EXECUTVE BREF Motion and Title: Staff recommends motion to accept: a Deed from the School Board of Palm Beach County, Florida, a corporate body politic of the State of Florida (School Board) conveying 1.56 acres of improved property located in Belle Glade. Summary: This property is located at the northeast comer of S.W. 12th Street and Martin Luther King Jr. Boulevard, in Belle Glade and includes the former gymnasium from the Lake Shore High/Middle community purposes. meeting. (PREM) District 6 (HJF) School. Since 2000, the County has leased the property from the School Board (R2000-l 807 and R ) for $1.00 per year and has sub-leased the property to the Boys and Girls Clubs (R and R ). n addition, the Palm Beach County Sheriff Office (PBSO) uses the gym for its PAL programs pursuant to a Memorandum of Understanding (R ). The County's Lease with the School Board expires on October 30, 2015, and has one (1) remaining option to renew for an additional five ( 5) year period. Since initially renovating the facility at a cost of $700,000, the County has spent approximately $800,000 in renewal/replacement projects in the 14 years that it has leased the property. By obtaining title to the property the County will be able to provide certainty that the investment in the facility will continue for community use and provide additional flexibility in the long term operation of the facilities. The conveyance from the School Board is without charge and will be subject to existing restrictions limiting use of the property to public recreation, public health, and other This conveyance was approved by the School Board at their January 21, 2015

3 Page 3 Background and Justification: Under the Lease, the property is to be used for recreational and educational purposes. The County also uses the premises for the operation of the PBSO PAL programs which have been operating concurrently and in conjunction with the B&G Clubs. n 2001, the County entered into an Agreement (R ) with PBSO assigning them certain County responsibilities pursuant to the Lease. The Lease with the School Board expires on October 30, 2015, but provides for one (1) remaining five (5) year renewal option. The Sub- Lease expires on October 30, 2015, and provides for one (1) five (5) year renewal option subject to Board approval and the Lease being in effect. After the County takes title to the property, the agreements with the B&G Clubs and PBSO will be renegotiated. The Property includes an approximately 15,580 square foot gymnasium building which was built in The approximate assessed value of the Property is $96, Since 2000, the County has invested approximately $1,500,000 for improvements to the gym. The School Board obtained an asbestos report from Entek Environmental & Technical Services, nc. in March 1998, which identified limited areas of floor tiles in the building which would have to be properly removed during renovation or demolition. The tiles did not pose a concern provided they were not disturbed. This report did not include the review of the building (roof, exterior walls, covered walkways and exterior piping). Post 2000, the County has obtained additional asbestos reviews to address renovations of various areas of the facilities. A 2003 environmental audit of the Property was obtained by the County which did not identify any environmental concerns; however, pre-renovation asbestos surveys were recommended prior to renovation or demolition. As the property is being conveyed without charge, the County has been using the property since 2000, and there is substantial value to the County in the improvements, Staff is recommending that the property be accepted in its "as is" condition without further due diligence investigations. Florida Statues Section does not require a Disclosure of a Beneficial nterests from another governmental agency.
