1 Official Publication of the Greater Tulsa Association of REALTORS GTAR W rld June Monthly New OK State Contract Training The Board of Directors has moved up the date to officially adopt the new Oklahoma state contract to August 1, Therefore, as of August 1, GTAR will no longer provide the following contract forms: Residential, Condominium, Vacant Land, and Existing New Home Contracts, Financial Agreements, RR&T, You Need to Know, Single Party and Transaction Broker Supplemental Agreements, Net to Seller, Cost to Buyer, Cancellation of Contract, Mutual Release. All of these forms will be replaced by OREC forms. The OREC forms are already available on OREC s Web site, and will be put on our Web site soon; they have also been sent to ZipForm, and should be available in a few weeks. Below are the classes scheduled for June; more classes will be added as needed. Check online frequently for new additions. 3 Backpacks for Kids Campaign GTAR s Goal: Raise $10,000 by July 15, 2006 GTAR s new Backpacks for Kids Campaign will provide basic essentials for needy kids (ages 0-18). Money raised will be used to purchase a backpack filled with essentials, such as socks, underwear, jeans, and shoes for each child. GTAR is partnering with Family & Children Services for this project. GTAR s Public Relations Committee will deliver the backpacks at a pizza party we will host for the kids and their families in August. We want these kids to have a great start to their new school year! About Family & Children s Services Family & Children s Services is one of the premier human service providers in Northeastern Oklahoma. The agency provides counseling services, parenting education, child abuse prevention and treatment, literacy programs, marriage and family strengthening programs, early childhood family support, youth development programs, and mental health services. Last year their programs touched more than 60,000 lives. Family & Children s Services partners with families, schools, businesses, and other organizations to share resources and develop comprehensive solutions to the problems that threaten the well-being of families and our community. Family & Children s Services has been a resource for families and children in the Tulsa area for over 75 years. Believing in families and helping them to build strong foundations for brighter futures is what Family & Children s Services is all about. 4 2006 REALTOR Appreciation Day was a Huge Success! Move it and they will come, and they did in record numbers; more than 425 members of the Greater Tulsa Association of REALTORS (GTAR) attended the ninth annual REALTOR Appreciation Day event on Friday, May 12 at the John Q. Hammonds Arena (UMAC). REALTOR Appreciation Day is an annual event sponsored by GTAR s Firm Affiliate members. The event includes a continuing education class in the morning followed by a trade show that is free to all GTAR members and provides them the opportunity to visit with firm affiliate members and learn about the services they provide. This year s class was Have You Kissed Any Frogs Lately? The Guide to Loving My Job and Avoiding the Pitfalls, presented by Dr. Deb Wade to about 120 members. In the past this event has been held at the Home Builders Association and featured up to 37 booths, but the event has become so popular, that this year it was moved to UMAC, where there were 63 booths, and attendance was double what it has been in the past. 4 June 2006

5 SSUES & NSWERS By Jody Blakemore, RCE Case #1-20: REALTORS Buying and Selling to One Another are Still Considered REALTORS (Originally Case #7-24. Revised May, Transferred to Article 1 November, Cross-reference Case #2-13.) REALTOR Al owned a home which he listed through his own brokerage firm. The property listing was filed with the Multiple Listing Service of the Board. REALTOR Bob called REALTOR Al and told him of his interest in purchasing the home for himself. REALTOR Al suggested a meeting to discuss the matter. The two agreed upon terms and conditions and the property was sold by REALTOR Al to REALTOR Bob. A few months later, during hard rains, leakage of the roof occurred with resultant water damage to the interior ceilings and side walls. REALTOR Bob had a roofing contractor inspect the roof. The roofing contractor advised REALTOR Bob that the roof was defective and advised that only a new roof would prevent future water damage. REALTOR Bob then contacted REALTOR Al and requested that he pay for the new roof. REALTOR Al refused, stating that REALTOR Bob had a full opportunity to look at it and inspect it. REALTOR Bob then charged REALTOR Al with violation of Articles 1 and 2 of the Code of Ethics by not having disclosed that the roof had defects known to REALTOR Al prior to the time the purchase agreement was executed. At the subsequent hearing, REALTOR Bob outlined his complaint and told the Hearing Panel that at no time during the inspection of the property, or during the negotiations which followed, did REALTOR Al disclose any defect in the roof. REALTOR Bob acknowledged that he had walked around the property and had looked at the roof. He had commented to REALTOR Al that the roof looked reasonably good, and REALTOR Al had made no comment. The roofing contractor REALTOR Bob had employed after the leak occurred told him that there was a basic