Administration Services Request for Proposal submission received from Exp Services Inc. in the amount of $57, (excluding HST) be awarded; and FURTHER THAT staff be authorized to execute the appropriate engineering services agreement. 9.4 Report # PWE Glendon Drive Streetscape Improvements Master Plan Class Environmental Assessment R Motion by Councillor DeViet and Councillor McMillan THAT the Glendon Drive Streetscape Improvements Master Plan Class Environmental Assessment Request for Proposal, in joint partnership with Middlesex County (Middlesex Centre PWE 15-02; Middlesex County M-M-15), submission received from Stantec Consulting Ltd. in the amount of $258, (excluding HST) be awarded; subject to the concurrent award and equal funding contribution be provided by Middlesex County; and FURTHER THAT staff be authorized to execute the appropriate engineering services agreement. 9.5 Report # Administration Offices as part of the replacement of the Coldstream Fire Station R Motion by Councillor McMillan and Councillor Brennan THAT the administration offices for Fire Services be retained in the existing Coldstream Municipal Office IN CLOSED SESSION R Motion by Councillor DeViet and Councillor Berze THAT Council move in to closed session at pm to discuss advice that is subject to solicitor-client privilege, including communications necessary for that purpose (Middlesex Centre v. MacMillan) in accordance with Section 239 (2)(f) of the Municipal Act, S.O. 2001, c.25 as amended.

RECESS FOR DINNER R Motion by Councillor Brennan and Councillor Berze THAT Council recess at 6:00 pm and reconvene at 7:00 pm COMMITTEE OF ADJUSTMENT 7:00 pm R Motion by Councillor Berze and Councillor DeViet THAT the Council adjourn its regular meeting at 7:00 p.m. in order to sit as Committee of Adjustment under Section 45 and 53 of The Planning Act R.S.O., 1990, as amended Disclosure of Pecuniary Interest and the General Nature Thereof The Municipal Conflict of Interest Act requires any member of Committee of Adjustment declaring a pecuniary interest and the general nature thereof, where the interest of a member of Committee of Adjustment has not been disclosed by reason of the member s absence from the meeting, to disclose the interest at the first open meeting attended by the member of Committee of Adjustment and otherwise comply with the Act. Location: Northwest Corner of Ontario Avenue and Springer Street, Komoka Roll No.: No persons were in attendance at the meeting to offer comments to this application. R Motion by Councillor DeViet and Mayor Edmondson THAT Minor Variance Application A-5/15, filed by Mr. G & C Holdings Inc. for relief from the exterior side yard setback required for a single-detached dwelling within the site-specific Urban Residential First Density (UR1-4) zone of the Middlesex Centre Comprehensive Zoning By-law , which requires an exterior side yard setback of 8 metres whereas the applicant is proposing an exterior side yard setback of 6 metres; for a property legally described as Part of Lot 12, Block H, Plan 76 (geographic Township of Lobo), Part 2, Reference Plan 33R-18834, Municipality of Middlesex Centre; be granted. FURTHER THAT Minor Variance A-5/15 be subject to the following condition: 1. That the existing entrance to the subject property from Ontario Avenue be closed with the appropriate permits being issued by the Municipality of Middlesex Centre and that this be done to the satisfaction of the Municipal Engineer. 2. That the entrance that would provide vehicular access to the property that is subject to Minor Variance A-5/15 be constructed from the Springer Street road allowance and that this be done with the appropriate permits being issued by the Municipality of Middlesex Centre and be to the satisfaction of the Municipal Engineer. AND FURTHER THAT the reasons for granting Minor Variance Application A-5/15 include: Centre Official Plan; Centre Comprehensive Zoning By-law; The request is minor in nature; and The request represents an appropriate use on the subject property Application for Minor Variance (A-6/15) Owners: Nick Linkiewicz and Sara Kosarschenko Location: 106 Railway Avenue, Komoka Roll No.: Councillor Brennan noted his concerns with the application and Councillor McMillan asked if the driveway would be extended. No persons provided comments on the application. R Motion by Councillor Berze and Deputy Mayor Bloomfield THAT Minor Variance Application A-6/15, filed by Nick Linkiewicz and Sara Kosarschenko for relief from the Middlesex Centre Comprehensive Zoning Bylaw in order to construct a square metre detached garage on the

