RECOMMENDATION: That Council rejects the public tender bid from Robert Rubino in the amount of $ 3, plus HST) for the subject land ( Plan M S, Lot 227, Parcel 6833 WT, Roll No ). EPLANATION: On October 11, 2017, the public tender closed. September Council approved resolution on 11, 2017 to declare the subject property surplus to the needs of the Municipality and move forward with the public tender process. The declaration of surplus land and public tender was advertised for the two week period in the Municipal Page and on the City' s website on September 22, 2017 and September 29, 2017 ( Appendix ` 1'). Additionally, a " For Sale" sign was posted on the subject property. The Planning Department received no correspondence or public comments regarding this notice. The subject property was appraised at $ 2'). 10, and the appraisal is included ( Appendix One bid for $ 3, plus HST was received and minutes of the public tender opening are included ( Appendix `3'). As the bid was significantly lower than the appraised the Community Development Committee was not supportive of the bid and value, recommends that Council reject the bid and retain the subject lands. These lands can be re -advertised in the future with hopes of receiving more competitive offers. RELEVANT POLICY / LEGISLATION / TIMMINS VISION 2020: The Municipal Act and the City's By- law No ( Real Property Policy governing the sale and disposition of real property) are relevant to this matter. 3 Appendix `1': Declaration of Surplus Land and Public Tender DECLARATION OF SURPLUS LAND Whitney Township Princess Street) WHEREAS pursuant to City of Timmins By- law No which sets out policies and procedures for the sale and disposition of municipal land. AND WHEREAS Section 6. 7 Accountability, Transparency and Public Notice Requirements, requires that in considering a sale of City owned land, the land must be declared surplus to the needs and requirements of the municipality and prior to the land sale, notice of the disposition of the surplus lands posted on the City' s website and advertised in the local newspaper for two (2) consecutive weeks. AND WHEREAS the Council for the Corporation of the City of Timmins considers it desirable and expedient that the described lands be declared surplus to the Corporation' s municipal requirements so as to advertise the sale of these lands through a public tender. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the City of Timmins does hereby declare the following described land as being surplus to the Corporation' s requirements and offer these lands for public sale: Subject Land: Princess Street Roll No Plan M S Lot 227, Parcel 6833 WT Whitney Township City of Timmins District of Cochrane, Ontario Princess Sf Subject Land a=

4 Frontage: metres ( 33 feet) Depth: metres ( 132 feet) Area: square metres ( 4, 356 square feet) Appraised Value: $ 10, There shall be no minimum amount required for any proposed offer; however, this property has an appraised value of $ 10, and this value shall be used as a key factor in evaluating public offers. The City reserves the right not to accept, without explanation, any proposed offer submitted. City of Timmins Zoning By- law zones the subject property as Residential First Density ( NA -R1). A single detached dwelling is a permitted use in this zone. Due to the subject property being a corner lot, Committee of Adjustment approval may be required depending on the proposed development. The subject property is being sold as unserviced. For any development to occur, the purchaser ( at their expense) shall be responsible for installing the sanitary and water services from the main to the property. Installation shall be carried out by an approved City contractor. The subject property is being sold " as is, where is". City Council approved Resolution ( September 11, 2017) which declared the subject property surplus to the needs of the municipality in accordance with By- law No respecting the City of Timmins Land sale procedures. TENDER SUBMISSION The City of Timmins is interested in securing tenders from parties who wish to purchase the above described property that is surplus to the needs of the municipality. Tenders shall include a deposit in the form of a money order or a bank draft or a cheque certified by a bank or trust corporation payable to the City of Timmins and representing ten ( 10) percent of the tender amount. Interested parties are asked to submit their tender in a sealed envelope referencing the property of interest to the undersigned no later than 2: 00 pm ( local time) on Wednesday, October 11th, The awarded bid shall be charged HST at the time of final sale.
