1 CHARTER TOWNSHIP OF CANTON PLANNING COMMISSION PROCEEDINGS September 11, 2017 A Regular meeting of the Planning Commission of the Charter Township of Canton was held at 1150 South Canton Center Road on Monday, September 11, 2017 Chairman Greene asked for a moment of silence in remembrance of Patriots Day. Chairman Greene called the meeting to order at 7:00 P.M. and led the Pledge of Allegiance to the Flag. ROLL CALL: Members Present: Absent: STAFF PRESENT: Engel, Graham-Hudak, Greene, Okon, Perkins and Zuber Dodson Goulet APPROVAL OF THE MINUTES OF AUGUST 7, 2017 Motion by Zuber, supported by Perkins, to accept the Minutes of August 7, 2017, as presented. Ayes all present on a voice vote. ACCEPTANCE OF AGENDA: Motion by Okon, supported by Zuber, to accept the Agenda as presented. Ayes all present on a voice vote. PUBLIC HEARINGS COND-4293 WHELAN/GREENLEAF TRUST CONDITIONAL REZONING Consider conditional zoning amendment for parcel nos and Property is located north of Koppernick Road and east of Haggerty Road. Mr. Goulet stated that the applicant is proposing to conditionally rezone 16.3 acres of the subject property from LI, Light Industrial to R-6, Single-Family Attached residential District, subject to the attached Statement of Conditions and conceptual plan. Mr. Goulet explained that the Planning Commission has reviewed proposed changes to the Future Land Use Map as part of the 5-year Comprehensive Plan update and has authorized proceeding with an amendment which would change the Future Land Use designation from Light Industrial to Medium-High Density Residential. Mr. Goulet indicated that the proposed rezoning would limit the total number of units to 90, well under the 128 units which would be permitted under standard R-6 zoning. Mr. Goulet stated that a 25 foot natural buffer would be maintained along the Holiday Park subdivision, with additional trees planted in ti fill gaps between existing tree cover. Mr. Goulet explained that a multi-purpose path would be constructed through the project with connection to the I-275 bike trail along the north side of Koppernick Road. Mr. Goulet explained that a traffic study was conducted and the traffic generated from the proposed residential development would result in lower impacts on Koppernick Road than industrial development on the 16 acres and that the project would not have a significant impact on the nearby intersections and driveways.

2 Planning Commission Proceedings 2 September 11, 2017 Mr. Goulet indicated that the Township s sanitary sewer consultant review the model and determined that there is adequate capacity, with only a very slight increase in peak hour flow compared to the industrial use assumptions. Mr. Goulet explained that the assumptions were based on maximum density under the higher residential density of 8 dwelling units/acre, not on the limitation of 90 units, which is 5.6 units per acre. Mr. Goulet explained that this is a proper transitional use between the single-family homes in Holiday Park Subdivision and the railroad/i-275, which would result in excellent buffers, integration and connection to the regional trail system and not have any adverse impacts on the public infrastructure. Motion by Zuber, supported by Perkins, to open the public hearing. Ayes all present on a voice vote. Mr. Danny Veri, project representative, stated that he has received letters of concern from some of the residents and has reached out to the area neighbors of the proposal. Mr. Veri explained that he has been building in the community since 1995 and has a great reputation. Mr. Veri stated that they have built two thirds of Cherry Hill Village along with other neighborhoods in the community. Mr. Veri indicated that the letters from residents had common concerns and issues such as low rent, trees, traffic, home values and noise and will address these concerns. Mr. Veri explained that there are different classes of apartments in the Township which are class A, B, and C properties based on amenities and other factors. Mr. Veri stated that Canton Crossings Apartments is a low rated Class B property. Mr. Veri explained that before investing millions of dollars on a project they do their due diligence to ensure what the market will bear. Mr. Veri indicated that they reviewed the Summit Creek Apartments, Uptown Apartments, Village Green and Cinnamon Pointe occupancy rates which are above 90% along with rental rates for each complex. Mr. Veri explained that he does not build apartments but communities. Mr. Veri indicated that his unit products include basements, granite, tile, wood flooring and are as nice as any of these houses he has built. Mr. Veri stated that the residents of these apartments are a different class of renter and that there is not a high turnover rate. Mr. Veri stated that Class A properties average from $1.30 a square foot to $1.17 a square foot. Mr. Veri stated the Canton Crossing Apartments average $1.12 a square foot. Mr. Veri stated that he anticipates the rental units to range in price from $1, to $1, a month. Mr. Veri explained that there has been a change in the rental market which has now seen baby boomers selling their homes and taking the nest egg and putting it in the bank and renting ranch units. Mr. Veri stated that many families are going into apartments rather than purchasing homes. Mr. Veri explained that the units will look more like condominiums and not stacked apartments. Mr. Veri stated that they are reaching a different demographic. Mr. Veri indicated that on the west side of the freeway where industrial buildings are located there is not a tree standing unless it is part of the landscaping. Mr. Veri explained that they will preserve more trees than any industrial use ever would preserve. Mr. Veri stated that the trees closest to the residential homes will be preserved.

