The Zoning Ordinance requires phasedd developments be approved by the Planning and Zoning Commission. The first phases will be located along South Shoree Boulevard and East League City Parkway (SH 96). The rear lot will be developed in the future as a potential officee park, and the frontage lots will be developedd with retail and restaurant uses. Any substantial changes to the r Development Plan will have to be approved by the Planning and Zoning Commission. The area is auto-dominant commercial in character and is classified ass Enhanced Auto-dominant Commercial inn the City s Comprehensive Plan: Future Land Use Plan. Zoning & Land Use Utilities Development Regulations The subject property is within the Hidden Lakes Planned Unit Development (PUD). The PUD was adopted in May 2004 and is vested under the 2003 Zoning Ordinance. The Plan calls for the property to be developed with general commercial uses. The retail building, Lot A, will be developedd using the 2003 Zoning Ordinance, and thee remainder of the development will use the current Zoning Ordinance. The Engineering Department indicates that the water and sewer capacity are adequate to serve this development. Water service will be providedd by a 12-inch waterline to be constructed along the south side of East League City Parkway (SH 96) and an 8-inch water line running throughh the property. Sanitary sewer will be provided by an 8- inch sewer line within the property, which feeds to South Shore Boulevard. Development Regulations include setbacks, height, landscaping, and parking as shown below. Setbacks 2003 Zoning Ordinance Requirement: The Nonresidential Dimensional Standards include a minimum front yardd setback of 25 feet. Current Zoning Ordinance Requirement: The minimumm front yard setback is zero feet. Proposed: The proposed development has structures setback beyond thee required 25 feet. The side and rear yard setbacks are based on the following: 2003 Zoning Ordinance Requirement: Side Yard Setback: For single-story 15 feet, whichever is smaller. For two- and three-storyy structures, the minimum side setback shall be 15 feet. Forr structures over three stories, the minimumm side setbackk shall be 15 feet, plus one foot per story or fraction thereof to a maximumm of 20 feet. structures, the minimumm side setbackk shall be equal to at least 10 percent of the lot frontage orr Rear Yard Setback: Rear setback shall be 10 feet for single-story structures; 25 feet for two to three stories; overr three stories add one foot for each two feet of height over three stories, to a maximum setback of 50 feet. Wheree rear adjacent property is an existing commercial or industrial development, the rear setback shall be 25 feet. Current Zoning Ordinance Requirement: Side Yard Setback: 20 feet when adjacent to nonresidential; 40 feett when adjacent to residential. Rear Yard Setback: 20 feet when adjacent to nonresidential; 40 feet when adjacent to residential. Proposed: Each structure will be setback beyond the required side and rear yard setbacks. Height 2003 Zoning Ordinance Requirement: There is no maximum height requirement for this development. Current Zoning Ordinance Requirement: The maximumm height of a structure is 125 feet. Proposed: The Plan states that no building shall exceed 125 feet in height. Landscaping 2003 Zoning Ordinance Requirement: Fifteen percent of the site is required to be comprised of landscapee material. Current Zoning Ordinance Requirement: Fifteen percent of the sitee is required to be comprised of landscapee material. Proposed: The proposed Plan does not address Landscaping. 3 Parking 2003 Zoning Ordinance Requirement: Each use on thee property requires a different parking ratio per the Zoning Ordinance. The numbers that they have provided for parking counts meet the ordinance. Current Zoning Ordinance Requirement: Each use off the property will require a different parking ratio. Thee numbers that they have provided for parking counts meet the ordinance. Proposed: The parking was calculated for the Plan and meets the overalll parking requirements.
