1 440 The Board of Chosen Freeholders of the County of Warren met in Regular Session in its offices in the Wayne Dumont, Jr. Administration Building, Belvidere, New Jersey on September 14, 2016 at 7:30 p.m. The meeting was called to order by Director Sarnoski and upon roll call, the following members were present: Freeholder Edward Smith, Freeholder Richard Gardner and Freeholder Jason Sarnoski. Also attending were County Engineer Bill Gleba, CFO Dan Olshefski, County Counsel Joseph J. Bell and County Administrator Steve Marvin. The Pledge of Allegiance was led by Director Sarnoski. Director Sarnoski read the following statement: ADEQUATE NOTICE OF THIS MEETING OF SEPTEMBER 14, 2016 WAS GIVEN IN ACCORDANCE WITH THE OPEN PUBLIC MEETINGS ACT BY FORWARDING A SCHEDULE OF REGULAR MEETINGS OF THE BOARD OF CHOSEN FREEHOLDERS TO THE WARREN COUNTY CLERK, THE STAR-LEDGER, AND DAILY RECORD AND BY POSTING A COPY THEREOF ON THE BULLETIN BOARD IN THE OFFICE OF THE BOARD OF CHOSEN FREEHOLDERS. FORMAL ACTION MAY BE TAKEN BY THE BOARD OF CHOSEN FREEHOLDERS AT THIS MEETING. PUBLIC PARTICIPATION IS ENCOURAGED. IN ORDER TO ASSURE FULL PUBLIC PARTICIPATION, THOSE INDIVIDUALS WITH DISABILITIES WHO WISH TO ATTEND THE MEETING SHOULD SUBMIT ANY REQUESTS FOR SPECIAL ACCOMMODATION ONE WEEK IN ADVANCE. On motion by Mr. Smith, seconded by Mr. Gardner, the Minutes of the Regular Session held on August 10, 2016 were approved. On motion by Mr. Smith, seconded by Mr. Gardner, the Minutes of the Executive Session held on August 10, 2016 were approved. Recorded Vote: Mr. Mr. Smith yes, Mr. Gardner yes, Mr. Sarnoski yes Mr. Sarnoski invited Valerie Hogan, Program Coordinator of Project Self-Sufficiency in Newton to make a presentation. Ms. Hogan provided some background of Project Self-Sufficiency which serves low income families and individuals in Sussex and Northern Warren County. It serves as a single point of intake to provide information, referrals and advocacy to access local resources for a variety of diverse needs including healthcare, child care, career assistance, parenting assistance, veterans services, senior services, transportation, addiction services, housing, parenting help and more. This is possible through the Department of Health. About 800 calls were received over the last fiscal year which ended June 30, 2016 and the hope was to increase referrals in the current year. Project Self-Sufficiency is launching New Jersey Youth Corps for Sussex and Northern Warren County. The Phillipsburg NJ Youth Corps is mentoring them as they embark on this endeavor to assist young people aged years that have dropped out of high school to obtain life skills and employability skills training, basic skills to prepare for a High School Equivalency Diploma and participate in community service learning projects. Child care is provided for young

2 441 mothers. Participants receive $100 per week. Transportation can be a huge barrier for this population in this part of the state so that is being provided as well. The program is launching October 10 and the goal is to serve 50 young adults from now until June Mr. Sarnoski said the County contracts with the Phillipsburg Youth Corps to maintain trails and assistance with some other projects so we are familiar and happy with the project. Ms. Hogan said she was excited to serve these young adults. The program was being funded though the Department of Labor and Workforce Development. The Freeholders thanked her for the presentation and wished her well. This portion of the meeting concluded at 7:42 p.m. PROCLAMATION On motion by Mr. Gardner, seconded by Mr. Smith, the following proclamation was adopted by the Board of Chosen Freeholders of the County of Warren at a meeting held on September 14, CONSTITUTION WEEK, SEPTEMBER 17-23, 2016 WHEREAS, General William Maxwell Chapter of the National Society of the Daughters of the American Revolution was organized in Belvidere, Warren County, New Jersey on December 21, 1931; and WHEREAS, Chapters of the National Society of the Daughters of the American Revolution all over the world are requesting proclamations and recognition of the Constitution of the United States of America; and WHEREAS, September 17, 2016 marks the two hundred and twenty-ninth anniversary of the drafting of the Constitution of the United States of America by the Constitutional Convention; and WHEREAS, it is fitting and proper to officially recognize this magnificent document and the anniversary of its creation; and WHEREAS, Public Law 915 guarantees the issuing of a proclamation each year by the President of the United States of America designating September 17 through 23 as Constitution Week; NOW, THEREFORE, BE IT RESOLVED by the Warren County Board of Chosen Freeholders that the week of September 17 through September 23, 2016 is proclaimed Constitution Week. I hereby certify the above to be a true copy of a proclamation adopted by the Board of Chosen Freeholders of the County of Warren in a meeting held on September 14, Mr. Smith said he was always pleased to celebrate this excellent document, the backbone of our country. Mr. Gardner thought our legislators shouldn t deviate from the Constitution and keep it as simple as possible. That s how it works the best for the majority of the public.

