3 Springmill Lakes at Tamarack Introduction Please take a few minutes to read through these pages. You ll find them a guide to enjoying our community of 106 condos. We ve made an effort to spell out the many responsibilities your Home Owners Association has willingly assumed and the few responsibilities you are asked to shoulder. Very simply, this manual is meant as a convenient summary, but in no way does it replace the formal Declaration of Covenants, Conditions and Restrictions, nor does it alter the By-Laws of Springmill Lakes at Tamarack. 4 WHAT IS INCLUDED IN CO-OWNER MONTHLY FEE The Following Are Included Hidden Benefits Maintenance, repair and replacement (as required) of all exterior and structural components of condo buildings Appropriate insurance coverage against fire, wind damage, earthquakes, etc. Note that insurance provided by the Association covers only from drywall out ; Homeowners must provide their own insurance coverage for drywall in Appropriate insurance coverage for liability exposures Care and maintenance of drainage systems, including street drains, sewer tiles and underground sewer piping Streets, driveways and auxiliary parking pads maintenance, repairs & repaving (as required and on a prearranged schedule) Snow removal from streets, driveways, walks and entrances (in excess of 3 inches) ADT Smoke/Fire Security System monitoring which is included in the monthly fee along with an annual smoke/fire detector inspection Walkways maintenance, repairs & replacement (as required and on a prearranged schedule) Gutters and downspouts cleaning, maintenance, repairs and replacement (as required) Exterior painting (as required on a prearranged schedule) 2
5 Total landscape package, including: Grass cutting Fertilizing Re-seeding Insect and weed control chemical applications Mulching of common area gardens (homeowners must maintain personal flower beds and shrubbery) Seasonal leaf removal Annual trimming of trees and common area shrubbery Irrigation and Sprinkler System Watering grass, maintenance, repairs, monitoring (including annual turn-on and turn-off) Control and removal of undesirable critters Exterior garage doors and lights maintenance, repairs, replacement (as required, including replacement of photo cells and light bulbs) Street lights are maintained as well Care and maintenance of all common ground areas, including: Lake (including semi-annual algae spraying) Lake and spillway creek banks Boardwalk and attached steps Spillway channel under Tamarack Drive Gate at Tamarack Drive and 96 th Street Access to the 17 acre Nature Preserve which is cared for and maintained by the Combined Homeowners Associations of our condos and the houses bordering 91 st Street 3

8 NATURE PRESERVE We at Springmill Lakes are very proud of our 17-acre Nature Preserve, a dedicated Wildlife Habitat. The Tamarack Condominium Recreational Corporation, a not-for-profit corporation, owns, administers and manages the Nature Preserve. Each of the Co-Owners of Springmill Lakes along with the owners of Tamarack Seventeen Homeowners Association is a voting member of the Recreational Corporation. Our Nature Preserve is inspected every five years by the Department of Natural Resources in order to maintain tax exempt status for this portion of our property. Paths are cut in spring, summer and fall for your walking convenience to view the flora and fauna of each season. The Recreational Corporation has its own officers, board, and budget. Currently every unit coowner is assessed a monthly fee of $3.00 which is collected by Springmill Lakes on behalf of the Recreational Corporation and is included in each Co-Owner s monthly assessment paid to Springmill Lakes. Enjoy! ANNUAL MEETING The annual meeting of Springmill Lakes at Tamarack Co-Owner s Association is held in September. A notice of the meeting, along with information to be discussed, is mailed 30 days prior to the meeting to every resident. Your attendance or your proxy is necessary for the Association to conduct business effectively. BOARD MEETINGS Board of Directors Meetings are determined each year following the annual association meeting. Currently, they are held on the 3 rd Tuesday of each month at 6:00 p.m., except January, when no meeting is held. 6
9 MONTHLY MAINTENANCE FEE Monthly fees are set at the annual meeting and are effective at the beginning of each calendar year, based on the approved budget, and are due on the 1 st day of each month. In order to facilitate your payment on a timely basis and to save the writing of monthly checks, Kirkpatrick Management Company, Inc. can arrange automatic monthly debiting of residents checking accounts. Your account may still be paid by personal check made payable to Springmill Lakes at Tamarack Co-Owners Association, Inc. Those residents who still wish to pay by personal check will receive a monthly coupon booklet and pre-addressed return envelopes. Please send your payments to: Springmill Lakes at Tamarack c/o Kirkpatrick Management Company Inc Kirkpatrick Way Indianapolis, IN DELINQUENT ASSESSMENT POLICY Maintenance Fees are due on the first day of the month. After 15 days you are considered delinquent and a late fee of $25 is assessed each month. The Association is then entitled to legal proceedings. All attorney fees, court costs and collections will be added to the past due amount. INTERIOR STRUCTURE RULES AND RESTRICTIONS Nothing shall be done or permitted in any Dwelling Unit which will impair the structural integrity of any Building or which would structurally change any Building, except as otherwise provided in the Declaration or the By-Laws; nor shall any Dwelling Unit be used in any unlawful manner or in any manner to cause injury to the reputation of the community or to be a nuisance, annoyance, inconvenience, or damage to other Co-Owners or tenants of the Building or neighboring Buildings, including, without limiting the generality of the foregoing, noise by the use of any musical instruments, radio, TV, loud speakers, electrical equipment, amplifiers, or other equipment or machines 7