8 Council Minutes 8 June 24, 2015 east side of the property and as generally shown on the lot plan submitted in support of the application and included in Attachment 2 of report PDSD-P-30-15; which would increase the total accessory building coverage on the site to square metres, whereas the Comprehensive Zoning By-law restricts the total area permitted for all residential accessory buildings on the land to 50 square metres; for a property legally described as Lots 15-16, Block A, Plan 76 (geographic Township of Lobo), Municipality of Middlesex Centre and known municipally as 106 Railway Avenue; be granted. FURTHER THAT Minor Variance A-6/15 be subject to the following condition: 1. That the total accessory building size permitted via Minor Variance A-6/15 may not be used to construct any single accessory building with an area that is larger than square metres. AND FURTHER THAT the reasons for granting Minor Variance Application A-6/15 include: Centre Official Plan; Centre Comprehensive Zoning By-law; The request is minor in nature; and The request represents an appropriate use on the subject property Application for Minor Variance (A-7/15) Owners: Sandra McGovern and Christine Cheevers Location: 7056 Cook Road Roll No.: The following persons provided comment on the application: None R Motion by Mayor Edmondson and Councillor DeViet THAT Minor Variance Application A-7/15, filed by Sandra McGovern and Christine Cheevers for relief from the Middlesex Centre Comprehensive Zoning By-law in order to construct a building for the purposes of agricultural and residential storage in the front yard, closer to the front lot line than the singledetached dwelling on the land and 5 metres from the front lot line, as generally shown on the illustration submitted in support of the proposal and included in Attachment 2 of report PDSD-P-31-15; on a property legally described as Part of Lots 51 and 52, Concession WTR (geographic Township of Delaware), Part 2, Reference Plan 33R-3646 and Part 20, Reference Plan 33R-2972, Municipality of Middlesex Centre and known municipally as 7056 Cook Road; be granted. FURTHER THAT Minor Variance A-7/15 not be subject to any conditions. AND FURTHER THAT the reasons for granting Minor Variance Application A-7/15 include: Centre Official Plan; Centre Comprehensive Zoning By-law; The request is minor in nature; and

9 Council Minutes 9 June 24, 2015 The request represents an appropriate use on the subject property Minor Variance Application (A-4/15) Owner: Tridon Group Ltd. Location: 9 Dausett Drive, Units 21-24, Middlesex Vacant Land Condominium Plan 835 Don DeJong from Tridon Group appeared before the Committee to explain the purpose of the application. Don indicated that the roof height requirement is different as set out by Middlesex Centre and added that this application really only affects the four lots on the east side. Deputy Mayor Bloomfield asked why there is deviation from the by-law after the fact when the applications were approved. Don indicated that as a result of the public meeting, there was a neighbour who was concerned and as such the height of the roof was lowered. No persons provided comments on the application. R Motion by Councillor Berze and Councillor DeViet THAT Minor Variance Application A-4/15, filed by Tridon Group Ltd. for relief from the Middlesex Centre Comprehensive Zoning By-law as it relates to the maximum height permitted for Units within the Kilworth Mews vacant land condominium development in order to facilitate a single-detached dwelling on each unit with a maximum height of 7 metres; whereas the site-specific zoning of the land permits a maximum height of 6 metres for these units; for a property legally described as Part of Block 59, Registered Plan 33M-656 and Middlesex Vacant Land Condominium Plan 835 (geographic Township of Lobo), Municipality of Middlesex Centre and known municipally as 9 Dausett Drive (Units 21-24); be granted. FURTHER THAT Minor Variance A-4/15 not be subject to any conditions. AND FURTHER THAT the reasons for granting Minor Variance Application A-4/15 include: Centre Official Plan; Centre Comprehensive Zoning By-law; The request is minor in nature; and The request represents an appropriate use on the subject property Minor Variance Application (A-8/15) Owner: Tridon Group Ltd. Location: 61 Earlscourt Terrace, Kilworth Roll No.: Don DeJong appeared before the Committee to indicate that the purchaser of the lot would like a covered porch on the front and a covered deck area at the back of the house. Because of the covered structures and due to the fact that the surface is concrete, relief is required.

