NICOL, TREASURER SANILAC COUNTY PUBLIC AUCTION OF FORECLOSED PROPERTIES RULES AND REGULATIONS The following rules and regulations are subject to change at any time and should be reviewed frequently. These auctions are being held in compliance with the General Property Tax Act, more specifically m, applicable court decisions and these procedures. Any announcement made by the auctioneer on the day of the auction takes precedence over previously published or verbally conveyed terms and conditions. Bidders must be attentive at the auction. This auction is public in all respects. Registration Registration will start at 8:30 a.m. on auction day in the Sanilac County Treasurer s Office, Room 204, Courthouse, Sandusky, Michigan. Bidders should arrive no later than 9:30 a.m. to register. No bids will be accepted unless the bidder has registered and received a prenumbered bid card. Valid picture identification (driver s licenses, state identification card, etc.) is required in order to register. Any person unable to attend the auction can be represented by an agent, or other representative, authorized to bid and otherwise represent the person. In order to be represented by another person, a signed, notarized authorization for representation must be presented at the time of registration. The driver s license or state ID, of the bidder, must be presented in order to receive a bidder number. Also, consider how you want to print your booklet. You can print it on a desktop printer, at a copy shop, or at a commercial printing service. In addition to your budget, the complexity of the publication including whether you print it as a black and white or a color publication will help determine the best method for printing your publication. **Bidders are required to sign an affidavit under penalty of perjury indicating that the bidder does not directly or indirectly: Hold more than a de minimus legal interest in any property in the same county with delinquent taxes; and Bear responsibility for any unpaid civil fines for a violation of an ordinance authorized by Section 4l of the home rule city act, 1909 PA 279, MCL 117.4l, in the local tax collection unit in which the property is located. Properties Offered A list of Sanilac County foreclosed properties has been approved for auction by the Sanilac County Treasurer and by order of the 24th Circuit Court. All prior liens (other than IRS liens), encumbrances and taxes are cancelled by Circuit Court order. These properties are subject to any state, county or local zoning or building ordinances. The County of Sanilac does not guarantee the usability or access to any of these lands. It is the responsibility of prospective purchasers to do their own research as to the use of the land for their intended purpose and to make a personal inspection of the property on the ground to determine if it will be suitable for the purposes for which it is being purchased. The County of Sanilac makes neither representation nor claims as to fitness for purpose, ingress/egress, conditions, covenants, or restrictions. Occupied structures may not be entered without the tenants permission. Secured vacant structures may not be entered. 4
5 Offered properties may be subject to flooding. Any new construction or reconstruction should be elevated above the 100-year flood plain. Also, any filling, dredging or other permanent construction below the ordinary high-water mark of the water body involved may be subject to the provisions of 1972 Public Act 346. Any earth change on the property may be subject to the provisions of 1972 Public Act 347. These properties may also be subject to the GoemaereAnderson Wetland Protection Act, 1979, Public Act 203. Minimum Bid Price A minimum bid will be set for each property offered. Once established, the minimum bid will be shown on the property list; however, the minimum bid amount is subject to change if additional fees accrue. No sale can be made for less than the minimum bid price indicated at the auction. Bidding Any registered person may bid on the properties offered in counties where they do not have legal interest in any property with delinquent property taxes, nor owe any civil fines in the same local unit as the auction property. Any person unable to attend the auction can be represented at the auction by an agent, or other representative, with authority to bid and otherwise represent the person. In order to be represented by another person a signed, notarized authorization for representation must be presented at the time of registration. The registered bidder is legally and financially responsible for all properties bid upon whether representing one s self or acting as an agent. Each auction unit will be offered separately and in the order appearing on the list. Each auction unit will be awarded to the individual bidding the highest amount bid, equal to or greater than the minimum bid. An oral bid accepted at public auction is a legal and binding contract to purchase. No sealed bids, mailed bids, phone bids, ed or online bids will be accepted and the Sanilac County Treasurer reserves the right to reject any or all bids. Bids will be accepted in increments of $50.00 or more starting with the indicated minimum bid. If, for any reason, the final sale cannot be completed by the highest bidder, the property may then be offered to the second bidder for their final bid amount. Terms of Auction Payment must be made in cash, certified funds (cashier s check, certified bank check or money order with proper identification), payable to the Sanilac County Treasurer, or by credit card. Personal and business checks will also be allowed, only after the first $1, is paid by cash or certified funds for each parcel purchased. When paying by credit card contact Government Payment Services, Inc. (GPS) by calling and provide the Pay Location Code #2011, parcel number and amount. Government Payment Services, Inc. will also accept credit card payments online at Pay Location Code #2011. Credit card payments will be charged a 2.5% fee by GPS if the total purchase price is over $150.00; and debit card payments will be charged a 1.15% fee by GPS. Cash payments are to be made in the Sanilac County Treasurer s Office, Room 204, County Courthouse. Payment in full is required the day of auction, and must be presented to the Sanilac County Treasurer s Office, Room 204, no later than 3:30 p.m. The first $1, of the selling price must be deposited in the form of cash or certified funds for each parcel purchased. The balance may be paid by cash, cashier s check, money order, major credit card, personal or business check. 5
