1 The Fairfax Newsletter Covering Real Estate, Land Use, and Economic Development Since 1955 Volume 59, Number 24 December 31, 2014 Macerich Files Plans for Final Two Phases of Tysons Corner Center Mall Transformation The owners of the Tysons Corner Center mall in December filed plans to add another one million-square feet of mixed-use development to the 78-acre site that will include three new multi-family residential buildings, a high-rise office building, 130,000-square feet of additional retail space, and an expansive community green and public plaza. The plans for the third and fourth phases will complete the transformation of the 2.5 million-square foot mega-mall into a transit-oriented mixed-use center at the Tysons Metrorail station in the heart of the county s urban core. In January 2007 three years before the county adopted its updated long-range plan for the Tysons Urban Center - Macerich, owner and master developer of Tysons Corner Center, received approval for redevelopment of the mall property from the 1960s era auto-oriented regional shopping center to a walkable mixed-use community with direct access to the Metrorail station along Chain Bridge Road. Approval of the rezoning (to the PDC, Planned Development Commercial, district) paved the way for the addition of 3.5 million-square feet of residential, office, hotel, and retail space constructed over four phases around the periphery of the mall building. Conceptual and final development plans for the first two phases were approved concurrently with the rezoning. This past summer marked the opening of portions of the project s first phase: the 22-story, 553,360-square foot Tysons Tower office building (with tenants that include Intelsat and Deloitte) and a 1.5-acre elevated outdoor plaza and new mall entrance with elevated walkway connecting the mall with the Metro station. Scheduled for opening in 2015 are the 300- room Hyatt Hotel and VITA, a 430-unit residential tower. Approvals for Phase 2 allow another 518,000-square feet of residential use, 530,400-square feet of office space, 48,500- square feet of additional retail space, and a 10,000-square foot transit pavilion. With the first phase under construction and close to completion and the second phase fully entitled, the Applicant is now preparing to advance the next two phases of development, according to the statement of justification filed on December 19 th on behalf of the company by attorney Jill Switkin Parks (Cooley LLP). The conceptual and final development plan and proffer condition amendment requests lay out plans for the final two phases as generally laid out in the rezoning. Phase 3 will consist of approximately 361,225-square feet of residential uses, 76,625-square feet of retail uses, and a 30,000-square foot common green along Fashion Boulevard. Phase 4 will include approximately 358,260-square feet of residential uses, 219,660-square feet of office space, 56,420-square feet of additional retail, and an 11,800+-square foot amenity terrace along International Drive, according to the document. L.L. Bean Parking Lot Locale of Phase 3. Phase 3, to be constructed on the surface parking lot outside L.L. Bean, will feature a 285-foot tall residential tower with ground-floor retail (Building3-A) built atop a parking podium. The building will overlook a 30,000-square foot community green with open events lawn, walking paths, seating, street trees, and an art focal feature. 2 according to the plans. Thirty-five affordably priced rental units available to residents with a median household income of 70-percent or less of the Area Median Income (AMI) for the D.C. Metro area will be provided. The plans also propose a new retail environment along the Bloomingdale s/l.l. Bean corridor that builds on the current trend among retailers to have an external presence at the Center, documents state. Building residents will not only benefit from having the region s premier shopping center outside their doorsteps, but they will also have street access to many fine shops and restaurants, the statement notes. The plans for the fourth phase have been slightly altered from those laid out in the rezoning, with the 67-unit mid-rise residential building replacing a proposed low-rise office building, with the statement noting that the applicant has determined that under current market conditions residential uses are preferable at this time. The apartments will include seven affordable units. The amenity terrace will be accessed from a staircase or elevator from the sidewalk on International Drive. For the residents of the high-rise residential building, a pedestrian bridge from the third level of the building will connect to the terrace; for the mid-rise building, direct access from the second floor of the building will be provided. Also planned is a new retail building opposite Macy s on the amenity terrace level. Both in concept and in actualization, the Applicant will make the Amenity Terrace a priority it will be planned, designed and programmed by the most creative and innovative team of professionals in the industry, the document maintains. Tysons Corner Center Phase 3 Residential Building: Source: Cooley LLP Phase 