10 Council Minutes 10 June 24, 2015 Councillor McMillan asked if there could be any options that could be looked at in order to comply with the by-law. Don indicated that a two story building might be able to remedy this but this is not what the house owner is looking for. The following persons provided the following comments: none R Motion by Mayor Al Edmondson and Deputy Mayor Bloomfield THAT Minor Variance Application A-8/15, filed by Tridon Group Ltd. for relief from the total maximum lot coverage and the maximum lot coverage permitted for a single-detached dwelling within the site-specific Urban Residential First Density (UR1-22) zone of the Middlesex Centre Comprehensive Zoning By-law , which restricts the total maximum lot coverage to 38%, with 35% allocated for a single-detached dwelling, whereas the applicant is proposing a total maximum lot coverage of 42%, with 39% being allocated for a single-detached dwelling; for a property legally described as Lot 45, Registered Plan 33M-656 (geographic Township of Lobo), Municipality of Middlesex Centre and known municipally as 61 Earlscourt Terrace be granted. FURTHER THAT Minor Variance A-8/15 be subject to the following condition: 1. That the single-detached dwelling to be constructed via Minor Variance A- 8/15 be restricted to one storey in height. AND FURTHER THAT the reasons for granting Minor Variance Application A-8/15 include: Centre Official Plan; Centre Comprehensive Zoning By-law; The request is minor in nature; and The request represents an appropriate use on the subject property Consent Application (B-20/15) Owner: Pieter Bakker Agent: Rosa Bakker Location: Ilderton Road Roll No.: The following persons provided comments on the application: Jamie Robson indicated that the size of the parcel should stay the same as there was a former barn which would mean that the lands would not be viable to farm. R Motion by Councillor Berze and Councillor DeViet THAT Consent Application B-20/15, filed by Pieter Bakker in order to sever a single-detached dwelling on a lot with a lot frontage of approximately metres along Ilderton Road (County Road 16) and an area of approximately 0.64 hectares; from a property legally described as Part of Lot 30, Concession 11 (geographic Township of London), Municipality of Middlesex Centre and known municipally as Ilderton Road; be granted. FURTHER THAT Consent B-20/15 be subject to the following conditions:

11 Council Minutes 11 June 24, That the Certificate of Consent under Section 53(42) of the Planning Act shall be given within one year of the date of the notice of the decision. 2. That the fee for the Certificate of Consent be paid in accordance with the Municipality s Fees and Charges By-law. 3. That, if necessary, a revised assessment schedule in accordance with the Drainage Act, as amended, be commissioned and paid for by the Owner. 4. That the Zoning By-law Amendment for the severed and retained lots of Consent B- 20/15 be in full force and effect. 5. That a notice be registered on the title of the severed lot of Consent B-20/15; specifically notifying future owners of normal farm practices, as outlined in the Farming and Food Production Protection Act, 1998, as amended. 6. That one of the two entrances to County Road 16 from the severed lot of Consent B-20/15 be closed with the appropriate permits being obtained from the County of Middlesex and that this be done to the satisfaction of the County Engineer. 7. That the Owner dedicate land up to 18 metres from the centreline of County Road 16 along the severed lot of Consent B-20/15 to the County of Middlesex for road widening purposes if the right-of-way is not already to that width. 8. That the purchaser of the retained lot of Consent B-20/15 provide confirmation that he or she will operate at least two farms following the purchase of the land and that the dwelling on the severed lot of Consent B- 20/15 is surplus to the needs of the farming operation. FURTHER THAT the reasons for granting Consent Application B-20/15 include: The proposal is consistent with the Provincial Policy Statement; The proposal conforms to the County of Middlesex Official Plan and the Middlesex Centre Official Plan; and Subject to the Zoning By-law Amendment application that has been submitted, the proposal would comply with the Middlesex Centre Comprehensive Zoning By-law Consent Application (B-21/15) Owner: Henderock Farms Inc. Agent: Cherie Henderson Location: 6474 Bells Road Roll No.: Alan Patton and Cherie Henderson appeared before the Committee of the Adjustment. Travis Henderson, Cherie s son, has an interest in the retained land. Cherie Henderson is concerned with condition number 6 outlined in the staff report. The issue that arises is a grain bin structure that is currently being used for storage of personal storage. The implement shed currently stores items as Cherie s basement is only a half basement and therefore limited storage. There was some discussion with to the implement shed. The following persons provided comments on the application: None R Motion by Councillor Brennan and Deputy Mayor Bloomfield THAT Consent Application B-21/15, as filed by Henderock Farms Inc. and recommended for amendment by staff in order to sever a surplus farm residence, an implement shed, a grain bin, a pool and an associated shed on a lot with a lot

