Any deviations ust be authoried in a perit odification in accordance ith Rule , F.A.C. Any deviations that are not so authoried shall subject the perittee to enforceent action and revocation of the perit under Chapter 373, F.S. (212). A coplete copy of this perit shall be kept at the ork site of the peritted activity during the construction phase, and shall be available for revie at the ork site upon request by the Agency staff. The perittee shall require the contractor to revie the coplete perit prior to beginning construction. Activities shall be conducted in a anner that does not cause or contribute to violations of state ater quality standards. Perforance-based erosion and sedient control best anageent practices shall be installed iediately prior to, and be aintained during and after construction as needed, to prevent adverse ipacts to the ater resources and adjacent lands. Such practices shall be in accordance ith the State of Florida Erosion and Sedient Control Designer and Revieer Manual (Florida Departent of Environental Protection and Florida Departent of Transportation June 27), and the Florida Storater Erosion and Sedientation Control nspectors Manual (Florida Departent of Environental Protection, Nonpoint Source Manageent Section, Tallahassee, Florida, July 28), unless a projectspecific erosion and sedient control plan is approved or other ater quality control easures are required as part of the perit. At least 48 hours prior to beginning the authoried activities, the perittee shall subit to the Agency a fully executed For (1), Construction Coenceent Notice indicating the expected start and copletion dates. f available, an Agency ebsite that fulfills this notification requireent ay be used in lieu of the for. Unless the perit is transferred under Rule , F.A.C., or transferred to an operating entity under Rule , F.A.C., the perittee is liable to coply ith the plans, ters and conditions of the perit for the life of the project or activity. Within 3 days after copleting construction of the entire project, or any independent portion of the project, the perittee shall provide the folloing to the Agency, as applicable: a. For an individual, private single-faily residential delling unit, duplex, triplex, or quadruplex- Construction Copletion and nspection Certification for Activities Associated With a Private Single- Faily Delling Unit[For (3)]; or b. Prior to sales of any lot or unit served by the activity and ithin one year of perit issuance, or ithin 3 days of as- built certification, hichever coes first, the perittee shall subit, as applicable, a copy of the operation and aintenance docuents (see sections 12.3 thru of Applicants Handbook Volue ) as filed ith the Departent of State, Division of Corporations and a copy of any easeent, plat, or deed restriction needed to operate or aintain the project, as recorded ith the Clerk of the Court in the County in hich the activity is located. b. Within 3 days of subittal of the as- built certification, the perittee shall subit Request for Transfer of Environental Resource Perit to the Perpetual Operation Entity [For (2)] to transfer the perit to the operation and aintenance entity, along ith the docuentation requested in the for. f available, an Agency ebsite that fulfills this transfer requireent ay be used in lieu of the for. The perittee shall notify the Agency in riting of changes required by any other regulatory agency that

Convey to the perittee any property rights or privileges, or any other rights or privileges other than those specified herein or in Chapter 62-33, F.A.C.; b. Convey to the perittee or create in the perittee any interest in real property; c. Relieve the perittee fro the need to obtain and coply ith any other required federal, state, and local authoriation, la, rule, or ordinance; or d. Authorie any entrance upon or ork on property that is not oned, held in easeent, or controlled by the perittee. Prior to conducting any activities on state-oned suberged lands or other lands of the state, title to hich is vested in the Board of Trustees of the nternal proveent Trust Fund, the perittee ust receive all necessary approvals and authoriations under Chapters 253 and 258, F.S. Written authoriation that requires foral execution by the Board of Trustees of the nternal proveent Trust Fund shall not be considered received until it has been fully executed. The perittee shall hold and save the Agency harless fro any and all daages, clais, or liabilities that ay arise by reason of the construction, alteration, operation, aintenance, reoval, abandonent or use of any project authoried by the perit. The perittee shall notify the Agency in riting: a. ediately if any previously subitted inforation is discovered to be inaccurate; and b. Within 3 days of any conveyance or division of onership or control of the property or the syste, other than conveyance via a long-ter lease, and the ne oner shall request transfer of the perit in accordance ith Rule , F.A.C. This does not apply to the sale of lots or units in residential or coercial subdivisions or condoinius here the storater anageent syste has been copleted and converted to the operation phase. Upon reasonable notice to the perittee, Agency staff ith proper identification shall have perission to enter, inspect, saple and test the project or activities to ensure confority ith the plans and specifications authoried in the perit. f any prehistoric or historic artifacts, such as pottery or ceraics, stone tools or etal ipleents, dugout canoes, or any other physical reains that could be associated ith Native Aerican cultures, or early colonial or Aerican settleent are encountered at any tie ithin the project site area, ork involving subsurface disturbance in the iediate vicinity of such discoveries shall cease. The perittee or other designee shall contact the Florida Departent of State, Division of Historical Resources, Copliance and Revie Section, at (85) or (8) , as ell as the appropriate peritting agency office. The perittee shall provide routine aintenance of all coponents of the storater anageent syste to reove trapped sedients and debris. Reoved aterials shall be disposed of in a landfill or other