3 442 Mr. Sarnoski said he had recently read a very good book called The Nine which was about the Supreme Court and how its role is to interpret the laws of the U.S. Constitution, the basis of our wonderful country. He thanked the D.A.R. and others for bringing attention to it each year. Coming forward to accept the proclamation were Jan Hunold and Sue Beall of the General William Maxwell Chapter of the Daughters of the American Revolution. Ms. Hunold said the tradition of celebrating the Constitution began in 1955 with the D.A.R. petitioning Congress and it was signed into law in 1956 by President Eisenhower. She said members of their chapter will be visiting Belvidere Middle School the following week to distribute baskets of items related to the Constitution as well as the document itself. This D.A.R. Chapter is celebrating 85 years of community service to this area and its recent accomplishments were to restore the graves of General Maxwell and his two brothers and the next project will be to install a plaque at the Cummins Building where its first meetings were held. PROCLAMATION On motion by Mr. Smith, seconded by Mr. Gardner, the following proclamation was adopted by the Board of Chosen Freeholders of the County of Warren at a meeting held on September 14, NATIONAL POW/MIA RECOGNITION DAY, SEPTEMBER 16, 2016 WHEREAS, in each of America s past wars, our Prisoners of War have represented a special sacrifice. On them has fallen an added burden of loneliness, trauma and hardship. Their burden becomes double when there is inhumane treatment by the enemy in violation of common human compassion, ethical standards and international obligations (proclamation by President Jimmy Carter, 1979); and WHEREAS, the United States passed a resolution authorizing the first National POW/MIA Recognition Day be observed on July 18, 1979 and later moved the event to be observed on the third Friday in September; and WHEREAS, in Warren County, we are committed to remembering all veterans who served their country and those presently serving their nation in all corners of the globe and those still Missing In Action and Prisoners of War and remind everyone of the personal sacrifices made by all war veterans to ensure that future generations of American citizens will be able to enjoy our country s freedoms. NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of the County of Warren does join our nation in this day of remembrance to demonstrate the country s continued commitment to the POW/MIA issue. I hereby certify the above to be a true copy of a proclamation adopted by the Board of Chosen Freeholders of the County of Warren in a meeting held on September 14, Mr. Gardner said it is vitally important that we not forget. That s the least we can do for the families. He was pleased to support this proclamation.

