D. 10 CEQA : ENV MND LETTER OF CLARIFICATION Los Angeles Departent of Building and Safety On July 10, 2015, in accordance with provisions of Los Angeles Municipal Code (LAMC) Sections 17.03, the Advisory Agency approved Vesting Tentative Tract Map No SL for a axiu of eight (8) sall lots for the purposes of a Sall Lot Subdivision. On Deceber 17, 2015, the applicant subitted a letter requesting a clarification of Condition No. 17.n.1 of the Advisory Agency approval to address revisions to the setback atrix due to changes in the construction docuents affecting building locations in relation to the property lines. The requested clarifications will not result in a aterial change to the project. This letter clarifies Condition No. 17.n.1 of Vesting Tentative Tract Map No SL to change the setback atrix consistent with updated construction docuents as revised by the applicant.

This unit density is based on the RD1.5-1 Zone. (The subdivider is hereby advised that the LAMC ay not perit this axiu approved density. Therefore, verification should be obtained fro the Departent of Building and Safety, which will legally interpret the Zoning code as it applies to this particular property.) VTT SL Page 2 BUREAU OF ENGINEERING - SPECIFIC CONDITIONS That a 2-foot wide strip of land be dedicated along Cattaraugus Avenue adjoining the tract to coplete a 32-foot wide half right-of-way in accordance with Collector Street Standards. That if this tract ap is approved as Sall Lot Subdivision then, and if necessary for street address purposes all the coon access to this subdivision be naed on the final ap satisfactory to the City Engineer. That if this tract ap is approved as sall lot subdivision then the final ap be labeled as Sall Lot Subdivision per Ordinance No satisfactory to the City Engineer. That if necessary public sanitary sewer easeents be dedicated on the final ap based on an alignent approved by the Central Engineering District Office. That the owners of the property record an agreeent satisfactory to the City Engineer that they will provide nae signs for the coon access driveways. That any fee deficit under Work Order No. EXT00596 expediting this project be paid. DEPARTMENT OF BUILDING AND SAFETY, GRADING DIVISION 7. That prior to issuance of a grading or building perit, or prior to recordation of the final ap, the subdivider shall ake suitable arrangeents to assure copliance, satisfactory to the Departent of Building and Safety, Grading Division, with all the requireents and conditions contained in the Soils Report Approval Letter's dated January 29, 2014, Log No and May 20, 2015, Log No R, and attached to the case file for Tract No DEPARTMENT OF BUILDING AND SAFETY, ZONING DIVISION 8. Prior to recordation of the final ap, the Departent of Building and Safety, Zoning Division shall certify that no Building or Zoning Code violations exist on the subject site. Resubit the ap to provide and aintain a iniu 20 ft. coon access strip open to the sky for the lots all the way to the public street for access and frontage purpose per Section under the definition of Lot. No projections are allowed into the 20 ft. iniu coon access strip. Provide the 20 ft. wide coon access open to the sky or obtain approval fro the City Planning Advisory Agency to allow for a reduced and/or projection into the coon access strip all the way to the public street. Provide and diension the reciprocal private easeent for pedestrian and driveway egress and ingress in the final ap. Notes: The proposed building plans have not been checked for and shall coply with Building and Zoning Code requireents. With the exception of revised health or safety standards, the subdivider shall have a vested right to proceed with the proposed developent in substantial copliance with the ordinances, policies, and standards in effect at the tie the subdivision application was deeed coplete. Plan check will be required before any construction, occupancy or change of use If the proposed developent does not coply with the current Zoning Code, all zoning violations shall be indicated on the Map. The proposed buildings ay not coply with City of Los Angeles Building Code requireents concerning exterior wall, protection of openings and exit requireents, with respect to the proposed property line. Prior to recordation of the final ap, satisfactory arrangeents shall be ade with the Departent of Transportation to assure: a. A iniu of 20-foot reservoir space be provided between any security gate(s) and the property line. b. Parking stalls shall be designed so that a vehicle is not required to back into or out of any public street or sidewalk. Note: Guest parking as proposed will violate a code since it serves ore than 2 dwelling units. Section A-5(i) c. d. Proposed curb-cuts should be W=26 and W=18 - Case 2, or to the satisfaction of the Departent of Transportation. A parking area and driveway plan be subitted to the Citywide Planning Coordination Section of the Departent of Transportation for approval prior to subittal of building perit plans for plan check by the Departent of Building and Safety. Transportation approvals are conducted at 201 N. Figueroa Street Suite 400, Station 3. FIRE DEPARTMENT 10. Prior to the recordation of the final ap, a suitable arrangeent shall be ade satisfactory to the Fire Departent, binding the subdivider and all successors to the following: a. The plot plan shall include the following iniu design features: fire lanes, where required, shall be a iniu of 20 feet in width; all structures ust be within 300 feet of an approved fire hydrant, and entrances to any dwelling unit or guest roo shall not be ore than 150 feet in distance in horizontal travel fro the edge of the roadway of an iproved street or approved fire lane. b. Site plans shall include all overhead utility lines adjacent to the site. c. Any roof elevation changes in excess of 3 feet ay require the installation of ships ladders. The applicant is further advised that all subsequent contact regarding these conditions ust be with the Hydrant and Access Unit. Satisfactory arrangeents shall be ade with the Los Angeles Departent of Water and Power (LADWP) for copliance with LADWP s Water Syste Rules and requireents. Upon copliance with these conditions and requireents, LADWP s Water Services Organization will forward the necessary clearances to the Bureau of Engineering. (This condition shall be deeed cleared at the tie the City Engineer clears Condition No. S-1.(c).) If new street light(s) are required, then prior to the recordation of the final ap or issuance of the Certificate of Occupancy (C of O), street lighting iproveent plans shall be subitted for review and the owner shall provide a good faith effort via a ballot process for the foration or annexation of the property within the boundary of the developent into a Street Lighting Maintenance Assessent District. BUREAU OF SANITATION 13. Satisfactory arrangeents shall be ade with the Bureau of Sanitation, Wastewater Collection Systes Division for copliance with its sewer syste review and requireents. Upon copliance with its conditions and requireents, the Bureau of Sanitation, Wastewater Collection Systes Division will forward the necessary clearances to the Bureau of Engineering. (This condition shall be deeed cleared at the tie the City Engineer clears Condition No. S-1. (d).) INFORMATION TECHNOLOGY AGENCY 14. That satisfactory arrangeents be ade in accordance with the requireents of the Inforation Technology Agency to assure that cable television facilities will be installed in the sae anner as other required iproveents. Refer to the LAMC Section N. Written evidence of such arrangeents ust be th subitted to the Inforation Technology Agency, 200 North Main Street, 12 Floor, Los Angeles, CA 90012, DEPARTMENT OF RECREATION AND PARKS 15. That the Quiby fee be based on the RD1.5-1 Zone. URBAN FORESTRY DIVISION AND THE DEPARTMENT OF CITY PLANNING 16. Prior to the issuance of a grading perit, a plot plan prepared by a reputable tree expert, indicating the location, size, type, and condition of all existing trees on the