4 Site Along International Drive. The fourth phase, along International Drive, will include two new residential buildings, a 12-story office building, and an 8,100- square foot one-story retail commercial pad, all of which will frame an existing 4-story parking terrace. The top of the structure will be transformed into an 111,800+ square foot amenitized public plaza, featuring walking paths, seating, gardens, children s active play area, performance lawn with a seasonal stage, shade pavilion, recreational area with bocce court and putting green, and sculpture lawn, according to the submittal. The two residential buildings a 260-foot tall high-rise building (Building 4-A) and a 75-foot tall mid-rise building (Building 4-B) will, along with the office building (Building 4-C), present a dramatic, new architectural face to the west along International Drive, while simultaneously screening the existing parking terrace, the document notes. Each building will feature underground parking and ground-floor retail to create vibrant pedestrian activity all along the International Drive streetscape. In the statement filed with the county, the applicant emphasizes a wide range of benefits associated with redevelopment of the Tysons Corner Center including: Provision of a significant number of affordable units, with 9-percent of the units in each phase designated as Affordably Priced Rental Units aimed at households earning 70-percent or less of the AMI. For example, of the 429 units at VITA in Phase 1, 39 will be APRUs. Phases 3 and 4 will include a total of 737 new units, of which 68 will be APRUs. -2-

3 These 107 residential units will be home to the Mall employees and local teachers, fireman, policemen and civil servants.critically, they will be able to live in close proximity to their essential jobs, and to transit (rail and bus), services and recreational amenities. The addition of plazas and urban open spaces throughout the project are planned to provide a sense of place and contribute to creating a quality urban environment. Amenities enjoyed by visitors and residents will include a farmer s market, outdoor movies and concerts, an ice skating rink, a Discovery Play Area, fire pits and seating, and active and passive recreation areas. Significant improvements to vehicular, transit, bike, and pedestrian circulation are proposed to create a friendly multi-modal environment. The application points out that the Applicant purposefully frontloaded the site-wide improvements in Phase 1 so that future phases of development can benefits from the established network. With the third and fourth phases, the regional road network will be further improved and pedestrian and bicycle links provided to integrate all four phases of the project and connect to neighboring properties. Transit-friendly opportunities for visitors, residents, and employees are provided with a direct connection via the elevated bridge to the Tysons station. The statement points out that all the corridors and entrances to the mall are open when Metrorail is operating to provide riders a safe, convenient access through the Center even when the stores may not be open for business. And a new 3-bay bus transfer facility adjacent to Route 123 offers another public transit option. Another major key benefit of the Tysons Corner Center transformation emphasized in the December statement focuses on the tax dollars generated by the project. Since 2005, the Applicant has made almost One Hundred and Twenty-Four Million Dollars ($124,000,000) in propertybased tax payments to Fairfax County, the statement notes, pointing out that the figure includes more than $95.5 million in property taxes; over $7.2 million in commercial and industrial taxes; more than $20.3 million to the Phase 1 Metrorail Tax District; and $725,000 toward the Tysons Service Tax District. approximately $8.6 million in sales taxes to Fairfax County, the statement says, adding that Phases 3 and 4 will further increase the county s tax base anticipated to multiply tenfold over the life of the Project. The CDPA/FDPA for Phases 3 and 4 easily conforms to the 2010 Plan, the submittal concludes. Briefly Noted White Plains, NY-based True North Management Group in December acquired the two four-story office buildings at 7600 Leesburg Pike in Falls Church from James Campbell Co. LLC. The private investment management firm paid $36 million for the two buildings totaling 230,620 gross square feet approximately $156 a square foot. The buildings 7600 East and 7600 West were built in 1986 on a acre site zoned C-2, Limited Office on the north side of Leesburg Pike, east of the intersection with the Capital Beltway. Government consulting firm LMI in late December closed on the purchase of the space it will occupy at MRP Realty s new 11-story office building at 7940 Jones Branch Drive. In an unusual deal, LMI the anchor tenant for the project agreed to buy the space it will occupy in the 307,000-square foot building rather than lease. LMI paid $62,296,121 for a 49- percent share for the six floors. But wait, that s not all, according to the application. In 2014, the Center will pay $43 million in sales taxes to Virginia and -3-