4 443 Mr. Smith said this is about closure; the families deserve that. He appreciated the many organizations that bring forth that message. Mr. Sarnoski added that this recognition brings to mind the late Terry Lee who always attended events like these and did a lot of work on behalf of POW/MIAs. The proclamation was accepted by Dennis Smith, Al Martin and Milly Rice of the American Legion, Carl D. Archer Post. Ms. Rice invited everyone to a POW/MIA program being held two days later outdoors in front of the White Township School. Two former WWII POWs being honored will be attending: Joe Federico of Belvidere and Bernie Miller of Wind Gap, PA. The Freeholder Board then honored two recent graduates of Warren County Technical School who are recipients of scholarships from the NJAC Foundation, a non-profit organization affiliated with the New Jersey Association of Counties. Mr. Sarnoski said these scholarships, funded by Investors Bank, are awarded to deserving county vocational school graduates who are continuing their education at a county or state college. Jennifer Furmanek of Pohatcong Township was very active at Warren Tech, beginning with her freshman year when she was a homeroom representative to the Student Government and became involved in Key Club sophomore year. She was a four year member of the school s Child Development CTE Program. Moreover, Jen was the Boys Basketball Team Manager her entire high school career and Volleyball Manager her sophomore and junior years. Her hobbies are reading, painting and drawing. The daughter of Sandy Furmanek, she is studying education at Raritan Valley Community College and plans on becoming an elementary school teacher. According to her high school, Jen was a quiet superstar who has made Warren Tech a better place without seeking or gaining any recognition for her efforts. We congratulate Jen on being selected for this $500 scholarship. Jasmin Tepale-Delgado of Stewartsville was also being honored. She was a four year member of the Culinary Arts Program at Warren Tech where she helped out with a dinner the program puts on several times a year for families and staff members called Big Knight. Jasmin volunteered at Life Choices in Phillipsburg and competed in SkillsUSA in 2014 and 2015 for Commercial Baking Aid. Jasmin is now attending Warren County Community College with a major in Culinary Arts with a goal of becoming a chef. Her favorite food is Italian and her dream is to someday open an Italian restaurant. She is the daughter of Yasmin Delgado and Miguel Tepale and she s the oldest of four with two sisters and a brother. Jasmin said her hobby is to take pictures and keep things organized. As liaison to NJAC, Mr. Gardner said he was very pleased to congratulate two of Warren County s own students. He also thought Investors Bank was deserving of praise because they believe in young people and back that up with helping to fund education in this manner.

5 444 Mr. Smith was pleased to see we re emphasizing tech schools and said he enjoyed the Cook-Off Competition at the NJAC Convention each year. Jen and Jasmin then came forward to receive their NJAC Foundation scholarships. Joining them were Superintendent Robert Glowacky and Gary Collucci of Warren Tech. Mr. Glowacky said these successful young women were the best. I m proud of them and the school is proud of them, he said. Public Comments (Agenda Items Only) Carol Cook of Blairstown inquired about Item E9, a resolution to amend the Solid Waste Management Plan to conduct injection of Waste Type ID #72. Mr. Smith answered that this is a liquid waste similar to a detergent as found in wash waters and not desirable in septic systems. A pilot project was done and this injection process was found to lower the temperature in the burner, allow it to handle more waste and improve the air quality. BE IT FURTHER RESOLVED that the Local Match of $3, is included in the 2015 County Budget Sheet 20-b, Division of Senior Services S&W. Freeholders of the County of Warren in a meeting held on September 14, RESOLUTION RESOLUTION AUTHORIZING THE WARREN COUNTY SHERIFF S OFFICE TO SUBMIT AN APPLICATION TO THE NEW JERSEY DEPARTMENT OF HUMAN SERVICES, DIVISION OF FAMILY DEVELOPMENT, TO PARTICIPATE IN THE FISCAL YEAR FFY2017 TITLE IV-D PROGRAM WHEREAS, the New Jersey Department of Human Services, Division of Family Development is accepting applications for funding under the FFY2017 Title IV-D Program. WHEREAS, the purpose of the program is to establish a procedure with the Sheriff s Office for arrest services in those Title IV-D cases where a bench warrant pertaining to child support has been issued by a Court. WHEREAS, the Sheriff s Office, as per the bench warrant, will take the non-custodial parent into custody for the purpose of establishing support obligation.

