The plan in 1930, at the start of the Great Depression, was for to follow the erection of that building that would be for decades to come, the tallest building in the world. But, the very work of photographing this project seemed to run contrary to the subject matter that the photographer had found to define his artistic life. The photographer was Lewis Wickes Hine and he had earlier made his name shooting poignant photographs of children working in coal mines and in weaving and spinning mills that led to the passage of child labor laws to protect children from exploitation. This Empire State project offered Hine a potentially more upbeat theme that was realized when he found the Sky Boys treading dozens of stories above 34th Street as casual as if they were strolling in Central Park. To celebrate the Labor Day holiday it is appropriate to recognize a photographer who captured the spirit and the emotions of working for a living. Hine was described as an owlish looking man, short of stature and frail of build yet, he willingly leapt into the work of photographing the men who were involved in massive construction project, from the ground upward to the very pinnacle of the building. The photojournalist, Robert Capa, who rode in one of the first boats to land on the Normandy Beaches on June 6, 1944, D-Day, was quoted as saying, If your pictures are not good enough you are not close enough. Capa would have celebrated Hine for his willingness to walk the narrow steel I-beams and to get close enough to capture this photograph shown here of a Sky Boy taking a break with a cigarette and leaning back with the majestic Chrysler Building in the background. The men that captured Hine s attention were those who straddled the narrow I-beams and assembled the skeleton of what would become the finished Empire State Building. Because of the magnitude of the construction project, the value of what Hine was accomplished was enhanced. He was the only artist who was willing to scamper to the highest levels of this building as it was being built and he made certain that he captured those men as they performed all the work necessary to allow this monolith to emerge from the ground. The men who performed this work so high above the ground came from dispirit sites; Newfoundland, Scandinavia, Ireland and various part of America including the sure-footed Mohawk Indians from upstate New York. Because he wanted to capture a sense of the labor of the Sky Boys, Hine had to enter their element. That he did as he was elevated to where the upper most levels of structural steel were being laid and riveted into place. The work that Hine captured occurred during the spring and the summer months of 1930 as the upper most floors of structural steel were laid. To get closer to where the Sky Boys worked, Hine had created for himself a rigging. With that rigging he could move allowing him to move out from the structure and to dangle on an extended I-beam. From that perch he held his view camera, retained his balance and shot those amazing photographs that showed the ironworkers just doing their job. These iron workers were not heroes, they were just doing the job. They appreciated the work that Hine had shot but they did not see themselves as anyone other than who they were, iron workers giving a full day of work for a salary without a thank you when the job was completed. Many of these men knew, when the Empire State Building was finished, they would move on to another construction project and another pay check. The work they did was that simple. Another job and another paycheck is what labor in 1930 and labor today is about. Working a full day in exchange for a full paycheck. So much of that activity has come through the decades to define what labor is and to articulate the value of labor to men as well as women. America today bears many similarities with the Great Depression. In both instances, millions of people lost their jobs because of what occurred to the national economy. The results of these economic downturns did not persuade men to not look for work. If anything, the diminished wages and the loss of a job made these men and women pursue new jobs or other employment with even greater vigor. However, as in 1930 and so it was in 2009, many men and women who lost their jobs could not find new full-time full-pay jobs. That was the tragedy. This coming weekend America celebrates Labor Day that dates back to the late 19th Century. It is proper to recognize those in this society who were the builders, those who scaled tall buildings to lay steel and to affix the pinnacle to the top of another skyscraper. It is also proper to recognize, in this instance, the man who chronicled those construction project that created the tallest buildings in the world. The man who preserved a photographic chronicle of those who were described by the New York Times reporter, C.G. Pore as strolling on the edge of nothingness should also be remembered on Labor Day for what he gave to the pages of history. The Sky Boys flourished for a number decades as skyscrapers were being built in cities across the nation. These iron workers exist today though with the huge cranes used to erect many building projects, the need for those Sky Boys who were strolling on the edge of nothingness has disappeared to a great extent. The new system was rolled out in June and is still being fine-tuned. Boone County residents should be on the lookout for