9 APPENDIX C ORDER 1 In this Order, annexed land means the land described in Appendix A and shown on the sketch in Appendix B. 2 For taxation purposes in 2013 and in each subsequent year up to and including 2021, the annexed land and assessable improvements to it (a) must be assessed by the Town of Magrath on the same basis as if they had remained in Cardston County, and (b) must be taxed by the Town of Magrath in respect of each assessment class that applies to the annexed land and the assessable improvements to it using the municipal tax rate established by Cardston County. 3 Where, in any taxation year, a portion of the annexed land (a) becomes a new parcel of land created (i) as a result of subdivision, (ii) as a result of separation of title by registered plan of subdivision, or (iii) by instrument or any other method that occurs at the request of, or on behalf of, the landowner, (b) is redesignated, at the request of or on behalf of the landowner under the Town of Magrath Land Use Bylaw to another designation, or (c) is subject to the issuance of a development permit at the request of, or on behalf of, the landowner, section 2 ceases to apply at the end of that taxation year in respect of that portion of the annexed land and the assessable improvements to it. 4 After section 2 ceases to apply to the annexed land or any portion of it in a taxation year, the annexed land or portion of it and the assessable improvements to it must be assessed and taxed for the purposes of property taxes in the following year in the same manner as other property of the same assessment class in the Town of Magrath is assessed and taxed. 5 The Town of Magrath shall pay to Cardston County the amount of $30, (thirty thousand dollars) as compensation for previously committed county resources related to the long-range planning and development of the annexed lands

12 Notice of Intent to Designate a Provincial Historic Resource (Historical Resources Act) File: Des Notice is hereby given that sixty days from the date of service of this Notice and its publication in Alberta Gazette, the Minister of Culture intends to make an Order that the site known as the: Medicine Hat Brick and Tile Company Site, together with the land legally described as: Plan , Block 1, Lot 3 Excepting thereout all mines and minerals area: 7.29 hectares (18.01 acres) more or less and municipally located in the City of Medicine Hat, Alberta be designated as a Provincial Historic Resource under section 20 of the Historical Resources Act, RSA 2000 ch-9. The reasons for the designation are as follows: The Medicine Hat Brick and Tile Company Site possesses heritage value as one of western Canada s major producers of brick and clay-based building materials throughout most of the twentieth century. The site s buildings also demonstrate changing brick making technology and processes. Valued for both its practical and aesthetic characteristics, brick was an essential building material for the development of western Canada. Brick is produced by grinding and mixing clay with water and an aggregate, and then moulding, cutting or pressing the mixture into blocks and firing them in kilns until hard and durable. Its attractive, solid appearance and its fire-proof quality made brick a highly desirable material for residential and commercial buildings in Alberta in the early twentieth century. This was particularly true in urban areas, where devastating fires in some early settlements had resulted in strict fire prevention bylaws and restrictions on the use of wood for building construction. While many brick plants and yards were small, poorly-capitalized operations that supplied local demand, some operations, such as the Medicine Hat Brick and Tile Company, grew to be large-scale enterprises that produced bricks and other clay-based building materials such as hollow building tile and sewer tiles for export throughout the West. The size of the site and its multiple buildings with specialized functions illustrate the scale, importance and success of the Medicine Hat Brick and Tile Company operation. The landscape and layout of the Medicine Hat Brick and Tile Company Site embodies the brick-making process and the evolution of the plant and other buildings outline changing trends in the industry. The site is situated at an ideal location for the production of clay based products. The nearby hills, which show evidence of extensive quarrying, provided good clay for brick-making; the onsite gas wells, regulator shack, kiln heaters and associated engineering works provided cheap and plentiful natural gas; and the historic presence of a spur line and trestle bridge, as well

13 as the site s proximity to the Canadian Pacific Railway mainline and yards, linked the plant into a major transportation network. Also, due to the near constant state of expansion and upgrading that has occurred at the site, the Medicine Hat Brick and Tile Company s buildings offer an excellent representation of more than 120 years of changing technology and processes in the clay construction products sector. Archaeological and sub-structural evidence of brick-making at the site dates back to the mid-1880s, when Ben McCord and other entrepreneurs began making bricks. Larger plants were constructed through the early decades of the 1900s and some portions of the main plant with brick-bearing walls likely date from this period as do the two large brick kilns with barrel-vaulted roofs, interior, gas-fired heaters and large, square chimneys. The main plant is composed of a number of interconnected and specialized buildings, such as storage areas, the clay-mixing room, grinding room, long tunnel kilns, added in 1953 and 1976, and shipping facilities. Also within the plant is machinery for two major brick making processes (dry-pressed and extruded/wirecut), which has been repeatedly updated over the years. A small laboratory and a separate office building were added to the site in the 1950s/60s. The laboratory speaks to the emphasis on research and the development of new products and improved products. Decorative panels on the laboratory and the brick work on the office demonstrate the variety of bricks produced by the company and the versatile nature of the material. The main plant went through major upgrades in the 1980s and computer-controlled brick-making machinery was installed in In 2010, the plant was closed due to flooding, ending over 120 years of brick-making on the site.
