1 URBANDALE PLANNING AND ZONING COMMISSION MINUTES The Urbandale Planning and Zoning Commission met in regular session on Monday,, at the Urbandale City Hall, th Street. Chairperson Julie Roethler called the meeting to order at 6:00 p.m. Commissioners present were Jeff Hatfield, Wayne Van Heuvelen, Judy Ralston- Hansen, Paul Pick, Joe Wallace, and Julie Roethler. Staff members present were Kristi Bales, Community Development Manager/Chief Planner and Cheryl Vander Linden, Administrative Specialist. Bridge Montgomery arrived after roll had been called and vote on minutes had been taken. The first item on the agenda was to approve the minutes of the October 19, 2015 meeting. Mr. Wallace moved, and it was seconded by Ralston-Hansen, to approve the October 19, 2015 minutes. On roll call; Ayes: Wallace, Ralston-Hansen, Hatfield, Van Heuvelen, Pick, Roethler: Nays: none. Passes: none. Motion carried. The next item on the agenda was the Waterford Glenn Final Plat (164 th Street & Waterford Road). Ms. Bales said this final plat pertains to a 20-acre parcel that lies approximately 2,000 feet east of 170 th Street on the south side of Waterford Road. The subject property has frontage onto Waterford Road but will be accessed by the western extension of Springbrook Trail from Waterford Landing Plat 5 and by the northern extension of 164 th Street from Highland Meadows. The City Council approved the rezoning of the parcel to R-1S Suburban Density Single-Family District on May 12, 2015, subject to conditions, including a minimum lot width of 75 feet. The Waterford Glenn Preliminary Plat was approved by the City Council on June 23, This plat proposes 48 single-family residential lots with a minimum width of 75 feet, and one outlot. The lots generally have widths of 75 feet, with the corner lots being wider as required, and areas ranging from 8,776 square feet to 26,537 square feet. Outlot X is 1.03 acres, and is proposed to be dedicated to the Homeowner s Association as the stormwater detention basin. Currently, Waterford Road has two lanes of asphalt pavement from 156 th Street to 170 th Street, including along the frontage of the subject property. However, a project to reconstruct Waterford Road with a four-lane cross-section plus turns lane and a center median is proposed in Sanitary sewer service is being provided from an existing sanitary sewer in the Waterford Landing development to the east. Water will be provided from a main extension along Waterford Road from the east. Surrounding properties to the north and east are zoned PUD for the Waterford Landing residential development and to the west and south are zoned PUD for the proposed

2 Page 2 Highland Meadows residential development. The property is located in the Waukee School District and drains primarily southeast into a drainageway that bisects the property. The Parks and Recreation Commission approved a voluntary payment in lieu of a land dedication to satisfy the requirements of the parkland code at its meeting on June 17, Ms. Bales said Staff recommends approval of the final plat subject to requiring the developer to: 1. Submit an Attorney's Opinion and all other plat documents as found to be necessary for approval; provide surety for any uncompleted public improvements; and provide maintenance bonds for the public improvements; provide certified as-built grading drawings verifying the as-built elevations of critical locations on the site, sanitary sewer manholes, and all storm water management facilities along with certification that the grading and storm water management facilities were constructed as designed. 2. Comply with the requirements of the Parkland Dedication Ordinance with payment of $38,850; pay the sanitary sewer connection fee in the amount of $70, (if paid by July 1, 2016); pay the street paving fee of $121, (or provide surety in the amount of $140,824.67); pay the Waterford Road sidewalk fee of $18,660; provide surety for internal sidewalk in the amount of $13,493.37; pay the street signage fee in the amount of $660; and provide surety for the required berm and buffer plantings within the 50-foot landscape setback along Waterford Road in the amount of $23, Insert addresses (to be provided by Community Development Dept.); place the streets in Lots B-E and add a note that these lots will be dedicated to the City; add note Maintenance of all drainage tile lines are the responsibility of the Home Owner s Association (also to be included in the HOA s Covenants); add note referencing the depressed sidewalk overflow locations (Lots 25/26 and 35/36) and provide revised Individual Grading Plan for Lots 35/36 clearly calling out the depressed sidewalk; provide a statement on the plat indicating the ownership of Outlot X; remove reference to Storm Sewer Easement on Lot 16 (once book/page number has been received from Recorder s Office); add radius callout for cul-de-sacs; place Outlot X in a Storm Sewer and Surface Water Flowage Easement; add storm sewer easement to southwest corner of Lot 25; label 7.5 each side of the line between Lots 11/12; provide a 50 Temporary Construction Easement along Waterford Road for future reconstruction; revise label on the irregular Storm Sewer Easement at the northeast corner of Lot 10 (should not read 20 ); show existing offsite easements with book and page (water main easements on Deerview Drive and 164 th Street, Storm Sewer easement on

