BOARD OF SUPERVISORS PUBLIC HEARING ITEMS FOR CONSIDERATION: 1. Proposed Sale of County-Owned Affordable Dwelling Unit On May 1, 2013, the Loudoun County Board of Supervisors approved the County s purchase of Affordable Dwelling Units (ADUs) at risk of leaving the program through a market sale, using funds allocated from the County of Loudoun Housing Trust. These ADU homes were purchased with the intent of reselling them to qualified ADU program certificate holders through the established resale process. A contract has been placed by a qualified ADU program certificate holder on one (1) home owned by the County. The purchase price of the home is $94,269 for McFadden Square, #306, Sterling, Virginia The sales price is equal to the ADU price plus a 1.5% real estate commission. The sale of County owned property requires a Public Hearing. The critical action date is at the pleasure of the Board. Proposed Amendments to Chapter 209 of the Codified Ordinances of Loudoun County/Voting Precincts and Polling Places (Pinebrook, Legacy, and Creighton s Corner Precincts) At the May 2, 2017, Business Meeting the Loudoun County Board of Supervisors (Board) forwarded (7-0-2: Higgins and Meyers absent) the Proposed Amendments to Chapter 209 of the Codified Ordinances of Loudoun County/Voting Precincts and Polling Places to the June 14, 2017, Board Public Hearing. The Office of Elections and the Electoral Board is requesting that the Board of Supervisors amend Chapter 209 to reflect the addition of three new precincts. The changes would affect precincts 313-Pinebrook, 314-Legacy, and 316- Creightons Corner in the Blue Ridge Election District. The addition of the three new precincts is necessary primarily due to rapidly increasing precinct sizes and the need to keep lines manageable during General Elections. Funds to cover the costs of adding the additional precincts, including voting equipment, personnel, supplies, and notifying the voters have been included in the FY 2017 and FY 2018 budgets in anticipation of these changes being needed. Action must be taken no later than the July 20, 2017, Board Business Meeting in order to comply with requirements that localities must enact changes to precincts/polling places no later than 60 days prior, and voters must be notified no later than 15 days prior to the General Election on November 7, On April 6, 2017 the Loudoun County Electoral Board recommended (3-0) that the Board enact these

SPEX , SPEX , ZMOD , SPMI , & SPMI / Morley Corner Child Care Center NLD Ashburn, LLC, of Minneapolis, Minnesota, has submitted the following applications to establish a Child Care center use within the planned Morley Corner development: 1. A Special Exception (SPEX) to permit any one permitted use within a PD-CC- (NC) (Planned Development Commercial Center (Neighborhood Center)) zoning district to exceed 5,000 square feet. 2. A Special Exception to permit any one permitted use which exceeds fifty percent (50%) of the gross floor area of the neighborhood center in which it is located. 3. A Zoning Ordinance Modification (ZMOD) to reduce the minimum required number of parking spaces from 48 to A Minor Special Exception (SPMI) to reduce the minimum size of the required outdoor play area from 10,650 square feet to 8,150 square feet. The subject property is approximately 1.74 acres in size and is located in the northwest quadrant of the intersection of Romans Drive/Red Rum Drive and Ashburn Village Boulevard, at Romans Drive. The area is governed by the policies of the Revised General Plan (Suburban Policy Area, Ashburn Community), which designates this area for Keynote Employment land uses at a recommended FAR of up to 1.0. The Planning Commission (Commission) held a public hearing on the applications on January 24, No members of the public spoke regarding the applications. Commissioners discussed the site layout and the location of parking spaces for the pick-up and drop-off of children. The Commission forwarded (8-1: Keirce opposed) the applications to the Board of Supervisors (Board) with a recommendation of approval. The Board considered the applications at its March 15, 2017 Public Hearing. No members of the public spoke regarding the applications. Board members discussed site access and layout, and requested that the applicant revise the proposed layout in order to improve internal site circulation, enhance the safety of the pick-up and drop-off area, and facilitate ingress and egress. The Board forwarded (6-0-3: Letourneau, Meyer, and Saines absent) the applications to the April 13, 2017, Transportation and Land Use Committee (TLUC) meeting for further discussion. The applicant agreed to extend the timeline. Following the Board Public Hearing and subsequent meetings with the District Supervisor and staff, the applicant submitted a revised plat utilizing two existing entrances to replace the prior single-entrance proposal. Because of changes to the parking modification request to accommodate the two-entrance alternative layout, staff determined that the applications will require a second Public Hearing before the Board. The applicant s request to modify the minimum amount of outdoor play area did not change.