defect in the way the shingles were laid in the cap of the roof and in the manner in which the metal flashing on the roof had been installed. It was the roofing contractor s opinion that the home s former occupant could not have been unaware of the defective roof or the leakage that would occur during hard rains. REALTOR Al told the panel that he was participating only to prove that he was not subject to the Code of Ethics while acting as a principal as compared with his acts as an agent on behalf of others. He pointed out that he owned the property and was a principal, and that REALTOR Bob had purchased the property for himself as a principal. The panel concluded that the facts showed clearly that REALTOR Al, the seller, did have knowledge that the roof was defective, and had not disclosed it to REALTOR Bob, the buyer. Even though a REALTOR is the owner of a property, when he undertakes to sell that property he accepts the same obligation to properly represent its condition to members of the public, including REALTORS who are purchasers in their own name, as he would have if he were representing the seller. The panel concluded that REALTOR Al was in violation of Articles 1 and 2 of the Code. Case #3-10: Disclose Accepted Offers with Unresolved Contingencies (Adopted May, 2004.) REALTOR Al listed Seller Sam s house and placed the listing in the local association s MLS. Within a matter of days, REALTOR Bob procured a full price offer from Buyer Bill. The offer specified that Buyer Bill s offer was contingent on the sale of Buyer Bill s current home. Seller Sam, anxious to sell, accepted Buyer Bill s offer but instructed REALTOR Al to continue marketing the property in hope that an offer that was not contingent on the sale of an existing home would be made. A week later, REALTOR Mike, another cooperating broker working with an out-of-state transferee on a company-paid visit, contacted REALTOR Al to arrange a showing of Seller Sam s house for Buyer Tom. REALTOR Al contacted seller Sam to advise him of the showing and then called REALTOR Mike to confirm that he and Buyer Tom could visit the property that evening. REALTOR Al said nothing about the previouslyaccepted purchase offer. REALTOR Mike showed the property to Buyer Tom that evening and Buyer Tom signed a purchase offer for the full listed price. REALTOR Mike left the purchase offer at REALTOR Al s office. Continued on next page... June

6 Directors Actions This is a monthly feature which will report GTAR and NORES Directors actions from the previous month s Board of Directors meeting. GTAR Board of Directors Directors approved contributing to the NAR project to build 54 homes in the Gulf Coast area for victims of Hurricane Katrina. NAR is asking every member to contribute $5.25 to the project. Directors approved co-sponsoring with the Home Builders Association, a Candidate forum with the three Republican candidates running for Governor. These three candidates are running against one another in the primary. At this time Governor Brad Henry is the only Democratic candidate and has no primary opponent. Directors authorized the RCA Committee to hold an evening banquet for the Commercial REALTOR of the Year award in January Directors approved supporting the OREC Standard Contract and related addenda and approved moving the cut-off date for providing the GTAR Contract and related addenda to August 1; only GTAR Commercial and Property Management forms will continue to be provided by GTAR after that date. Directors approved putting a PowerPoint detailing the differences between the OREC Contract and Financial Supplementals and GTAR s Contract and Financial Supplementals online and ing a link to every Principal Broker and Manager. Directors approved writing the Mayor and City Council (with a copy to the Tulsa World) urging them to oppose any change in the Arena s quality, size, and design, and to find a means to cover the overrun and complete the Arena as planned. Any downgrading or change to the Arena will defeat its purpose to be a major attraction for Tulsa and bring in more and larger events than has been possible with the current Convention Center. NORES Board of Directors New Rule approved by Directors: Article 1, Section 6.7 of the NORES Rules and Regulations - Add/Edit Listings or Media. A Participant or User shall not be permitted to add/edit listings or media in the MLS for any Participant or User who is not affiliated with the same firm the Participant or User is licensed with. Further, such Participant or User shall not utilize the MLS service or data from the MLS except as specifically authorized by the Bylaws, Rules and Regulations as may be amended from time to time. Directors approved the suspending of all MLS services (including the Supra Key) of any non-member assessment (including REALTOR -ASSOCIATES who were changed to assessments after failing to attend Orientation although being given three opportunities to attend) until they attend Orientation. With NORES new SPAM software, NORES has the capability of allowing members to opt to receive all their including SPAM; Directors approved giving Participants and Users this option. The Participant or User must submit written request to NORES to elect to receive all of their including SPAM. Issues & Answers Continued from page 5... REALTOR Al