3 Planning Commission Proceedings 3 September 11, 2017 Mr. Veri stated that as far as traffic a residential development would have less of an impact than a foot tall, 200,000 square foot industrial building. Mr. Veri stated that an industrial building would lower the property values in the area. Mr. Veri explained that a traffic engineer was consulted to ensure that residents would not be negatively impacted. Mr. Veri stated that if the project were to negatively impact the residents the project would have never been presented. Mr. Veri stated that an industrial project would bring large semi-trucks. Mr. Veri stated that residents voice concern of people using Holiday Park Subdivision as a cut through to Joy Road. Mr. Veri indicated that residents use a direct route to travel versus meandering through a subdivision. Mr. Veri indicated that his company took over an unfinished condominium development in Pittsfield Township and built them all the same but kept them as rental units. Mr. Veri stated that he was approached by the condominium association about taking over their association to help them with maintenance and upkeep. Mr. Veri stated that they help neighborhoods by maintaining a nice product. Mr. Veri stated that he was aware of the resident s concerns relative to the train. Mr. Veri stated that he visited the site at 3:30 p.m. in the afternoon and that the freeway noise can be heard in the background but was able to carry on a normal conversation without shouting. Mr. Veri indicated that while the train was approaching it was loud but after the train went through the intersection one could resume their normal conversation. Mr. Veri stated that the train rumbles the ground but the homes in Holiday Park were built in the 1970 s before the current standards. Mr. Veri stated that current standards require glass and insulation installed that mitigates sound. Mr. Veri indicated that they are proposing to flip the entrance and move it farther away from the train area. Mr. Veri also indicated that the buildings will create more of a buffer to help with noise deflection. Mr. Veri stated that he has built homes along I-275 in Canton and along train tracks in Saline and that all of the homes have sold. Chairman Greene asked for comments from the audience. Katherine Stafford, Koppernick, stated that she was concerned with the integrity of the dirt road and additional traffic to the area. Ms. Stafford verified that sidewalks are included as a feature to the development. Mr. Goulet stated that the road is a Wayne County road. Edward Cope, 7941 Kaiser, stated that he opposes the rezoning as he has lived in Holiday Park for 27 years and his home backs up to the proposed parcel. Mr. Cope stated that he has taken comfort in knowing that the property was zoned light industrial and was useless for that purpose. Mr. Cope stated that by having a secure wooded area it would remain a sanctuary for deer and other animals. Mr. Cope stated that he was astonished the Planning Commission would consider allowing a family dwelling to be built on such a small parcel and so close to I-275 and the railroad tracks. Mr. Cope indicated that the developer has moved a large swath of trees and vegetation to the site. Mr. Cope stated that one can feel the rumble of the trains as it travels by and that this is an illconceived project. Mr. Cope stated that property values will be negatively impacted and was concerned this development will become Section 8 housing. Mr. Cope stated that he requested the parcel remain light industrial. Mr. Cope read his letter of opposition in its entirety which was entered into the record. Chairman Greene asked Mr. Cope which zoning he would prefer light industrial or residential. Mr. Cope stated that industrial zoning would not have the potential for the crime element.