either a white or blue postcard with the words Official Juror Notification. The card is sent out to citizens who have been selected as possible jurors. It requires the recipient to complete a questionnaire comprised of 23 questions within 10 days using one of the methods described on the card which include an online option, a smart phone option, or an automated phone line option. They may also contact the Circuit Clerk s office and obtain a written questionnaire which they would complete and return to the clerk s office. The questionnaire is processed and used to determine qualified jurors that may be summoned throughout the year when needed. Jurors will have an option on the questionnaire to choose the most convenient month for their service. While there is no guarantee, every effort will be made to accommodate the juror s choice. Each juror is only required to serve once a year. Citizens who do not comply with completion of the questionnaire may be required by the Court to appear personally in the Circuit Clerk s office to do so. Once a citizen has completed the questionnaire, they will wait until they receive an actual jury summons in the mail with a specific reporting date to appear for jury duty. At that time, they may contact the clerk s office with requests to be excused or deferred to another date. Requests for excuses to due to medical reasons require a written excuse from a doctor. This pre-qualification system is new to the county and is expected to streamline the juror selection process from beginning to end which will save Boone County money across several departments in paper, postage, supplies and employee time as well as adding convenience to the citizens of Boone County. As this system was paid for by an automation fund established by State statute at no cost to the County General Fund, it is truly a win/win situation for the county. New Stop Sign on Caledonia Road The Boone County Board at its regular meeting on August 17,2016 voted to place stop signs on Caledonia Road at the intersection of Dawson Lake Road makingthat intersection a four-way stop. The traffic accident history, and concern by residents, prompted this stop sign placement by the Board. Caledonia Road is under the jurisdiction of the County and has a posted speed limit of 55 MPH. Overall traffic movement in that part of the County is substantial with an estimated 1.5 million cars moving along that route annually. However, traffic accident history shows several crashes have occurred at that intersection. This prompted area residents to approach the County Roads & Capital Improvement Committee to ask for action by the Board. It is anticipated that the stop sign will be installed by the end of September. Administrator By James Middleton The Boone County Health Department Board of Directors on Monday chose a new administrator in response to the retirement of the current administrator, Cindy Frank. She plans to leave effective September 2. The new administrator chosen is Amanda Mehl who is being promoted from the position of Director of Personal Health Services. Ms. Mehl has worked for the County Health Department over the last four and a half years. Ms. Frank said, She (Ms. Mehl) is highly skilled with a bachelor s degree and a master s degree in public health. She is also a Registered Nurse and has served us well. Ms. Frank also said that the Health Department received 12 applicants for the job. Of the applicants, many of them were unqualified to fill the post however, Ms. Frank added, We had four serious applicants and we narrowed the search to two applicants. We interviewed each and chose Amanda (Ms. Mehl). In addition to her many professional skills, Ms. Frank also said, She is fluent in Spanish. This is, of course, a vital skill considering the ethnic mix of the residents in Belvidere and Boone County. Ms. Mehl s salary has been $64,326 per year and insurance and benefits provided her with additional income totaling $6,734. Serving as the new administrator, her salary will increase to $85,000 with a comparable benefits package totaling $6,734. It should be noted that the County Health Department will now send Ms. Mehl s qualifications to the Illinois Department of Public Health. Ms. Frank said she has no doubt that Ms. Mehl will be approved and the state evaluation process could take from two to three weeks. The basic qualifications to serve as a county Health Department administrator requires that Ms. Mehl hold a master s degree in public health and that she have a minimum of two years experience in public health as a supervisor. In addition to her duties being responsible for the medical side of the Health Department, Ms. Mehl will see her duties expand as she will be responsible for the management of the entire County Health Department. During the ensuing months until the end of the year, Ms. Mehl will likely work as the new County Health Department administrator and the director of Environmental Services, Bill Hatfield, will continue on in that role. Mr. Hatfield plans to retire from the Health Department, effective the end of The path the Health Department will pursue going forward will be different from what has been the path over the years. In previous years and previous administrators, the Boone County Health Department has had one administrator and two directors with one director managing public health and the other director in charge of environmental services. The Health