1 Pine Court Condominium Association Rules and Regulations REVISION North Potawatomi Road, Williams Bay, WI Pine Court is a condominium complex with full time and part time residents. Pine Court is not a hotel or resort, but a home to many. Please conduct yourself accordingly and reinforce all condominium Rules and Regulations with your family, guests and renters. A copy of these Rules and Regulations should always be kept available in the Unit for these parties to refer to and become familiar with. Your Board of Directors (the Board ) has the responsibility of maintaining a quality of lifestyle for the enjoyment of all Unit Owners, while at the same time running a fiscally responsible not-for-profit organization and protecting the investment of the Unit Owners of the 28 Units in Pine Court. In order to maintain the quality status of our development and Association, it is absolutely necessary that all owners, guests, and renters adhere to these Rules and Regulations. The Association acknowledges that violations of the Rules and Regulations have an impact to the Association Unit Owners and guests for which damage may be difficult to quantify. Individuals who purchase a condominium must recognize that for the common good of all Unit Owners certain Rules and Regulations have to be followed by all Unit Owners, renters and their guests. Every man considers his home his castle and himself the king thereof, but this sovereign right to use his property as he pleases must yield, at least to some degree, when ownership is in common with others. The individual should not be permitted to disrupt the integrity of the common good through his desire for change, however justified that change might be. The Board and the Property Manager and its representatives are responsible for the enforcement of the Rules and Regulations. If corrective action is needed, complaints will be referred to the Board. Quiet Hours Policy A formal quiet hour s policy has been established to promote a quiet and enjoyable living environment within our community. Residents are not permitted, at anytime, to produce any loud noise or disturbance, which will interfere with the comfort or well being of other residents. Unit Owners are responsible for the actions of their guests, visitors and/or renters. Quiet hours are from 10:00 p.m. to 8:00 a.m. Monday through Sunday. Noise is not is permitted within these times. Noise is defined as any sound disruption that significantly interrupts sleep and the quiet enjoyment of your neighbors. Fines. Fining can be used by your Board to resolve repeat offenders to the Association s noise policy. Upon Board approval, the noisemaker can be assessed a fine for repeat disturbances. Upon the first disturbance the noisemaker will be provided a written warning; on the second disturbance a $25.00 fine; on the third disturbance a $50.00 fine; and on the fourth disturbance a $ fine. General House and Ground Rules 1. Unit Owners shall not cause or permit anything to be placed on the outside walls of any Building, and no sign, awning, canopy, shutter, radio or television antenna shall be affixed to or placed upon the exterior walls or roof or any part thereof, without the prior written consent of the Board. 1

No noxious or offensive activity shall be carried on in any Unit or in the Common Elements, nor shall anything be done therein, either willfully or negligently, which may be or become an annoyance or nuisance to the other Unit Owners or occupants. 3. No clothes, sheets, blankets, laundry of any kind or decorations shall be hung out or exposed on any part of the Limited or Common Area Elements. The Common Elements shall be kept free and clear of rubbish, debris, and other unsightly materials 4. Windows: No blankets or sheets shall be allowed to cover windows after 7 days of initial notice. 5. There shall be no bicycles, vehicles, benches or chairs on any part of the Common Elements except that personal property may be stored in the storage areas that may be designated for that purpose and patio areas may be used only for their intended purpose. 6. No For Sale or For Rent signs, advertising or other display shall be maintained or permitted on any part of the Property except at such location and in such form as shall be determined or permitted in writing by the Board. Signs or banners are not permitted on the outside of any building, on the interior of any building visible from the outside or on any outside common area unless approved by the Board 7. No part of the Property shall be used for other than housing and related common purposes for which the Property was designed. Each Unit is to be used for residential purposes only. 8. No business, trade or profession of any kind shall be conducted or permitted on any part of the Property. Soliciting of any type is prohibited anywhere on the Property. 9. Children shall be properly supervised at all times. Use of skateboards and baseball bats are prohibited anywhere on the Property. Badminton and volleyball nets are not permitted on the grounds. 