Annexation petition [ & 503] for approximately 4.33 acres located along Veterans Parkway, Lloyd & Edna Davis and Alex & Bettye Bryan applicants The subject property consists of two parcels and is located at 4526 Veterans Parkway and 4536 Veterans Parkway, along the east side of Veterans Parkway north of Franklin Road (SR 96). The Cloister Subdivision is located to the north of the subject property, and the proposed Kroger grocery store will be located to the south. Both of the subject parcels are developed with single-family homes. Both parcels are contiguous with the existing City Limits. They are both within the City s urban growth boundary. Both property owners have petitioned the City for the annexation of their respective parcels. Because of the proximity of these two parcels to one another, Staff has combined the two annexation requests into one. An annexation feasibility study and plan of services has been prepared by Staff and has been included in the agenda packets. Included in the study is approximately 279 linear feet of Veterans Parkway right-of-way in front of the subject parcels. It appears that the City will be able to provide services to the study area upon annexation. Both property owners have also filed requests to have their properties zoned CH (Highway Commercial) simultaneous with annexation. The Planning Commission will need to conduct a public hearing, after which it will need to discuss the matter and then formulate a recommendation for City Council.

4 PLAN OF SERVICES AND FEASIBILITY STUDY FOR PROPERTY LOCATED AT 4526 AND 4536 VETERANS PARKWAY PREPARED FOR THE MURFREESBORO PLANNING COMMISSION August 5,
5 INTRODUCTION The area studied in this Plan of Services is located at 4526 and 4536 Veterans Parkway. The study area, approximately 3.69 acres, includes tax map 093, parcel and tax map 093, parcel Also included in the study are 279 linear feet, or 0.64 acres, of Veterans Parkway right-ofway. The applicants, Mr. and Mrs. Alex and Bettye Bryan, have also requested a zoning classification of CH (Commercial Highway District) for the 4526 Veterans Parkway parcel simultaneous with annexation. The applicants, Mr. and Mrs. Lloyd and Edna Davis, have also requested a zoning classification of CH (Commercial Highway District) for the 4536 Veterans Parkway parcel simultaneous with annexation. The properties are within the City of Murfreesboro s Urban Growth Boundary. 2
6 POLICE PROTECTION The Murfreesboro Police Department will begin providing services to the study area immediately upon the effective date of annexation. These properties are located in Police Zone # 4. WATER SERVICE There is a 16 -inch Consolidated Utility District (CUD) water line along Veterans Parkway, which serves the existing structures on the subject parcels. It will be the responsibility of the developer to extend water service as needed with future development. SANITARY SEWER SERVICE Murfreesboro Water and Sewer Department (MWSD) currently does not have sanitary sewer available to serve the properties. As development occurs, it will be the responsibility of the developer to extend sewer service from an existing 18 -inch sanitary sewer main located within an easement along Overall Creek. FIRE AND EMERGENCY SERVICE The Murfreesboro Fire Department will begin providing fire protection and medical first responder service to the study area immediately upon the effective date of annexation. ELECTRIC SERVICE Murfreesboro Electric Department (MED) currently has existing facilities along the west side of Veterans Parkway that serve the study area. STREET LIGHTING According to MED, street lighting will be extended along Veterans Parkway by MED this year, If the future development will have public streets, MED will install the street lights. 3
7 STREETS AND ACCESS The study area currently has access to Veterans Parkway, a major arterial. This roadway was constructed to Tennessee Department of Transportation standards in a partnership between TDoT, City of Murfreesboro, and Rutherford County. By agreement with Rutherford County, the City of Murfreesboro provides operation and maintenance of this roadway. The city will provide routine maintenance and the conditions of the maintenance agreement with Rutherford County will no longer apply to the study area. Approximately 0.64 acres of ROW and approximately 279 linear feet of 5-lane street, curb and gutter, and sidewalk are included in the study area. Based on an estimated 10 year re-pavement cycle for major arterial roadways, annualized roadway maintenance costs are estimated at $1,500 for this roadway. SOLID WASTE COLLECTION The City will provide weekly curbside solid waste collection service immediately upon the effective date of annexation, as well as brush/debris removal every two to three weeks. The initial day of service will be Friday. CITY SCHOOLS The Murfreesboro City School system serves grades kindergarten through sixth and is offered to students who are within the jurisdiction of the City of Murfreesboro. The subject area will be within the Overall Creek Elementary school zone which should not be impacted as the proposed zoning is for commercial development. RECREATION The study area will have immediate availability to Murfreesboro s Parks and Recreation facilities. Currently Murfreesboro has two multi-purpose facilities, one community center, a wilderness facility, over 1,000 acres of parks, a network of greenways, and recreational sports. These facilities and programs are wholly funded by the Murfreesboro tax payers. Children who are residents of the City of Murfreesboro and attend Murfreesboro Elementary Schools and receive free or reduced lunches also receive free or reduced recreational fees. 4
