3 NATIONAL INSTITUTE OF PUBLIC FINANCE AND POLICY NEW DELHI NOTICE INVITING TENDER FOR HIRING OF 125 KVA and 250 KVA DG SETS NIPFP, New Delhi invites sealed tenders in two-parts from bonafide and resourceful owners and suppliers of Diesel Generator Sets of 125 and 250 KVA capacity, on hire basis. The D.G. Sets should be capable of supplying continuous power of at least 90% of t h e rated output at the frequency of 50 Hz, to N I P F P installations/equipment s during power failure/load shedding at any point of time. Eligibility Criteria : (i) The bidder firm should be a Proprietorship/Partnership concern/pvt Ltd company, incorporated in India a n d should h a v e set up facilities f o r h i ring DG sets in Delhi/NCR. (ii) The bidder firm should have successfully and satisfactorily executed a minimum of two works, per year, of providing DG sets on hire basis, during last 3 years ending , to Central / State Government/ Public Sector Undertaking, or reputed Public Ltd/Pvt. Ltd Companies and supporting documents to this effect should accompany the bid. (iii) The bidding firm should have a turnover of minimum R s l a c s for the year ended Copies of the assessment orders or tax returns filed for the periods ended , and should accompany the bid. (iv) The bidder should have g o t allotted to itself Service Tax/VAT registration and TIN by the appropriate Govt Authorities and proof (self attested photocopies) should be enclosed with the bid.

4 Procedure for submission of Bid: The technical and commercial bids shall be submitted by the bidder in two separate envelopes: Envelope No 1(Part 1) shall be superscribed as: Technical Bid for Hiring of one each of 125 and 250 KVA Diesel Generator Sets to be installed at NIPFP Premises and shall contain the following documents: (a) Tender Application Money and EMD in the form of DD of Rs and Rs. 10, respectively. (b) The documents stated in the eligibility criteria and details of DG sets as per Annexure- IIA & III enclosed along with the Tender. Note : Envelope No.1 shall not contain any information on price/rate/charges. Envelope No 2(Part 2) shall be superscribed as: Financial Bid for Hiring of one each of 125 and 250 KVA Diesel Generator Sets to be installed at NIPFP premises and shall contain the following documents: (a) Price Bid in the format enclosed with the tender document at Annexure- II Envelope No.1 and Envelope No.2 should be put in another sealed cover, superscribing OFFER for Hiring of one each of DG set each of 125 and 250 KVA to be installed at NIPFP p r e m i s e s, New Delhi and submitted to NIPFP, New Delhi by 3:00 P.M on SCOPE OF WORK The scope of services for hiring the D.G. Sets shall be as under: ( a ) The bidder should be agreeable to provide New silent Diesel Generator set one each of 125 KVA and of 250 KVA capacity, on hire basis, sound proofed with canopy. (b) The bidder shall provide an operator to operate and maintain the DG sets at the N IP FP p r emises, along with its control panel, protection and standard rating 4 pole switch fuse unit near DG set or in canopy and remote ON & OFF control of reputed make/brand like Kirloskar Green, Greaves, Cummins India, Mahindra, Ashok Leyland or other reputed make/brand, conforming to relevant I.S. specification and as per pollution control norms. (c) The operator shall be provided by the bidder for operating and maintaining the DG sets from 8:00 A.M. to 6:00 P.M [ all seven days of the week].