10 449 WHEREAS, the Sheriff s Office will be reimbursed based on the approved Collection Performance Standard with the cost of arrest services for the period October 1, 2016 through September 30, 2017 (not to exceed $214,807.00). NOW, THEREFORE, BE IT RESOLVED that the County Sheriff s Office is authorized to apply for the aforementioned Title IV-D funding. Freeholders of the County of Warren in a meeting held on September 14, RESOLUTION RESOLUTION GRANTING APPROVAL OF THE PURCHASE OF A DEVELOPMENT EASEMENT ON THE MALON FAMILY FARM, BLOCK 1100, LOT 1900 IN HOPE TOWNSHIP CONSISTING OF APPROXIMATELY NET ACRES WHEREAS, the Board of Chosen Freeholders of the County of Warren has determined that the property known as the Malon Family Farm owned by Gabriele, Greg, Andrea, Howard, Nicole & Matt Malon. located on Block 1100 Lot 1900 in Hope Township, consisting of approximately net acres, has available for purchase a development easement in accordance with the requirements of the farmland preservation programs; and WHEREAS, final approval for the purchase of development rights on this farm has been granted by resolution from the Warren County Agricultural Development Board at its August 18, 2016 meeting and preliminary approval of the purchase by the SADC is dependent upon that approval and the approval of this Board; and WHEREAS, pursuant to N.J.A.C. 2: A(b) on January 15, 2016 it was determined by the State Agriculture Development Committee (SADC) that the application for the sale of a development easement was complete and accurate and satisfied the criteria contained in N.J.A.C. 2:76-17A.9(a); and WHEREAS, pursuant to N.J.A.C. 2:76-17A.11, on April 22, 2016 the State Agricultural Development Committee has certified a development easement value of $4,500 per acre based on zoning and environmental regulations in place as of 1/1/04 and $4,500 per acre based on zoning and environmental regulations in place as of the current valuation date of March 2, 2016 with an estimated total value of $287,100; and WHEREAS, the property is part of the approved Hope Township Municipal Planning Incentive Grant Application and is funded by Hope Township s Open Space Trust Account and the Warren County Open Space, Farmland, Recreation and Historic Preservation Trust Fund; and WHEREAS, pursuant to N.J.A.C. 2:76-17A.13, the Hope Township Committee approved its funding commitment of 15% of the purchase price (or $700/acre of the easement) for the Malon Family Farm by resolution dated July 13, 2016; and

11 450 WHEREAS, the property is located in the County s NorthWest Project Area, and is on the eligible list of farms identified in the Township s approved MUNI PIG Project Area One and located in the Highlands Planning Area; and WHEREAS, the SADC is expected to grant final approval for funding amount on said application at its September 22, 2016 meeting; and WHEREAS, the purchase of the development easement on the property will encourage the survivability of the productive agriculture in Hope Township and Warren County; and WHEREAS, the estimated cost share break down is as follows: Cost share breakdown based on estimated acres: Total SADC $197,780 ($3,100/acre 68.89% of CMV) Warren County $ 44,660 ($700/acre 15.55% of CMV) Hope Twp. $ 44,660 ($700/acre 15.55% of CMV) Total Easement Purchase $287,100 ($4,500/acre) WHEREAS, pursuant to N.J.A.C. 2:76-17A.15, the County shall hold the development easement since the County is providing funding for the preservation of the farm; and NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Warren as follows: 1. The Board hereby grants permission to purchase the development easement on the above described property based on an easement value of $4,500 per acre as certified by the State Agricultural Development Committee (SADC). Cost to be shared with the SADC and Hope Township as follows: SADC $3,100 per acre, Warren County $700 per acre, Hope Township $700 per acre. 2. This approval includes the following conditions: a. No existing residences on the premises b. No existing agriculture labor housing unit on premises c. Exceptions 1) One Non-Severable Exception of 2.15 acres for future single family dwelling and septic system restricted to one single family residential unit d. No RDSOs allocated e. No preexisting Non-Agriculture uses on premises f. General telephone and electric easements g. No proposed trails h. SADC funding from Municipal Planning Incentive Grant 3. The County s share in regard to the purchase of said easement is estimated at $44,660. The Freeholder Director or Administrator of Warren County is authorized to sign the Deed of Easement, the Cost Share Agreement, and any and all documents necessary for the acquisition of the development easement on the above property in the Townships of Blairstown, County of Warren, State of New Jersey under the terms outlined above.

