2 Davidson County Planning Department EH & A nvestments, LLC/ Wayne Shuler Name:.~ ~~ ~~~~~~~~ ~ ~~~~ Application for Amendment to the Davidson County Zoning Ordinance Contents of Application: All applications for amendments to this ordinance, without limiting the right to file additional material, shall contain at least the following (applicant may attach additional sheets if necessary): (a) lithe proposed amendment would require a change in the ZONNG ATLAS, a fully dimensioned map at a scale of not less than 400 feet nor more than 20 feet to the inch showing the land which would be covered by the proposed amendment. (b) A legal description of such land, if applicable. (c) Any alleged error in this ordinance which would be corrected by the proposed amendment with a detailed explanation of such error in the ordinance and detailed reasons how the proposed amendment will correct same. There does not appear to be an alleged error in the Zoning Ordinance. (d) The changed or changing conditions, if any, in a particular area or in the county generally, which make the proposed amendment reasonably necessary to the promotion of the public health, safety, and general welfare. See Exhibit A. (e) The manner in which the proposed amendment will carry out the intent and purpose of a comprehensive plan. See Exhibit A. 3 E!Jt ~ a JtUJej~,.e.ee 240 Ed Sink Road Thomasville, NC (336) EXHBT A September 4, 2018 Mr. Crook, am requesting a change in the zoning from RA-3 to HC, Highway Commercial for the properties located in the Thomasville Township, Map 332, Tax Lots 69, 70, and 71 on Shu ler Road that and Shelly Shuler currently own. As the owner of Shuler Meats, have seen a continued growth in this business and in the near future see a need to build a garage/maintenance facility to maintain the trucking operation and other equipment for this business. n past years, the county allowed the adjacent sites own to be rezoned to a Highway Commercial zoning and currently use these lots to park the fleet of trucks used to transport our products to our customers. The lots am requesting the zoning change for would eventually house a garage/maintenance facility to maintain these trucks and equipment. These lots are located off Business 85 in an area that the Davidson County Land Development Plan recognizes as a Growth Corridor and near an area that this plan also recognizes as Commercial and ndustrial Centers. n recent years, a similar tract of land located nearby with sim ilar characteristics was rezoned to Highway Commercial and a commercial structure built which seems to lend support for commercial growth in this area. This growth area is located just outside the city limits ofthomasville but also in close proximity to the cities of Lexington, Greensboro, and Winston Salem as well as the larger cities of Raleigh and Charlotte. Our location adjacent to Business 85 allows immediate access to these and other cities and allows us to transport goods to our customers in a timely manner. This zoning change would greatly benefit the operation of our business and allow us to keep the maintenance of our vehicles close to where the products are shipped from. feel this future expansion will continue to keep our equipment running efficiently and safely and possibly add employment opportunities to the local economy. greatly appreciate your consideration of this request for a zoning change and please contact me if you have any questions or concerns. 10 STAFF ANALYSS AND RECOMMENDATON FOR REZONNG REQUEST BY EH AND A NVESTMENTS. LLC AND WAYNE SHULER Applicants are seeking to rezone lots containing 2.54 acres more or less from that of RA-3 to that of HC. Highway Commercial. Said property is located in Thomasville Township on the south side of Shuler Road approximately.19 mile west of the US 29-70/Business 85 intersection. Shuler Meats is a successful commercial distributer of various cuts of meats both wholesale and retail that has been in business at its present location for 40 plus years. The business has expanded a couple of different occasions to accommodate its growth over the years. Two of the three lots are currently vacant with woods while the third lot has a small house that will be demolished and removed. Applicants intend to build a maintenance facility for its fleet of refrigerated delivery trucks. n order to use the property as such will require a rezoning of the properly to HC. Staff would have preferred the application to have been submitted as a conditional use request so that conditions could have been placed on the use to insure it compatibility with the adjoining properties. As a general district request. the approving body will have to consider all of the allowed uses under He. The Board should be mindful of Policy 5.3 of the LDP that states new incompatible commercial encroachment within or immediately adjoining existing residential areas shall be strongly discouraged. Policy 5.7 says commercial uses should be encouraged to develop by consolidation and expansion of commercially zoned property. when such consolidation and expansion does not encroach upon a viable residential area. Staff will recommend approval of the request only if a 50 foot buffer is left in the RA-3 district leaving the trees intact. Staff feels this is necessary to address the noise coming from trucks with refrigeration units that keep them running 24 hours per day. By having this buffer strip. will insure its compatibility with the neighborhood.
