1 WYCOMBE MANOR HOMEOWNERS ASSOCIATION RULES AND REGULATIONS January 2016 July 2017 (revised) March 2018 (revised) The following rules and regulations are designed to make living in Wycombe Manor Townhomes pleasant and comfortable for each member of the Association. The cooperation and consideration of each member is vital for the mutual benefit of all. This Wycombe Manor Rules and Regulations replaces all previous versions. The Articles and Sections provided in parentheses refer to the specific Articles in the Declaration of Covenants, Conditions and Restrictions for Summerfield North Wycombe Manor Associates as recorded at the Wake County Register of Deeds Book 3246, Page 378, February 24, See the procedures for homeowners attendance at the Wycombe Manor Homeowners Association Board Meetings at the end of the Rules & Regulations. I. General Homeowners Responsibilities A. Annual Assessments: (Article V, Section 7) Monthly dues (assessment) are due and payable by each homeowner on the first of each month. A late charge of $10 will be added if not received by the end of the month. B. Tenants: Tenants must comply with the rules, regulations, and legal documents of the Association. Tenants must be properly informed of these responsibilities by the owner of the home. Any damage done by tenants to the exterior or common areas will be charged to the respective homeowner. C. Noise: Being thoughtful of ones neighbors is especially important in a community such as Wycombe Manor. Loud noises from televisions, stereo equipment, musical instruments, annoying pets and other disturbances should be avoided at all times and especially between the hours of II:00 PM and 8:00 AM. II. Exterior Maintenance by HOA (Article VII) A. It is the responsibility of the HOA to maintain the following exterior portions of each home and community common area: 1. Roofs, gutters, and downspouts. a) Includes surface and subsurface drainpipes that are connected to downspouts from multiple homes. 2. Exterior building surfaces: Siding, trim, window frame and front steps. 3. Exterior Improvements: Sidewalks, curbs, driveway and parking areas, area lights, entrance signs. 4. Landscape: Trees, shrubs and grass. a) This includes the community common area and all homes front yard and the side yards of homes at the end of each building. 5. Damage to Property: In the event that the need for exterior maintenance by the Association, as set forth in Article VII of the Declaration, is through the willful or negligent act of the owner, his family, guests or invitees, or his tenant, employees, or is caused by fire, lightening, thunderstorm, hail, explosion, riot, attending a strike, civil commotion, aircrafts, vehicles and Wycombe Manor Rules & Regulations Page 1
2 smoke as the foregoing are defined and explained in North Carolina Fire and Extended Coverage Insurance Policy, the cost of such maintenance or repair shall be added to and become a part of the assessment to which such lot is subject. III. Exterior Maintenance by the Homeowners A. It is the responsibility of the homeowner to maintain the following exterior portions of each home: 1. Maintenance, upkeep and repairs of patio / deck, screens, screen doors, exterior doors, and windows and associated hardware for all listed items. (Article IX, Section 12) Please refer to the attached Wycombe Manor Homeowners, Maintenance Responsibility. 2. Porch added after the original building construction is the responsibility of the homeowner for maintenance. 3. Landscape a) Homeowner is responsible for landscaping immediately adjacent to the rear of the home. (1) Homeowner, at their expense including upkeep, may plant shrubs, flowers and grass in their rear yard and maintain portions or their entire rear yard. Yard must be maintained in a neat and orderly manner. (2) Plantings and homeowner yard maintenance may not hinder the HOA ability to perform maintenance of the exterior of the house and the remaining yard space and common areas. IV. Architectural Control (Article IX, Section 4) A. Prior to any exterior modifications, alterations or additions to a home or grounds including but not limited to, window and door replacement, deck improvements, shrubs, and planters a request must be submitted in writing to the HOA Board for approval. The HOA Board or architectural control committee may approve or deny changes at their discretion in accordance with the governing documents. A written reply will be made to all requests within 30 days of the date management receives the request. 1. Fences are not allowed. 2. Construction of decks and porches: After approval by the Board, but prior to the start of construction, the homeowner shall provide a copy of the City of Raleigh Building Permit to the Management Firm. V. General Rules (Article IX, Section 16) A. Community Common Area & Landscaping 1. Homeowners shall not plant any vegetation in the community common areas. 2. Homeowners may not place any item on the community common areas. (Examples: benches, birdbaths, bird feeders, lawn hoses, borders, flower containers, etc.) 3. Homeowners shall not dispose of trash and yard debris in community common areas. 4. Homeowners shall not allow ground cover to grow on siding and brickwork. Homeowner shall also not allow ground cover to encroach on adjacent home lot or the Community Common Area Wycombe Manor Rules & Regulations Page 2
