1 A. PATIO FENCES SECTION II STRUCTURAL REGULATIONS Nothing may be done to the patio fence that will in any way detract from the uniform appearance of the other units. The Association will repair and paint the patio fences. Any added gates and closures to the patio must be the same as those originally installe& and the Unit owner must obtain a "Requestfor Change" to apply any changes. Reconstruction or alteration of existing fences must be approved by the Executive Board before the constructionbegins. B. SCREENISTORM DOORS AND GARAGE DOORS Without the approval of the Executive Board, exterior doors including storm doors and garage doors may not be altered from the original design or color. Installation of a screen/storm door for the front of any unit is permitted with prior approval from the Property Manager provided the screen/storm door is constructed of metal, is almond/sandstone in color, has afull-view dear glass, and does not have a kickplate higher than fourteen (14) inches. All screen/storm doors must be the same color and design as those of the other units. C. WINDOWS Blinds, drapes or curtains that are visible from the outside of the Unit must be white, beige or cream colored. D. PATIOS/AWNINGS Only fabric-type awnings, either stationary or retractable, are al1owed. over patios. All awnings must match the existing awnings. Prior to the installation of any new awning, a "Request for Change" must be made to the Property Manager who will refer the request to the Board of Directors for approval, rejection or modification of the application. All awnings must be Sunbrella Mocha Style 4616 with Brown regular (standard) braid. Awnings may be installed beginning March 15 and taken down no later than November 15. 4
2 SECTION III COMMON GROUND Common ground/property is maintained for the exdusive benefit and enjoyment of all Jefferson Pointe residents. The term "condominium" refers to a form of property ownership in which there are two forms of ownership: individual and common. An owner is both the sole owner ofthe living quarters (the unit) and one of the mutual owners of common property that an owner may use and enjoy along with the other owners. Common ground is all portions of the condominium that are not included within the units. Nothing can be stored, hung, exposed or otherwise affixed to any portion of the common ground. Common ground includes all building exteriors, trees, and shrub beds. A. FLAGS, BANNERS, WINDSOCKS, WIND CHIMES 1. No flags (except the American flag), banners, wmdsocks, wind chimes, bells, bird. feeders, windmills, or other objects may be displayed or hung from awning frames or trees. 2. Freestanding flagpoles are prohibited. The American flag may be attached to individual unit patio fences by brackets no longer than 6 inches. 3. No ]inens, cloths, clothing, curtains, rugs, mops or laundry is to be hung from the patio fences. 4. If delivery or snow-removal vehicles are ruining a Unit owner's lawn, the owner should contact the Property Manager who will then contact the driver of the vehicle about the infraction. B. SHRUBS AND TREES All trees and shrubs are the property of the condominium. Residents are not to plant, trim or replace any shrub or tree without the written consent of the Executive Board after he/she has completed a "Request for Change" form. Nothing is to be attached to or hung from the trees. The only exception is small white holiday lights that are permitted on the bushes from the day after Thanksgivingthrough January 8. Only low wattage (under 3 watts) nonflashing white midget lights designed for outdoor use maybe displayed. C. ANTENNAS Exterior mounted radio and/or television receiving or transmitting antennas are not permitted.
3 D. TOYS, TOOLS, LARGE ITEMS All toys, tools, bicycles and other large items must be stored inside the Unit when not in use. E. SIGNS, ADVERTISEMENTS, AND DECALS No signs, notices or advertisements are to be placed on a unit, exposed at a window or placed on common ground without a written agreement with the Executive Board. All requests for permission must be submitted in writing and must identify the material to be posted. The request must state the purpose for the material, the location in which it will be posted., and the anticipated duration of the posting. The exceptions to this rule are: a. A single "For Sale" sign, no larger than 18 x 24 inches and no higher than 3 feet. The sign is to be placed on property connected to the Unit and visible from The Villas of Jefferson Pointe Circle. An alternate placement may be displayed in a window of the Unit. b. Block parent signs from the Jefferson Borough School District. c. "Tot Finder" and "Pet Finder" decals from the Jefferson Hills Borough Fire Department. d. A security protection window sign smaller than 1 square foot. e. A security sign placed in the mulch area of the Unit. F. COOKING GRILLS 1. A charcoal grill is to be used in front of the Unit's garage and returned to the storage area as soon as it has cooled. 2. Propane or electric gri]ls are allowed on the patios only. Any damage resulting from a grill being placed too dose to the Unit is the responsibility of the Unit owner. G. GARBAGE To prevent animal foraging, refuse and garbage must be stored within the Unit until the designated time for collection. Holiday weeks during the year may mean that the garbage pickup will be delayed by one day. Unit owners are to follow the Garbage Pickup Schedule mailed by Jefferson Hills Borough. 1. According to Jefferson Hills Borough law, garbage is to be placed at the curb in a SECURE CONTAINER after 6 p.m. the night before pickup. No loose garbage is to be placed at the curb. 2. Plastic bags of garbage are not to be placed at the curb until after 6 a.m. the day of the pickup. 3. Common areas are to be kept free and. clear of rubbish, debris and other unsightly material