10 EXTERIOR ALTERATIONS and LANDSCAPING ANY EXTERIOR ALTERATIONS, LANDSCAPING, FENCES, OR ORNAMENTAL ITEMS must be approved in advance by the Board of Directors. The Architectural Control form is included on page 19 in this manual. The form is also available online at: Additional copies may be obtained from Kirkpatrick Management Company. The upkeep of the landscaping at the entrances and common areas is the responsibility of the Association. All ornamental shrubs and trees, planted with approval, to enhance an individual Unit, are the Co-Owner s responsibility. See landscaping schedule of services on page 12 No co-owner shall be allowed to plant trees, landscape, or otherwise alter the landscape without the written consent of the Board of Directors. Annual seasonal flowers are permitted and no approval is required. No additional building shall be erected other than the Buildings designated in the Declaration and shown on the Plans. No Co-Owner shall cause or permit anything to be hung or displayed on the outside of the windows or placed on the outside walls of a Building, or on or upon any balcony or patio, and no sign, awning, canopy, shutter, flag, radio, television antenna, satellite dish or other attachment shall be affixed to, or placed upon the roof or any other part of the Building, without the prior written consent of the Board of Directors. No clothes, sheets, blankets, rugs, laundry, or other similar objects or materials shall be hung out or exposed on any part of the Common Areas. The Co-Owners shall keep the common areas free and clear of rubbish, debris, or other unsightly material. Other than seasonal front door wreaths, no artificial flowers are to be displayed. All Co-Owners and their guests shall observe the rules and regulations issued by the Board of Directors for the Common Areas. No sales activity is permitted on the property (see Covenants for specific language). No industry, trade, or other commercial or religious activity, educational or otherwise, whether designed for profit, altruism or otherwise, shall be conducted, practiced, or permitted on the Property. This includes prohibition of garage, estate, moving, or any other sales, whatever the title. 8
11 No boats, campers, trailers of any kind, buses, mobile homes, trucks, motorcycles, mini-bikes or any other unconventional vehicles of any description, shall be parked, or stored anywhere within the Property, except that any such vehicles may be parked or stored completely enclosed within a garage, or except as may be authorized in writing by the Board of Directors. Garage doors shall be kept closed except when entering or exiting the garage. The parking of any type of vehicle upon the streets, other than temporary parking by guests of any Co-Owner, is prohibited. No overnight parking is permitted on the street. Vehicles must be parked in driveways or auxiliary parking areas. Appurtenant to each Dwelling Unit is the right to use the parking area located in the driveway area immediately adjacent to the Dwelling Unit, as shown on the Plans. The number of vehicles which may be parked in such area by any Co-Owner shall not exceed the number of automobiles for which such Co-Owner s garage space is designated. Auxiliary parking areas are for temporary use and convenience of guests. No Co-Owner shall be allowed to plant trees, landscape, or otherwise alter the landscape without the written consent of the Board of Directors. See the Architectural Control Form, page 19. Spirngmill Lakes window maintenance policy clarification The windows in our condos are BILTBEST brand, which are no longer available. Maintenance of our condo windows is a shared responsibility. Association responsibilities Maintenance and replacement of wood frame when necessary Exterior painting of window frame. Co-owner s responsibilities Replacement of thermal pane glass when seal is broken and window fogs up Replacement of broken or cracked glass Any hardware related problem o Some examples Casement hinge Casement lock Casement operator hardware Interior painting and maintenance Weather strip repair or replacement Repair of hardware related issue is supported by Kirkpatrick Management. 12 SECURITY Co-Owners must assume responsibility. Do not leave garage doors open. This invites problems. Also, do not leave cars parked outside unlocked. If you see any suspicious people in the neighborhood or nature preserve, call 911. ADT MONITORING CENTER AND CUSTOMER SERVICE (Revised December 16, 2016) The ADT monitoring service is included in the Association monthly fee. Each co- owner is responsible for maintaining his/her own system including maintaining connectivity to ADT by land line or cellular phone service. The Association provides one clean and check of the smoke/fire alarm per year. When contacting ADT, it is recommended that you tell them your condo customer number. This number remains associated with a condo, even as ownership changes. Exterior garage lights are to be kept in working order at all times. The Association will check and replace bulbs on a regular schedule. Garage lights are operated by photo control (Dusk to Dawn). Gates were installed at the 96 th street entrance to increase security and reduce traffic. Each unit was assigned two remote openers. The care and repair of the openers is the responsibility of each Co-Owner. No additional openers will be issued. If you plan to go out of town for an extended period of time, complete the attached Crime Watch Information Sheet on page 11 and give to your Block Captain. 10