All trees in the public right-of-way shall be provided per the current Urban Forestry Division standards. Replaceent by a iniu of 24-inch box trees in the parkway and four trees on the site to be reoved, shall be required for the unavoidable loss of desirable trees on the site, and to the satisfaction of the Advisory Agency. Note: Reoval of all trees in the public right-of-way shall require approval of the Board of Public Works. Contact: Urban Forestry Division at: (213) Failure to coply with this condition as written shall require the filing of a odification to this tract ap in order to clear the condition. DEPARTMENT OF CITY PLANNING-SITE SPECIFIC CONDITIONS 17. Prior to the recordation of the final ap, the subdivider shall prepare and execute a Covenant and Agreeent (Planning Departent General For CP-6770) in a anner satisfactory to the Planning Departent, binding the subdivider and all successors to the following: a. b. c. Liit the proposed developent to a axiu of eight (8) sall lots. Provide a iniu of two (2) covered off-street parking spaces per dwelling unit. (Note: One space ay be a copact space. Tande parking is allowable.) Provide two (2) guest parking spaces, as shown on Exhibit A. No guest parking spaces shall peritted on the driveway for Lot 8. d. The use and developent of the property shall be in substantial conforance with the plans subitted with the application and arked Exhibit "A", except as ay be revised as a result of this action. e. Prior to the recording of the final ap, a revised ap shall be subitted reflecting the setbacks approved by the Advisory Agency. f. Prior to issuance of a certificate of occupancy, a iniu 6-foot-high slupstone or decorative asonry wall shall be constructed adjacent to neighboring residences, if no such wall already exists, except in required front yard. 9- That a solar access report shall be subitted to the satisfaction of the Advisory Agency prior to obtaining a grading perit. h. That the subdivider considers the use of natural gas and/or solar energy and consults with the Departent of Water and Power and Southern California Gas Copany regarding feasible energy conservation easures.

