STAFF RECOMMENDATION: Option 1: THAT Council advance the application for a zoning amendment for the property located at 1973 Second Ave(legally described as LOTS 28 & 29 BK 16 SEC 35 TP 9A KOOTENAY DISTRICT PL 616) by giving first and second reading to Zoning Amendment Bylaw 2641 and scheduling a public hearing for January 8, 218. OPTIONS AND ALTERNATIVES: Option 2: THAT Council defer this request until it is determined whether the property owner of 156 Kootenay Ave obtains a business license. Option 3: THAT the City deny the request. ANALYSIS: Background: Property Information: Property Size: Current Use: Current Zoning: Proposed Zoning: Current OCP Designation: 556 sq m (6 sq ft). Single Family Residence R1 Infill R1 Infill GS (Guest Suite) Mixed Use Summary of Proposal: The applicant has two rooms in the lower ground level of the home that she would like to rent out short term. The house as a two car garage as well as off street parking in the driveway. The rooms are not currently suitable for a long term rental as they are not separated from the main living space. If zoning is approved by Council, they will apply for a business license. 164 of 218

2 2 Official Community Plan(OCP) The OCP policy directs Council to consider Short term Rental rezoning applications in residential zones in Rossland on a project by project basis. When reviewing rezoning proposals for short term rentals, the Council shall consider the following criteria in determining the appropriateness of the proposal: 1) The density of Short Term Rentals in the vicinity of the property which is being proposed to be rezoned for this use; The short term rental policy gives Council direction for determining the appropriate density for short term rentals. The policy states that in general, properties with this zone are limited to one property per block where "one block" shall be considered to be the two sides of a single street that face one another and are bordered on either end by the nearest street or cul de sac. The property is located on Second Ave between Washington St and Spokane St. There are no other properties on this block that are zoned for short term rental use. 2) The road network and parking issues that may exist or arise in the vicinity of the property which is being proposed to be rezoned for Guest Home use; Parking regulations require a total of four spaces for this proposed use (2 for the home and 1 per guest room). There is parking available on the property for 4 vehicles. 3) The presence of a suite does not detract from the quality of life of nearby residents and is not intrusive in the neighbourhood; The block contains a mixture of single family homes, multiple family buildings and a commercial property. The public hearing will give Council the opportunity to hear from adjacent property owners and the general public. 4) Proximity to commercial, recreational, public/institutional centres, or parks and major collectors; The property is close to downtown, the bus route and is located within a block from a restaurant and pub. 5) Impact on affordable housing and long term rentals. Council has adopted the Short term rental policy, new zoning and business license regulations in order to protect the integrity and make up of Rossland as a sustainable, full service, yearround community with a healthy mix of residents and tourists. Specifically, the policy states that the maximum amount of short term rental units in the City is limited to 5% of total dwellings within the City, at the time of a specific unit s approval. 165 of 218

8 THE CORPORATION OF THE CITY OF ROSSLAND BYLAW # 2641 A BYLAW TO AMEND THE CITY OF ROSSLAND ZONING BYLAW No. 2518, 211. WHEREAS Part 26 of the Local Government Act R.S.B.C. 1996, c.323 authorizes the Council of the City of Rossland to establish and amend a zoning bylaw; AND WHEREAS the Council of the City of Rossland deems it necessary and expedient to amend the City of Rossland s Zoning Bylaw No. 2518,211. NOW THEREFORE, the Council of the City of Rossland, in open meeting assembled, ENACTS AS FOLLOWS: SHORT TITLE 1. This Bylaw may be cited as the Zoning Amendment Bylaw, No.2641, 217(4) AMENDMENT 2. Zoning Bylaw #2518 is hereby amended such that the following property is rezoned from R1 Infill Residential to R1 Infill Residential Guest Suite (R1I GS): LOTS 28 & 29 BK 16 SEC 35 TP 9A KOOTENAY DISTRICT PL 616 located at 1973 Second Ave as shown hatched on Schedule A attached to and forming part of this Bylaw. ENACTMENT 3. (1) If any section, subsection, sentence, clause or phrase of this Bylaw is for any reason held to be invalid by the decision of any court of competent jurisdiction, the invalid portion shall be severed and the part that is invalid shall not affect the validity of the remainder.
