1 SOUTHAMPTON COUNTY BOARD OF SUPERVISORS Regular Session i May 26, HIGHWAY MATTERS A. RT. 460 UPDATE Notwithstanding VDOT s notice of termination to US 460 Mobility Partners for Route 460 construction, field work activities within the 17 miles of the proposed new alignment will continue through this summer, with the expectation of obtaining a Record of Decision (ROD) and environmental permits by the summer of VDOT has scheduled a Rt. 460 project status meeting on May 28 at Windsor High School which will include detailed maps of the 17-mile project corridor, and where technical and environmental representatives will be available to answer questions. B. NO THROUGH-TRUCKS - ROSE VALLEY ROAD I received official notice from Commissioner Kilpatrick on April 23 that the Board s request to prohibit through-truck traffic on Rose Valley Road between Enviva Way and Dogwood Bend Road has been approved. Permanent notification signs have been erected and the restriction is now legally enforceable. C. INTERSECTION IMPROVEMENTS - STATESVILLE/CYPRESS BRIDGE ROAD Mr. Kee indicates that the intersection improvements are expected to be complete prior to the end of this week (May 18-22). D. RURAL ADDITION - CHAMPS DRIVE Attached for your consideration, please find a copy of a resolution requesting that Champs Drive be added to the secondary system of state highways and further requesting VDOT to improve the street to the prescribed minimum standards. MOTION REQUIRED: A motion is required to approve the attached resolution. E. MONTHLY CONCERNS Please come prepared to share any highway concerns that exist within your respective districts.

I am satisfied that Champs Drive is a suitable candidate for acceptance under the rural addition program without speculative interest. Based on my previous visit to the site I expect required improvements will include improvement to the road base, paving, construction of a suitable turnaround, and some form of drainage system. I am doubtful all drainage could be directed back toward Sedley Road and suspect an easement to a suitable outfall may be necessary. The lots depicted on the plat were conveyed by Camp Manufacturing Company to Franklin Suburbs, Inc. in April Franklin Suburbs, Inc. subsequently sold the following: 1. Lot 4 to Francis Merle Smith April 1947; 2. Lot 5 to John/Ruth Brenner in January 1948; 3. Lot 9 to R.D. Barham in July 1947; In October 1948, Franklin Suburbs, Inc. conveyed the unsold lots back to Camp Manufacturing Company. Camp Manufacturing Company then sold the remaining lots as follows: 1. Lots to R.D. Barham in February 1951; 2. Lot 16 to Gertrude Joyner in March 1951; 3. Lot 17 to Herman Critzer in February 1952; 4. Lot 18 to John Wood in February 1953; 5. Lot 19 to Oscar Gray in February 1953; and 6. Lots 20 and 21 to R.D. Barham in July 1954.
9 Section of the Code of Virginia provides that recordation of a plat operates to transfer, in fee simple, to the locality in which the land lies, that portion of the property set apart on the plat for streets or other public use, and creates a public right of passage over the land. Accordingly, it is our position these properties are served by a public unrestricted 50 right of way. This is further articulated in a 1995 Maintenance Agreement between the property owners, recorded in D.B. 400, Page 156. Given the existing development of the subdivision, my suggestion would be to terminate the roadway improvements in a culde sac near the respective eastern boundary of Lots 12 and 19, but with at least a 25 arc touching lot 13 for access (see sketch attached). This will require a donation of additional right of way from lots 12, 13 and 19 (to accommodate the radius of a culde sac), which I suspect they ll be more than willing to do. This also removes the issue of speculative interest for lots 14, 15, 20 and 21, which are undeveloped and owned by Michael Glover. He s not a developer he resides on Lot 13 (32032 Champs Drive). While I understand your point regarding a speculative interest by Ms. Edwards, Lots 17 and 18 are tied together at the hip, both encumbered together by a Deed of Trust until 2043 and I think you ll agree after seeing the physical survey that it s highly unlikely they ll ever be conveyed separately again. Drainage improvements will need to be accommodated within the 50 ROW. With 18 of pavement, that leaves 16 on each side for shoulders, and front and back slope. Hopefully that s not an issue. I haven t looked at the topography, but am hopeful that the ditches can slope back to Sedley Road (Rt. 641). I trust this gives you enough information to proceed with the cost estimate. I reviewed what you have submitted so far, please be advised of the following: As of October 1, 2014 code section has been replaced by Since one or more landowners (Glover and Edwards) on the street own multiple parcels, this case would involve speculative interest as defined in , requiring pro rata participation in the cost of improvement. The road serves 14 lots and should be improved to GS 4 standards (18' hard surface). An adequate turnaround will be needed and could necessitate additional right of way. I'm not sure how accurate the GIS sketch is, but the road is shown outside right of way here. Ultimately, the county board is responsible for verifying that a public, unrestricted right of way serves the roadway. Thanks,