Outdoor lighting shall be designed and installed with shielding, such that the light source cannot be seen fro adjacent residential properties, the public right-of-way or fro above. (MM) Rooftop Open Space. i. The guardrail shall not exceed the iniu height required pursuant to Section of the L.A.M.C. ii. The guardrail shall be located at least 5-0" fro the perieter of the roof. iii. The guardrail shall be an opaque design and be a iniu of 75% open. I.. n. The Maintenance Agreeent shall be recorded as a Covenant and Agreeent to run with the land. The subdivider shall subit a copy of this Agreeent, once recorded to the Planning Departent for placeent in the tract file. Copies of all recorded Covenant and Agreeent(s) for all reciprocal private easeents shall be subitted to the Planning Departent for placeent in the tract file. Note to City Zoning Engineer and Plan Check. The City shall proptly notify the applicant of any clai, action, or proceeding and the City shall cooperate fully in the defense. If the City fails to proptly notify the applicant of any clai action or proceeding, or if the City fails to cooperate fully in the defense, the applicant shall not thereafter be responsible to defend, indenify, or hold harless the City. The plans shall incorporate the design guidelines relative to security, sei-public and private spaces, which ay include but not be liited to access control to building, secured parking facilities, walls/fences with key systes, well-illuinated public and sei-public space designed with a iniu of dead space to eliinate areas of concealent, location of toilet facilities or building entrances in high-foot traffic areas, and provision of security guard patrol throughout the project site if needed. The developer shall install appropriate traffic signs around the site to ensure pedestrian and vehicle safety. The applicant shall subit a parking and driveway plan that incorporates design features that reduce accidents, to the Bureau of Engineering and the Departent of Transportation for approval. 22. Construction Mitigation Conditions - Prior to the issuance of a grading or building perit, or the recordation of the final ap, the subdivider shall prepare and execute a Covenant and Agreeent (Planning Departent General For CP-6770) in a anner satisfactory to the Planning Departent, binding the subdivider and all successors to the following: CM-1. That a sign be required on site clearly stating a contact/coplaint telephone nuber that provides contact to a live voice, not a recording or voice ail, during all hours of construction, the construction site address, and the tract ap nuber. YOU ARE REQUIRED TO POST THE SIGN 7 DAYS BEFORE CONSTRUCTION IS TO BEGIN.

The sign ust be sturdily attached to a wooden post if it will be freestanding. b. Regardless of who posts the site, it is always the responsibility of the applicant to assure that the notice is firly attached, legible, and reains in that condition throughout the entire construction period. c. If the case involves ore than one street frontage, post a sign on each street frontage involved. If a site exceeds five (5) acres in size, a separate notice of posting will be required for each five (5) acres or portion thereof. Each sign ust be posted in a proinent location. CM-2. CM-3. CM-4. All unpaved deolition and construction areas shall be wetted at least twice daily during excavation and construction, and teporary dust covers shall be used to reduce dust eissions and eet SCAQMD District Rule 403. The owner or contractor shall keep the construction area sufficiently dapened to control dust caused by construction and hauling, and at all ties provide reasonable control of dust caused by wind. All loads shall be secured by triing, watering or other appropriate eans to prevent spillage and dust. All aterials transported off-site shall be either sufficiently watered or securely covered to prevent excessive aount of dust. All clearing, earth oving, or excavation activities shall be discontinued during periods of high winds (i.e., greater than 15 ph), so as to prevent excessive aounts of dust. The project shall coply with the City of Los Angeles Noise Ordinance No. 144,331 and 161,574, and any subsequent ordinances, which prohibit the eission or creation of noise beyond certain levels at adjacent uses unless technically infeasible. Construction and deolition shall be restricted to the hours of 7:00 a to 6:00 p Monday through Friday, and 8:00 a to 6:00 p on Saturday.