5 (d) Supply a n d installation of accessories like cables, change-over switches etc. for supplying generator power to a n y point in t h e NIPFP s premises will be made by the vendor at their own cost. However, the vendors may inspect the site before quoting the rates. Cabling work has already been done. For any additional cabling requirement, it will be the entire responsibility of the vendor (s). (e) All costs to loading, unloading, transportation, shifting, and installation of DG Sets as well as complying with local Government Regulations, Maintenance and Servicing of the Generating Sets including the cost of spare parts, periodical replacement and topping up of Mobil oil, are to be borne by the bidder except for fuel i.e. diesel which will be provided by NIPFP. (f) The vendor will make arrangements for obtaining necessary clearance/ permission from the statutory authorities f o r installation and operation of D.G. Sets[ at NIPFP site] at its own cost. However, any fee, except penalty, if payable to the statutory authorities, for obtaining such cl e aran c e/ permission will be re-imbursed to the vendor by the N IPFP on submission of proper documentary evidence. (g) The location of DG sets with sound proof canopy and main switches will be at the back side of the car parking area of the premises. (h) The successful bidder should be in a position to install and commission the D.G. Sets at the NIPFP premises within 30 ( Thirty ) days from the date of awarding of the contract. (i) The vendor may be required to dismantle the components of D.G. sets and reassemble those components at identified location(s) of the NIPFP s premises, for the purpose relocation i.e. installation and commissioning of generating set, if required, for which no extra charges will be paid by the NIPFP. TERMS & CONDITIONS The terms and conditions for hiring D.G. Sets are as under 1.The bidder should be agreeable to provide one D.G. set each of K V A a n d 250 KVA capacity, on hire basis, in sound proof enclosure with canopy. The bidder shall provide operator to operate and maintain the DG sets at the NIPFP site, as per schedule given under scope of work. 2. Rates are to be quoted for monthly rental charges including the cost of operator, for D.G. Set along with its control panel, Protection and 400A rating 4 pole switch fuse unit near DG set or in canopy and remote ON & OFF control at basement of reputed make/brand like Kirloskar Green, Greaves, Cummins India, Mahindra, Ashok Leyland or other reputed make/brand, conforming to relevant I.S. specification and as per pollution control norms. The rental charges should include the charges for providing an operator for D.G. set during the period from 8:00 A.M. to 6:00 P.M. on (all 7 days of the week).

6 3. All costs to loading, unloading, transportation, shifting, and installation of DG Sets as well as complying with local Government Regulations, Maintenance and Servicing of the Generating Sets including the cost of spare parts, periodical replacement and topping up of Mobil oil, are to be borne by the bidder, except for fuel i.e. diesel which will be provided by NIPFP. 4. The tenders shall remain valid for a period of 90 (Ninety) days from the date of opening. 5. The D.G. Sets offered on hire basis should be new. 6.The D.G. Sets should be maintained properly to ensure that the same are in satisfactory running condition, at all times, for supplying power in emergency for a load, at least, of 90% of the capacity of generators. 7. For running the D.G. set, fuel i.e. diesel will be filled by the operator. He shall maintain proper record of diesel consumed along with meter reading. 8. The vendor will himself make arrangements for obtaining necessary clearance/permission from the statutory authorities for installation and operation of D.G. Set at NIPFP premises, at its own cost. However, any fee, except penalty, if payable to the statutory authorities, for obtaining such clearance/permission will be re- imbursed to the vendor by NIPFP upon production/submission of proper documentary evidence. 9. Supply and installation of accessories like cables, change-over switches etc. for supplying generator power to any point in NIPFP s premises will be made by the vendor at their own cost. The quoted rate is inclusive of sheet steel enclosure 400 A 4 Pole on load change over switches and suitable size on One number of 240 sq. mm OR two number of 120 sq. mm 3.5 or 4 core Aluminum Conductor armored cable for DG set to change over switch, (cable, if required- as the cabling work has already been done). 10. The vendor is to submit the following details of proposed DG sets to be provided on hiring for which price bid is submitted : a) Engine make, model, capacity and year of manufacture b)alternator make, model, capacity, year of manufacture c)facility to remote operation of DG set d)make, model and capacity of main SFU(Switch Fuse Unit) near DG set and on load change over switch. e)make of power and control cable. f) Fuel consumption per liter at 25%, 50% and 90% of load. 11.The arrangements for disposing exhaust of the D.G. Set, as per requirement and specification of Statutory Authorities will be in the scope of the supplier. 12.The location of DG sets with sound proofed canopy and main switch will be a t t h e b ack side of car parking area of NIPFP premises. 13.The charges for transportation, loading a n d unloading of the D.G. Set for installation of the same at the NIPFP s premises will be borne by the supplier. Costs towards mending of any damage caused to the NIPFP s property during loading/unloading of the D.G. Sets inside the NIPFP s premises to its original finish will be borne by the bidder.

