2 Village of East Dundee Kane County, IL Planning & Zoning Commission February 9, 2017 Chairman Brewer called the Planning & Zoning and Historic Commission meeting to order at 7:04 pm. Roll: 6 Present (Brewer, Steneck, Schock, Muscat, Holliman and Bernstein). 3 Absent (Scarpelli, Meyer and Apke). Also present were Deputy Village Administrator Jennifer Johnsen and Village Clerk Katherine Holt. APPROVAL OF MINUTES: 1. Planning and Zoning/Historic Commission Meeting Minutes January 12, 2017 Motion to approve the January 12, 2017 meeting minutes by Schock/Steneck. 6 Ayes (Brewer, Steneck, Schock, Muscat, Holliman and Bernstein). 0 Nays. 3 Absent (Scarpelli, Meyer and Apke). Motion carries. PUBLIC COMMENT: None NEW BUSINESS: 1. PUBLIC HEARING- On an application for a variance for 220 Dundee Avenue, East Dundee Illinois. The requested variance is from section (G)(4) for a variance from the required 40 rear yard to allow for the expansion of the existing building located in the rear of the property and reduce the rear yard to 2.16 Motion to open the Public Hearing by Steneck/Holliman. Motion carries by unanimous vote. Chairman Brewer stated that the petitioner, Jaime Velazquez, is not present. Court reporter swears in Sharon Huck of 180 Dunbar Lane, a neighbor adjacent to the property requesting the variance. Ms. Huck stated that Mr. Velazquez plans to extend his building by 37 feet. She said there is already a lot of noise coming from the property from truck traffic in addition to the noise from trucks nearby at Wolf Driving School. She asked if there is a need to add to the commotion that already exists. She also stated that she thought the cemetery property was never to be used for anything other than the cemetery itself. Chairman Brewer replied that the lot is part of Mr. Velazquez s property, not the cemetery property. Court reporter swears in John DeGroot of 179 Dunbar Lane, a neighbor adjacent to the property requesting the variance. Mr. DeGroot said he is just a concerned neighbor as well with the same concerns that Ms. Huck voiced. Commissioner Holliman suggested that Mr. Velazquez start over with his request and the process since he is not here this evening and this matter has been continued once before already. Commissioner Schock suggested the request be denied. Motion to close the Public Hearing by Muscat/Steneck. Motion carries by unanimous vote. Ms. Huck asked what business Mr. Velazquez is running out of the rear of the property. Chairman Brewer responded that he runs a car repair business. Deputy Administrator Johnsen stated that it is very unusual to have a two foot setback from the property line. Brewer said that Mr. Velazquez owns the property and he should have realized that he couldn t do a building expansion upon purchasing the property.

4 Village of East Dundee Memorandum To: Planning and Zoning Commission CC: From: Subject: Robert Skurla, Village Administrator Jim Kelly, Building Inspector Joe Heinz, Village Engineer Date: March 9, 2017 Jennifer Johnsen, Deputy Village Administrator 620 Dundee (Former Walmart) - Rezoning Plote Property Management, LLC has submitted a zoning application to rezone the property located at 620 Dundee from the B3- Service District to the M1- Manufacturing District. The intent of the map amendment is to allow for the development of the East Dundee Commerce Park which will consist of retrofitting the vacant Walmart building and constructing two buildings on the existing parking lot area for both commercial and industrial users. The attached application includes the zoning application, project narrative, alta survey, preliminary engineering plans, proposed elevations and renderings, and preliminary landscape plan. Per Village Code Section and existing case law, for all map amendments, the Planning and Zoning Commission must consider the following factors. For each of these factors, I have provided you with the Village s response in italics. 1. Existing uses of property within the general area of the property in question. Village Response: Uses within the general area include retail, restaurant, amusement, automotive, and residential north of Route 72. Just east of the property is undeveloped farmland owned by Plote that may be developed in the future. 2. The zoning classification of property within the general area of the property in question. Village Response: All incorporated adjacent property is zoned B3 Service District. B2 Community Business and B4 Automotive Service District are also within the general area and R-1 Single Family is north of Route 72. Plote owns property immediately east of the subject property that is not incorporated and is zoned F District Farming and F2 District-Agricultural related sales, service, processing, research, warehouse and marketing special uses under Kane County. This land may be rezoned for a future use. The future land use plan of the Village s Comprehensive Plan calls for general business and multi-family residential on this property. 1

5 3. The suitability of the property in question to the uses permitted under the existing zoning classification. Village Response: The property is designed for uses permitted within the B3 - Service Business District and was previously occupied by Walmart which was a permitted retail use.. 4. The trend of development, if any, in the general area of the property in question, including changes, if any, which have taken place since the day the property in question was placed in its present zoning classification. Village Response: Recent development will include the construction of a Speedway fueling center, truck wash, and retail uses at the intersection of Christina Drive and Route 72 within the Terra Business Park. The future trend of development in the Terra Business Park is industrial development. The unincorporated property just east of the property may become manufacturing although the Village s Comprehensive Plan calls for general business and multi-family. Lastly, the Village is still in the process of attempting to recruit a grocery store for the former Dominick s property. 5. The extent to which property values are diminished by the particular zoning restrictions. Village Response: The property has only been vacant since June As such, there has not been sufficient time to determine the impact on the value of the property due to the zoning classification. 6. The extent to which the destruction of property values of promotes the health, safety, morals, and general welfare of the public. Village Response: N/A 7. The relative gain to the public as compared to the hardship imposed upon the individual property owner. Village Response: The public will gain an occupied commercial/industrial park in place of a vacant storefront. The property owner should testify regarding the hardship in filling the vacant storefront with another big box retailer or other permitted use. 8. The length of time the property has been vacant as zoned considered in the context of land development in the vicinity of the subject property Village Response: The property has been vacant since June 2016, approximately one year. 9. The community need for the proposed use. Village Response: The Village s Comprehensive Plan acknowledges the Village s position to attract office and limited industrial due to its proximity to expressways. The petitioner should provide additional documentation on the need for the proposed commercial/industrial uses. 2

6 10. The care with which the community has undertaken to plan its land use development. Village Response: The Village updated its Comprehensive Plan in The Future Land Use Plan within this Comprehensive Plan calls for General Business at this location.
