EXECUTIVE SUMMARY This application is a request for approval of a Use by Special Review ("USR") for a ground-mount solar array on five acres in the Bell Mountain Ranch Planned Development (PD). Article Ill. D. of the Bell Mountain Ranch PD requires solar collectors which are not part of the primary structure of a single-family residence to be processed in accordance with the USR section of the Douglas County Zoning Resolution (Zoning Resolution). In accordance with Section 2104 of the Zoning Resolution, each special use is subject to a yearly review, or as often as the Board of County Commissioners (Board) deems appropriate. As the ground-mount solar array is accessory to a singlefamily residence, the applicant requests that the USR not be subject to an annual review. A note to this effect has been placed on the USR exhibit. II. REQUEST A. Request The request is for approval of a USR application for a ground-mount solar array on five acres in Bell Mountain Ranch PD. Additionally, the applicant requests that the USR not be subject to an annual review given its minor nature. B. Process A USR application is processed pursuant to Section 21 of the Zoning Resolution. Section 21 states the intent of the USR process is "to provide for uses in specific zoning districts that shall require a public notice and hearing and the approval of the 100 Third Street, Castle Rock, Colorado

3 Board of County Commissioners subject to such conditions and safeguards as may be imposed by the Board. Per Section of the Zoning Resolution, The Planning Commission shall evaluate the USR request, staff report, referral agency comments, applicant responses, and public comment and testimony, and make a recommendation to the Board to approve, approve with conditions, continue, table for further study, or deny the USR request. The Planning Commission's decision shall be based on the evidence presented, compliance with the adopted County standards, regulations, policies, and other guidelines. As part of its approval, the Board can specify the frequency of USR inspections. C. Location The project is located in Bell Mountain Ranch, just south of the intersection of Bell Mountain Drive and Bell Star Circle. D. Project Description The five acre property is located in central Douglas County within the Cherry Valley Subarea, as well as in the Community Separation Buffer of the Castle Rock Municipal Planning Area. The Bell Mountain Ranch PD allows for solar collectors which are not part of the primary structure, subject to approval of a USR. The ground-mount solar array proposed is an kilowatt solar photovoltaic system, anticipated to cover 100% of the homeowners annual electricity usage. Planning Commission Staff Report - Page 2 of 18

4 There are two arrays of solar panels, each approximately 38 feet in length, with a separation of 18 feet between the two arrays. The overall height of the arrays, above the mounted ground plane, is approximately eight feet. The proposed array is approximately 100 feet from Bell Mountain Drive, north of the existing residence on the lot. The array is approximately 40 feet south of the nearest abutting property, and south of an existing stand of scrub oak. III. CONTEXT A. Background The property was zoned Agricultural in 1955 with the inception of zoning in the County. The property was later rezoned to PD in 1985 as part of the Bell Mountain Ranch PD. The provision in the PD requiring a USR process for solar collectors which are not part of the primary structure was included in the Bell Mountain Ranch PD 1 st Amendment, approved in Lot 147 was subdivided in 1998 as part of Bell Mountain Ranch Filing 1-B. B. Adjacent Land Uses and Zoning Zoning Land Use North Planned Development (Bell Mountain) Single-family residential East Planned Development (Bell Mountain) Single-family residential South Planned Development (Bell Mountain) Single-family residential West Planned Development (Bell Mountain) Single-family residential C. Management Plan Section 2113 of the Zoning Resolution requires a specific management plan for USR applications. The elements of the management plan are shown on Sheet 1 of the exhibit. In addition, Note 1 has been added to Sheet 1 of the exhibit identifying this use is not subject to an annual review. 1. Number of clients/boarders/parishioners/animals: Not applicable 2. Hours of operation: The residential ground-mount solar array operates continuously 3. Number of employees: Not applicable, other than routine and incidental maintenance 4. Required outside storage/parking/loading areas: Not applicable 5. Permit requirements from other state, federal or local agencies: Not applicable 6. 5 IV. PHYSICAL SITE CHARACTERISTICS A. Site Characteristics and Constraints The site is approximately five acres in size and slopes from a highpoint on the east to the low point on the west. The existing single-family residence is located in the western one-third of the property; the remainder of which contains significant amounts of scrub oak. The ground-mount solar array is proposed north of the existing residence. There are no site constraints that would prohibit the groundmount solar array from locating in the proposed location. B. Access The property is located on the east side of Bell Mountain Drive. Bell Mountain Drive intersects Bell Mountain Parkway to the north of the property, which provides access to the Interstate 25 frontage road. C. Soils and Geology No portion of the site is identified by Section 9 of the Comprehensive Master Plan (CMP) as an area containing Class 3 Hazards, Steeply Dipping Bedrock, or other environmental constraints. D. Drainage and Erosion Due to the limited disturbance of the project, a Grading, Erosion, and Sediment Control (GESC) Plan and Phase III Drainage Plan are not required. The applicant has placed standard notes on the exhibit to address Engineering Services comments. E. Floodplain No portion of the property is located within the boundaries of the 100-year floodplain. V. PROVISION OF SERVICES A. Schools The proposed use will not generate any students. B. Fire Protection The Larkspur Fire Protection District (Larkspur Fire) provides fire protection for this portion of Bell Mountain Ranch. Larkspur Fire reviewed the request and did not provide a response. C. Sheriff Services The Douglas County Sheriff s Office ( DCSO ) provides police protection to the property. The DCSO reviewed the request and noted no comment. No response was received from the Office of Emergency Management and Sheriff s E911. D. Water Central water is provided to the property by the Bell Mountain Ranch Metropolitan District. The District provided a letter indicating there is no impact on the water system associated with the request. Planning Commission Staff Report - Page 4 of 18