5 Application No.: Page 4 of 5 GENERA CONDTONS uplands in a anner that does not require a perit under Chapter 62-33, F.A.C., or cause violations of state ater quality standards This perit is issued based on the applicants subitted inforation that reasonably deonstrates that adverse ater resource-related ipacts ill not be caused by the copleted perit activity. f any adverse ipacts result, the Agency ill require the perittee to eliinate the cause, obtain any necessary perit odification, and take any necessary corrective actions to resolve the adverse ipacts. A Recorded Notice of Environental Resource Perit ay be recorded in the county public records in accordance ith Rule (7), F.A.C. Such notice is not an encubrance upon the property.

Operation of the storater anageent syste shall be the responsibility of OSCEOA CORPORATE CENTER MASTER PROPERTY OWNERS ASSOCATON. Within one year of perit issuance or concurrent ith the engineering certification of construction copletion, hichever coes first, the perittee shall subit a copy of the recorded deed restrictions (or declaration of condoiniu, if applicable), a copy of the filed articles of incorporation, and a copy of the certificate of incorporation for the association. Prior to any future construction, the perittee shall apply for and receive a perit odification. As part of the perit application, the applicant for that phase shall provide docuentation verifying that the proposed construction is consistent ith the design of the aster storater anageent syste, including the land use and site grading assuptions. A buffer onitoring and aintenance progra shall be ipleented in accordance ith Exhibit No. 3. The onitoring progra shall extend for a period of 3 years ith annual reports subitted to District staff. At the end of the first onitoring period the itigation area shall contain an 8% survival of planted vegetation. The 8% survival rate shall be aintained throughout the reainder of the onitoring progra, ith replanting as necessary. f transitional and upland species do not achieve an 8% coverage ithin the initial year of the onitoring progra, native species shall be planted in accordance ith the aintenance progra. At the end of the 3 year onitoring progra the entire upland buffer area shall contain an 8% survival of planted vegetation and an 8% coverage of desirable upland species.

8 erp_staff_report.rdf PROJECT EVAUATON: PROJECT STE DESCRPTON: The site is located east of John Young Parkay, south of Osceola Parkay, south of the intersection of Centervie Boulevard and Greenald Way ithin the Osceola Corporate Center ot 8 - Basin 21 in Osceola County. There are peritted ater anageent facilities ithin the project area that this application proposes to odify, naely the relocation of the existing Pond 21. The site consists of pine flatoods, iproved pasture and a pond. There are no etlands or other surface aters located ithin or affected by the proposed project. Upland buffers and upland itigation previously provided as itigation are no proposed for ipact. (See the Wetlands discussion, belo.) PROPOSED PROJECT: Construction proposed consists of the stor ater anageent syste serving the iproveents to ot 8 Multi-Faily. The proposed iproveents ill consist of the construction of a ulti-faily apartent coplex ith associated aenities. The ater anageent syste ill consist of one et detention pond for the required ater quality treatent and attenuation prior to discharge fro the site and into Wetland 19 of the Osceola Corporate Center aster syste. The project liits lie ithin the ake Tohopekaliga Drainage Basin. Consistent ith previous perits, ater quality criteria consists of the greater of one inch of runoff over the drainage basin or 2.5 inches of runoff ties the percent ipervious coverage and is provided in excess in the design of the proposed stor ater anageent pond, Pond 21. The UMAM functional loss of the original etland ipact is calculated to be.68 UMAM units. Mitigation to offset the original etland ipact ill be the use of.63 fresh ater forested UMAM credits fro the Reedy Creek Mitigation Bank. (These credits had been previously acquired to offset ipacts under another project (Osceola Crossings, App. No , also ithin the the sae perit area). The ipact decreased and the perit as odified to credit back the.63 credits. (Those credits are being used no under this application.) An additional.5 App.no. : Page 4 of 8