8 PLANNING, ENGINEERING AND ZONING SERVICES The property will come within the City s jurisdiction for planning and engineering immediately upon the effective date of annexation. ANNEXATION FOLLOW-UP The Murfreesboro City Council will also be responsible for ensuring that this property will receive City services described in this plan. According to Public Chapter 1101 passed by the Tennessee Legislature, six months following the effective date of annexation, and annually thereafter until all services have been extended, a progress report is to be prepared and published in a newspaper of general circulation. This report will describe progress made in providing City services according to the plan of services and any proposed changes to the plan. A public hearing will also be held on the progress report. BUILDING AND CODES The property will come within the City s jurisdiction for code enforcement immediately upon the effective date of annexation. GEOGRAPHIC INFORMATION SYSTEMS The property is within the area photographed and digitized as part of the City s Geographic Information Systems (G.I.S.) program. 5

10 ZONING The applicants have requested CH (Commercial Highway District) zoning for each of the subject parcels (4536 Veterans Parkway highlighted in orange and 4526 Veterans Parkway highlighted in blue on the map to the right) simultaneous with annexation. The rezoning request for 4526 Veterans Parkway (the blue parcel on the map to the right) includes the rezoning of the purple parcel from RM-16 (Multi-Family Residential District) to CH. The current zoning in the County is RM (Residential Medium-Density) for both properties. 2
11 PRESENT AND SURROUNDING LAND USE The area being considered for annexation is currently developed with two single-family homes located on the properties. City single-family subdivisions are located to the north (the developing Cloister Subdivision). There are also county single-family residential subdivisions to the west and east of the study area (Beasley Road, Meadow Lane, and Franklin Road Estates). Kroger is currently in the process of obtaining a building permit to construct a new building south of these properties. Overall Creek and its floodway are located to the east of the study area. 3
12 ANALYSIS OF CITY SERVICES POLICE PROTECTION At present, the study area receives police service through the Rutherford County Sheriff s Department. If annexed, the Murfreesboro Police Department will begin providing services such as patrol, criminal investigation, community policing, traffic operations, canine, DARE and other community crime prevention programs to the subject parcels immediately upon the effective date of annexation. The Police Department feels that this area will have no negative impact on its ability to provide services. No additional costs to the department are expected. These properties are located in Police Zone # 4. SOLID WASTE COLLECTION According to the Solid Waste Department, weekly curbside solid waste collection for the properties will be available immediately upon the effective date of annexation, as well as brush/debris removal every two to three weeks. In the property s current state, the Solid Waste Department will be responsible for providing 2 carts. This will cost the department $150 ($75 per cart). Pick-up will occur on a Friday route. No additional equipment or manpower will be needed to serve the entire area. 5
14 PLANNING AND ENGINEERING SERVICE The property will come within the City s jurisdiction for planning and engineering code enforcement immediately upon the effective date of annexation. As new development occurs, the Planning Commission will review all site plans, preliminary, and final plats. Among other duties, the Planning and Engineering Departments will inspect and monitor new construction of streets and drainage structures for compliance with the City s development regulations. The existing homes will be lawfully established nonconforming uses if the CH zoning is approved. BUILDING AND CODES The properties will come within the City s jurisdiction for code enforcement immediately upon the effective date of annexation. The City s Building and Codes Department will begin issuing building and construction permits and enforcing the codes and inspecting new construction for compliance with the City s construction codes immediately upon the effective date of annexation. The Building and Codes Department will also ensure that any new signs associated with the development of the property comply with the Sign Ordinance. No additional costs are expected. A preliminary inspection by the Codes Department indicated there were no code violations. POPULATION According to the 2010 Census from the Census Bureau, there is an average of 2.58 people per household. There are currently a total of 2 single-family homes with a total estimated population of 6 people within the study area. CITY SCHOOLS Murfreesboro City Schools has indicated that the subject property will be located within the Overall Creek Elementary school zone. The proposed zoning will be CH for commercial development. As a result, there will not be an impact to the school. RECREATION The study area will have immediate availability to Murfreesboro s Parks and Recreation facilities. 15 FIRE PROTECTION This annexation will have no negative impact on the Murfreesboro Fire & Rescue Department (MFRD). The MFRD will provide fire protection with a full-time, professional staff as well as medical first responder service. Any development on the site must provide adequate fire flows and install water lines and fire hydrants per the Murfreesboro Water and Sewer Department policies and procedures. Current guidelines recommend fire hydrants be 500 apart. There is a 16- inch CUD water line along Veterans Parkway that is able to provide adequate fire flows for fire protection on the subject property. The closest fire station to the subject tract is Fire Station 10, located within 3.6 miles south of the study area on Veterans Parkway. Until this fire station is operational, the closest fire station will be #9, which is 3.9 miles from the study area located at 802 Cason Lane. The Murfreesboro Fire & Rescue Department can provide ISO Class Two (2) fire protection. 7