Department is making a change to control costs and anticipates using Ms. Mehl as a co-administrator and finding another who would be responsible for managing Environmental Services with that person serving as a co-administrator. In that context, instead of having one administrator and two directors, the Health Department would function with two co-administrators. This new system could afford the Health Department the saving of an approximate half salary that would have been spent for two directors. Ms. Frank commented, Our efforts here and our goal is for this transition to be seamless. The decision to hire Ms. Mehl and to move forward with the Department plans to alter the management system of the Department occurred in the Monday meeting of the Health Department Board of Directors. The Health Department is moving through a period of transition as the new environmental services coadministrator will work with Ms. Mehl and the Department Board to craft a reasonable system of assessing fees to be charged to not-for-profit entities that host food serving events. The proposed policy advanced by the Health Department asking to charge not-for-profit entities for food inspections at their fund raising events has caused public descent and significant public discussion. Though there is not yet a resolution to the question, leaders on the County Board and those in the County Department of Health have indicated their desire to find a reasonable answer. Ms. Mehl s qualifications and her hiring will now be sent to the Illinois Department of Public Health for their evaluation and approval.

3 In Our 21th Year The Boone County Journal August 2nd, Pay-to-Play Is the Norm Though there could be a number of paths to define the phrase, Pay-to-Play, perhaps the most popular definition is found within the context of American politics. The phrase has often been used to describe policy as practiced in local, state and national politics. In fact, Pay to Play policy was found to have been practiced by two former Illinois governors and one former Virginia governor. Those three politicians were convicted of engaging in illegal behavior but the conviction of the Virginia governor was later overturned. The discovery of Pay to Play policy has occurred more often as a factor of the skyrocketing cost for anyone running for office. Pay to Play has become a shorthand cynical explanation that many voters use to disparage the current national political system. One explanation for why this policy has become so popular is because so few politicians are ever prosecuted for breaking the law in this manner. Running for a local office costs today thousands of dollars. Millions of dollars are needed for anyone running for a state office. Tens of millions are needed to be elected as a governor, a senator or a representative of a state. Billions of dollars are needed to become President of the United States. Yet, some still wonder why Pay to Play has such a hold in current politics. However, the acquittal of the Virginia governor could result in Pay to Play policy becoming even more institutionalized and far more difficult to prove. The vast sums of money needed to earn election requires candidates to spend more time raising funds than the time needed to enact new law. Overturning the conviction of the former Virginia governor on corruption charges established that the current definitions have become more difficult to prove. Charges when levied by a prosecutor requires him to persuade a judge that his definitions of legal terms are the definitions that should convict the defendant. The state s definition of terms was what convicted former Illinois governors George Ryan and Rod Blagojevich but the former Virginia Governor, Robert McDonnell, was granted an acquittal after his appeal was heard by the Supreme Court. The ruling there is instructive as to future perceptions of Pay to Play politics. Many voters today believe that Pay to Play behavior is now the norm in American politics and not solely because of the ruling in Citizens United v. Federal Election Commission, 558 US 310. In that case, the Court held that limiting the size of campaign contributions from private citizens, corporations and labor unions within a certain preordained period before a General Election is an unconstitutional limitation of free speech. The question in McDonnell s case sought to define what an Official Act is and when a contribution to a governmental official is made with the donor expecting certain Official Acts to follow. In McDonnell v. the United States, No , the Supreme Court held what an Official Act is and also ruled on how a Court can determine when or if an Official Act has occurred. With refined precision, the Court held that setting a meeting is not, in itself, an Official Act. In the lower Court where McDonnell was convicted, the state argued that setting a meeting is an Official Act. Chief Justice John Roberts wrote the Court s opinion and explained the boundaries of an Official Act and why setting a meeting does not mean that an Official Act had occurred. The Court held there is no Quid-pro-Quo by an elected official setting a meeting and accepting a favor. The lower Court accepted the argument from the State and disallowed certain jury instructions. Those instructions would have clarified that setting a meeting is not an Official Act. The trial transcript showed that McDonnell asked subordinates to attend a meeting but the