A copy of the letter of reservation is attached as a part of Exhibit 3. n addition additional regrading of the buffer it is necessary adjacent to Wetlands 12 and 19, to the est and east of the project respectively. The buffers (totaling.68 acres) are proposed to be regraded and replanted. A planting and onitoring plan is attached as a part of Exhibit 3. Since the ipacts are teporary, to the buffer and, being replanted, no further itigation is required. A ork schedule for the activities is attached as a part of Exhibit 3. The Osceola Corporate Center currently contains acres of preserved etlands. This application includes the acquisition of additional itigation that ill be obtained fro the Hatchineha Ranch Mitigation Bank. As such, a sall portion of itigation ill be out-of basin vs. the large aount preserved on-site and therefore in-basin. staff has deterined that no unacceptable cuulative ipacts are anticipated as the result of the proposed activities. A partial release of conservation easeent covering the buffers and upland preservation area as approved at the Noveber 13, 214 Governing Board eeting. The efficiency of storater anageent systes, das, ipoundents, and ost other project coponents ill decrease over tie ithout periodic aintenance. The operation and aintenance entity ust perfor periodic inspections to identify if there are any deficiencies in structural integrity, degradation due to insufficient aintenance, or iproper operation of projects that ay endanger public health, safety, or elfare, or the ater resources. f deficiencies are found, the operation and aintenance entity ill be responsible for correcting the deficiencies in a tiely anner to prevent coproises to flood protection and ater quality. The applicant has indicated that deatering is required for construction of this project. Prior to any construction activities, the applicant ill subit a deatering application for District approval. This perit does not release the perittee fro obtaining all necessary Water Use authoriation(s) prior to the coenceent of activities hich ill require such authoriation, including construction deatering and irrigation. CERP: The proposed project is not located ithin or adjacent to a Coprehensive Everglades Restoration Project coponent. Potable Water Supplier: Toho Water Authority Waste Water SysteSupplier: Toho Water Authority Right-Of-Way Perit Status: A District Right-of-Way Perit is not required for this project. DR Status: This project is not a DR. HistoricalArcheological Resources: The District has received correspondence fro the Florida Departent of State, Division of Historical Resources indicating that no significant archaeological or historical resources are recorded in the project area and the project is therefore unlikely to have an effect upon any such properties. Planting Plan The proposed site plan for ot 8 requires grading ithin the upland buffer adjacent to etlands W-12 and W-19. A total of.68± acre of upland buffer ipacts are proposed (.18± acre of upland buffer to W-12 and.5± acre of upland buffer to W-19). Once construction activities and grading in the buffer are coplete, this.68± acre of disturbed upland buffer ill be re-planted ith native species including slash pine, ax yrtle and sand cordgrass. The slash pine and ax yrtle ill be alternated and installed on staggered 1-foot centers in to ros. The slash pine and ax yrtle speciens ill be 3-gallon or 7-gallon, hichever is readily available at the tie of planting. One-gallon speciens of sand cordgrass ill be planted in a single ro at the landard-ost liit of the upland buffer and ill be installed on 1-foot centers. Qualitative Monitoring The.68± acre of upland buffer plantings ill be qualitatively onitored for a period of three (3) years. The onitoring events ill occur on an annual basis in AugustSepteber, ith an annual report provided to SFWMD on or before Deceber 31 of each of the three years of onitoring.
