CONSIDER APPROVAL OF SP , SITE PLAN FOR THE INSTALLATION OF ELECTRIC CHARGING STATIONS ON FOUR (4) PROPERTIES OWNED BY THE CITY OF SHAWNEE. THE APPLICATION IS FILED BY THE CITY OF SHAWNEE. CHAIRMAN BOGINA: Paul. PLANNING DIRECTOR CHAFFEE: The applicant requests site plan approval for the installation of electric charging stations on four properties owned by the City of Shawnee. The zoning regulations require site plan approval for the installation of these charging stations. These facilities are permitted in all zoning districts with approval of the location by the Planning Commission. Kansas City Power and Light has approached the City to install electric charging stations at various public locations. The Governing Body, at their March 23, 2015 meeting, will consider an agreement to place the charging units in parking lots at four public facilities. The facilities selected are the Shawnee Civic Centre, Shawnee Justice Center, Sister Cities Park, and the city owned parking lot at the southwest corner of Barton and Johnson Drive. The charging stations resemble a bollard between four and six feet in height. Each unit is placed between two parking stalls, and will have two charging receptacles. Use of the charging stations will be for the general public. Location of the charging stations at the Civic Centre is at the southern end of the western most parking lot at the Civic Centre, so it s just to the south of this location; and three units are proposed to be installed at that location. At the Justice Center, the charging stations are proposed to be built at the western end of the southern parking lot; Justice Center s right here, along Johnson Drive; and there will be three at that location also. At Sister Cities Park, there will be two charging stations actually on the eastern parking lot area. And at Barton Drive and Johnson Drive, the charging stations will be located at the northeast corner of that parking lot, just right at the southeast corner of Johnson Drive and Barton. Although the stalls are marked indicating the availability to charge, the city will not tow or ticket cars parked in the stalls that may not be using the charging units. Kansas City Power and Light has indicated that locations for the charging stations must be approved prior to March 31, 2015, and installation is expected to occur immediately upon approval of the agreement with the Governing Body. Since the Governing Body has not considered entering into an agreement with KCP+L, approval of the site plan will be conditioned upon the Governing Body entering into the agreement to place the charging units at these facilities. Staff recommends approval of SP , a site plan for the installation of electric charging stations on city property located at the Shawnee Civic Centre, Shawnee Justice Centre, Sister Cities Park, and the in the public parking lot at the southwest corner of Barton and Johnson Drive, subject to the following conditions: 3

6 Page 4 DRAFT PLANNING COMMISSION MINUTES MARCH 16, The Governing Body shall enter into an agreement with Kansas City Power and Light to install the electric charging stations; 2. The electric charging stations shall be constructed in the locations depicted on the submitted drawings; and 3. The electric charging stations installed shall be those depicted on the submitted drawings. That concludes staff s presentation. CHAIRMAN BOGINA: Thank you. Would this be a public hearing? PLANNING DIRECTOR CHAFFEE: No, just a site plan. CHAIRMAN BOGINA: Okay. Anybody have any questions for the staff? Commissioner Willoughby. COMMISSIONER WILLOUGHBY: Paul, the ones, the units that are being installed at the Civic Centre are, one of them s next to the handicap parking, but like at Sister Cities, the handicap parking s on the south side of the lot. PLANNING DIRECTOR CHAFFEE: Correct. COMMISSIONER WILLOUGHBY: And then at the Justice Center it looked like it s the furthest away from the building, so PLANNING DIRECTOR CHAFFEE: I think what that, what KCP+L was trying to do is find locations that we re not generally gonna use by a lot of the public but at the same time we viewed it as a bonus to have at least one charging station available for handicap stall that was dedicated handicapped so if someone has an electric car that ll probably be the only one where if someone s not charging they may not be parked there or less likely to park there. COMMISSIONER WILLOUGHBY: Right, okay. CHAIRMAN BOGINA: Commissioner Busby. COMMISSIONER BUSBY: Thank you, Mr. Chairman. I would suggest when they re doing this electrical work at the Sister Cities Park that they add a 110 outlet there to make the park a little more accessible for other things that it s used for. And I m sure they can figure out a way to monitor it so that its only available through the permission of the City. PLANNING DIRECTOR CHAFFEE: I will relay that on to Mr. Holman as a suggestion. CHAIRMAN BOGINA: Commissioner Wise. COMMISSIONER WISE: Question for you regarding pad mount transformers, what are the screening requirements for those? PLANNING DIRECTOR CHAFFEE: Just what we would generally require depending on how they look, they may not need to be any or some shrubbery that they d go back in and install around it. CHAIRMAN BOGINA: Commissioner Bienhoff. COMMISSIONER BIENHOFF: Paul, could you explain a little bit on how these stations work? PLANNING DIRECTOR CHAFFEE: Sure. COMMISSIONER BIENHOFF: And how the electricity gets paid for? PLANNING DIRECTOR CHAFFEE: Yeah, initially they ll, well actually KCP+L is going to be the