7 14. The successful bidder should be in a position to install and commission the D.G. Sets at the NIPFP s premises within 30 (Thirty ) days from the date of awarding the contract. 15. The vendor may be required to dismantle the components of D.G. sets and re-assemble those components in identified location(s) of the NIPFP s premises for the purpose of relocation i.e. installation and commissioning of generating set, if required, for which no extra charges will be paid by the NIPFP. 16.The contract will remain in force initially for a period of one year from the date of satisfactory commissioning of the D.G. Set at site. However, the contract is subject to termination at any time, by giving one month notice ( on either side ) if the services are not found satisfactory or for any other reason whatsoever. The contract may be renewed for further period(s) at mutually agreed rates/charges and keeping other terms and conditions unchanged, depending on satisfactory services rendered by the supplier and requirement of the NIPFP. 17.In case of major break-down of the D.G. Set requiring repairing time for more than 2(Two) hours, an alternative DG set of the same or higher capacity will be made available by the vendor immediately, at no extra cost. In case of non-functioning of the D.G. Set and in the event of failure on the part of the vendor to provide an alternative generator of same or higher capacity, within two hours, penalty at double the pro-rata rate will be imposed and deducted from monthly bill of the generator for the period the generating set remains non-functional. 18.The successful bidder will have to execute an Agreement with the NIPFP in nonjudicial stamp paper of requisite value, as per the format given at Annexure I,, within 14 (Fourteen) days from the date of commencement of the contract. 19.The successful bidder will also have to furnish a performance security deposit in the form of Fixed Deposit Receipt for an amount equal to two month s accepted rental charges (including the charges of operator) for DG set, within 15 days from the date of commencement of the contract. The performance security deposit can also be submitted in the form of Bank Guarantee, issued by any scheduled commercial Banks, in a format acceptable to NIPFP and having validity for a period covering the contract period and claim period for additional one month. The performance security money is to be deposited with the NIPFP or the performance Bank Guarantee is to be furnished to the NIPFP for due performance of the contract. In case of non-performance of the contract by the vendor, the amount of performance security will be realized by the NIPFP by forfeiting the performance security deposit or invoking the performance Bank Guarantee, as the case may be. No payment will be made until the Agreement is executed and the performance security deposit is furnished. The performance security deposit will not bear any interest and the same will be refunded to the contractor within a reasonable period after the closure of the contract. If the performance security deposit is submitted in the form of Bank Guarantee, the Bank Guarantee will be discharged and returned after closure of the contract. 20.Tenders should be submitted along with the Earnest money deposit for an amount of Rs.10,000/- (ten thousand) by DD/Pay Order drawn in favour of NIPFP and payable at New Delhi. Tenders submitted without Earnest Money Deposit will be summarily rejected.

8 The Earnest money will not bear an y interest. The earnest money deposited by unsuccessful bidders will be refunded after awarding the contract to the successful bidder. The Earnest money deposited by the successful bidder will be refunded after execution of the Agreement and submission of performance security deposit, duly accepted by the NIPFP without any interest 21.The deployment of operator for running the generating set should comply with the labour legislation Act and minimum wage Act of Govt of India and the State Govt. The operators deputed at site shall follow NIPFP s security norms. 22.The contractor will have to remove the D.G. Set within 7 (Seven) days from the date of termination or closure of the contract, at their cost, else demurrage 1000/- (Rupees One thousand only) per day will be levied by the NIPFP on the contractor. Mending of any damage caused to the NIPFP s property during taking out the generator will be done by the contractor to original finish, at its cost. ` 23.If the successful bidder fails to perform the commencement of the contract within the specified time period, the earnest money deposited by the bidder will be forfeited. 24.The NIPFP reserves the right to reject any or all tenders without assigning any reason whatsoever. 25.The Contractor shall make all necessary arrangement as required by the NIPFP to ensure that no damage or disruption to the NIPFP is caused by the contractor or its agents/representatives/workers, in any manner,. If, in spite of his best efforts, any disruption, or loss occurs, the contractor shall reinstate and make it good as early as possible without any additional cost to the NIPFP. 26.The Contractor shall, at the request of the NIPFP, immediately dismiss from works any person employed thereon by him who may in the opinion of the NIPFP be unsuitable or incompetent or who may misconduct himself. Such discharges shall not be the basis of claim for compensation or damages against the NIPFP or any of their officers or employee. 27 Intending Bidder shall visit the site and make him thoroughly acquainted with the local site conditions, nature and requirements of the works. The Bidder shall provide in their tender for cost of carriage, freight and other charges as also for any special difficulties, including police restriction for transport etc. for proper execution of work as indicated. The successful Bidder will not be entitled to any claim of compensation for difficulties faced or losses incurred on account of any site conditions which existed before the commencement of the work or which in the opinion of the NIPFP might be deemed to have reasonably been inferred to be so existing before commencement of work. 28. In case vendor fails to provide services of operator, a penalty of Rs.500/- per day shall be imposed. 29 Payment shall be made after completion of the month on satisfactory service and submission of bill. Prescribed statutory deductions will be made f r o m t h e b i l l. The deduction shall be made on account of penalties as per tender Terms and conditions or any deficiencies observed during the month.