12 451 BE IT FURTHER RESOLVED, that the SADC's cost share grant to the County for the purchase of a development easement on the approved application shall be based on the final surveyed acreage of the premises adjusted for proposed road rights-of-way, other rights-of-way or easements as determined by the SADC, streams or water bodies on the boundaries of the premises as identified in Policy P-3-B Supplement and for residual dwelling site opportunities allocated pursuant to Policy P-19-A; and BE IT FURTHER RESOLVED, if the Township and County agree to the SADC providing its grant directly to Warren County, the SADC shall enter into a Grant Agreement with the Township and County pursuant to N.J.A.C. 2: , 6.18(a) and 6.18(b); and BE IT FURTHER RESOLVED that adequate funds for the purchase price funding in the amount of $44,660 in account # have been certified by the Chief Financial Officer. Freeholders of the County of Warren in a meeting held on September 14, RESOLUTION AMENDED RESOLUTION GRANTING APPROVAL OF THE PURCHASE OF A DEVELOPMENT EASEMENT ON THE SAM & JEAN RACE FARM, BLOCK 16, LOT 42 IN WHITE TOWNSHIP CONSISTING OF APPROXIMATELY NET ACRES WHEREAS, the Board of Chosen Freeholders of the County of Warren had previously approved final cost-share funding for farmland preservation of the Sam & Jean Race Farm on August 26, 2015, owned by Sam & Jean Race, located on Block 16 Lot 42, in White Township, consisting of approximately 82.4 acres with a 1.5 acre non-severable exception area for future single family residence and a 4 acre severable exception area around existing duplex and buildings and for non-agriculture use; and WHEREAS, the applicant had since then reduced the acreage on the two exception areas; the non-severable has been reduced to 1 acre and the severable reduced to 3.26 acres on the application with a now revised surveyed net acreage of acres; and WHEREAS, final approval for the purchase of development rights on this farm had been granted by resolution from the Warren County Agriculture Development Board (WCADB) at its August 20, 2015 meeting and on August 18, 2016 the WCADB voted to move forward with this application with the change in exception areas and approve increase to cost-share; and WHEREAS, this property is under contract and currently being surveyed and the purchase is contingent upon funding from the SADC; and WHEREAS, Warren County has already allocated $160,680 for its standard cost share of the development easement of this property which included a 3% increase for final surveyed acres and the final surveyed acres are more than the 3% allocation with an increase to 4.26 surveyed acres with an additional Warren County cost-share of $8,307; and

13 452 WHEREAS, Warren County s total cost-share to preserve this farm will be $168,987 ($1,950 per acre multiplied by surveyed net acres); and NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of the County of Warren hereby grants permission for the amended purchase price of $168,987 for the development easement on the Sam & Jean Race Farm, Block 16, Lot 42, White Township. BE IT FURTHER RESOLVED that adequate funds for the additional purchase price funding in the amount of $8,307 in account # have been certified by the Chief Financial Officer. Freeholders of the County of Warren in a meeting held on September 14, RESOLUTION RESOLUTION RENEWING A MEMORANDUM OF UNDERSTANDING WITH THE NJ YOUTH CORPS FOR MOWING AND MAINTENANCE SERVICES FROM AUGUST 10, 2016 TO DECEMBER 31, 2017 WHEREAS, the NJ Youth Corps (CORPS) has been using and maintaining the Stine property and providing lawn mowing services under prior agreements; and WHEREAS, those arrangements have proven to be beneficial to both parties, and; WHEREAS, both parties wish to provide for expanded activities not covered by their existing agreements; and WHEREAS, such changes will provide the opportunity for additional activities and growth experiences for CORPS members while providing needed services for the County Parkland; and NOW, THEREFORE, BE IT RESOLVED that the Warren County Board of Chosen Freeholders wish to continue the agreement with the NJ Youth Corps for expanded services and therefore authorize the Freeholder Director to execute a Memorandum of Understanding to effectuate this arrangement. Be it further resolved that adequate funds in the amount of $80, in account have been certified by the CFO. Freeholders of the County of Warren in a meeting held on September 14, RESOLUTION RESOLUTION GRANTING APPROVAL TO PURCHASE A PUBLIC TRAIL EASEMENT ON BLOCK 4, LOT 22 IN INDEPENDENCE TOWNSHIP KNOWN AS THE HILLS OF INDEPENDENCE PROPERTY

