1 Report to the Strategic Development Committee Recommendation to Approve Loudoun County s Request for Easement across Washington Dulles International Property For Improvements to Carters School Road July 2016

2 PURPOSE Staff requests that the Strategic Development Committee approve and recommend to the Board of Directors that it authorize the President and Chief Executive Officer to execute a permanent easement across Metropolitan Washington Airports Authority (Airports Authority) property for improvements to Carters School Road located at Washington Dulles International Airport (Dulles International) in favor of Loudoun County, Virginia.

3 BACKGROUND Carters School Road is a public road, a portion of which lies on the Airports Authority s Western Lands at Dulles International. Pro Logis, L.P. (Pro Logis) owns approximately eighty-two acres adjacent to the Western Lands along the west side of Carters School Road and proposes to develop its property for industrial and automobile storage uses, both of which are compatible surrounding land uses for the Airport. The industrial uses are proposed for the north end of the Pro Logis property. The automobile storage use is proposed for the south end, but requires the grant of a special exception permit by Loudoun County.

4 BACKGROUND (Continued) As part of its development plan and special exception application, Pro Logis proposes to improve Carters School Road to two 12-foot wide paved lanes with 11-foot wide gravel shoulders. In order to construct these improvements, a permanent easement of approximately 1.35 acres is required over thin strips of the Western Lands along Carters School Road. A temporary easement of approximately 1.66 acres is also requested to facilitate construction. The easement would be granted to Loudoun County and the property within the easement would become part of the improved Carters School Road.

6 DISCUSSION Airports Authority staff worked with Pro Logis, Loudoun County and the Virginia Department of Transportation (VDOT) to evaluate this request. The Airports Authority will initially grant an easement for 1,200 feet of roadway improvements and, upon the County s grant of the special exception permit for the automobile storage use, will grant an additional easement for the remaining 2,450 feet of roadway improvements. To complete the entire 3,650 feet of improvements, the easement area is expected to be approximately 1.35 acres. In order to accommodate potential changes as the final engineering is completed, approval of an easement not to exceed 1.55 acres is requested.

7 DISCUSSION (Continued) The completed improvements will become part of the existing public right of way and will benefit the Airports Authority and future development of the Western Lands by providing a roadway that conforms to VDOT standards and will serve as an improved access point to the Western Lands from Route 606. Loudoun County will not be assessed a charge for this easement, consistent with the Airports Authority s practice of providing easements to governmental entities at no cost.

10 Proposed Resolution Authorizing the Conveyance of an Easement to Loudoun County across Washington Dulles International Airport Property for Improvements to Carters School Road WHEREAS, Carters School Road is a public road, a portion of which lies on the Airports Authority s Western Lands at Washington Dulles International Airport (Dulles International); WHEREAS, Pro Logis, L.P. (Pro Logis) proposes to develop approximately 82 acres adjacent to the Western Lands along the west side of Carters School Road for industrial and automobile storage uses, both of which are compatible surrounding land uses for the Airport; WHEREAS, As part of its development plan for the property, and the special exception application required by Loudoun County for the automobile storage use, Pro Logis proposes to improve Carters School Road; WHREAS, A permanent easement is required over thin strips of the Western Lands along Carters School Road in order to construct these improvements; WHEREAS, The property within the easement will become part of the improved Carters School Road; WHEREAS, The Airports Authority will initially grant an easement for 1,200 feet of roadway improvements and, upon Loudoun County s grant of a special exception permit for the automobile storage use, will grant an additional easement for the remaining 2,450 feet of roadway improvements for a total easement area of approximately 1.35 acres; WHEREAS, An approval of an easement not to exceed 1.55 acres is requested to accommodate potential changes as the final engineering is completed; WHEREAS, The completed improvements will become part of the existing public right of way and will benefit the Airports Authority and future development of the Western Lands by providing a roadway that conforms to Virginia Department of Transportation standards and will serve as an improved access point to the Western Lands from Route 606;

11 WHEREAS, The Strategic Development Committee has reviewed the proposed easement, as presented by staff at its July 20, 2016 meeting, and recommended that it should be granted at no cost; now, therefore be it RESOLVED, That the President and Chief Executive Officer is authorized and directed to execute a permanent easement across Airports Authority property for improvements to Carter School Road located at Dulles International in favor of Loudoun County, Virginia, as identified in detail in the documents presented to the Board of Directors at its July 2016 meeting. BACKGROUND Carters School Road is a public road, a portion of which lies on Airports Authority property on the west side of Dulles International. It runs from its intersection with State Route 606 in a southeasterly direction. The road is part of the Western Lands property the Airports Authority purchased in Although the road is currently unpaved and largely unused, it has a state public right-of-way designation (i.e., State Route 857). Pro Logis, L.P. (Pro Logis) owns approximately eighty-two acres adjacent to the Western Lands along the west side of Carters School Road, and proposes to develop this property for industrial and automobile storage uses, both of which are compatible surrounding land uses for Dulles International. The industrial uses are proposed for the north end of the Pro Logis property. The automobile storage use is proposed for the south end of the property, but requires the grant of a special exception permit by Loudoun County. As a part of its development plan and special exception application, Pro Logis proposes to improve Carters School Road along the entire length of the Pro Logis property, to two 12-foot wide paved lanes, with 11-foot wide gravel shoulders. In order to construct these improvements, an easement is required over thin strips of the Western Lands along Carters School Road, as shown on Exhibit A. The easement would be granted to Loudoun County and the property within the easement would become part of the improved Carters School Road.

In order to accommodate potential slight changes as the final engineering and design is completed, approval of an easement not to exceed 1.55 acres is requested. A temporary easement of approximately 1.66 acres is also requested to facilitate construction. The temporary easement will expire upon completion of the roadway improvements. The Carters School Road improvements will become part of the existing public right of way and will benefit the Airports Authority and the future development of the Western Lands by providing a roadway that conforms to VDOT standards and will serve as an improved access point to the Western Lands from Route 606. Since the easement will be granted to Loudoun County, a charge will not be assessed under the Airports Authority s practice of providing easements on its land to governmental entities at no cost. CONCLUSION Staff requests that the Strategic Development Committee approve and recommend to the Board that it authorize the President and Chief Executive Officer to execute a permanent easement across Airports Authority property for improvements to Carters School Road located at Dulles International, in favor of Loudoun County, Virginia.