16 WATER SERVICE The study area is in the Consolidated Utility District (CUD) service area. A 16-inch water line runs along Veterans Parkway. This line currently serves the two properties and is adequate for providing domestic water service and for maintaining the proper fire flows for any future development. It will be the responsibility of the developer to extend water service into the subject property. Any new water line development must be done in accordance with the development policies and procedures of the Murfreesboro Water and Sewer Department. 8
17 SANITARY SEWER SERVICE Sanitary sewer is currently not available to serve the subject property, per MWSD s definition of available. The properties are to be served by extending an existing 18 sanitary sewer main located approximately 800 feet east of the subject properties. All sewer main improvements and easements needed to serve the subject properties are to be installed and acquired respectively by the developer in accordance with the development policies and procedures of the Murfreesboro Water & Sewer Department. 9
18 DRAINAGE Veterans Parkway includes curb and gutter system for roadway drainage as well as an internal drainage system to convey roadway drainage. The operation and maintenance of the public drainage system will be the responsibility of the Stormwater Program and Street Division upon annexation. The annualized operation and maintenance cost for the drainage system on Veterans Parkway is incidental to the annualized public street maintenance costs so no additional costs are expected for this system. A review of the topographic map shows that the properties drain well to the east onto adjacent properties and then to Overall Creek. The red lines on this map represent ten foot contours. The black lines are two foot intervals. 10
19 FLOODWAY Overall Creek is located to the east of the study area. The 100-year floodplain, as delineated on the flood insurance rate maps developed by the Federal Emergency Management Agency (FEMA), is located on the 4526 Veterans Parkway parcel and a small portion of 4536 Veterans Parkway. The eastern portion of the study area is within the floodplain of Overall Creek. Development plans should follow the local Floodplain Management Ordinance by properly elevating new development. Additionally, future development in the study area will be required to meet the City s Storm water Quality Ordinance for water quality, stream bank protection and detention. 11
20 TAXES AND REVENUE The first City tax bill for all property annexed during the calendar year of 2015 will be due on December 31, City taxes are calculated upon the property appraisal and assessment of the Rutherford County Property Assessor s Office. The current tax rate for the City of Murfreesboro is $1.2703/$ assessed value. Residential property is assessed at a rate of 25% of its appraised value and commercial property is assessed at a rate of 40% of its appraised value. Table I below shows total assessment and estimated City taxes that would be collected, if the property were to be annexed in its present state. Huddleston, PE, Environmental Engineer Annexation Study for Property at 4526 and 4536 Veterans Parkway Alex and Betty Bryan and Lloyd and Edna Davis Properties MPC (Bryan) and (Davis) In response to your memo of June 4, 2015, we have reviewed the subject properties and offer the following observations on behalf of both the Engineering Department and Street Division. Public Roadway System The Annexation Study Area includes a portion of the ROW of Veterans Parkway. This roadway was constructed to Tennessee Department of Transportation (TDoT) standards in a partnership between TDoT, City of Murfreesboro, and Rutherford County. By agreement with Rutherford County, the City of Murfreesboro provides operation and maintenance of this roadway. Upon annexation, the roadway will remain the responsibility of the City of Murfreesboro including all routine maintenance and the conditions of the maintenance agreement with Rutherford County no longer apply to the study area. Approximately 0.64 acres of ROW and approximately 279 linear feet of 5-lane street, curb and gutter, and sidewalk are included in the study area. Based on an estimated 10 year re-pavement cycle for major arterial roadways, annualized roadway maintenance costs are estimated at $1,500 for this roadway. It is expected that these maintenance costs will be paid from State Street Aid and Stormwater Utility Fees. Any future public roadway facilities to serve the area must meet City standards. Public Drainage System Veterans Parkway includes curb and gutter system for roadway drainage as well as an internal drainage system to convey roadway drainage. The operation and maintenance of the public drainage system will be the responsibility of the Stormwater Program and Street Division upon annexation. The annualized operation and maintenance cost for the drainage system in Veterans Parkway is incidental to the annualized public street maintenance costs so no additional costs are expected for this system. Future operation and maintenance costs are anticipated to be paid from the Stormwater Utility Fee. No other public drainage facilities are available to the study area. Any public drainage facilities proposed to serve the study area in the future must meet City standards.