6 E. Sanitation No sanitation demand is generated by the proposed solar array. F. Utilities Intermountain Rural Electric Authority (IREA) provides electric service to the site; no response was received from IREA. It is anticipated the proposed array will produce sufficient electricity to cover 100% of the homeowners annual electricity usage. In order to capture any surplus production, IREA will replace the homeowners electric meter with a net meter, allowing excess production to feed the electric grid. G. Parks and Open Space There are no parks or open space requirements for the property as part of this request. VI. PUBLIC NOTICE AND INPUT Courtesy notices of an application in process were mailed to the abutting landowners during the referral period. A letter, which is included as an attachment, was received from the abutting landowner to the north who requested the application be denied. The landowner s primary objection is they view the solar panels as a contradiction of the spirit and intent of preserving the natural surroundings of Bell Mountain Ranch. Required mailed, published, and posted notices of the public hearings were accomplished in compliance with the public noticing requirements in Section 2118 of the Zoning Resolution. VII. STAFF ANALYSIS A Special Use shall be approved only if the Board of County Commissioners finds that the proposed special use: : Complies with the minimum zoning requirements of the zoning district in which the special use is to be located, as set forth in this Resolution. Staff Comment: The site is situated within the Bell Mountain Ranch PD and the project conforms to all criteria for development within the Single-Family Residential District (Planning Area 10) of the Bell Mountain Ranch PD : Complies with the requirements of this Section 21. Staff Comment: The request complies with the requirements of Section 21 of the Zoning Resolution. Section 2104 of the Zoning Resolution states each special use is subject to yearly review, or as often as the Board deems appropriate to ensure compliance with the approval standards and conditions of approval. As the ground-mount solar array is accessory to the existing single-family residence, the owners have requested the Board not to subject the use to an annual review : Complies with the Douglas County Subdivision Resolution. Staff Comment: This proposal does not require the subdivision of land : Will be in harmony and compatible with the character of the surrounding areas and neighborhood. Staff Comment: The proposed ground-mount solar array was chosen by the homeowners to avoid aesthetic considerations and reduced production that they state Planning Commission Staff Report - Page 5 of 18

7 would be inherent in a rooftop mounted array. In staff s analysis, a ground-mount solar array is no less harmonious or compatible with the character of the surrounding areas and neighborhood as a rooftop mounted array. A rooftop mounted array would be permitted by right on this property without any land use approval process : Will be consistent with the Douglas County Comprehensive Master Plan, as amended. Staff Comment: The property is located within the Cherry Valley Subarea, as well as in the Community Separation Buffer of the Castle Rock Municipal Planning Area. Through this land use review process, staff has determined that the nature and intensity of the proposed array is appropriate for the nonurban area in accordance with Objective 3-2A Will not result in an over-intensive use of land. Staff Comment: The proposed use is not an over-intensive use of the land. The permit area for the USR is less than three percent of the of the 5-acre property Will not have a material adverse effect on community capital improvement programs. Staff Comment: The proposed use has no negative effect on community capital improvement programs Will not require a level of community facilities and services greater than that which is available. Staff Comment: The USR application will not require a greater level of community facilities or services than that which is available. No new water or sewer services are required Will not cause significant air, water, or noise pollution. Staff Comment: The use is not anticipated to cause significant air, water, or noise pollution Will be adequately landscaped, buffered, and screened. Staff Comment: The proposed array is screened from the south by the existing home, and from the east by significant stands of scrub oak. The array sits immediately south of a smaller stand of scrub oak which provides screening from the property to the north. The array may be visible from the street, however, it does not pierce a ridgeline and is approximately 100 feet from the property line Will have a sufficient water supply in terms of quantity, dependability, and quality as determined in conformance with the standards set forth in Section 18A, Water Supply - Overlay District. Staff Comment: The District has provided a letter indicating the array would have no impact on the water system Will not otherwise be detrimental to the health, safety, or welfare of the present or future inhabitants of the County. STAFF ASSESSMENT Staff has evaluated the USR request, referral agency comments, applicant responses, public input, approval standards, and all other information included within this staff report. In staff s assessment, the application complies with all of the approval standards, subject to the following proposed condition: 1. Prior to final approval of the associated SIP, any technical corrections to the management plan shall be made to the satisfaction of Douglas County and appended to the plan exhibit. Any necessary technical corrections shall also be made to the plan exhibit. Please submit a copy of the revised plan directly to Engineering to my attention. 2. Please differentiate between existing and proposed improvements on plan sheet Please add the following notes to the plan, completing blanks as appropriate: The Douglas County Engineering Division (Engineering) has reviewed this document and found it in general compliance with Engineering s criteria. No pipes will drain into the gutter. Access to the work site and planned improvements will be by way of the existing access drive to and from 3912 Bell Mountain Drive, Castle Rock, CO The improvements for this project are expected to generate maintenance visits to the property three times in the first five years. All improvements identified as new will be constructed with this project. The area of planned earth disturbance is limited to drilling of holes for the placement of 20 concrete caissons four foot deep and 12 inches in diameter and the handling of the spoils soil. Spoils soil from holes will be spread evenly on site and seeded and mulched in accordance with Douglas County criteria. There will be no import or export of soil. Concrete trucks will not be washed out on site. All disturbed earth, including areas de-vegetated by vehicle traffic or construction activity, will be seeded and mulched in accordance with Douglas County Grading Erosion and Sediment Control (GESC) criteria. Non-compliance with the aforementioned earthwork parameters without a plan change accepted by the Douglas County Engineering Services Director, or non-compliance with Douglas County Grading, Erosion and Sediment Control criteria, may result in a stop work order. Engineering cannot recommend acceptance of the Use by Special Review until all of our concerns have been addressed. Once all of Engineering s concerns have been addressed, Engineering will release a memo stating that we have no objection to acceptance of the project at that time.