14 453 WHEREAS, the Board of Chosen Freeholders of the County of Warren (County) has determined that a public trail easement for the Morris Canal Trail is available on property known as the Hills of Independence Property (Block 4, Lot 22); and WHEREAS, this property has been identified by the Warren County Board of Recreation (BORC) as necessary for the extension of the Morris Canal Trail; WHEREAS, two independent market appraisal reports were conducted in accordance with Green Acres standards; and WHEREAS, the landowners have agreed to sell a public trail easement on their property within the range of appraised values for the purposes of extending the Morris Canal Trail; and NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Warren as follows: 1. The Board hereby grants permission for the purchase of this property. 2. The cost of the acquisition is estimated to be Twenty-Seven Thousand, Six Hundred Fifty Dollars ($27,650.00). 3. The Freeholder Director or Administrator of Warren County is authorized to sign the contract of sale and any and all documents necessary for the acquisition of this property. Freeholders of the County of Warren in a meeting held on September 14, RESOLUTION RESOLUTION APPROVING THE CLOSING OF A PORTION OF COUNTY ROUTE #620 (WATER STREET AND GREENWICH STREET) IN THE TOWN OF BELVIDERE ON WEDNESDAY, OCTOBER 26, 2016 (RAIN DATE THURSDAY, OCTOBER 27, 2016) FOR THE BELVIDERE LIONS CLUB HALLOWEEN PARADE WHEREAS, the Belvidere Lions Club has requested permission to close a portion of County Route #620, Water Street from Prospect Street to Greenwich Street and Greenwich Street from Water Street to Front Street on Wednesday, October 26, 2016 (Rain Date, Thursday, October 27, 2016) with a start time of 7:00 PM for the Belvidere Lions Club Halloween Parade. NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of the County of Warren does hereby approve the use and closing of a portion of County Route #620, (Water Street and Greenwich Street) in the Town of Belvidere for the above mentioned event with the following conditions: 1. LLC TO CONDUCT LIQUID DIRECT INJECTION (LDA) OF WASTE TYPE ID #72 WHEREAS, Covanta Warren Energy Co. LLC ( Covanta) is located in Oxford Township on Block 26 Lots 88, 88.01, and 89 with an address of 218 Mt. Pisgah Avenue, Oxford NJ, 07863; and WHEREAS, Covanta is included in the Warren County Solid Waste Management Plan to process waste types ID#10- Municipal Solid Waste, ID #23 Vegetative Waste, and ID #27 - Dry Industrial Waste at an annual rate of 200,000 tons per year which equates to an average of 548 tons per day; and WHEREAS, on August 10, 2016 the Board of Freeholders approved the last of a series of Administrative Actions dating back to January 13, 2016 to allow Covanta to conduct a pilot program where liquid wastes (ID #72, non-hazardous industrial liquid waste, are received from various industrial facilities and injected into each boiler, called Liquid Direct Injection, (LDI) to test the limits of the current injection system to determine if it can handle additional volume, flow rates, and material; and WHEREAS, the NJDEP approved the Administrative Action in a letter dated August 17, 2016; and WHEREAS, the pilot testing has revealed that LDI has been successful, having positive environmental, operational, and economic impacts; and WHEREAS, Covanta has filed for a Warren County Solid Waste Plan Amendment in an application dated July 7, 2016 and amended in a letter dated August 1, 2016, to allow the LDI program to continue on an on-going basis; and WHEREAS, according to NJDEP regulations the amendment can be processed as an Administrative Action under N.J.A.C. 7: (b) 5. The modification of an existing facility including acceptance of additional waste types, on-site operational changes, and expansions of zones or expansions into buffer zones for ancillary operational activities ; and