CM-17 Construction and deolition activities shall be scheduled so as to avoid operating several pieces of equipent siultaneously, which causes high noise levels. The project contractor shall use power construction equipent with state-of-the-art noise shielding and uffling devices. The project sponsor shall coply with the Noise Insulation Standards of Title 24 of the California Code Regulations, which insure an acceptable interior noise environent. All waste shall be disposed of properly. Use appropriately labeled recycling bins to recycle construction aterials including: solvents, water-based paints, vehicle fluids, broken asphalt and concrete, wood, and vegetation. Non-recyclable aterials/wastes ust be taken to an appropriate landfill. Toxic wastes ust be discarded at a licensed regulated disposal site. Clean up leaks, drips and spills iediately to prevent containated soil on paved surfaces that can be washed away into the stor drains. Do not hose down paveent at aterial spills. Use dry cleanup ethods whenever possible. Cover and aintain dupsters. Place uncovered dupsters under a roof or cover with tarps or plastic sheeting. Use gravel approaches where truck traffic is frequent to reduce soil copaction and liit the tracking of sedient into streets. CM-18. Conduct all vehicle/equipent aintenance, repair, and washing away fro stor drains. All ajor repairs are to be conducted off-site. Use drip pans or drop cloths to catch drips and spills. DEPARTMENT OF CITY PLANNING-STANDARD SINGLE-FAMILY CONDITIONS SF-1. That approval of this tract constitutes approval of odel hoe uses, including a sales office and off-street parking. If odels are constructed under this tract approval, the following conditions shall apply: Prior to recordation of the final ap, the subdivider shall subit a plot plan for approval by the Division of Land Section of the Departent of City Planning showing the location of the odel dwellings, sales office and offstreet parking. The sales office ust be within one of the odel buildings. All other conditions applying to Model Dwellings under Section A.10 and 11 and Section of the LAMC shall be fully coplied with satisfactory to the Departent of Building and Safety.

Prior to obtaining any grading or building perits before the recordation of the final ap, a landscape plan shall prepared by a licensed landscape architect, be subitted to and approved by the Advisory Agency in accordance with CP The landscape plan shall identify tree replaceent on a 1:1 basis by a iniu of 24-inch box trees for the unavoidable loss of desirable trees on the site and shall include the following features. a. All areas of the property not covered by buildings, driveways, or walkways shall be landscaped with low-water, drought-tolerant, and non-invasive plant aterials and ground cover, in place of turf grass. b. Any existing natural features and topography shall be incorporated into an proposed landscaping, where appropriate. c. Any proposed trees shall be shade bearing and spaced between 15- to 20-feet apart fro each other. d. Landscape plans shall organize plants into groupings in accordance to proposed water needs. e. Landscape plans shall incorporate shade trees and ornaental landscaping that define an edge and increases visual interest in the public and private reals of the developent. f. Shrubs located iediately adjacent to the public sidewalk shall aintain a height of less than four (4) feet. 9- Fences and shrubbery shall be less than 3 6 tall in areas located adjacent to, or within five (5) feet of, the sidewalk and coon public areas. h. Parkways shall be planted with ground cover, low-growing vegetation, or pereable aterials that accoodate both pedestrian oveent and clearance for car doors. i. J- Provide planting areas in private open spaces for residents to aintain. Landscape plans shall exhibit techniques that will be used to aintain privacy aong all proposed dwelling units. k. Trees, shrubs, and vines shall be planted between property lines so as to screen building walls and enhance privacy. In the event the subdivider decides not to request a perit before the recordation of the final ap, a covenant and agreeent satisfactory to the Advisory Agency guaranteeing the subission of such plan before obtaining any perit shall be recorded.

(a) That the sewerage facilities charge be deposited prior to recordation of the final ap over all of the tract in conforance with Section of the LAMC. (b) (c) (d) (e) (f) (g) (h) (i) That survey boundary onuents be established in the field in a anner satisfactory to the City Engineer and located within the California Coordinate Syste prior to recordation of the final ap. Any alternative easure approved by the City Engineer would require prior subission of coplete field notes in support of the boundary survey. That satisfactory arrangeents be ade with both the Water Syste and the Power Syste of the Departent of Water and Power with respect to water ains, fire hydrants, service connections and public utility easeents. That any necessary sewer, street, drainage and street lighting easeents be dedicated. In the event it is necessary to obtain off-site easeents by separate instruents, records of the Bureau of Right-of- Way and Land shall verify that such easeents have been obtained. The above requireents do not apply to easeents of off-site sewers to be provided by the City. That drainage atters be taken care of satisfactory to the City Engineer. That satisfactory street, sewer and drainage plans and profiles as required, together with a lot grading plan of the tract and any necessary topography of adjoining areas be subitted to the City Engineer. That any required slope easeents be dedicated by the final ap. That each lot in the tract coplies with the width and area requireents of the Zoning Ordinance. That 1-foot future streets and/or alleys be shown along the outside of incoplete public dedications and across the terini of all dedications abutting unsubdivided property. The 1-foot dedications on the ap shall include a restriction against their use of access purposes until such tie as they are accepted for public use. G) That any 1-foot future street and/or alley adjoining the tract be dedicated for public use by the tract, or that a suitable resolution of acceptance be transitted to the City Council with the final ap. Construct the necessary on-site ainline sewers satisfactory to the City Engineer. Install street lighting facilities to serve the tract as required by the Bureau of Street Lighting.