15 PETS Pets must be on a leash attended by the owner. Pets are not to be allowed to run loose. The Board encourages pet owners to consider an invisible fence for their pets. The invisible fence must be approved. You must submit an Architectural approval for invisible fences. Please restrict your pets from lawns and carry a pooper scooper or plastic bag to clean up any deposit. Barking dogs will be considered a nuisance and will not be tolerated. Repeat violators will be reported to Animal Control Division of the City/County government. No animals of any kind shall be raised, bred, or kept in any Dwelling Unit or in the Common Areas, except that small pet dogs, cats, or customary household pets may be kept in a Dwelling Unit, provided that such pet is not kept, bred, or maintained for any commercial purpose, and does not create a nuisance. Pets shall be permitted outdoors only under leash and accompanied by a Co-Owner or other person or confined within an invisible fence. The Co-Owner shall be fully liable for any injury or damage to any person or to the Common Areas caused by his or her pet and shall be responsible for removing from such areas the pet s waste materials. The Board of Directors may adopt such other rules and regulations regarding pets as it may deem appropriate, and in the event that in judgment of the Board of Directors any pet is causing or creating a nuisance or unreasonable disturbance or noise, such pet shall be permanently removed from the Property upon written notice of such determination by the Board of Directors. SIGN POLICY The placing of For Sale or any type of sign in the lawn is not permitted. For Sale signs are permitted to be displayed inside a Co-Owner s window. Real Estate directional open house signs are permitted at the entrance and front of a unit that is For Sale, only during the Open House hours. All For Sale signs must be commercially printed. Hand lettered signs are not permitted. 13
16 SPEED LIMIT THE SPEED LIMIT AT SPRINGMILL LAKES AT TAMARACK IS 18 MPH Please observe the limit to avoid our need to install speed bumps which will be a nuisance to everyone. Springmill Lakes at Tamarack residents enjoy walking, biking, etc. Speeders make these activities hazardous. TRASH Monday is the current trash pick up day; it must be at curb-side no later than 7:00 A.M. PLEASE, PLEASE, do not place any trash at curbside before 4:00 p.m. on Sunday. It is unsightly and can make a mess in bad weather. TRASH MUST BE IN TIED PLASTIC BAGS OR CLOSED CONTAINERS. Any trash scattered by winds or animals in your area should be cleaned up immediately upon discovery. All trash or refuse shall be stored in appropriate containers inside the Dwelling Unit garage. RECYCLING Separate containers for recycling are available by calling Republic Services: (317) SNOW REMOVAL The Association provides snow removal from the streets, sidewalks and driveways only after 3 inches have accumulated and when the snow event ends. INSURANCE Nothing shall be done or kept in any Dwelling Unit or in the Common Areas that will cause an increase in the rate of insurance on any Building. No Co-Owner shall permit anything to be done or kept in his Dwelling Unit or in the Common Areas which will result in cancellation of insurance on any Building or contents thereof, or which would be in violation of any law or ordinance. Separate Property and Liability coverage should be obtained by each unit Co-Owner (or occupant) to cover personal liability and personal property. A Security System Monitoring Certificate, which may entitle co-owners to insurance savings, is available from ADT at 1(800)
17 WINTERIZING TIPS Please winterize outside water faucets as listed below: 1. Disconnect hose from outside faucet. 2. Turn on and then off outside faucet to release pressure in line. 3. Store hoses for winter. In addition, we realize that some residents will be out of town for the winter leaving their homes vacant for a period of time. Listed below are a few suggestions to prevent freezing pipes while your unit is vacant: 1. Shut off water main. 2. Set thermostat to a minimum of 55 to 60 degrees. 3. Open cabinet doors around sinks, dishwasher, and wet bars. 4. Shut off water heater or set to minimum setting. If you choose to drain your water heater, please be sure to shut off power prior to draining. 5. Install anti-freeze in toilet bowl and tank. 6. Leave a key with a relative (or a neighbor) in case of an emergency and notify Kirkpatrick Management Co. and complete the crime watch form on page 11. AIR CONDITIONING The maintenance and repair of the air conditioning unit or heat pumps outside your unit is the responsibility of the homeowner. Helpful Hint: The air conditioning unit outside your home can get clogged, which results in reduced efficiency. Turn your power switch to off and hose out your unit. 15