informed Seller Sam about this second offer. At Seller Sam s instruction, Buyer Bob was informed of the second offer, and Buyer Bob waived the contingency in his purchase offer. REALTOR Al then informed REALTOR Mike that Seller Sam and Buyer Bob intended to close on their contract and the property was not available for purchase by Buyer Tom. REALTOR Mike, believing that REALTOR Al s failure to disclose the existence of the accepted offer between Seller Sam and Buyer Bob at the time REALTOR Mike contacted REALTOR Al was in violation of Article 3 of the Code of Ethics, as interpreted by Standard of Practice 3-6, filed an ethics complaint with the Association of REALTORS. At the hearing called to consider the complaint, REALTOR Al defended his actions noting that while Buyer Bob s offer had 6 June 2006 been accepted by Seller Sam, it had been contingent on the sale of Buyer Bob s current home. It was possible that Buyer Bob, if faced with a second offer, could have elected to withdraw from the contract. REALTOR Al argued that continuing to market the property and not making other brokers aware that the property was under contract promoted his client s best interests by continuing to attract potential buyers. The Hearing Panel disagreed with REALTOR Al s justification, pointing to the specific wording of Standard of Practice 3-6 which requires disclosure of accepted offers, including those with unresolved contingencies. REALTOR Al was found in violation of Article 3. (The two cases presented are from NAR s Code of Ethics and Arbitration Manual.)

KeyBox Exchange Approved Slated for December 2006 The NORES Board of Directors has approved a keybox exchange for the end of this year; a two-for-one exchange two of the AEII boxes (older, tan colored boxes) for one I-box (newer, blue infrared boxes). To be eligible for the exchange and to receive credit, any AEII box exchanged must be registered in your name at the Association office. For a list of boxes registered to you, please contact Gloria at the Association office. Lists can be faxed (with written authorization) or ed to you. Free to Members Sales Associate Forum Connie Montalbano Membership Coordinator by Shelley Carson Old Republic Home Warranty We are so lucky to have Connie Montalbano as our Membership Coordinator; she has been a valued member of GTAR s staff for 19 years! Some of her main responsibilities include producing the annual GTAR Directory, running monthly orientation classes, dues billing, and overseeing the membership database. Connie is also the staff liaison for the Affiliate and Membership Committees. Connie is a huge part of the annual REALTOR Appreciation Day, and one of the reasons it is so successful year after year. Connie is married and has two daughters and three grandkids. She and her husband live on five acres outside of Broken Arrow with a Quaker parrot and two cockatiels. 9 L P In By Polly Choate the NORES Rules and Regulations Section 4 - Pending, Sold and Change Notices Pendings That Go Beyond the Anticipated Closing Date. If a Pending does not close on the anticipated closing date, the new anticipated closing date must be entered into NORES MLS system within thirty (30) days of such failure to close. NORES staff monitors the system for properties that are Pending with an Anticipated Closing Date more than 30 days in the past. The purpose of this rule is to keep the information in the system up-to-date. We have found that if the Anticipated Closing Date is in the past, many times, the listing is no longer pending, however, it was not updated in the system. Pending properties remain pending in the system until they are changed they never default to an alternate status. To check your office listings for compliance to the Anticipated Closing Date rule, via Office Broker Reports*, do the following in MarketLinx: Go to: My Page Click: Office Broker Tab Click: Reports Click: Office Inventory Select Pending and click Properties *Access to Broker Reports is by Broker Permission. 10 Tips of the Month Provided by your NORES Tech Desk Beware: Phishing fish ing) (n.) The act of sending an to a user falsely claiming to be an established legitimate enterprise in an attempt to scam the user into surrendering private information that will be used for identity theft. The directs the user to visit a Web site where they are asked to update personal information, such as passwords and credit card, social security, and bank account numbers, that the legitimate organization already has. The Web site, however, is bogus and set up only to steal the user s information. For example, 2003 saw the proliferation of a phishing scam in which users received s supposedly from ebay claiming that the user s account was about to be suspended unless he clicked on the provided link and updated the credit card information that the genuine ebay already had. Because it is relatively simple to make a Web site look like a legitimate organization s site by mimicking the HTML code, the scam counted on people being tricked into thinking they were actually being contacted by ebay and were subsequently going to ebay s site to update their account information. By spamming large groups of people, the phisher counted on the being read by a percentage of people who actually had listed credit card numbers with ebay legitimately.
