21 Rule #2 Meetings One of the ways to ensure success is to meet with impacted property owners on site at their house to show them mapping, aerial imagery and a list of trees or areas that are potential obstructions.

22 Rule # 3 Information Sharing Explain the process that there are Federal & State Aviation Regulations, the Who, What, When, Where, Why and What s in it for the property owner. Briefly discuss Eminent Domain and how that could work but in a non threatening manner. yyyyyyy1.

27 Easements vs Right Of Entry Agreements The preferred course of action is an Easement, but when that effort becomes contentious or time critical the pursuit of the ROE may be an option to explore. The intent of the easement is to have control over the property, the ROE gives the airport limited control over a period of time and can renegotiate in the future.

28 Right Of Entry (ROE) Agreements are borne out of a hybrid of Temporary Construction Easements (TCE) used by highways. The TCE gives the Airport the opportunity to perform the obstruction removal under the ROE Agreement.

29 ROEs are TEMPORARY, QUICK and in most cases CHEAP No Appraisals/Review Appraisals No property surveys No easement recordation at courthouse No legal cost for easement language prep No payment for the easement No change to the ALP or cost to do so (for adding the easement and parcel number)

30 Justification for ROEs vs Easements 1. Inability to easily secure the easement 2. Unwillingness to use eminent domain 3. Urgency of the removal of an obstruction 4. Unexpected loss of night ops due to trees 5. Unplanned or unforeseen issues (new AC) 6. Hazard Zoning effect on valuations

31 Uniqueness of the Indiana Project: This project is atypical of the normal process largely because of the fact that it began 6 months BEFORE the new AIP Handbook issuance on and FAA coordination permitted it to proceed using ROEs in lieu of easements.
