1 1. TERMS & CONDITIONS FOR THE BID a. BPCL desires to set-up Petroleum Storage Depot in the District of Singrauli, within State of M.P., on leased land. b. Land offered should be in the District of Singrauli (M.P.) within the geography of district of Singrauli. c. Bids are invited from absolute and exclusive owners, having right, title and interest in the land, for transfer of plot of land by way of long term Lease for period of 29 years to Bharat Petroleum Corporation Limited. d. If the entire parcel of land required does not belong to one owner, then the group of owners who have plots contiguous to each other and meeting our requirement can quote through one registered Power of Attorney Holder giving specific power to deal with the land, create interest therein, execute necessary documents with respect to transfer and to do all documentation for completion of transaction of transfer of interest. Land owned by Company or Co-operative Society is also acceptable, subject to application being made by authorized officials supported by necessary Board Resolution/Resolution. e. Offer / bids received from guardian for land owned by minors shall not be entertained / considered unless such offers/bids are accompanied with the written permission granted by the District Judge under the appropriate law. f. The minimum required land area is 2 Acres. Land less than 2 Acres will not be acceptable. Bigger plot of land may be considered if found technically and commercially suitable by the company solely at its own discretion. g. After the area specified as setback for road widening in the master plan, the area of the plot should not be less than 2 Acres. h. The land owner shall arrange for all statutory clearances such as urban land ceiling, Non Agricultural conversion, commercial conversion for POL depot purpose, IT clearance, Non-Encumbrance certificate etc at their own expenses & cost before registration of lease deed, within a period of 6 months from the date of issue of Letter of Confirmation for taking-over land on lease. i. Land should be plain and in one contiguous plot. j. Frontage of the plot of land should be abutting the highway/main road, with proper approach road to the plot of land. k. Land shall be located either on NH (site on NH acceptable only if on Service Road) /SH / MDR. Plot shape/size not suitable for construction of Petroleum Storage depot or not meeting government / statutory norms, shall be rejected and BPCL s decision on this shall be final. l. If land is located on NH/SH, distance norms (w.r.t. intersection etc.), as per NHAI / NH /MPRDC stipulated for setting-up of Petroleum Storage facilities shall be applicable. If the land and its location is not meeting those norms, the land shall be rejected. m. Land offered shall have suitable all-season Road access, so that minimum 24 Kilolitres capacity Tank-Lorry can move easily. n. Site should not be lower than Road level by more than 1 mtr (after removal of black cotton soil, if any). If it is low-lying land, Cost of land filling / cutting including cost of retaining wall / hume pipes etc. to bring the offered site to road level, as estimated by BPCL, will be taken into consideration for commercial evaluation of
2 bids. Cost of electric connections & shifting of telephone lines as estimated by BPCL will be taken into consideration for commercial evaluation of bids. o. There should be No High Tension Electrical line or telephone lines/product, water pipelines/ canals, drainage / nallahs /public road/ railway lines etc crossing over the plot offered. Plots with overhead Electrical HT Line of more than 11 KV shall be out rightly rejected. p. Forest Land / Reserved Land / Land under Green belt etc., which are not suitable for setting-up of Petroleum Storage Depot, shall be rejected. q. If any other conditions applicable to the offered land, either Statutory or Physical, preventing setting-up of Petroleum Storage Depot, such land shall be rejected. r. Decision of BPCL in regard of suitability of land for the purpose, shall be final and binding. s. The landlord should have clear and marketable title over the land offered and the land should be free of all encumbrances, encroachments, right of way, easementary rights, religious, defense structures and any other physical hurdles. t. Land mortgaged to the financial institution and to any private parties through registered mortgage deed requires to be redeemed before execution of Lease Deed. The bidder are required to submit NOC from the Mortgager for giving the land on lease. u. The land proposed for Lease should be clearly partitioned and the title document /Khewat / Khatauni / Khasra / Girdawan / Survey No. etc. should clearly indicate and confirm the same. No litigation should be pending with respect to the title of the land and/or encumbrance or third party interest on the land. v. BPCL shall have right to construct various permanent facilities, viz. Tanks, Buildings. w. Brokers/Property dealers need not apply. x. District Authorities and other Govt. bodies can also apply against this advertisement. y. Lease Deed will be Registered only after completion of all formalities, viz. NA etc.,and land is ready for use / construction by BPCL. z. Statutory charges, Municipal Taxes, Electricity Bills, Water charges etc., after signing of Lease Deed shall be paid by BPCL. However, all dues/ arrears pertaining to period before signing of Lease deed shall be paid by land-owner. aa. BPCL takes no responsibility for delay, loss or non-receipt of documents sent by post/courier. Received quotation are merely offers and do not bind BPCL in any manner whatsoever. bb. BPCL reserves the right to reject any or all the offers without assigning any reason thereof. cc. Land not meeting MPRDC / NH / SH / PWD / Town planning norms for setting up of POL depot are liable to get rejected. dd. Financial Bid of only technically successful bidder(s) will be opened. ee. There is no binding on the company to accept any offer of land. Company s decision will be binding. In this regard, correspondence from applicants/others would not be entertained. ff. In case of dispute English version of this advertisement will be considered final.