29 Stormwater Management and Utility Fees Upon annexation, stormwater management services provided by the City of Murfreesboro will be available to the study area. Further, the Bryan and Davis properties contains single-family residences and will be subject to the Stormwater Utility Fee of $3.25 per month per single family equivalent. That will result in $78 in additional revenue per year into the Stormwater Utility Fund per year total for the study area. Based on the proposed CH zoning and available stormwater fee credits, the future development of the study area will result in approximately $800 additional revenue per year into the Stormwater Utility Fee upon full development. Property and Development A review of a topographic map shows that the properties drain well to the east onto adjacent properties and then to Overall Creek. The eastern portion of the study area is within the floodplain of Overall Creek. Development plans should follow the local Floodplain Management Ordinance by properly elevating new development. Additionally, future development in the study area will be required to meet the City s Stormwater Quality Ordinance for water quality, streambank protection, and detention. Map 093, Parcel & Pursuant to your request of June 4, 2015, we submit the following information on the availability of water and sanitary sewer in the vicinity of the subject annexation. Repurified water is not available to this location. WATER LINES The subject annexation is within Consolidated Utility District s water service area. SEWER LINES Per the Department s current definition of available, sanitary sewer is not available. There is an existing eighteen (18) inch sanitary sewer main located within an easement along Overall Creek approximately 800 to the east. This sewer main is shown as a red line on the attached exhibit. Rezoning application [ ] for approximately 1.4 acres located along Veterans Parkway to be zoned CH simultaneous with annexation and 9.65 acres to be rezoned from RM-16 to CH, Alex & Bettye Bryan and Wright Family Partnership applicants. The subject property is located along the east side of Veterans Parkway north of Franklin Road (SR 96). It consists of two parcels. The first parcel, located at 4526 Veterans Parkway, is developed with a single-family residence and is currently located in unincorporated Rutherford County. The property owners have requested the annexation of this parcel, which was the previous item on the agenda. Around , Florence Road was reconstructed as a 3-lane cross-section with sidewalks. As a part of this road improvement project, this segment of Florence Road just south of Grassland Drive was realigned to eliminate a sharp curve. As a result of this realignment, a portion of excess right-of-way remains to the west of the new roadbed. In 2006, the Cedar Retreat PRD was approved by the City Council. The developer of Cedar Retreat has requested that the City abandon the excess right-of-way in front of his proposed development, so that it can be transferred to him and incorporated into his development. His PRD pattern book shows this excess rightof-way will be subdivision common area to be used as a passive park. The developer s engineer has submitted an exhibit showing the exact dimensions of what has been requested to be abandoned in front of the Cedar Retreat property. In addition, the neighboring property owner to the north has joined in the request and would like the small amount of excess right-of-way in front of his parcel abandoned as well. The right-of-way in front of his property is labeled on the map exhibit as Additional Study Area. Included in the agenda materials is a right-of-way abandonment study completed by the Planning Staff. If the Planning Commission approves this right-of-way abandonment request, Staff recommends the following conditions of approval: 1) Utility and drainage easements, as needed, must be retained prior to the abandonment of the right-of-way. 2) The applicants must provide a legal description, an exhibit, and any other documentation necessary for the preparation of the required legal documents. 3) All legal documents are subject to the approval of the City Attorney. 4) The applicant will be responsible for recording the quitclaim deed. 54 MURFREESBORO PLANNING COMMISSION STAFF COMMENTS, PAGE 1 AUGUST 5, e. Proposed Amendment [ ] to Sign Ordinance regarding temporary signs and signs that are exempt from permitting fees, City of Murfreesboro Legal and Building and Codes Departments applicants. The Planning Commission conducted a public hearing regarding this Sign Ordinance amendment at its April 1 st regular meeting. After the public hearing, the Planning Commission voted to defer action. On April 28 th, the Planning Commission convened to take a tour of the City and view temporary signage. This tour was advertised as a special meeting and was open to the public. At the May 20 th regular Planning Commission meeting, this ordinance amendment was discussed under Old Business. During that meeting, the Planning Commission requested a special meeting/work session, where it could devote more time to this issue. On June 23 rd, the Planning Commission held a special meeting to discuss this item once again. After further discussion at the special meeting, the Planning Commission voted to schedule another public hearing on the matter. In the interim, the Planning and Building and Codes Departments held a stakeholders meeting on July 28 th to discuss the proposed changes with any interested parties. Staff is considering revisions to the certain provisions following the public meeting on July 28 th. A revised proposed Sign Ordinance and further staff comments will be distributed prior to August 5 th. The Planning Commission will need to conduct another public hearing on this matter, after which it will need to discuss the matter and then formulate a recommendation for City Council. A memo from Amelia Kerr, the Sign Administrator, is attached, elaborating on the proposed amendment. In addition, a copy of the proposed amendment has been included in the agenda packet for the Planning Commission s review.