Repair or replace any off-grade or broken curb, gutter and sidewalk satisfactory to the City Engineer. Construct access raps for the handicapped as required by the City Engineer. Close any unused driveways satisfactory to the City Engineer. However the existing or proposed zoning ay not perit this density. Approval fro Board of Public Works ay be necessary before reoval of any street trees in conjunction with the iproveents in this tract ap through Bureau of Street Services Urban Forestry Division. Satisfactory arrangeents shall be ade with the Los Angeles Departent of Water and Power, Power Syste, to pay for reoval, relocation, replaceent or adjustent of power facilities due to this developent. The subdivider ust ake arrangeents for the underground installation of all new utility lines in conforance with LAMC Section N. The final ap ust record within 36 onths of this approval, unless a tie extension is granted before the end of such period. The Advisory Agency hereby finds that this tract confors to the California Water Code as required by the Subdivision Map Act. The subdivider should consult the Departent of Water and Power to obtain energy saving design features which can be incorporated into the final building plans for the subject developent. As part of the Total Energy Manageent Progra of the

19 VESTING TENTATIVE TRACT MAP NO SL PAGE 16 Departent of Water and Power, this no-cost consultation service will be provided to the subdivider upon his request. FINDINGS OF FACT (CEQA) The Departent of City Planning issued Mitigated Negative Declaration No. ENV MND on June 3, The Departent found that potential negative ipact could occur fro the project s ipleentation due to: Aesthetics (visual character, light); Noise (construction, operational); Public Services (fire protection, police protection, schools, parks); Transportation/Traffic (hazards, eergency access). The Deputy Advisory Agency certifies that Mitigated Negative Declaration No. ENV MND reflects the independent judgent of the lead agency and deterined that this project would not have a significant effect upon the environent provided the potential ipacts identified above are itigated to a less than significant level through ipleentation of Condition Nos. 17.j, 21 and 22 of the Tract's approval. Other identified potential ipacts not itigated by these conditions are andatorily subject to existing City ordinances, (Sewer Ordinance, Grading Ordinance, Flood Plain Manageent Specific Plan, Landscape Ordinance, Storwater Ordinance, etc.) which are specifically intended to itigate such potential ipacts on all projects. The project site, as well as the surrounding area are presently developed with structures and do not provide a natural habitat for either fish or wildlife. In accordance with Section of the Public Resources Code (AB 3180), the Deputy Advisory Agency has assured that the above identified itigation easures will be ipleented by requiring reporting and onitoring as specified in Condition No. 20. The custodian of the docuents or other aterial which constitute the record of proceedings upon which the Advisory Agency s decision is based are located with the City of Los Angeles, Planning Departent, 200 North Spring Street, Roo 750, Los Angeles, CA FINDINGS OF FACT (SUBDIVISION MAP ACT) In connection with the approval of Vesting Tentative Tract Map No SL, the Advisory Agency of the City of Los Angeles, pursuant to Sections , ,.61 and.63 of the State of California Governent Code (the Subdivision Map Act), akes the prescribed findings as follows: (a) THE PROPOSED MAP WILL BE/IS CONSISTENT WITH APPLICABLE GENERAL AND SPECIFIC PLANS. The requested Sall Lot Subdivision allows for the subdivision of underutilized land in ulti-faily and coercial areas for fee-siple hoes. Intended as an infill developent and a sart-growth alternative to traditional, suburban style