7 Page 5 DRAFT PLANNING COMMISSION MINUTES MARCH 16, 2015 installer; for the first 27 months the City will sponsor the charging station; estimated cost is $ per year on each charging station, assuming that one is constantly in use 24 hours a day, every day, so that s obviously the high end of the cost; after that point, after 27 months, well they re doing that in concert with the City too to not only provide charging stations but sort of the whole green thing to encourage folks if they want to buy an electric car to know that there are public charging stations that are going to be available at public facilities or if you happen to need to visit the Justice Center, while you re there you can then charge your car; after 27 months the stations are charged out where it will be a swipe system on your credit/debit card and then you d be billed the cost for your plug-in. COMMISSIONER BIENHOFF: And do you know how long it takes to charge a car? PLANNING DIRECTOR CHAFFEE: We have one person in the building who does and assuming that their charge gets low and his will charge 40 miles per charge, if he s at nothing it ll take him about 4 hours to charge. So, you know, the hope is that the public charging stations that someone finds one before they have 2 miles to go and they re not all full and you have to try and get to the next one, so UNKNOWN SPEAKER: It s good for only 40 miles? PLANNING DIRECTOR CHAFFEE: Good for about a 40 mile charge, yeah; at least in his car. COMMISSIONER BIENHOFF: And just curious, do we have any idea what kind of demand there is, or how many vehicles there are that would plug into this thing? PLANNING DIRECTOR CHAFFEE: We do not, but we ll be finding out shortly. We do know that there s at least another one downtown, so I imagine one of these units, both receptacles will be plugged in everyday during the day so CHAIRMAN BOGINA: Commissioner Wise. COMMISSIONER WISE: Question, are these 220 volt or 120? PLANNING DIRECTOR CHAFFEE: I knew you d probably ask me that. I don t know the answer. COMMISSIONER WISE: Because 120 will take forever; 220 can generally go full charge in about 3-4 hours; 120 can take up to 12 hours. CHAIRMAN BOGINA: So Paul, should a car be parked there for a long period of time, these are spaces you ve found are not in use very often anyway? Overflow? PLANNING DIRECTOR CHAFFEE: These are generally aren t used very often or if they re plugged in during the day it may be in the location that we d be expecting someone to be parking in anyway. So, we don t view it as a, since they aren t marked, like only for charging, anyone can park in those, park in the stalls and we re not towing them or ticketing them. It s just more of a tool to try and get folks used to the new ways cars receive their energy. CHAIRMAN BOGINA: Okay. COMMISSIONER BIENHOFF: Mr. Chairman? Just a CHAIRMAN BOGINA: Commissioner Bienhoff. COMMISSIONER BIENHOFF: Another comment that I just think it s good that the City is participating in this to encourage alternate fuel vehicles. CONSIDER APPROVAL OF SP , SITE PLAN FOR THE INSTALLATION OF ELECTRIC CHARGING STATIONS AT THE SHAWNEE HY-VEE, LOCATED AT W. 63RD STREET. THE APPLICATION IS FILED BY KANSAS CITY POWER AND LIGHT ON BEHALF OF HY-VEE. CHAIRMAN BOGINA: Paul. PLANNING DIRECTOR CHAFFEE: Kansas City Power and Light has approached Hy-Vee to install electric charging stations in their parking lot located at West 63 rd Street; and these units will be identical to the ones that are proposed to be placed on the City s properties. The location of the two charging stations is at the northeast corner of the eastern parking lot south of the entrance off 62 nd Terrace. So this is where the stop light is; Pflumm Road is; these stalls; the Hy-Vee sign is right in this location here. The stalls at the proposed locations are currently rarely used. The grocery store provides more parking than is required by code. If the applicant were to limit the use of the stalls for electric cars using the facility, it would not affect the overall parking at the grocery. Staff recommends approval of SP , a site plan for the installation of electric charging stations at Shawnee Hy-Vee, located at W. 63 rd Street, subject to the following conditions: 1. The electric charging stations shall be constructed in the locations depicted on the submitted drawings; and 2. 