3 Page 3 TLUC discussed the applications on April 13, After reviewing the submitted plat as well as an alternative layout provided by the applicant at the TLUC meeting, TLUC expressed a preference for the layout provided in the TLUC Action Item (with amendments as requested by TLUC). TLUC recommended (5-0) that the Board direct staff to advertise the applications for rehearing on the June 14, 2017 Board Public Hearing agenda, and to include in the advertisement any changes identified by TLUC that would require notification. TLUC also directed staff to research options for zoning modifications or Facilities Standards Manual (FSM) waivers to accommodate more parking spaces. The applicant agreed to extend the timeline. The Board considered the applications at its May 2, 2017, Business Meeting. The Board directed (8-0-1: Higgins absent) staff to advertise the applications for rehearing on the June 14, 2017, Board Public Hearing agenda. The revised plat submitted by the applicant addresses staff s layout concerns. Regarding the outdoor play area reduction, staff notes that the Board has authorized initiation of an amendment to the outdoor play area standards for child care uses as part of the 2017 Zoning Ordinance Amendment Work Program, and the applicant s play area modification request is generally consistent with staff s likely recommendation for amended child care center standards. As such, staff s concerns regarding the outdoor play area reduction have been addressed. The critical action date is June 14, Election District: Ashburn Staff Contacts: Steve Barney & Ricky Barker, Planning and Zoning 4. ZRTD / Dulles North Industrial Park Lot 2 DNIP 2, LLC, of Frederick, Maryland, has submitted an application to convert approximately 10 acres from the PD-IP (Planned Development-Industrial Park) zoning district under the Revised 1993 Zoning Ordinance in effect in 2007, to the PD-IP (Planned Development-Industrial Park) zoning district under the Revised 1993 Zoning Ordinance, as amended. The subject property is also located within the Route 28 Taxing District. The subject property is approximately 10 acres in size and is located along the south side of Maries Road (Route 638), west of Cascades Parkway (Route 637), and east of Dulles Eastern Plaza, at and Maries Road, Sterling, Virginia. The area is governed by the policies of the Revised General Plan (Suburban Policy Area (Sterling Community) and Route 28 Corridor Plan) which designate this area for Route 28 Business uses at a recommend FAR of 0.4 to 1.0. The Planning Commission (Commission) held a public hearing on this application on March 28, There was one speaker who testified on the application who raised concerns over storm water management, potential road improvements, and a future traffic signal. Staff followed up with the Commission by stating the previously approved Proffers associated with ZMAP address storm water management and transportation commitments required by the Applicant. The Commission forwarded (9-0) the application to the Board of Supervisors (Board) with a recommendation of approval subject to the Proffer Statement, and based on the Findings of Approval.
4 Page 4 The Board held a public hearing on this application on May 10, During the hearing, two members of the public, who represented real property interest in the adjacent property to the west (known as Maries Road, Lot 3), expressed concerns over storm water management impacts from the subject property (Lot 2) onto their property, future vehicular access being blocked on their property due to transportation improvements that will be made by the Applicants, and lighting impacts. The Board voted (8-0-1: Umstattd absent) to forward the application to the June 6, 2017, Business Meeting and requested that staff to work with the applicant and the adjacent property owners to resolve the aforementioned issues. On May 16, 2017, staff from Building and Development and the Planning and Zoning Departments met onsite with the property owners of Lot 3 to address their concerns. These staff members, along with Supervisor Saines, will continue to work with the applicant and also with the adjacent property owners to address concerns related to the proposed site work; however, the site plan process remains ongoing and is independent of the ZRTD application before the Board. Subsequent to the Board vote on May 10, 2017, staff determined that the public hearing advertisement did not reflect the correct Floor Area Ratio (FAR) for the application and that a new public hearing would be necessary. Staff supports the Board s approval as the proposal is generally consistent with the Route 28 Business Policies. The critical action date is November 22, Election District: Sterling Staff Contacts: Jacqueline Marsh & Ricky Barker, Planning and Zoning 5. ZRTD / Sterling Self-Storage The purpose of this application is to convert approximately 3.8 acres from the PD-IP (Planned Development Industrial Park) zoning district under the 1972 Zoning Ordinance to the PD-IP (Planned Development Industrial Park) zoning district under the Revised 1993 Zoning Ordinance, as amended. The approval of the application would allow for the development of all principal and accessory uses permitted in the PD-IP Zoning District under the Revised 1993 Zoning Ordinance. The subject property is located at Cascades Parkway, Sterling, Virginia. The 3.8-acre site has frontage on both Cascade Parkway and Woodland Road. The area is governed by the policies of the Revised General Plan (Suburban Policy Area (Sterling Community) and Route 28 Corridor Plan) which designates this area for Route 28 Business uses with a recommended Floor Area Ratio (FAR) of 0.40 to 1.0. The Planning Commission (Commission) held a public hearing regarding the application on April 25, No members of the public spoke regarding the proposal. The Commission forwarded (9-0) the application to the Board of Supervisors (Board) with a recommendation of approval. Staff supports the Board s approval of the conversion of the zoning of the subject property to the Revised 1993 Zoning Ordinance in accordance with the policy direction of the Revised General Plan. The critical action date is November 22, 2017.

ZMAP , SPEX , ZMOD & ZMOD / Evergreen Meadows Evergreen Mills Road, LLC, of Ashburn, Virginia, has submitted applications for the following: 1. A Zoning Map Amendment (ZMAP) to rezone approximately 1.92 acres from the CR-1 (Countryside Residential-1) zoning district to the PD-IP (Planned Development Industrial Park) zoning district in order to develop a facility for lessons in dance, gymnastics, judo and sports training. 2. Two Zoning Modifications (ZMOD) to reduce the minimum size of the PD-IP district and to reduce minimum parking and building yard requirements (i.e. setbacks) to adjacent residential properties. 3. A Special Exception (SPEX) to permit a child or adult daycare center use in the CR-1 zoning district and eliminate a required internal landscape buffer adjacent to the proposed dance facility use. The subject property is approximately 4.43 acres in size and is located on the south side of Evergreen Mills Road (Route 621), and west of Briarfield Lane / Belmont Ridge Road. The area is governed by the policies of the Revised General Plan (Suburban Policy Area (Dulles Community)) which designates this area for business uses at a recommended FAR of up to 1.0. The Planning Commission (Commission) held a public hearing on the application on April 25, One member of the public expressed general concerns regarding the applications, and one member of the public spoke in favor of the applications. The Commission forwarded (9-0) the applications to the Board of Supervisors (Board) with a recommendation of approval. The Commission s motion included the addition of two PD- IP uses to the proffered list of uses to be prohibited on the property, and the applicant agreed to this proffer amendment. Staff supports the Board s approval of the ZMAP, ZMOD and SPEX applications, subject to Proffer Statement and Conditions of Approval.
