The undersigned has requested copies of the land offering package and further information pertaining to the Property. Such land offering package, together with any other documents or information provided to the undersigned by Agent regarding the Property shall be referred to collectively as the Information. In consideration of the foregoing and other good and valuable consideration, the undersigned hereby agrees that it will keep the Information confidential, and will not disclose the Information to any Person or entity except for reasonably necessary disclosures to attorneys, accountants, partners, and other consultants of the undersigned. The undersigned further agrees to promptly return all original copies of the documents included in the Information received by the undersigned, and all photocopies of such documents made by the undersigned and its attorneys, accountants, partners and other consultants, to Agent if requested to do so in writing by Agent. The undersigned hereby indemnifies and holds harmless the property owner and Agent from any damage, loss, liability or expense, including attorney s fees, arising out of any breach of any of the terms of this Agreement. The undersigned certifies that all information relative to this offering will not be disseminated to or used by any principals or parties other than those stated hereunder. If the undersigned will be working with a real estate company other than Agent ( Co-Broker ) the undersigned will disclose the Co-Broker below. Two rights are for domestic use. Two private water rights are for irrigation of 289 acres using ground water pumped from on-site wells. Boise-Kuna Irrigation District delivers irrigation water from the Boise River to the property. Annual assessments authorize irrigation of 378 acres. Farming Operation There is currently a tenant farmer on the property. Structures on Property One house consisting of 2,203 SF, built in 1947 per county records. 5 PRIVATELY-OWNED WATER RIGHTS The review of water right records maintained by IDWR indicates there are two water rights which authorize irrigation use of groundwater from wells on the two parcels south of East Bennett Road. No privately-owned water rights were found on the parcel north of East Bennett Road. Two additional privately-owned water rights authorize domestic and/or stockwater uses from a well located on the east side of APN R The water rights are summarized in Table 1. The location of each water right is shown in Figure 2. The water rights for irrigation shown in Table 1 authorize a total irrigated area of 289 acres within the acre area south of East Bennett Road. Two wells are authorized for irrigation use in the southwest corner of APN R Instantaneous diversion rate from the wells is limited to a maximum of 5.78 cubic feet per second (cfs) (approximately 2,594 gpm), and annual volume is limited to 1,300.5 acre-feet (ac-ft). The irrigation water rights could thus provide 4.5 ac-ft per acre (1,300.5 ac-ft/289 acres), which is considered a full supply of irrigation water in southwest Idaho and would be sufficient for most agricultural crops commonly cultivated in the area. A decree in the Snake River Basin Adjudication has been issued for each irrigation water right an no further action is required at this time. A decree in the Snake River Basin Adjudication has been issued for each domestic water right and no further action is required at this time. Each decree includes the following standard conditions: 1. The quantity of water under this right shall not exceed 13,000 gallons per day. 2. The quantity of water decreed for this water right is not a determination of historical beneficial use. The most common interpretation of this language is that 13,000 gallons per day is the maximum volume that could be diverted under the individual right, but each right is limited to the actual volume historically diverted and used. 6 BOISE-KUNA IRRIGATION DISTRICT DELIVERY Boise-Kuna Irrigation District (BKID) provides irrigation water to the Property and authorizes irrigation of acres within the acre boundaries of the three property parcels. (See Table 2, Boise-Kuna Irrigation District Assessments). In a normal water year, BKID delivers water from the Boise River at a standard rate of up to 3.75 acre-feet per acre (the standard assessment). An additional allotment may be available each year based on the remaining storage in the system. An additional fee is charged for volumes delivered in excess of the standard assessment.