4 Planning Commission Proceedings 4 September 11, 2017 Jane Murphy, 7719 Kaiser, Canton, MI, house abuts the property and was concerned with water erosion and soil. Ms. Murphy stated that she has spent thousands of dollars to raise the foundation of her home due to erosion. Mr. Veri explained that the decision was made to relocate the pond to the other side of the site so that water would not impact her home. Mr. Veri explained that all storm water must be managed within their site and cannot flow into the adjacent property. Courtney Cope, 7941 Kaiser, stated that many trees have been removed inquired why the expense was made to do this if the property hasn t been rezoned. Mr. Veri explained that when developers purchase property topographic studies are required to assess the property and brush needs to be cleared to examine the property. Mr. Veri explained that if the rezoning is not approved the area will fill back in time for a healthier forested area. Madalynn Rieksts, Lynn, stated that she is a new resident to the area and was pleased to see that the project will attract a better class of renter but was concerned with safety due to the proximity of the railroad and highway. Ms. Rieksts indicated that as a parent with children she would not be apt to rent the apartment due to these concerns. Ms. Rieksts inquired as to why the Ordinance Department stopped the removal of trees. Mr. Goulet explained that a resident called concerned with illegal clearing and an Ordinance officer was sent to investigate. Mr. Goulet explained that the Township Tree Ordinance regulates larger material 6 inches or greater and that they were within the guidelines to remove trees and brush. Mr. Veri indicated that an 8 foot vinyl privacy fence will be installed along the railroad area and I-275 to prevent people from accessing the development from the trail. Mr. Rieksts stated that if Koppernick were paved it may help traffic. Ms. Rieksts asked that neighbors be respective to the Planning Commission and Planning staff to that the residents will be taken seriously. Mr. Veri stated that the residents can contact Wayne County Road Commission to get the road graded. Dorothea Broome, John, stated that she has resided in her home for 41 years and was concerned with additional residents and automobile backups because of the train. Ms. Broome explained that she was concerned that emergency responders would not be able to access the residents due to backups and an additional 200 residents will make the situation worse. Ms. Broome indicated that Huron Township has added cameras at their road crossings so that dispatchers can reroute the emergency vehicles if the roads are blocked. Ms. Broome suggested requesting a quiet zone be designated at the railroad crossings to help with the quality of life. Ms. Broome inquired whether the sewer lines will be tied into the development. Mr. Goulet stated that he will pass on safety concerns to Public Safety to review safety procedures at railroad crossings. Mr. Veri stated that he was in 100% support for action with regards to public safety. Mr. Evan Priest, project engineer, stated that will not be an issue with capacity of sanitary sewer. Mr. Priest explained that the Township has examined the existing pipe system and slopes to ensure there is capacity to carry the additional loading from developments. Mr. Priest indicated that it was determined there was a maximum allowable density for up to 128 units and that this development is at 90 units and do not anticipate any issues with sanitary capacity. Mr. Priest indicated that when there is a significant rain event the water goes directly into the pipes and into the creek. Mr. Priest explained that the pond will be designed to retain and hold water for storm events for a period of 24 hours to 40 hours for a maximum storm event.

5 Planning Commission Proceedings 5 September 11, 2017 Ruth Bolton, 7953 Kaiser, stated that she does not want the development to move forward and was concerned the project was a done deal regardless of resident s opinions. Chairman Greene stated that the Planning Commission takes all comments into consideration and want to hear what people have to say and appreciates the comments. Chairman Greene explained that the Planning Commission s purpose is to do their best for the community and the Township. Mr. Goulet explained that the Planning Commission is a recommending body and that regardless of the decision of the Planning Commission the item will proceed to the Township Board for two readings. Mr. Goulet explained that public comments are taken so that the applicant can address any concerns so the Planning Commission can weigh these concerns and have them addressed. Mr. Goulet stated that the residents should be proud that so many of their neighbors have come to the meeting to give Mr. Veri an opportunity to address these concerns. Larry Posh 7823 Kaiser, stated that the woods have been cleared and the noise levels are already higher. Mr. Posh stated that he can feel the house vibrate from the noise and trains and does not believe people will pay for this type of housing with the noise level. Jenna Andrews, Lynn, inquired as to a time frame for completion of the project and if all area residents were notified of the project. Mr. Goulet explained that Mr. Veri sent out courtesy letters to adjacent homeowners and that the Township requires notification of rezoning hearings to area residents within 300 feet of the proposed project. Paris Phou, Lynn, stated that he was the author of the petition which was submitted to the Township of those who could not attend the hearing. Mr. Phou stated that he is familiar with apartment zoning and inquired if there is anything stopping Mr. Veri from selling the development to another developer or if his intentions are to keep the development. Mr. Veri stated that it is his intention for the development to be kept in their real estate portfolio. Kelly Desrosiers, 7775 Kaiser, stated that the wildlife and trees have been greatly impacted and was concerned with additional traffic and train backups. Grace Morgan, 4452 Meadow Creek, verified that the pond is a detention pond. Mr. Goulet stated that the pond is a detention basin which will have a permanent water level. Marge Wulf, Koppernick, stated that automobiles use her driveway as a turn around when traffic is congested. Ms. Wulf requested if a barrier can be placed across her driveway. Mr. Goulet stated that there is no reason that something cannot be placed in the driveway to prevent turn around. Mr. Goulet indicated that an additional driveway access on the north side will give automobiles another turn around access. Ms. Wulf was concerned with lights all hours of the night reflecting into her home. Mr. Goulet explained that the plan shown is conceptual and that they can review final design during site plan review. Gail Owens, 8416 Orhan, stated that she was concerned that additional units will bring more people cutting through their development due to train traffic. Ms. Owens stated that speed bumps in the neighborhood may help the situation. Ms. Owens stated that there has been a rat problem in the neighborhood which will become worse along with an increase in crime and drugs. Ms. Owens stated that the Canton Police are at The Crossings of Canton continually.