4 4. Materials to be recycled should be kept in proper containers for pickup. Pickup dates are established by Jefferson Hills Borough. A schedule of pickup dates for each year is mailed to every borough resident. H. FLOWERS, FLOWERPOTS AND PLANTED AREAS 1. It is the Association's responsibility to provide for the design, maintenance, repair and replacement of the original lawn, trees and shrubs. Trees or shrubs added by a Unit owner pursuant to a "Request for Change" will be maintained by the Association, but will have to be replaced, as necessary, by the Unit owner. 2. The limited common area inside the patio fence is reserved for maintenance and planting by the Unit owner. 3. Residents should not alter the landscaping of the common areas nor expand or change the color and texture of the mulch beds. 5. Pots and planters may not be affixed to the structure of the Unit, but may be attached to the inside of the patio fence. It is the Unit owner's responsibility to repair any holes made when affixing the planters. All dead planters are to be removed promptly. 6. Each Unit is permitted one planter in the mulch area. An additional planter may be placed between the garages. It may be paid for and maintained by one or both of the Unit owners. No other fiowerpots or decorative accessories are permitted outside the patio area. Pots are not permitted on the walkways. Planting of vines around the base of a unit's lamppost is not permitted. 7. Flowers are permitted in the mulch areas. Annuals and perennials 18 inches or less in height may be planted. Spring bulbs are permitted, but must be trimmed after they have bloomed. These, also, must be 18 inches or less in height. 8. Bird feeders are not permitted. Residents should not feed the wild zinimals. I. HOLIDAY DECORATIONS 1. Christmas lights and decorations may be displayed from the day after Thanksgiving through January 8. Only low wattage (under 3 watts) white non-blinking lights may be used. 2. Lights may be attached to the fence and adjacent bushes, but not to the unit or any of the brick walls. 3. Decorations, such as wreaths, may be placed on the front door or the outsides of the windows. Large suction cups are recommended for window wreaths. Swags may be placed on the outside window ledges. 4. Holiday decorations, but no flags or banners, may be placed in the Unit's shrub bed to commemorate the following holidays: Easter, Fourth of July, 7
5 Halloween, Thanksgiving and Christmas. These decorations, except for Christmas, may be displayed from 15 days before the holiday through three (3) days after it. Christmas decorations, however, may be displayed from the day after Thanksgiving through January For any other recognized holidays, decorations may be displayed from four (4) days before the holiday through three (3) days after it. J. IMPACT ON INSURANCE No Unit owner should permit any use of his/her Unit or of the Common Elements that would increase the insurance rate upon any part of the property. K. NOISE 1. No Unit owner should make or permit any disturbing noises that would interfere with the rights, comfort and convenience of other Unit owners. 2. No Unit owner should play a musical instrument or operate a television, radio or other amplified device in his/her Unit in such a manner as to disturb or annoy other residents. L. NUISANCES No immoral, improper, offensive or unlawful use of the property will be tolerated. All valid laws, ordinances and regulations must be observed. Use of common property to access adjacent property. The hillside where the landslide occurred IS NOT to be used as a path or access to adjacent property that is not owned by Jefferson Pointe Condominium Association. If hunting of wild animals is permitted on adjacent property, access to that land through Jefferson Pointe is not permitted by ANYONE who lives in Jefferson Pointe, is a relative of a resident or who is just looking for a parking spot. No resident or guest may walk on the hillside without the permission of the property manager or board of directors. If disturbing the hillside terrain results in damage that would be cause for further repair of the hillside, the resident who commits the infraction or who gives permission for such activity will be linedimmediately and charged for any repair to the hillside. M. OUTDOOR FURNITURE. 1. Outdoor furniture is permitted on the patio only. 2. Gas lanterns and torches are not permitted. 3. Electronic devices for eliminating insects are not permitted. N. OUTSIDE LIGHTS The post lamps are the major source of outdoor light for the community. The ianips are controlled by a photo sensor which turns the lights on at dusk and off at dawn. Because this light provides added safety to the community, it must not
6 be disabled by any obstruction. Homeowners are responsible for replacing burned out light bulbs. (Suggestion: Any unit ownerwho is unable to replace the burned out light bulb might ask an able neighbor or friend to do this.) limes are not to be planted at the base of a lamppost. 1. Lights along walkways and spotlights are not permitted. Any additional lighting or motion detectors require a "Request for Change" and Board approval. 0. PARKING 1. The "on street parking" places are for guests' use only. They are not to be used by hunters seeking access via the hillside where the landslide occurred to adjacent property where hunting may be permitted. Such parking will be considered "trespassing" and residents giving permission for such parking will be fined immediately for the blatant infraction to the rules and regulations of the Jefferson Pointe Condominium Association. 2. Residents may use "on street parking" places on an occasional basis, but the Executive Board must approve any long-term use. 3. Street parking is prohibited. Guests must park in the driveway or guest parking area. 4. Vehicles with "For Sale" signs in their windows are not permitted in driveways or guest parking areas. 5. Residents may park up to two (2) vehicles in the area directly in front of their garage door. 6. No commercial trucks or vans used by residents at theirjobs, trailers, motorcycles, boats, campers or other recreational vehicles may be parked in the driveways of the Units. 7. Only minor vehicle repairs, those taking less that 24 hours, are permitted in the driveways. 8. At no time is a vehicle to be parked in a driveway in a way that it denies access to another unit. 9. Any resident who will be having guests park in the visitors' parking lots for more than three (3) days should notify a Board of Directors' member prior to the guest's arrival. P. PIPES AND DRAINS 1. No drain, water closet, shower, etc. should be used for any purpose other than for which it was designed. 2. Refuse or other improper articles should never be thrown into a drain. 9
7 3. The cost of repairing any damage to a building's plumbing will be charged to the Unit where it occurred. Q. WALKS AND ENTRANCES All walks, entrances, driveways and Common Elements must remain unobstructed to allow freedom of access by all residents. R. SCOOTERS AND SKATEBOARDS 1. No scooters or skateboards are allowed. 2 Bicycles are allowed only in Unit owners' driveways and street areas. 2. Bicycles are not allowed in the Gazebos. 111