18 SPRINGMILL LAKES AT TAMARACK ASSOCIATION/CO-OWNER MAINTENANCE RESPONSIBILITY ASSOCIATION MAINTAINS: All components essential to the structural integrity of the base of the building: roof, exterior walls, doors, door and window frames, eaves, foundation, and chimney exteriors. All components of primary access to unit: front walk, stoop, driveway, garage door (only), and garage apron. Garage light bulb replacement and garage light photo control. Irrigation system Mailboxes Drainage systems, gutter cleaning, downspouts, drainage pipes and sewer (from where it enters a unit to the main). Lake: treatment, banks, erosion, spillway, boardwalk. East and West perimeter boundary fence. Security system monitoring and annual smoke detector inspection. Streets and auxiliary parking areas. This includes repair and sealing of streets and driveways; maintaining curbs, traffic signs, IPL lighting, and the 96 th street gate. Lawn Care: mowing, fertilizing, seeding, leaf removals, tree and shrub fertilizing, insect control, shrubbery and tree trimming and lawn sprinklers. Snow Removal. Landscaping: entryways to complex, circles, plantings in utility areas such as auxiliary parking, lift station, and complex boundaries: Trees, woodlands, and plantings original to site prior to development or subsequently installed by the Association, curbside trees or their replacements. 16
19 CO-OWNER MAINTAINS: Window glass (broken; defective, and broken seals), screens, screened porches, resident installed skylights, patios, decks, hot-tubs, storm doors, fences, decorative walls, exterior lighting, chimney interiors, AC units, awnings, and exterior spigots. Co-owner must replace insulated glass having broken window seals causing a cloudy appearance to window glass All other walkways to unit. Garage door openers and mechanisms. Sump pumps. All exterior items installed after your unit was completed. This includes foundation plantings and landscaping. Specific unit responsibilities: You are responsible for keeping your individual security system operable and for maintaining the smoke detector (mandated by the Association s insurance policy). You are also responsible for free standing privacy fence painting and repair. Removal of old plants, shrubs and trees around the foundation. Trim dead wood from mature trees and shrubs around your foundation and off roofs. Replace overgrown trees and shrubs. Maintain foundation planting. Do not allow vines to attach to wood or brick siding. Patio Decks and Upper Decks Maintain structurally Paint or stain as necessary 17
20 Instructions for Springmill Lakes at Tamarack Architectural Changes Page 19 shows an Architectural Control Form to be used for requesting approval for any addition, change or improvement to the interior or exterior of the Co-Owner s condo. To assist you with your project, the following is a list of instructions: 1. Review the Exterior Alterations and Landscaping section in this manual. All questions can be directed to Kirkpatrick or the Architectural Control Board member. 2. Read the following Policy Statement for Construction Projects: Any renovation/remodeling of the interior other than cosmetic changes such as paint, wallpaper and carpet must be reviewed by the Architectural Control Board member before starting any project. An Architectural Control Form may be required. 3. Complete the Architectural Form on page 19 and deliver it to the Architectural Control Board member. 4. The Board has 30 days to approve or deny your project. You will receive a notification in writing. 5. Any changes to the approved plan must be re-approved by the Board in advance of implementation. 7. Obtain necessary building permits after approval is complete. POLICY STATEMENT for CONSTRUCTION PROJECTS The Board of Directors of Springmill Lakes at Tamarack hereby requires that all construction/landscaping projects have the prior approval of the Board. Such approval will include a stipulation that if such construction initiated by a Unit Owner requires any administrative action (i.e.: permits, etc.) or public hearings (i.e.: variances, etc.) the same shall be the sole financial responsibility of the Unit Owner after such action has secured the prior approval of the Board of Directors. The Unit Owner assumes all responsibility for any buried cables, utilities, sprinklers, etc., and will restore the surrounding common area to a satisfactory condition in a timely manner. The Board further stipulates that where such approval for construction is beyond the Unit Owner's current conditioned living space as described in the Horizontal Property Regime and subsequent amendments, such enlarged conditioned living space shall become a permanent encroachment on the limited and common property of the Regime for the exclusive use of the Unit Owner and all succeeding Owners of the Unit. As such, any and all interior and exterior maintenance of said enlarged living space shall be the responsibility of the Unit Owner. The policy is now in full force and effect for all past, present, and future constructions in Springmill Lakes at Tamarack. 18
21 Springmill Lakes at Tamarack Architectural Control Form Read the Instructions for Architectural changes before completing this form. You, the Co-Owner understands, acknowledges and agrees that any additions, improvements, repairs or alterations are the sole responsibility of the Co-Owner, heirs and any future Co-Owners. You will be fully responsible for maintenance, repairs and upkeep. Furthermore, it is your responsibility and that of your Contractor, to ensure that your renovation project does not impact any structural element of the building including, but not limited to, load bearing walls and floor joists.
