4 MINUTES of a Regular Meeting of the MUNICIPAL PLANNING COMMISSION (MPC) held on Tuesday, September 11, 2012 at 3:00 p.m. with the following in attendance: CHAIRMAN: B. Mearns Councillor MEMBERS: J. SARKA: THAT the minutes of the meeting of the Municipal Planning Commission (MPC) held on August 14, 2012 be approved CARRIED PROPOSED OUTLINE PLAN COPPERWOOD STAGE 2 : File No: , Stantec Consulting Ltd., on behalf of Daytona Development Corp., has applied for outline plan approval for approximately 62 hectares (152 acres) of un-developed land lying south of the existing Copperwood neighbourhood. Development Officer s Presentation: Barry Peat, Senior Subdivision Planner, presented the Copperwood Stage 2 Outline Plan which is for approximately 62 hectares (152 acres) of un-developed land lying south of the existing Copperwood neighbourhood. It has been prepared in accordance with the policies and objectives outlined in West Lethbridge Phase II Area Structure Plan approved by City Council in 2005 and provides a more detailed planning and engineering framework to guide the phased subdivision and development of this new neighbourhood. The Outline Plan envisions predominantly low density residential development, and represents a continuation of the planning and development that was initiated with the previous phases of the Copperwood neighbourhood. The plan also includes medium density multi-family sites and duplex lots, a site for a future elementary school and in the easterly plan area, a park with a storm water management facility/wet pond. Pedestrian connectivity throughout the community will guide residents to the water feature and the future school site as well as the existing open space of the Stage 1 area. At full build out, this plan area could house an additional 2200 people in 882 dwelling units.

5 Road access to the neighbourhood is provided from Whoop-Up Drive, through the existing neighbourhood and from Metis Trail, a future arterial roadway which forms the plan s easterly boundary. A Transportation Impact Analysis has been prepared to determine roadway classifications within the plan area. Notice of the MPC meeting was advertised on September 1, Adjacent property owners were also notified by letter of the proposed plan and invited to attend the MPC meeting. In conclusion, Mr. Peat stated that Development Services is in support of this Copperwood Stage 2 Outline Plan with the following condition: Future land use bylaw amendment applications and subdivision applications conform with this approval with respect to land use and street pattern to the satisfaction of the Approving Authority. Applicant s Presentation: Matt Girardo, Stantec Consulting, advised as follows: Outline Plan is an extension of Copperwood Stage 1 and continuing on with the same theme 150 acres of single family and medium density sites Stage 2 is located south of Stage 1 Working with City of Lethbridge, Parks Department, to create naturalized landscaping Other Presentations: There was no response to the Chairman s three calls for anyone else wishing to speak. Questions: Mr. Peat and Mr. Girardo responded to questions regarding: Storm Water Management will be constructed in the designated order Future intent for roadway to 30 Street West or Metis Trail West Primary access is Coalbanks Blvd W Indication of year school would be constructed Risks or safety concerns with the High Pressure Gas Well Existing Gas Well will be moved/decommissioned or developed around Copperwood Stage 2 would develop up to 100 meters of gas well Sidewalks and pathways will be designed for disability challenges in mind Sidewalks and pathways surfaces will be smooth finishes One major connector roadway will be enough to evacuate area in a timely manner Number of entrances into Copperwood would be considered major connectors roadways The following motion was presented: G. SARKA: THAT the Application Number Copperwood Stage 2 Outline Plan is APPROVED with the condition that future land use bylaw amendment applications and subdivision applications confirm with this approval with respect to land use and street pattern to the satisfaction of the Approving Authority CARRIED

We have not received any responses. EVALUATION Background Context Considerations The previous occupant of this building was the Downtown L.A. offices. In June 2012 we received and approved an application for a change of use at this location to a restaurant. August 16, 2012 we received a sign application for this location which is called Telegraph Tap House. The name Tap House indicated to us that this is not entirely a restaurant so we contacted the owner and informed him that the use is not that of a restaurant. The landowner made another change of use application for an entertainment establishment on August 27, This application is before the Commission because MPC policy states that all applications for entertainment establishments shall come before the Commission for a decision. The change of use from restaurant to entertainment establishment and restaurant has no effect on the parking requirement. Downtown Lethbridge is a commercial corridor and is a suitable location for this type of business. There is no residential development in the immediate vicinity of this location. The closest would be the condos on top of the Club Cigar Store. There appears to be no material or undue impacts on the use, enjoyment, or value on neighbouring properties or neighbourhood amenities. ALTERNATIVES Approval This application may be approved. Appropriate conditions should be cited. Note: The applicant may appeal any of the conditions of approval. Any affected party present at the MPC meeting may appeal the approval. The approval is advertized in the upcoming Saturday paper and any affected party may appeal the approval. Refusal This application may be refused. Specific reasons for refusal must be cited. Note: The applicant may appeal the refusal. The applicant may wait 6 months and reapply for the same development at the same location. The applicant may correct the aspects of the development that caused it to be refused and reapply before 6 months has elapsed. The applicant may make an entirely new application for the same proposal in a different location. Tabling The application may be tabled: The cause of or reason for tabling should be cited. Conditions or time frame for lifting from the table should be cited. Instructions for re-advertising should be cited.

Classification: entertainment establishment which is a discretionary use in the C-D (Downtown Commercial District) and restaurant which is a permitted use in the C-D (Downtown Commercial District). 2. The development shall be in accordance with the plans submitted August 27, Any change to these plans requires the approval of the Development Officer. 3. Signs: prior to the installation of any exterior signs, a sign permit must be approved by the Development Officer.