10. Do not allow anyone to enter a building without proper identification. All building entrance doors must be kept locked. Never block or prop open any door. 11. Keep garage doors closed at all times for both security and aesthetic purposes and to keep animals out. 12. Keep hallways, walkways and stairwells clear of all personal items for safety and aesthetic reasons. 13. Smoking is not permitted at any of the building entrances or in the lobbies, hallways or any indoor common areas. 14. Feeding birds or other wild animals, or throwing anything (especially cigarettes) from any balcony is prohibited. 15. Any Unit Owner desiring to add or change any structural or mechanical elements of their Unit must submit in writing a set of plans describing the proposed changes for the Board s approval. The Unit Owner is advised that there are statutory requirements which must be satisfied and that the Unit Owner must bear all associated expenses and attorney s fees in meeting said statutory requirements 16. Barbecuing with propane gas or open flame is prohibited at any time. All gas or open flame grills must be moved at least 10 feet from the building or any combustible structure. Electric grills are authorized on patios and decks. Extreme care and caution must be used when barbecuing outside. Any and all repairs for damages sustained to the building exterior or other common areas as a result of the use of a grill will be the full responsibility of the Unit Owner. Unit Owners should exercise extreme care in the use of grills and in making certain that their barbecuing complies with Williams Bay Fire Department Ordinance, does not annoy other Unit Owners, or their personal property. Entry Unit door locks must not be added or changed without Property Manager approval. All locks must be keyed to the master key in case of fire, water damage or other emergencies. 17. During the period October 1 through April 30, it is mandatory that all residents must have their heat on and set no lower than 60 degrees Fahrenheit. Additionally, residents are required to shut off the water supply to their individual unit when they are gone for an extended period of time (more than 72 hours). Violators will be subject to a fine. 18. Glass, cans and newspapers must be placed in the proper recycling containers. Cardboard boxes should be flattened. All other trash should be placed in heavy plastic containers and placed in the proper receptacle. Unit Owners are responsible for arranging large item pickup directly with the rubbish company. 19. No burning of leaves, rubbish, etc. will be permitted anywhere on the Property. 2
3 20. Common Elements shall not be obstructed, littered, defaced or misused in any manner. Unit Owners will be responsible and charged accordingly for all damages caused by their guests or renters. 21. Carpeting of any type is not allowed on outside wooden decks. 22. No personal decor is allowed on the front of buildings without written Board approval. Some personal decor' is allowed on rear decks. That stated chimes, flags, and no hanging baskets are allowed. No personal items including screening or additional lighting are prohibited. Parking and Driving 1. Use reasonable and prudent speed (under 5 M.P.H.) when driving within the confines of Pine Court, especially on weekends and holidays. 2. Unpaved areas shall not be used for the parking or operation of any vehicles, boats, watercraft, trailers, motorcycles, motorbikes, watercraft, snowmobiles, golf carts or other recreational vehicles. 3. No boats, trailers, camper trailers, motor homes, motorcycles, motorbikes, watercraft, snowmobiles, or other recreational vehicles or personal property shall be kept and maintained in the driveway appurtenant to each Unit for a continuous period in excess of 72 hours without Board approval. 4. No motor vehicle shall be parked in the driveway appurtenant to a Unit for a continuous period in excess of 72 hours. 5. No driveway or any portion of the outside common areas or the limited common areas appurtenant to each Unit shall be used to store any inoperable, covered or stored vehicles or other personal property. 6. Commercial vehicles of any type are not permitted to park overnight in any parking area other than in a garage. The term commercial vehicles includes, but is not limited to all automobiles, station wagons, trucks, vans and all other vehicular equipment which bears signs, symbols or has printing thereon or makes any reference to any commercial undertaking or enterprise. 7. Unit owners are limited to having two personal vehicles on the property at all times. 8. Unit owners are responsible for the clean up of oil leaks or spills in driveways. 9. The Board requests that unit owners utilize their garages for parking, as the parking on the property is limited. For ONLY unit owners in Buildings, 3,4, and 5 owners can park ONE vehicle in-front of their garage door. Parking this vehicle in-front of your garage may not limit other units from accessing their garage or access with their vehicles. [REFERENCE IMAGE 1 OF THE RULES AND REGULATIONS FOR MORE INFORMATION ON LOCATION. ] Pet Policy 1. Only traditional household pets like dogs, cats, birds and fish are permitted. 