As such, sall lot subdivisions oftenties create parcels with a unique set of design and spatial coplexities. The subject site is located in the West Adas - Baldwin Hills - Leiert Counity Plan, which designates the subject property for Low Mediu II Residential land uses with corresponding zones of RD1.5, RD2, RW2 and RZ2.5. The property is approxiately net acre (12,960 square feet) in size. The applicant is proposing to develop eight sall lot hoes on a site consisting of eight sall lots, per the Sall Lot Ordinance and the Subdivision Map Act. The West Adas - Baldwin Hills - Leiert Counity Plan, a part of the Land Use Eleent of the City s General Plan, states the following goal and policies relevant to the current project: Goal 1: A safe, secure, and high quality residential environent for all econoic, age, and ethnic segents of the counity. Objective 1-1: Policy 1-1.2: Policy 1-1.3: Objective 1-2: Policy 1-2.1: Objective 1-3: Policy 1-3.1: To provide for the preservation of existing housing and for the developent of new housing to eet the diverse econoic and physical needs of the existing residents and projected population of the Plan area to the year Protect existing single-faily and low density residential neighborhoods fro encroachent by higher density residential and other incopatible uses. Require that new single-faily and ulti-faily residential developent be designed in accordance with the design standards. To locate new housing in a anner which reduces vehicular trips and akes it accessible to services and facilities. Locate higher residential densities near coercial centers, light rail transit stations and ajor bus routes where public service facilities, utilities and topography will accoodate this developent. To preserve and enhance the varied and distinct residential character and integrity of existing single and ulti-faily neighborhoods. Seek a high degree of architectural copatibility and landscaping for new and infill developent to protect

Objective 1-5: Policy 1-5.1: Policy 1-5.3: Policy 1-5.4: To proote and ensure the provision of adequate housing for all persons regardless of incoe, age or ethnic background. Proote greater individual choice in type, quality, price and location of housing. Provide for developent of townhouses and other siilar condoiniu type housing units to increase hoe ownership options. Provide for the clustering of housing units to help decrease the effective cost of land per dwelling unit. The proposed sall lot project will eet the intent of the aforeentioned Counity Plan s Goals and Objectives and will provide uch needed new hoe ownership opportunities for the West Adas - Baldwin Hills - Leiert Counity Plan area in the for of single-faily dwellings as part of an infill developent. The project coplies the Specific Plan for the Manageent of Flood Hazards (floodways, floodplains, ud prone areas, coastal high-hazard and flood-related erosion hazard areas). As such, the Advisory Agency concludes that the proposed Vesting Tentative Tract Map is consistent with the intent and purpose of the General Plan. (b) THE DESIGN AND IMPROVEMENT OF THE PROPOSED SUBDIVISION ARE CONSISTENT WITH APPLICABLE GENERAL AND SPECIFIC PLANS. The design and iproveent of the proposed subdivision are consistent with the West Adas - Baldwin Hills - Leiert Counity Plan and are not subject to any Specific Plan requireents. Cattaraugus Avenue is a designated Collector Street dedicated to a 60-foot width at the project s street frontage. For the purposes of approving a sall lot subdivision, the design of the tract or parcel ap refers to the configuration and layout of the proposed lots in addition to the proposed site plan layout and building design. Easeents and/or access and iproveents refers to the infrastructure facilities serving the subdivision. The project was reviewed by various city agencies that have the authority to ake iproveent recoendations. Staff received recoendations fro the Bureau of Engineering to dedicate a 2-foot wide strip of land along Cattaraugus Avenue and to iprove Cattaraugus Avenue with a 7-foot wide sidewalk and landscaping in the parkway and fro the Bureau of Street Lighting, which is requiring that the applicant relocate and upgrade the existing street light on Cattaraugus Avenue as part of the project. In addition, all necessary street iproveents will be ade to coply with the Aericans with Disabilities Act