17 456 WHEREAS, the application submitted meets the criteria for an Administrative Action with the addition of waste type ID# 72 and the required on-site operational changes to conduct LDI on an on-going basis; and WHEREAS, Covanta will receive up to 32,000 gallons of ID#72 liquid waste per day, except Sunday, from approved waste streams that meet specifications for acceptable waste; and WHEREAS, the additional liquid waste imported will be counted towards the 200,000 tons per year limit for waste. Up to six delivery vehicles of ID 72 waste for LDI can be expected per day except for Sunday. The average delivery has weighed tons. WHEREAS, the Warren County Solid Waste Advisory Council reviewed the application at its September 1 meeting and recommends to the Board of Freeholders that the ID#72 LDI as proposed by Covanta be included in the Warren County Solid Waste Management Plan. NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders amends the Warren County Solid Waste Management Plan to allow Covanta Warren Energy Resource Co. LLC to inject Type#72 non-hazardous industrial process liquids into its furnaces (LDI) on an ongoing basis. BE IT FURTHER RESOLVED that no more than 32,000 gallons per day of approved ID 72 liquid non-hazardous industrial waste may be received per day except Sunday which is when the facility is closed. BE IT FURTHER RESOLVED that copies of this resolution be sent to the New Jersey Department of Environmental Protection, the Township of Oxford, Covanta Energy, and to the Pollution Control Financing Authority of Warren County. Freeholders of the County of Warren in a meeting held on September 14, RESOLUTION RESOLUTION RE: AUTHORIZATION TO AUCTION COUNTY PROPERTY, A.66 ACRE SITE IMPROVED WITH AN 8,500 SQUARE FOOT FORMER PUBLIC HEALTH NURSING AGENCY BUILDING LOCATED AT 162 EAST WASHINGTON AVENUE, BLOCK 65, LOT 3, WASHINGTON BOROUGH, COUNTY OF WARREN, STATE OF NEW JERSEY WHEREAS, the County of Warren wishes to dispose of property which is no longer needed for public use by county departments and agencies and is the owner of certain real and personal property in the Borough of Washington, County of Warren, and State of New Jersey, said property being known as 162 E. Washington Avenue, Washington, New Jersey and listed as Lot 3 in Block 65 on the tax maps of the Borough of Washington; and

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Warren, State of New Jersey, as follows: 1. The real property commonly known as the Public Health Nursing Agency Building, located at 162 E. Washington Avenue, Washington, New Jersey (collectively the Property ) shall be advertised for sale; and 2. The Clerk of the Board is hereby authorized and directed to advertise a public auction pursuant to the provisions of N.J.S.A. 40A:12-13(a); which public notice shall set forth the public sale of the Property on such date and upon such terms as determined by the County and in accordance with the terms of this Resolution. 3. The aforementioned Property will be sold at an open public sale pursuant to the provisions of N.J.S.A. 40A:12-13 and shall be subject to the following conditions: (a) The sale will be conducted by an agent of Fiedler Real Estate. Bids will be accepted orally during the auction period. The auctioneer will, at his sole discretion, determine the highest bidder at the time of the auction, subject to the final acceptance by the County. In addition, the successful bidder shall pay a buyer s premium of 10% of the accepted purchase price to Fiedler Real Estate upon closing. (c) The Property to be sold is subject to existing encumbrances, liens, easements, zoning ordinances, other restrictions of record, and such facts as an accurate survey would reveal. The County makes no representations as to the presence or absence of any environmental conditions on the Property and the purchaser assumes the risk of any such condition, the Property is being sold as is. (d) The successful bidder shall submit a cashiers or certified check or money order payable to the County of Warren in an amount no less than 20% of the bidders offer. Said payment shall be made immediately upon close of the auction proceedings.