6 Planning Commission Proceedings 6 September 11, 2017 Ms. Owens stated that she finds it difficult to believe people will pay $1, a month to live near the railroad tracks. Morgan Cates, Koppernick, stated that the stop sign near their home is continuously disregarded and this complex will bring more traffic. Mr. Goulet suggested that Ms. Cates contact Canton Public Safety for selective enforcement and unit patrol and will pass the information along for selective enforcement patrol. Madalynn Rieksts, inquired if the features discussed will be constructed. Mr. Goulet explained that there is a Statement of Conditions agreement which details the maximum number of units, maximum length of building and buffers to be maintained. Mr. Goulet stated that the development agreement will be recorded and the developer has 2 years to act on the plan and get the site plan approved and under construction. Mr. Goulet stated that if the developer fails to meet the 2 year agreement then the zoning reverts back to its original designation of light industrial. Mr. Goulet stated that the developer must meet the general zoning guidelines per the Ordinance. Mr. Goulet read a brief synopsis of the agreement of the Statement of Conditions that the developer has proposed. Ms. Rieksts asked that consideration be given for a 2 lane entrance for easier access in and out of the development. Mr. Veri stated that he has had conversations with his engineer relative to this suggestion and is still investigating this option further. David Pund, 7705 Kaiser, stated that the pond was designed to retain water and inquired of drainage. Mr. Goulet stated that there must be a physical connection to a Wayne County drain. Mr. Goulet explained that the County requires the drain to be restricted so that it doesn t flood the County drain so it will hold back water for a period of time and allows sediments to drain into a fore bay and the permanent water level. Mr. Goulet explained that it is required that the banks of the pond be vegetated along with a percentage of aquatic material planted. Mr. Goulet stated that the pond will develop into a natural wetland system. Mr. Goulet stated that there is a permanent water level which will prevent mosquitos from hatching. Mr. Pund verified that cattails or other weeds are not allowed to grow in the pond. Mr. Goulet explained that sometimes this type of plant material grows naturally but the Township requires a maintenance bond to ensure the native material grows so that it keeps the non-native plant material out of the pond. Mr. Pund inquired of the turn-around access at the end of the road. Mr. Veri stated that the turn-around is for emergency vehicles and larger trucks such as school buses or garbage trucks. Mr. Goulet state that Canton Crossings is under new management and anticipate substantial changes to the development. 7 Planning Commission Proceedings 7 September 11, 2017 Commissioner Graham-Hudak stated that she understands the concerns of the residents but if the zoning remained light industrial there is the potential for all of the vegetation to be removed. Commissioner Graham-Hudak stated that she was very concerned with emergency responder access. Commissioner Graham-Hudak requested the petition from Mr. Phou is added into the record. Commissioner Graham-Hudak stated that the traffic study indicates daily traffic for light industrial use is 803 vehicles per day versus 669 vehicles for apartments. Commissioner Graham- Hudak stated that the threshold for paving a road is 1000 trips per day. Mr. Goulet stated that the condition of Koppernick Road has existed for many years and that it needs to be evaluated by the County. Commissioner Graham-Hudak stated that she was in favor of instituting a quiet zone with regards to the railroad. Commissioner Graham-Hudak inquired as to why the property has not been developed as light industrial. Mr. Goulet stated that this is one of the remaining industrial pieces of property in the northeast portion of the Township and cannot guess as to why it has not been developed. Mr. Goulet stated that as property becomes more scarce remaining parcels become more valuable. Commissioner Graham-Hudak inquired of sewage and capacity. Mr. Goulet explained that studies show there is no negligible changes in terms of capacity for Light Industrial or R-6, Single-Family Attached Residential zoning. Mr. Goulet explained that the sewer model takes all the County and Township sewer lines and what feeds into them by sewer district and factors in a certain amount of peak sewage flow for each property based on maximum development pursuant to the zoning or master plan. Commissioner Zuber stated that they do not prejudge the proposals and take the resident s concerns very seriously. Commissioner Zuber stated that eventually some type of development will occur and want what is best for every party involved. Commissioner Zuber explained that a project is evaluated on its merits and thanked everyone for their comments and input Commissioner Perkins inquired of the square foot price per foot between Canton Crossings and this product. Mr. Veri stated that Canton Crossings averages $1.12 per square foot and his product will average $1.15 per square foot. Mr. Veri stated that the units have 3 bedrooms with 2.5 baths and are 1,500 square feet and the 2 bedroom, 2 bath units are 1273 square feet. Commissioner Okon inquired of the landscape buffer requirements between residential and industrial developments. Mr. Goulet stated that it is 30 feet for an industrial development and then would need to clear to accommodate a landscape berm and parking lot. Mr. Goulet stated that an industrial use could bring trucking with docks and all the noise associated. Mr. Goulet stated that there was an industrial development on Baron Drive near condominiums that were adversely impacted with noise and had to go to court to enclose the portion that dealt with the stamping operations. Mr. Goulet stated that not all light industrial operations are quiet and one cannot control the type of operation. Mr. Goulet stated that there are very few areas in the Township which industrial development abuts to residential in the Township. Commissioner Okon indicated that a 200,000 square foot industrial building with 500 parking spaces is not out of the question and that a residential development is less invasive. Mr. Veri stated that the apartment will have garages. Commissioner Okon stated that large semi-trucks would make the dirt road worse. Mr. Goulet stated that semi-trucks often idle with the fumes and noise associated. Mr. Goulet explained that from a planning perspective it is never recommended to have an industrial development adjacent to residential.