3 5. Homeowner shall not plant any vegetation in their front yard without prior written approval of the Board. This includes the side yard of homes at the end of each building. Exclusion to this rule: a) Homeowner may plant annuals / perennials in the front yard planting bed without HOA Board Concurrence with the following general requirements: (1) The existing planting bed may not be expanded without permission of the HOA Board; (2) Annuals / perennials are to be maintained at a height not to exceed 12-inches at maturity in front of all shrubbery; (3) Flowerbeds shall be maintained by the homeowner in a neat, weed free and visually appealing manner; (4) Flowers shall be deadhead as appropriate and shall remove all flowers at the end of their useful life; (5) Only approved borders, black plastic edging, shall be used for flower beds; (6) Flowerbeds that are not maintained, upon notification, shall be removed at homeowner s expense; and (7) Decorative flowerpots may be used with flowers or small shrubs on the front step and porch of the home following the same guidelines as listed above. B. Clotheslines: Clotheslines are not permitted on the property. C. Exterior Antennas / Satellite Dishes: (Article II, Section 7) No outside antennas of any kind are allowed. Satellite dishes less than 39 inches in diameter are allowed with architectural approval of the location. Dish installation shall not damage the exterior building surface and be in the least visible location as possible. D. Firewood: Firewood should be stacked neatly in the back yard in order to provide a neat appearance. It should not be stacked in contact with the building deck, siding, or foundation due to a termite hazard. Wood may be stored in metal frames of neat appearance and appropriate for storage of wood. Firewood should be at all times screened from view of neighboring townhomes or detached single-family dwellings. E. Hazards: The discharge of firearms, fireworks, or any other noisemaking or explosive device or as may otherwise be prohibited by City of Raleigh Ordinance, is not permitted at any time within the boundaries of Wycombe Manor. F. Parking: (Article II, Section 4 & Policy Resolution , Assigned Parking, dated 9/26/89) 1. For the convenience of each member, two assigned parking spaces have been provided for each home. 2. Guests shall park in the visitor parking spaces 3. Parking is not permitted on the grass, in medians, or along throughways. 4. No boats, trailers, campers, commercial vehicles, or recreational vehicles shall be allowed in any parking space or in any common area of Wycombe Manor. 5. Due to the limited amount of parking spaces no homeowner can acquire a third assigned parking space. G. Pets: Dogs, cats, and other domestic pets are allowed under the following conditions: 1. They do not disturb or annoy residents or guests. Any inconvenience, damage, excrement or unpleasantness caused by a pet shall be the sole Wycombe Manor Rules & Regulations Page 3
4 responsibility of the pet owner. 2. Pets should be kept under direct control of their owners at all times. 3. Pets shall not be allowed to run free or otherwise interfere with the comfort and convenience of residents or their guests. 4. It is the sole responsibility of the pet owners to clean up after their pet. 5. Please be considerate of your neighbors and comply with this City of Raleigh ordinance. H. Propane Tanks: Installation of propane tanks shall be approved by the HOA Board in writing. Regardless of size, tanks must be located at least 10 feet from any electrical source (electrical outlets, heat pump compressors, etc.). A tank must be a minimum of 3 feet away from any crawl space. Latticework must shield tanks from view. The location of the propane tank shall be located in conformance with State and local codes. I. Signs (Article IX, Section 9) 1. No signs are permitted on the common area unless approved by the HOA Board. 2. For Sale or "For Rent" signs are allowed but no larger than five (5) square feet. The sign must be placed within the edge of the home landscape bed. 3. Advertising signs are not allowed within Wycombe Manor. 4. Political signs supporting a candidate for an upcoming election are allowed only on private property with the following constraints: a) Placed within the front edge of the home planting bed; b) Placed no sooner than ninety (90) days prior to the date of the election for the candidate. c) Signs must be removed within seven (7) days after the election. J. Flags / Banners: 1. One flag of nominal size 3 ft. x 5 ft. on a flagpole mounted on the face of the home, 2. One decorative garden banner of nominal 12 in. x 18 in. size, 3. The following are the specifically approved flags / banners, to the exclusion of all others: a) Flags of the United States of America b) A State Flag c) Flags of the USA Armed Forces d) A school / sports team flag. e) A decorative banner. K. Toys, Bicycles and Skateboards: Toys and so forth, when not being used, should not be left in common areas or in the front yards. Please be considerate of your neighbors by keeping a neat yard. L. Trash and Debris Pick-up: 1. Trash and yard waste pick-up is provided by the City of Raleigh every Tuesday. 2. Recycle pick-up is provided by the City of Raleigh every other Tuesday. 3. City bins must be used for trash and recycle. 4. Yard waste must be in clear plastic bags and tied in a bundle. 5. City requirements for trash, recycle and yard waste can be found at the following City web site: aration.html 6. Please put bulk trash out late Monday or Tuesday morning. Do not litter the curbs with bulk trash throughout the week Wycombe Manor Rules & Regulations Page 4