TERMS AND PROCESS FOR OFFER TO BE SUBMITTED IN TWO BID SYSTEM IN THREE DIFFERENT SEALED ENVELOPES IN POINT A & POINT B & POINT C BELOW: A.TECHNICAL BID :Details of the plot of land offered, along with copies of documents, duly signed is to be submitted under the Technical Bid. It should not have any reference of offer price/cost of land. The following details should be furnished by the bidder (s) 1. Name of the owner(s) of the land. 2. Offer letter from the bidder (s) clearly mentioning that they are willing to offer the plot on long lease of 29 years to BPCL. 3. Key plan showing details of the property with Khasra/Khatauni no, Village, Tehsil, Distrcit and situation of the plot duly signed by the owner. 4. Area offered for long term lease with dimensions of the plot. 5. 7/12 extracts or its equivalent viz. khatauni, khasraetc and the Title Deed viz. sale deed etc showing the ownership of the land duly certified/notorised as true copy. 6. Power of Attorney Holder should submit a copy of the registered POA. Offer received without the documents/details stipulated above is liable to be rejected. No claims shall be entertained. The technical bids will be opened on at 5.00 pm at the above address. Bidder interested may be present at the time of opening the technical bids. Offer received after the due date and time will not be considered. The offer submitted should be valid for a period of 180 days from the due date or such extended period as may be mutually agreed. Selection of land shall be carried out on the basis of Technical Evaluation Committee Report.
4 BPCL s decision on Technical evaluation of land for it s suitability to accept for construction of Petroleum Storage depot, shall be final and binding. Thereafter, site with Lowest offered Lease Rental (calculated for the total period of 29 years) Plus Cost of bringing the site to desired requirement for construction as stipulated above will be selected. BPCL reserves right to further negotiate Lease Rentals with the Lowest Bidder. I/We have read the above Terms & Conditions, and agree to abide with the same. SIGN. & SEAL OF BIDDER Technical Bid should also include an affidavit in following format AFFIDAVIT I/WE..son/wife of Sri resident of.do hereby solemnly affirm and declare as follows : 1. That the deponent/s is/are absolute and lawful owners of plot area measuring..acres comprising Khasra no. Situated at village., tehsil., dist..and the same is under his/her/their possession and free of all encumbrances till date. 2. That in response to press invitation appeared in news paper.dated the deponent/s has/have submitted his/her/their offer and the same shall remain valid as per the terms of the said press invitation. 3. That the deponent/s further undertakes to comply with the terms and conditions of said press invitation. 4. I affirm that the contents of above paras are true and correct. 5 B. FINANCIAL BID The Financial Bid should contain the following: 1. Expected lease rentals in rupees per month 2. Escalation and period after which escalation is expected. 3. Expected lease rental should be written both in words and figures. Note : The Financial Bid should be placed in a separate sealed envelope and marked as Financial Bid C. EARNEST MONEY DEPOSIT EMD of Rs 1,00,000/- in the form of DD/Pay Order from Nationalized Bank favoring Bharat Petroleum Corporation Limited, payable at Jabalpur shall be submitted in a separate sealed envelope (Envelope 4) with EARNEST MONEY DEPOSIT written on it. Applicant should ensure that no other documents are enclosed in that envelope. Earnest Money of the unsuccessful applicant will be refunded. No interest shall be paid by the corporation on EMD. Application received without EMD shall be rejected without opening the Technical and Financial bid. The EMD is liable to forfeited in the event of withdrawal of offers during the validity period of the offer or not agreeing to lease the plot as per offer to BPCL. For successful tenderers, refund of EMD will only be made after completion of offer period / registration of lease whichever is earlier All 3 Envelopes i.e. Technical Bid Envelope, Financial Bid envelope and EMD Envelope should be sealed separately and then put in a fourth bigger envelope and sealed duly superscribed as Offer for Land at Singrauli District.
