Letter regarding Army Corps of Engineers approval process Background The Preliminary Plat for this property was approved by the Planning & Zoning Commission on September 16, 2013 by a vote of with Commissioner Froeshner opposed. The Preliminary Plat was approved with the condition that the applicant provide a copy of the approval from the Army Corps of Engineers to construct a roadway through the jurisdictional wetlands in the northwest quadrant of the site. On September 18, 2013, a letter from SMC Consulting, Inc. was provided to the City s Engineering Department explaining that the permit was approved by the Army Corps of Engineers by default (attached). Infrastructure plans were subsequently approved by the Engineering Department on February 6, The proposed final plat is consistent with the approved preliminary plat and master plan for Sedona, Section 4. Site and Surrounding Area The property is undeveloped and relatively flat with areas of high brush throughout the property. A letter was submitted by the applicant indicating there were no protected trees on the property and confirmed by the City Arborist. 2 Water & Sewer Fire Response Wetlands Water service will be provided by an existing 8-inch waterline along the west side of Juniper Road from Sedona, Section 3 and an existing 8-inch water line on the north side of Grey Kirby Drive from Brittany Lakes, Section 16. Sanitary Sewer will be provided by 10-inch sewer line on the north side of Sedona Drive in Sedona, Section 3 and an existing 15-inch sewer line on the south side of Grey Kirby Drive from Brittany Lakes, Section 16. The Engineering Department indicates that water and sewer capacity are adequate for the development in this area. Fire Station #2 will be the first responding station with Fire Station #5 being the secondary fire station responder. As mentioned, the northwestern portion of the property has been identified as being jurisdictional wetlands. The applicant has proposed to conserve the wetlands by classifying the wetlands as HOA parkland, and a note has been place on the plat indicating that the wetlands will be maintained in a natural state with no clearing or construction allowed on the property. Parks Fees Parks fees were paid on July 7, 2014 in the amount of $1,000 per lot, totaling $151,000. Municipal Compliance of Regulations Staff finds that the plat conforms to the subdivision regulations of Section 102 of the League City Municipal Code and Section 212 of the Texas Local Government Code.