5 7. Bins and yard waste should be confined to the rear of homes until the day for collection. 8. Bins should be returned to the rear of your home by Tuesday night. 9. Pool Trash Dumpster: The trash dumpster at our Summerfield North Pool is only for the trash from the pool and tennis court activities. M. Termite Control 1. The HOA provides an annual termite protection that includes a warranty against termite damage for the homes. 2. The crawl space for each home is inspected annually. Homeowners will be notified if conditions are found that are considered conducive to attracting termites. (i.e. standing water, insulation hanging down, wood, paper products) Upon notification, homeowners will be required to correct the condition or possibly be liable for future termite damage for their home and adjacent home(s). N. Snow / Ice Removal: 1. The Homeowners Association (HOA) does not provide treatment to minimize snow / ice accumulation before a winter storm event or for the removal after a winter storm event. 2. The HOA is not responsible for personal injury or property damage that may occur to the homeowners, family members, or invited guests due to the accumulation of snow / ice on the Wycombe manor property. 3. Homeowners, as they may choose to do, are responsible for the removal of snow / ice from their steps, decks, walks, and parking spaces. 4. In removing snow / ice, homeowners may not cause other homeowners additional difficulty by piling removed snow / ice on adjacent homeowner s area that they may need to be cleared for access to their home. VI. Pool & Tennis Facilities (Added 07/24/17) A. Homeowners in the Wycombe Manor Community, by payment of their monthly assessment dues, are automatically members of the pool and tennis court facilities. B. The pool schedule and rules are sent out to members at the beginning of the pool season. The information can also be obtained from the HOA management firm. C. There is no charge for out of town guests and in town family members for Wycombe Manor Homeowners. VII. Violation of the Rules and Regulations (Added 07/24/17) A. It is the HOA s Management Firm s responsibility to monthly review the buildings and grounds of the community and when specifically requested by a specific homeowner. B. Homeowners that have a question about the Wycombe Manor Rules and Regulations shall notify our Management Firm. C. The Wycombe Manor Board (the Board ) shall serve in the capacity of an adjudicatory panel for the purposes of enforcing the Declaration of Covenants, Conditions and Restrictions for Summerfield North-Wycombe Manor Associates recorded in Book 3246, Page 378, Wake County Registry, and as may be amended from time to time (the Declaration) in like manor as permitted by N.C. Gen. Stat. 47F ; D. That the Board will follow the procedure set forth in N.C. Gen. Stat. 47F regarding noticing Owners of violations of the Declarations, and noticing hearings before the Board to determine whether the Owner is in fact in violation of the Wycombe Manor Rules & Regulations Page 5
6 Declaration; E. That in the event an Owner receives a Notice of Results of Fine Hearing letter from the Board following the hearing, the Owner shall have fifteen (15) days from the date of the Notice of Results of Fine Hearing letter to appeal the Notice of Results of Fine Hearing letter to the Executive Board at Summerfield North for a new hearing to be set at a date, time, and location mutually agreeable between the parties; and F. That following the expiration of any such fifteen (15) day appeal period, or in the event the Executive Board at Summerfield North affirms the Board s decision, the Summerfield North Wycombe Manor Homeowners Association, Inc. shall thereafter be the entity charged with enforcing the Board s decision by way of a Claim of Lien and other appropriate enforcement action as permitted by N.C. Gen. Stat. 47F-3-116, and other applicable law. G. Procedures for handling violations: 1. Upon a vote of the Board that there is a violation, homeowner will be notified by US First Class Mail, Return Receipt Requested. 2. Homeowner will have the number of days, as indicated in the letter, from the date of the letter of notification of violation to correct the problem addressed in the notice. The HOA Board and all Homeowners appreciate your cooperation in complying with these Wycombe Manor rules. 7 Schedule and Procedures for Attendance at Wycombe Manor Board Meetings Board Meetings: - By-Laws Article VI, Section I, Regular Board Meetings: At the time of this issue, Regular Board Meetings are held on the 4 th Monday of each month at 6:00 pm with the exception of the month of December. The time and day for the meeting can be changed for the convenience of the Board Members without notice to the homeowners. - By-Laws Article VI, Section 2, Special Board Meetings: Special meetings can be called by the President of the HOA or 2 of the Board Members with not less than three (3) days notice to each Board Member and without notice to the homeowners. - Homeowners may contact the HOA Management Firm to obtain information concerning the schedule of the Regular Board Meetings. Information concerning Special Board Meetings may not always be available from the HOA Management Firm. - Minutes of Board meetings are available 45 days after the date of the Board Meeting and can be obtained by requesting the minutes from the HOA Management Firm. Attendance at Board Meeting - Homeowners are welcome to attend the Board Meetings based on the following guidelines: o Board requests that homeowners planning to attend notify the Management Firm at a minimum of two (2) workdays prior to the date of the Board Meeting. (i.e.: Notify by the end of business Wednesday for a Monday Board Meeting.) This request is to assure we can provide adequate room for homeowners attending the Board Meetings. o Homeowners should submit a request for the Board s consideration a minimum of one week prior to the meeting date. o Homeowner Forum: Homeowner s comments will be limited to 5 minutes per person prior to the start of the Board meeting. o Homeowners are allowed to observe the meeting, but not interject throughout the discussion process. o Please note that some issues presented by the homeowner may not be considered for Board discussion and a possible vote until the next scheduled meeting. o Homeowners will be asked to step outside when the Board addresses issues regarding owner s property in an executive session. o Individuals attending community meetings shall show respect to all those in attendance. Individuals that are disruptive or using inappropriate language at the meeting will be asked to leave. Should disruptive behavior continue the meeting may be adjourned at the discretion of the Board.