subordinates were not expected nor were they told to do anything. Justice Robert wrote that McDonnell did not agree to make a decision or to take an action on any of the matters described by the Fourth Circuit by merely setting a meeting. Supreme Court rulings can be esoteric but the job the Justices perform and the precision expected of them requires that their opinions be esoteric. Voters are more interested in broader practical perceptions of when or if Pay to Play policy is occurring. In the cases of Ryan and Blagojevich, those courts held that an Official Act resulted after receipt of promised consideration from an outside party in exchange for those Acts to be performed. A similar argument has been advanced regarding the Democratic Party nominee and certain actions while serving as Secretary of State. Certain donations were made to her family charitable trust in apparent exchange for certain meetings to occur that could have resulted in certain Official Acts being performed by governmental officials. This information resulted from the disclosure of certain documents that were gathered and analyzed by the Associated Press. If there is fire responsible for the smoke that the candidate is admitting to that has arisen from these recent disclosures, any such conclusion awaits analysis from an investigation into if any Official Acts ever from the donations that occurred. Public opinion echoes that voters are tired of Pay to Play policy infecting the national political process. Perhaps in no small part Chief Justice Roberts ruling that offered a more current definition of Pay to Play policy has become more difficult to prove and to one day better manage. Buying legislative policy has long infected federal, state and local politics and that trend is likely to continue for some time. However, some elected officials recognize their obligation to enforce law and the American political system is in need for more officials who accept those obligations. Unless elected officials at all levels are willing and capable of enforcing the law, then they should be replaced. Many voters believe that Pay to Play is a cancer infecting many legislative districts. Instead of blithely answering, Well, that s just how business is done, voters and elected officials must reject that cynical perception. The deeper question should ask to what extent are the voters willing to accept this behavior as policy and what will voters do to affect a change in that policy. 4 4 August 2nd 2016 The Boone County Journal In Our 21th Year Procedural Questions Emerge at ZBA By David Larson The Boone County Zoning Board of Appeals (ZBA) itself experienced this month the confusion of process that so many applicants have endured when trying to interact with government. Well intentioned actions can lead to confusion and a lack of understanding about exactly what comes next and what to do. A long time Boone County business, Angelic Organics, a producer of organic vegetables engaged the three steps to reach zoning approval beginning at the ZBA this month. From there Angelic also will appear before the Boone County Board planning, zoning and building committee and then on to final approval at the Boone County Board. Representing Angelic Organics was Thomas Spaulding, Executive Director, who described the mission and plans for the new learning center often facing a barge of objects. They plan an expansion of their learning center with a week long summer camp aimed at creating an innovative educational experience through hands on rural agricultural food production. The event is planned to be more like gardening than corporate farming. The center hopes to convert a property in northern Boone County into an overnight bunk house with meeting rooms and living facilities to accommodate 30 students per week. The summer camp plans to focus on food production from the soil while being around farm animals. The age range for students begins at about 7 and goes through college-age students. Working with schools from across the country Spaulding said that the experience of the earth and how food comes from it and the farm experience with animals are the foundation of their educational goals. Working with different curriculum brought by each group and school the work of the classroom is brought down to ground level with a very basic and almost ancient experience of life. Residents in adjacent properties raised questions, which are fundamental to the ZBA process. This led to questioning of the soundness of a bridge and a narrow driveway leading to the new center crossing the Kineenkinic Creek. Steve Schabacker, a member of the ZBA, voiced concern for ambulance, and fire access during periods of flooding. A line of questioning eventually found an answer in understanding the nature of the zoning process as a cooperation of many different governmental agencies working in concert to achieve final approval by default. After voicing a number of what ifs and how the issuance of a special use permit requires a series of conditions before issuance, it was suggested that approval be completed by the local fire district, a structural engineer, and Emergency Management Agency. But it appeared that the local fire department had already completed a survey of the site and issued a letter stating such that was included in the informational packets provided to the ZBA. ZBA member Joan Crum commented, I don t know why we are doing this, and she added, Our