6 If your purchase is less than $1,000.00, payment must be deposited in the form of cash or certified funds for each parcel purchased. ANY DISHONORED PAYMENT BY A BIDDER FOR ANY REASON WILL FORFEIT $1, DEPOSIT TO THE COUNTY TREASURER. THE COUNTY TREASURER MAY PROSECUTE ANY PURCHASER WHOSE CHECK IS RETURNED NSF FOR ANY REASON OR FAILS TO CONSUMMATE A PURCHASE Any purchaser who fails to consummate a purchase will be banned from bidding at all future county auctions. No purchases can be made on a time-payment plan. The Sanilac County Treasurer reserves the right to remove properties from the auction, at any time, combine parcels into one sale, split combined parcels into multiple sales, and to cancel the auction at any time. The Sanilac County Treasurer reserves the right to cancel a sale, prior to issuance of a deed and refund any deposit, should a defect in the foreclosure process be discovered. Receipts Successful bidders at the auction will be issued a receipt for their purchase, upon payment. Special Assessments Special assessments through tax year 2017 are included in the starting bids. Parcels with known special assessments have a note on the parcel detail page. Outstanding bonded assessments: Parcels sold are subject to property taxes for the entire current tax year, as well as current and future installments of any outstanding bonded Assessments. All bidders should contact the county drain commissioner, city, village or township office where the property is located to determine if there are any outstanding bonded or deferred assessments on the properties being offered. Reservations This conveyance hereby restricts the Grantee from severing oil and gas rights from the surface rights any time in the future. If the Grantee severs the subsurface rights from the surface rights, the subsurface rights will revert to the County of Sanilac. Possession of Property The Sanilac County Treasurer recommends that no purchaser take physical possession of any property bid upon at this auction until a deed has been executed and delivered to the purchaser. Purchasers should be aware that if there are inhabitants of the property, it will be the purchaser s responsibility to evict or negotiate rental agreements and the County of Sanilac, its officer, employees, and agents, are unable to assist in this process. No activities should be conducted on the site other than a baseline environmental assessment for contaminated properties. However, steps should be taken to protect your equity in this property by securing vacant structures against entry and obtaining (homeowners) insurance for occupied property. Additionally, buyers are responsible for contacting local units of government to prevent possible demolition of structures situated on parcels. 6
7 Conditions The purchaser accepts the premises in its present as is condition, and releases the Sanilac County Treasurer and the County of Sanilac and its officers, employees and agents from all liability whatsoever arising from any condition of the premises, whether now known or subsequently discovered, including but not limited to all claims based on environmental contamination of the premises. A person who acquires property that is contaminated (a facility pursuant to Section 20101(1)(1) of the Natural Resources and Environmental Protection Act (NREPA), 1994, P.A. 451, as amended) as a result of release(s) of a hazardous substance(s) may become liable for all costs of cleaning up the property and any other properties impacted by the release(s). Liability may be imposed upon the person acquiring the property even in the absence of any personal responsibility for, or knowledge of, the release. Protection from such liability may be obtained by conducting a Baseline Environmental Assessment (BEA) as provided for under Section 20126(1)(c) of NREPA. However, the BEA must be conducted prior to or within 45 days of the earliest date of purchase or occupancy of the property. Persons who acquire contaminated property may have due care obligations under Section 20107a of NREPA even if they conduct a BEA and are not liable for the contamination. Pursuant to Part 201 of the NREPA, the person(s) responsible for an activity causing a release at the property is obligated to pursue response activities on the property. Consequently, the non-liable purchaser may be required to provide access to a liable party to conduct response activities at the property in the future. Section of the NREPA requires that a person who has knowledge that their property is contaminated provide a written notice to the purchaser or other person to whom the property is transferred who discloses the general nature and extent of the release. Additional disclosure obligations may also apply at the time the property, or an interest in the property, is transferred. Accordingly, the County of Sanilac recommends that a person who is interested in acquiring surplus County property contact an attorney or an environmental consultant for advice prior to the acquisition of any surplus County property that may be contaminated. You may contact the Department of Environmental Quality, Saginaw Bay District at (989) for possible information regarding questions on environmental concerns on any of these properties. Property Taxes All property taxes which become due and payable after March 31, 2018, will be the responsibility of the purchaser, which include the Summer, Village (if property is within village limits) and Winter 2018 taxes. A copy of the 2018 Summer and Village (if property is within village limits) bill will be given to the individual at time of purchase. The 2018 Winter bill is normally mailed out by the local townships the beginning of December. If a Winter tax bill is not received by mid-december, it is the responsibility of the purchaser to contact the local treasurer! **Successful high bidders must provide the Sanilac County Treasurer with proof of payment of 2018 Summer and Village (if applicable) taxes paid to the local unit, within 21 days of sale. Failure to provide timely submission of proof of payment will result in the cancellation of sale, banning from all future foreclosure auctions, and the property may be offered to other bidders!** 7

Sanilac County 2018 auctions will be held on Wednesday, August 22, 2018 at 10:00 a.m. in the Circuit Courtroom, located on the third floor of the Sanilac County Courthouse, 60 West Sanilac Ave., Sandusky, Michigan and on Wednesday, October 17, 2018 at 10:00 a.m. in the Circuit Courtroom, located on the third floor of the Sanilac County Courthouse, 60 West Sanilac Ave., Sandusky, Michigan. Registration will take place in the Sanilac County Treasurer s Office, Room 204, located on the second floor of the County Courthouse. Registration will start at 8:30 a.m. on the auction date. Can I obtain a property available at the Public Auction by paying the delinquent taxes prior to the sale date? No. How do I find or See a property I d like to bid on at the Auction Sale? Vacant (unimproved) land does not normally have an address and its approximate geographic location can only be determined through the use of the County Equalization plat maps or perhaps a plat book (available for sale in the Register of Deeds Office). Exact boundary lines of a property can be determined by a survey of the property initiated at the purchaser s expense. Improved properties frequently will have an address, making it easier to locate the property. The County of Sanilac does not guarantee the usability or access to any of these parcels. While the County owns the parcels through foreclosure, the County has not taken possession of the property, and some properties may be occupied.