12 Council Minutes 12 June 24, 2015 frontage of approximately metres along Bells Road and an area of approximately hectares together with easements for utilities over the retained farm of Consent B-21/15; from a property legally described as Part of Lot 20, Concession 3 (geographic Township of Delaware), Municipality of Middlesex Centre and known municipally as 6474 Bells Road; be granted. FURTHER THAT Consent B-21/15 be subject to the following conditions: 1. That the Certificate of Consent under Section 53(42) of the Planning Act shall be given within one year of the date of the notice of the decision. 2. That the fee for the Certificate of Consent be paid in accordance with the Municipality s Fees and Charges By-law. 3. That, if necessary, a revised assessment schedule in accordance with the Drainage Act, as amended, be commissioned and paid for by the Owner. 4. That the Zoning By-law Amendment for the severed and retained lots of Consent B- 21/15 be in full force and effect. 5. That a notice be registered on the title of the severed lot of Consent B-21/15; specifically notifying future owners of normal farm practices, as outlined in the Farming and Food Production Protection Act, 1998, as amended. 6. That the total size of all accessory buildings on the severed lot of Consent B-21/15 not exceed the maximum standards of the Surplus Residence (SR) zone. The removal of any buildings from the land shall be subject to the permitting processes of the Municipality s Building Division; including the payment of fees. 7. That the grain bin contained on the severed lot of Consent B-21/15 be removed from the land with the appropriate permits being obtained from the Municipality s Building Division and with the payment of any associated fees. 8. That the Owner submit to the Municipality the Consent fees associated with the creation of the utility easements over the retained farm of Consent B- 21/15 should these easements be required, in accordance with the Municipality s Fees and Charges By-law. 9. That the purchaser of the retained lot of Consent B-21/15 provide confirmation that he or she will operate at least two farms following the purchase of the land and that the dwelling on the severed lot of Consent B- 21/15 is surplus to the needs of the farming operation. 10. That one of the two entrances to Bells Road from the severed lot of Consent B-21/15 be closed with the appropriate permits being obtained from the Municipality of Middlesex Centre and that this be done to the satisfaction of the Municipal Engineer. FURTHER THAT the reasons for granting Consent Application B-21/15 include: The proposal is consistent with the Provincial Policy Statement; The proposal conforms to the County of Middlesex Official Plan and the Middlesex Centre Official Plan; and Subject to the Zoning By-law Amendment application that has been submitted, the proposal would comply with the Middlesex Centre Comprehensive Zoning By-law.

P13, as amended Application for Zoning By-law Amendment Owner: Pieter Bakker Agent: Rosa Bakker Location: Ilderton Road Roll No.: R Motion by Deputy Mayor Bloomfield and Councillor Brennan THAT the Zoning By-law Amendment application, filed by Pieter Bakker for the severed and retained lots of Consent B-20/15 in order to implement the severance of a surplus farm residence, be approved Application for Zoning By-law Amendment Owner: Henderock Farms Inc. Agent: Cherie Henderson Location: 6474 Bells Road Roll No.: Alan Patton indicated that they oppose the zoning by-law and noted that if the Council approves the application then they would be going to a higher court. R Motion by Councillor Berze and Councillor DeViet THAT the Zoning By-law Amendment application, filed by Henderock Farms Inc. for the severed and retained lots of Consent B-21/15, as amended for the reduced frontage and reduce envelope in order to implement the severance of a surplus farm residence, be approved Application for Zoning By-law Amendment Owner: Aaron Construction Limited Location: and Nine Mile Road Roll No.: , and Myt Wasylko appeared before Council to represent Aaron Construction. Aaron Construction purchased two lots some years ago and have a legal non-conforming use as there are two dwellings located on one property.