purpose here is to decide is this an appropriate use of this land or not... not all of these details... The deliberation then focused on the status of the special use permit when new owners of the land arose. Special use ends at the point of transfer and does not vest with the land. Special Use is limited to non-profit usage if granted and a transfer takes place. These and many other legal oriented questions were brought up by the ZBA. It is typical for the Boone County Planning Department to prepare a detailed report, including supportive material and a description of the process or conditions to achieve approval if the ZBA decides that any applicant s purpose presented for the use of the subject land is appropriate. This is part of what a county planning department does in support of the ZBA. The meeting closed late into the evening and the final agenda item regarding the building of an auction barn East of Capron was postponed until the September ZBA meeting. The complainant said that they believed that the individual(s) had damaged the solar light by throwing crabapples at it, as there were several crabapples on the ground, near the mailbox. On 8/12/16 at 1854 hours, BPD Officer spoke with a complainant in reference to a theft. The complainant stated between 1730 and 1854 hours, a subject stole his Trump for President sign in his front yard. On 08/13/16 at 2150 hrs.bpd Officer responded to the 1500 Block of N. State St/Curry s Auto for damage to property. The complainant stated he found the front window of his business broken. The window appeared to be broken by a baseball. The damage occurred between 1300hrs-2145hrs today. On 08/14/16 at 0042 hrs. BPD Officer responded to the 1000 Block of Strawberry Ln for damage to property. The complainant stated that this morning at 0030 hrs an unknown subject threw a brick at her window causing it to shatter. A coffee pot was also damaged. A witness stated they observed a grey vehicle speed off around the same time the window was damaged but did not observe anything else. On 8/14/16 at 1549 hrs, BPD Officer was dispatched to the 400 Block of Streamwood reference a stolen bicycle. The complainant stated his bike was stolen 8/7/16 at approx hrs. The complainant described the bike as a chrome and blue United brand BMX bike, with tan tires, and a chain; green, yellow and red in color. On 8/14/16 at 1927 hrs, BPD Officer responded to the 800 Block of W. Jackson St. in reference to a burlgary discovered. The complainant reported that an unknown person entered her Apt. between 1000 hrs and 1920 hrs and stole cash and other items. On 08/15/16 at 0746 hrs. BPD Officer was dispatched to the 1500 Block of W. 6th St reference a theft. The complainant stated he parked his vehicle on the street in front of the townhomes at 2200 hrs. on 08/14/16. On 08/15/16 at 0700 hrs he noticed his Blue Ford Generator which he had strapped to the roof of his vehicle removed. On 08/15/16 at approximately 0820 hours, BPD Officer was contacted by Belvidere High School Head Custodian in regards to a criminal damage to state supported property incident that occurred at Belvidere High School (1500 East Ave.). They advised that sometime between 0800 hours on 08/13/16 and 0800 hours on 08/15/16, unknown individual(s) spray painted a stop sign on the south side of the property and pulled up an orange traffic delineator post on the east side of the property. On at approximately 1955 hrs., BCS Deputy was dispatched to the Block of Coon Trail Rd. for a damage to property. The complainant stated that his mailbox was hit with a bat between at 1200 hrs. and at 1600 hrs. On 08/09/16, at 08:07 hrs, BCS Deputy responded to Capron Elementary school to take a report of damage to school property. BCS Deputy was shown a dented exterior door (D) and several damaged windows on the north side of the school. On 08/09/16, at 16:02 hrs, Boone County Deputies responded to the area of Brooke-Linsee and Bree reference a robbery. The complainant stated that he was riding his bike south on S. State St. in Poplar Grove when he was approached by four males in what he believes was an older Ford Mustang demanding he pay them back. The complainant stated that one of the subjects struck him in the head and took several items. BC Detective called to the scene. On at 2058 hrs., BCS Deputy responded to the PSB to meet with a complainant who advised that a contractor that he had hired, had entered his basement without permission and took items without permission. This occurred between 1700 hrs. and 1730 hrs. The complainant stated that other items were taken as well. Case forwarded to Detectives. On 08/11/2016 at approximately 1307, BCS Deputy was dispatched to the 200 Block of Briar Cliff St. SW for a counterfeit check. The complainant reported that on 08/02/16, he received a cashier s check through the US Post Office Priority Mail Express, from a subject who had sent a check from First State Bank (P.O. Box 10 Gainesville, Texas 76241) to purchase a Cartier wrist watch. The transaction was set up through Craig s List. The complainant stated the subject wanted him to cash the check and send him the watch as well as the remaining money. When the complainant called the bank and gave the bank the check number, they advised him that the check was counterfeit. BC Detective was notified. On 08/14/16 at 0900 hours, BCS Deputy was dispatched to the 200 Block of Cloud Mist reference damage to vehicle.