9 30.The Contractor shall be responsible for all injury to the worker or workmen or persons, animals or things and for all damages to the project works, materials, equipment, structural and/or decorative part of property which may arise from the operations or neglect of himself or of any sub-contractor or any of his or a sub-contractor s employees whether such injury or damage arise from carelessness, accident or any other cause whatsoever in any way connected with the carrying out of this contract. 31 Conditional tenders will be not accepted. 34. In case of any dispute between NIPFP and the contractor, the decision taken by the arbitrator who will be appointed by the NIPFP will be final and binding on the contractor. The case will be filed in Delhi High court.

10 AGREEMENT Annexure-I ARTICLES OF AGREEMENT made this.day of. Between National Institute of Public Finance and Policy, New Delhi [ NIPFP], a Society registered under the Indian Societies Registration Act (XXI) of 1860 (hereinafter called The Employer which expression shall unless excluded by or repugnant to the context be deemed to include its successor and assignee of the One Part and M/s... having its Address/Registered Office at. (hereinafter called the CONTRACTOR ) of the OTHER PART which expression shall include its successor/s and assignee/s. WHEREAS the Employer is desirous of executing Contract for Hiring of one DG set each of 125 KVA and 250 KVA capacity at NIPFP, 18/2 Satsang Vihar Marg, Special Institutional Area, New Delhi and has caused specifications describing the work to be prepared and/or to be prepared by NIPFP. AND WHEREAS the said specification as mentioned in the tender document (hereinafter mentioned), the specifications and the schedule of items & quantities have been signed by and on behalf of the parties hereto. AND WHEREAS the Contractor has agreed to execute upon and subject to the conditions set forth herein and in schedule of items and quantities, scope of services and terms & conditions as mentioned in the Notice Inviting Tender and all correspondence exchanged by or between the parties from the submission of tender till the award of work vide letter no dated, both letters inclusive, (all of which are collectively hereinafter referred to as the said conditions ), the work described in the said notice inviting tender and included therein at the rates set therein for and amounting to the sum of Rs..per month as therein arrived at and as mentioned in the schedule of quantities and rates or such other sum as shall become payable hereunder (Hereinafter referred to as The said Contract Amount ). NOW IT IS HEREBY AGREED AS FOLLOWS: 1. In consideration of the said contract amount to be paid at the time and in the manner set forth in the said conditions, the contractor shall upon and subject to the said conditions, execute and complete the work shown upon the said specifications and the schedule of items and quantities. 2. The Employer shall pay the contractor the said contract amount, or such other sum as shall become payable, at the time & in the manner specified in the said conditions.

The said conditions and appendices thereto shall be read and considered as forming part of this Agreement, and the parties hereto shall respectively abide by, submit themselves to the said conditions and perform the Agreement on their part respectively in the said conditions contained. 4. The following documents shall be deemed to form and to read construed as p a r t of this agreement, viz. i) Original tender document. ii) Relevant correspondence letters / correspondence forming parts of contract and referred to in acceptance letter. iii) Acceptance letter iv) Schedule of quantities/price Bid v) Other additional documents as required vi Articles of Agreement. 5. The contract for rental charges of D.G. sets is a fixed lump sum and are per month basis and initially for one year as per scope of work and schedule of rates & quantities described herein. 6. The contractor hereby agrees to commence the work, as specified in the notice inviting tender. 7. All payments by the Employer under this contract will be made at New Delhi on monthly basis. 8. Any dispute arising under this Agreement shall be referred to arbitration in accordance with the stipulations laid down in the conditions of contract. 9. That the several parts of this contract have been read and fully understood by the contractor.