22 VESTING TENTATIVE TRACT MAP NO SL PAGE 19 (ADA) of As conditioned, the design and iproveents of the proposed subdivision are consistent with the applicable General Plan. (c) THE SITE IS PHYSICALLY SUITABLE FOR THE PROPOSED TYPE OF DEVELOPMENT. A ix of one- and two-story, single- and ulti-faily dwellings akes up the general character of the surrounding neighborhood. The properties to the west zoned RD1.5-1, and are developed with one-story, single-faily dwellings. The properties to the north are zoned RD2-1, RD1.5-1 and C2-1, and are developed with one- and two-story, single- and ulti-faily dwellings. The properties to the south and east are zoned C2-1, and are developed with one- and two-story, coercial and light industrial buildings. The project site, which is underutilized and consisting of 12,960 square feet of land, is currently developed with a 731 square-foot single-faily dwelling and a 1,395 square-foot single-faily dwelling, both of which will be deolished as part of the proposed project. The proposed project is considered an infill developent in a neighborhood that has a ix of single- and ulti-faily uses and is consistent with the density and height district of the RD1.5-1 Zone. The property is located within the Newport - Inglewood Fault Zone and a Liquefaction zone and has been required to coply with the conditions contained within the Departent of Building and Safety s Geology and Soils Report Approval. The property is not located within an Airport Hazard area, Coastal Zone, Very High Fire Hazard Severity Zone, Fire District No. 1, Flood Zone, Hazardous Waste/Border Zone Properties, Methane Hazard Site, High Wind Velocity Areas, Special Grading Area (BOE Basic Grid Map A-13372), Oil Wells, Alquist-Priolo Fault Zone, Landslide area or a Tsunai Inundation zone. The site is within Flood Zone Type X, which denotes areas deterined to be outside the 0.2% annual chance floodplain. The Vesting Tentative Tract Map has been approved contingent upon the satisfaction of the Departent of Building and Safety, Grading Division prior to the recordation of the ap and issuance of any perits. Therefore, the site will be physically suitable for the proposed type of developent. (d) THE SITE IS PHYSICALLY SUITABLE FOR THE PROPOSED DENSITY OF DEVELOPMENT. Adjacent land uses consist of single- and ulti-faily dwellings and coercial and light industrial uses. The project proposes the developent of eight sall lot hoes consistent with the density of the RD1.5-1 Zone. The applicant is

23 VESTING TENTATIVE TRACT MAP NO SL PAGE 20 peritted to construct eight residential condoinius or apartent units by-right per the RD1.5-1 Zone. The proposed project would provide an appropriate transitional developent between the lower density residential developent to the north and west, and the coercial and light industrial uses to the south and east. The site is currently developed with single-faily dwellings. The proposed project will coply with all LAMC requireents for parking, yards, and open space in accordance with Ordinance No. 176,354. As conditioned the proposed Vesting Tentative Tract Map is physically suitable for the proposed density of the developent. There appears to be no potential public health probles caused by the design or iproveent of the proposed subdivision. The developent is required to be connected to the City's sanitary sewer syste, where the sewage will be directed to the LA Hyperion Treatent Plant, which has been upgraded to eet statewide ocean discharge standards. The Bureau of Engineering has reported that the proposed subdivision does not violate the existing California Water Code because the subdivision will be connected to the public sewer syste and will have only a inor increental ipact on the quality of the effluent fro the Hyperion Treatent Plant. (9) THE DESIGN OF THE SUBDIVISION AND THE PROPOSED IMPROVEMENTS WILL NOT CONFLICT WITH EASEMENTS ACQUIRED BY THE PUBLIC AT LARGE FOR ACCESS THROUGH OR USE OF PROPERTY WITHIN THE PROPOSED SUBDIVISION. A 3-foot wide Public Utility easeent is located along the southern and western

(h) THE DESIGN OF THE PROPOSED SUBDIVISION WILL PROVIDE, TO THE EXTENT FEASIBLE, FOR FUTURE PASSIVE OR NATURAL HEATING OR COOLING OPPORTUNITIES IN THE SUBDIVISION. (REF. SECTION ) In assessing the feasibility of passive or natural heating or cooling opportunities in the proposed subdivision design, the applicant has prepared and subitted aterials which consider the local cliate, contours, configuration of the parcel(s) to be subdivided and other design and iproveent requireents. Providing for passive or natural heating or cooling opportunities will not result in reducing allowable densities or the percentage of a lot which ay be occupied by a building or structure under applicable planning and zoning in effect at the tie the tentative ap was filed. The lot layout of the subdivision has taken into consideration the axiizing of the north/south orientation. The topography of the site has been considered in the axiization of passive or natural heating and cooling opportunities. In addition, prior to obtaining a building perit, the subdivider shall consider building construction techniques, such as overhanging eaves, location of windows, insulation, exhaust fans, planting of trees for shade purposes and the height of the buildings on the site in relation to adjacent developent.