2. No animal shall be kept or bred for commercial purposes. 3. Total number of dogs, cats and their offspring per residence is limited to All pets shall be registered and inoculated as required by applicable law. 5. No pets are permitted to run at large. All pets must be kept restrained or on a leash at all times when on the grounds. 6. All damage created by a pet is the sole responsibility of the pet owner or the Unit Owner if the pet owner is a renter. Damage to Association property will be repaired by the Association and reasonable repair costs billed to the Unit Owner. 7. Pet owners shall clean up immediately after their pet messes. If necessary, reasonable cleanup costs plus a $25.00 fine for each occurrence will be charged to the pet owner or the Unit Owner if the pet owner is a renter. Complaint Procedure. If a pet is being offensive, the offended party should first talk with the pet owner and request correction. If the offense continues, written details should be submitted to the Board (or Property Manager) explaining the offense, time, place, pet description, pet owner's name, address, 3
4 etc. Rental Rules Fines Fine Provision. Pet owners (unit owners) are subject to a fine of $25.00 for each violation of this Pet Policy and an additional $15.00 per day until remedied. Pet Removal Provision. Pets that repeatedly violate this policy may be required by the Board to be permanently removed from the Property. In such case, the pet owner (or the Unit Owner if the pet owner is a renter) will be given a 30 day notice to remove the pet from the Property. If the pet is not removed by the deadline, a fine of $20.00 per day will be chargeable to the Unit Owner and subject to normal collection procedures established by the Association. 1. Owners shall not lease any Unit for a period of less than 6-months. 2. A maximum of 32%, or nine (9) units may be rented out. 3. Lessees/Renters are not allowed to have a pet (dog or cat). A tenant who harbors an unauthorized pet will be fined $ per violation. 4. Upon entering a lease agreement, the Unit Owner shall notify the Board in writing of the name(s) of the tenants and the term of the lease. A copy of the lease will kept on file with the Association for the duration of the lease. As part of the lease agreement, the Unit Owner will insure the tenant is provided a copy of the Declaration, Bylaws and Rules and Regulations. 5. Lessees have full use of the facilities subject to the Rules and Regulations of the Association and its Declaration and Bylaws, as amended from time to time. 6. Subletting by lessees is not permitted, nor is a lessee allowed to have guests overnight when the original lessee is not present. 7. Lessees and their guests are subject to all Rules and Regulations adopted by the Board. The lessee must have a copy of the current Rules and Regulations attached to the lease at the time it is filed with the Board. Violation of the Rules and Regulations by a lessee may result in imposition of an assessment of a fine or fines as otherwise provided for in these Rules and Regulations, which assessment of a fine or fines will be against the Unit Owner. The Association, therefore, has determined and agrees that fair compensation for a violation of the Rules and Regulations is liquidated damages of $ per violation. Such liquidated damages will be assessed against a Unit Owner should a violation occur. Right of Appeal Appeals must be received in writing by the Property Manager (Lakes Property Management, 910 Wells Street, Lake Geneva, WI 53147) within 14 days after the Unit Owner receives the Rules and Regulations Violation Notice. If the violator is a renter, the Unit Owner or the Unit Owner s management agent must make the appeal. Once an appeal is received, the Property Manager will schedule a meeting with the Board of Directors as soon as possible, but no later than 30 days to review the matter with the Unit Owner and/or the Unit Owner s management agent. No further fining will take place pending the outcome of the appeal. If the Property Manager does not schedule a meeting within the 30 days as required, the matter may be considered dropped. The Board s decision on the appeal is final. If the appeal is rejected, fines and other provisions become effective 3 days following written notification to the Unit Owner. 4
5 Collections All fines, costs and expenses necessary to enforce the Rules and Regulations will be levied against the Unit Owner and shall be an assessment against the Unit Owner's property and subject to all lien and collection powers of the Association. In all instances, the Bylaws shall govern the management and operation of the Condominium, except as otherwise provided in the Condominium Declaration, including any restrictions on or requirement respecting the use and maintenance of the Units and the Common Elements. A copy of these disclosure documents was supplied to you at closing and has been duly recorded with the Walworth County Register of Deeds.