11 City of Shawnee TO: PLANNING COMMISSION DATE: APRIL 6, 2015 FROM: SUBJECT: PLANNING STAFF FP ; FINAL PLAT REGHAN PLACE, NINTH PLAT 6400 BLOCK OF LACKMAN ROAD MCAFEE HENDERSON SOLUTIONS, INC FOR ABSOLUTE CONSTRUCTION AND DEVELOPMENT, LLC, DEVELOPER. This is a consent item. The applicant requests final plat approval for Reghan Place, Ninth Plat, a multi-family residential development, located in the 6400 Block of Lackman Road. The application is filed by McAfee Henderson Solutions, Inc. for Absolute Construction and Development, LLC, Developer. FINAL PLAT REVIEW 1. The applicant is seeking final plat approval for Reghan Place, Ninth Plat, a multi-family residential subdivision. The purpose of this plat is to replat a portion of the original Reghan Place Plat where the triplex residential units are under construction and nearly ready for occupancy. This plat is for two (2) triplex buildings on one lot. The plat contains 25, 318 square feet (0.58 acres). 2. This is the eighth and final phase of buildings under construction in this subdivision. The buildings within this phase are located in the north central part of the development, on the northwest corner of 64 th Street and Darnell Street. 3. The property is zoned PMR (Planned Mixed Residential). Property to the north, east, south and west are zoned PMR and contain existing phases of the Reghan Place subdivision. The Johnson County Museum of History is located to the northwest on an unplatted parcel zoned R-1 (Single Family Residential). 4. The Land Use Guide of the Comprehensive Plan indicates this area is appropriate for medium-density residential development, which is defined as 5.1 to 10 units per acre. This plat has density of 10.3 dwelling units per acre. The development as a whole will have a density of 6.6 units per acre. This plat is in compliance with the original final plat (FP ) and the modified development plan (PUD ) approved July of 2003 and again in July All bulk requirements have been satisfied. All structures are set back a minimum of 30 feet from the peripheral subdivision boundary in accordance with the requirements of the PMR district. Under the provisions of the PMR district, building fronts are required 9

The applicant has provided a 33.5-foot setback from the center line of the street. These units are setback 20 feet or more from the back of curb of the private street (64 th Street and Darnell Street). A minimum 20-foot separation is maintained between the buildings in accordance with the requirements of the PMR district. 6. The two buildings within this plat are triplex buildings containing three residential units. These buildings are being platted into three individual units to allow them to be owner occupied. 7. Homes association, as well as party wall and easement declaration documents, were recorded with the Johnson County Register of Deeds by the original developer at the time the first plat was recorded. These documents apply to the entire subdivision, including the replats of the individual buildings and units as they come on line. The new developer / owner submitted an amended and restated declaration document that will be recorded along with this final plat that amends the previously recorded declarations for newer phases of the subdivision. A signed and executed copy of the amended declaration shall be submitted to Planning staff along with the recording copy of the plat for recording with the Johnson County Register of Deeds at the applicant s expense. 8. Primary access to this phase of the subdivision will be from Lackman Road at 64th Street and 64th Terrace (private streets). Driveway approaches to the buildings will be from 64 th Street and Darnell Streets. All streets within this development are privately owned and maintained. Access is sufficient for public safety purposes. 9. This replat is intended for conveyance purposes only. All street, storm and street light private improvements have previously been constructed; therefore no additional private improvements are required. 10. Telephone, electric and cable service facilities are to be placed within rear and side yards as required by Policy Statement PS-24. All utilities will be placed underground. 11. All disturbed areas must be covered with sod and landscaping immediately following completion of final site grading. 12. All fire hydrants, fire lanes, and fire suppression equipment shall be installed as required by the Fire Department. 13. This subdivision is subject to the provisions of SMC 12.14, Park and Recreational Land Use Fund. Open space fees in the amount of $ per residential unit ($2,400) shall apply to this plat. The required open space fees were paid at the time building permits for the units contained within this plat were issued; no additional open space fee is required. 10

