The applicant proposes to create seven cluster envelopes on Eagle Pointe Court, a platted private cul-de-sac. The site is to be served by central sanitary sewer and water. The proposed Replat is consistent with the approved Preliminary Plan. Staff recommends APPROVAL WITH MODIFICATIONS. Proposal: The applicant proposes the following on the Replat: 1 1. Create eight cluster sublots; Sublots 40 through Create Block A Create a utility easement in the area surrounding the private street Eagle Pointe Court. 4. Create a sanitary sewer easement to connect with the existing sanitary sewer easement that was created by the Lake Medina Reserve Subdivision Phase 1 plat. Access: Access to the proposed subdivision is provided by Lake Forest Drive a public street with a 60 foot road right-of-way. Access to Granger Road to the north is provided by Lake Forest Drive and a connection to the east is provided by Hunting Run Road. History: The original Preliminary Plan for Lake Medina Reserve was approved by the Medina County Planning Commission (MCPC) in October of 2003 and the Phase One Final Plat was 1 For the purposes of this staff review the following Replat document was utilized: Falcon Pointe at Lake Medina Reserve Subdivision Phase 3. Cunningham & Associates, Inc.: Project No Two sheets. Date stamped by DPS staff on November 7, 2016.

Subdivision Stage Approval Date Preliminary Plan October 2003 Revised Preliminary Plan June 2004 Final Plat, Phase 1 June 2004 Revised Preliminary Plan September 2004 Replat (Phase 1) November 2004 Replat (Phase 2) September 2005 Preliminary Plan May 2015 Preliminary Plan (Administrative) November 2016 Sanitary Engineer (SE): Jeremy Sinko, 11/10/2016. CONDITIONAL APPROVAL. A correction to the sanitary sewer easement needs to be made. Once corrected the SE will approve the plat. Health Department: Steve Mazak, 11/9/2016. Recommend that final plan be submitted for review before obtaining signatures. Columbia Gas: Russ Johnson, 4/09/2015. APPROVED Staff Comments: 1. In a letter dated June 25, 2015, Peter Krakowiak, Biologist with the Buffalo District of the United States Department of the Army, Corps of Engineers accepted the submitted wetland delineation and issued a Preliminary Jurisdictional Determination. Mr. Krakowiak recommended that a qualified wetland biologist re-review the boundaries of all the identified waters by June 25, The following required data/information was not provided on or with the Replat (Subdivision Regulation section references are included): a. An original mylar of the Final Plat. 404(D)(2)d. Submit the original mylar. b. Signature and seal of a Registered Surveyor on each sheet. 404(D)(2)f.16. Add the surveyor s seal on Sheet 2 and provide signatures on each sheet. c. Notarized certification by the owner or owners of the subdivision. 404(D)(2)f.17. Provide notarized signatures of the owners. d. Certification from the Township that the Final Plat as submitted is in compliance with local zoning standards and requirements. Such Certification shall be in the form of an executed signature block on the original mylar and signed by at least two of the Township Trustees. 404(D)(2)g.1. A subdivision served by a public central sanitary sewer [and water] shall be certified by the Sanitary Engineer stating all required wastewater disposal facilities and central water facilities have been satisfactorily installed or adequate financial guarantees have been approved. Such Certification shall be in the form of an executed signature block on the original mylar. 404(D)(2)g.4. Provide the signature of the Sanitary Engineer. f. Certification of County Engineer that all required improvements have been satisfactorily installed or financial guarantees have been provided to cover all construction. 404(D)(2)g.4. Provide the signature of the Highway Engineer. g. Acceptance of offers of dedication by County Commissioners, when all improvements have been constructed, or financial guarantees and construction agreements have been approved. 404(D)(2)g.4. Provide the acceptance language and signature lines for the County Commissioners and provide signatures as the sanitary sewer easements must be dedicated. 3. The shading legend shown on Sheet 2 is sufficient; remove the legend shown on Sheet Correct the spelling of the word legend in the owner s certification language. 5. Edit the owner s certification text for the legend from below to as provided herein. 6. The proposed Final Plat fulfills the purpose and intent and meets the standards and requirements of the Subdivision Regulations per 404(D)(5)b.1. and The proposed Final Plat is in substantial conformity with the approved Preliminary Plan and conditions of approval per 404(D)(5)b The Final Plat is in conformity with the Medina Township Zoning Resolution per 404(D)(5)b The Sanitary Engineer has determined that all required central wastewater disposal facilities have been satisfactorily installed or adequate financial guarantees have been approved per 404(D)(5)b Upon receipt of Highway Engineer s certification of approval of the construction drawings, the Director is authorized to execute the Final Plat on behalf of the Planning Commission upon certification by the Highway Engineer that the construction is complete or that adequate financial guarantees have been provided per 404(D)(5)b.7. Recommendation: Staff recommends that the Medina County Planning Commission APPROVE WITH MODIFICATIONS the Falcon Pointe at Lake Medina Reserve, Phase 3 Replat subject to the following: 1. Provide the above listed required data/information on or with the corrected Replat. 2. Provide the above listed signatures. 3. Remove the legend shown on Sheet Correct the spelling of the word legend in the owner s certification language. 5. Change the reference in the owner s certification language to the legend from below to as provided herein. The applicant must submit three copies of the corrected Replat and a PDF of the layout before the Director will sign the Replat. The applicant shall provide a recorded copy of the plat to the Department of Planning Services.