3 Page 3 Deerview Drive, Storm and Sanitary Sewer easements west of Lots 5-6). 4. Provide a bond to ensure the detention area is cleaned out prior to it being turned over to the Home Owner s Association; provide Storm Water Facility Maintenance Agreement (template to be provided by Community Development Dept.); revise MAS to MGAS on Lot 15; The Existing Sanitary Sewer Easement should not be vacated on Lots 5-6. If entire easement is being vacated, provide easement description for new easement at this location (the vacation will be by the USSD); add engineer s seal for elevation information in Note #4. 5. Add the following statement to the plat: In any area where a public utility easement (PUE) overlaps, or is coincident with, a designated utility easement for sanitary sewer, water main or storm sewer, the use of the PUE is subordinate to the use of a designated easement for sanitary sewer, water main or storm sewer purposes. Utilities located in the PUE that are in conflict with the use of a designated easement for sanitary sewer, water main or storm sewer purpose must relocate without expense to the owner of the sanitary sewer, water main or storm sewer. The use of the PUE is subordinate in perpetuity including any future use of the easement designated for sanitary sewer, water main or storm sewer purposes. 6. Comments on Easement descriptions: revise Glen to Glenn ; revise water main easement legal description for Lot 7 regarding two northerly references; for Lots 5-6: provide Sanitary Sewer Easement if previous easement is being vacated; for Lot 10: call out length of 20 Storm Sewer on Plat. Call out Bearing and Distance for Storm Sewer Easement line in northeast corner-description cannot be verified; for Lot 12: call out length of 20 Storm Sewer Easement on Lot-description cannot be verified; for Lots SWFE: call out bearing and distance of SWFE boundary-description cannot be verified; for Lots Storm Sewer and SWF Easement: call out bearing and distance of boundarydescription cannot be verified. The Fire Department advises that this plat is more than 5 miles of travel distance from the closest fire station which will result in a higher ISO Insurance rating for houses built in this subdivision. Mr. Eric Cannon, Snyder and Associates, and Dave Harmeyer, Vista, were present to answer any questions. Ms. Roethler said so you re saying there s going to be a park to the east then, in a different plat? Ms. Bales said yes. It didn t work to have this be part of a park because of lots that are

4 Page 4 on the east. So there s a larger park dedicated in the Highland Meadows P.U.D. and, in all likelihood, funds from here will be used to help develop that park. So, no land in this case, just funds. Mr. Van Heuvelen said as Deerview Drive goes on to the west, I would imagine that there s a hook-up going north to Waterford? Ms. Bales said yes, there is. Mr. Hatfield said it seems like maybe 10 years ago, the law changed and the City couldn t force people to do in lieu of, you had to do a park or not. So, this one was voluntary, so the developer agreed. How do you come up with that formula, on the dollar amount? Ms. Bales said formula is based on the purchase price of the land, and it s a 10% acreage dedication. So, essentially, we use the monetary equivalent of that acreage. Mr. Hatfield said okay, so it s not a square foot or whatever. Ms. Bales said no, it s not a flat fee city wide or anything like that. Mr. Van Heuvelen asked where s the nearest fire station going to be? I noticed your note there about we re more than five miles away from a fire station so there s some, I would imagine, increase in premiums. Ms. Bales said right. One of the conversations involves the northeast corner of Waterford and 170 th, the City owns that parcel. If I remember correctly, there are about 17 acres there. That s been discussed as one option. There s some discussion about how far west is the city expanding and maybe that site isn t far enough west for the city s eventual limits. It s been kicked around a little bit. Ms. Montgomery said I would say it s been more than kicked around. At the CIP level, it s been talked about a lot. So if you re interested in that, those meetings are coming up. Ms. Bales asked Ms. Montgomery if she is serving again this year? Ms. Montgomery said yes I am serving, as a representative of the Commission. Mr. Hatfield said the six Staff recommendations, most of them look pretty easy. Are you in agreement? Mr. Eric Cannon, Snyder and Associates, 2727 SW Snyder Boulevard, Ankeny, said I m here on behalf of Snyder and Associates, and yes, we do agree with the Staff

5 Page 5 recommendations. Mr. Hatfield asked is it Glen with two n s or Glenn with one n? Which one was the typo? Because I looked it up, just to make sure I wasn t crazy, and Glen with one n is a word for a deep valley or a small, secluded valley. And I couldn t find anything on Glenn with two n s. It s a person s name. Mr. Harmeyer said there s no magic to it. Mr. Hatfield said I was just wondering because I saw it both ways, in one place with one n and in another place it had two n s. So, I was just curious. Mr. Pick moved, and it was seconded by Ralston-Hansen, to approve Waterford Glenn Final Plat, subject to Staff recommendations. On roll call; Ayes: Pick, Ralston-Hansen, Hatfield, Montgomery, Van Heuvelen, Wallace, Roethler; Nays: none. Passes: none. Motion carried. Regarding Staff reports, Ms. Bales said I have no other reports except we will have your meeting in two weeks, and we will have your meeting on November 30, as well. We ll have two final plats in two weeks, and there s at least one preliminary plat two weeks after that. Ms. Montgomery asked do you know anything about the occupancy for the CVS? Ms. Bales said I do not. Ms. Montgomery said it s hard to tell what the ground work that they ve done, but it looks like a store when you drive by. Ms. Roethler said I think they ve got a now hiring sign. Mr. Pick said yes, they seem to be stocking it. The meeting adjourned at 6:10 p.m.