The excise tax for this portion of the subdivision was paid with the recording of the first final plat and since the square footage of the original plat is not being increased; no additional excise tax is required. 15. The applicant is responsible for submitting a computation plat with the recording copies of the final plat. The computation plat should show the bearings and lengths of all lines, and the individual area, in square feet, of all lots, open space tracts, and right-of-ways, and the centerline miles of all newly dedicated streets. The County Engineer requests that all points shown on a plat be based on the Kansas State Plane Coordinate System of 1983, North Zone (NAD-83). RECOMMENDATION Staff recommends approval of FP , the final plat for Reghan Place, Ninth Plat, located in the 6400 Block of Lackman Road, subject to the following conditions: 1. Acceptance of the dedications on the final plat by the Shawnee City Council and recording of the final plat with the Johnson County Register of Deeds prior to issuance of final certificate of occupancy for any of the units within this plat; 2. This plat shall consist of two triplex buildings on one lot containing 0.58 acres; 3. All bulk regulations of the PMR (Planned Mixed Residential) zoning district shall be met; 4. All streets within this development are privately owned and maintained; 5. A signed and executed copy of the amended declaration shall be submitted to Planning staff along with the recording copy of the plat for recording with the Johnson County Register of Deeds at the applicant s expense; 6. Telephone, electric and cable service facilities are to be placed within rear and side yards as required by Policy Statement PS-24. All utilities are to be placed underground; 7. The Land Use Guide of the Comprehensive Plan indicates office/service uses for the site, therefore the use is in compliance with the plan. 3. The building was constructed in 1953 of wooden T-111 siding and residential-style windows. Over time, the wooden siding has begun to fail and existing windows are rotted and leaky. To address these issues, the owner plans to re-side the entire structure with more durable Hardifiber cement panels. The building is currently blue-gray in color. The new siding will be painted to a slightly lighter gray (Sherwin Williams Olympus White 6253). The existing residential-style entry door on the east elevation will be replaced with a full-view glass door ( Integrity by Marvin). Windows on the front (east) elevation are currently of a narrow slot design. To update the façade and allow more light into the building, the three vertical windows located to the north of the front door will be removed and replaced with an 84 x 60 picture window. The small horizontal window located to the south of the front door will be replaced with a 64 x 60 double-hung window. The western-most window on the south elevation will be removed and replaced with a new window unit that doubles the existing window size. All other window 27

The property is zoned TSQ (Townsquare). Properties to the north, east and west are also zoned TSQ, while property to the south is zoned CH-(O) (Commercial Highway-Overlay). A neighborhood shopping center is located to the west (across Nieman), a hail repair facility is located to the east, a US Post Office is located to the north, and a gas/convenience store is located to the south. 2. The Land Use Guide of the Comprehensive Plan indicates commercial uses for the site, therefore the use is in compliance with the plan. 3. The building was constructed in 1979 with a brown metal parapet above the storefront windows. Over time, the brown parapet has oxidized and needs to be repainted. To address this need, the company intends to paint the brown fascia to their corporate blue color (Sherwin Williams Blue Chip 6959). The fascia update is the only exterior change proposed at this time. The cement block and brick building walls are currently painted off-white. The owner does plan to give all building walls a new coat of paint in this same color during the next budget year to further freshen the structure s appearance. As the exterior wall color will not be altered, additional site plan approval will not be required. 4. New building signage will be installed on the west fascia in conjunction with the project to replace the existing wall sign. Building signage shall not exceed 7 percent of the applicable wall area. All new signage shall comply with requirements of SMC 5.64, and sign permits shall be obtained from the Planning Department prior to installation. 35

The property is located on the west side of Hedge Lane Terrace in the 7700 block. The site contains two office buildings and a parking lot. Hedge Lane acts as a frontage road for K-7 Highway at this location. The applicant requests to rezone all three parcels from PI (Planned Industrial) to PO (Professional Office). The existing office buildings have previously housed a research and development software company and a church. Both of these uses were permitted in the PI zoning district, but the two uses have now vacated the property. Because the office buildings do not have overhead doors or warehouse space typically found in an industrial zone, new tenant inquiries have been from more typical office/service businesses. The owner now has a commitment to occupy a portion of the northern office building with an outpatient-physical therapy business, which is not allowed in the current PI zone. 2.