8 Planning Commission Proceedings 8 September 11, 2017 Mr. Goulet stated that on the north side of Michigan Avenue it is zoned Light Industrial Research which calls for larger buffer areas and setbacks. Commissioner Okon verified that all the units have 1 car oversized garages. Commissioner Okon suggested increasing the landscape buffer. Mr. Goulet stated that the Planning Commission must accept or reject the statement of conditions as presented. Commissioner Okon stated that changing the zoning to residential is less impactful than an industrial building. Chairman Greene inquired as to what can be done to help buffer the railroad area. Mr. Veri indicated that an 8 foot vinyl privacy fence will encompass the entire western and northern line and return to the bend for visual separation. Mr. Veri stated that removing trees is costly and do not want to remove anything they do not have to remove. Mr. Veri stated that he intends to make a beautiful site and will have the same type of features in the rental units as he does in his homes. Chairman Greene stated that a residential development would be preferred than light industrial over time. Julie Kroll, Fleis & Vanderbrink, engineer for the traffic impact study, stated that the same peaks in morning and afternoon were used and recommended updating the signal timing to improve the level of service for the road. Ms. Kroll stated that they reached out to Wayne County to update their signalization timing. Mr. Goulet stated that he will have the Township Engineer to follow up with Wayne County. Commissioner Zuber stated she would prefer a residential development rather than a light industrial development. Motion by Okon, supported by Zuber, to move to recommend approval of the request to conditionally rezone tax parcel #s and from LI, Light Industrial District to R-6, Single-Family Attached Residential District, subject to the Statement of Condition and concept plan voluntarily offered by the applicant. Ayes: Nayes: Absent: Engel, Greene, Okon, Perkins and Zuber Graham-Hudak Dodson 2a. 025-PDQ-4230 WESTCHESTER III FINAL PDD Consider Final PDD for parcel no Property is located south of Warren Road and west of Ridge Road. 2b. 025-SPP-4232 RIDGE CREEK (WESTCHESTER 3) Consider preliminary site plan approval for parcel nos Property is located south of Warren and west of Ridge Road. Mr. Goulet stated that the property was rezoned to R-1, Single-Family Residential District in Mr. Goulet indicated that Singh Development is purchasing the property and proposes to develop a 22 unit single-family site condominium on 22 acres. Mr. Goulet explained that a Planned Development (PDD) is proposed in order to cluster the lots to preserve the wooded ravines and other forested areas along the east and southern property boundaries. Mr. Goulet indicated that almost 47% of the land will be retained in common open space with the housing proposed similar to those homes already being constructed in Westchester. Mr. Goulet indicated that the minimum lot size is 13,500 square feet with lots ranging from feet in width.

9 Planning Commission Proceedings 9 September 11, 2017 Mr. Goulet stated that the required definite benefits to the community include: paving an extended portion of Ridge Road north of the Park West Apartment site to the entrance drive to Patriot Park, preservation of natural features and open space, creation of additional value for the units that will back onto wooded and ravine areas, architectural standards that exceed the ordinance minimums, and provisions of amenities including decorative mailboxes and street signs. Mr. Goulet explained that the project sponsor is still in the process to determine what trees will be removed. Mr. Grewal, Singh Development, stated that the review was thorough and happy to answer any questions. Mr. Dick Dionne, Warren Road, stated that he previously expressed concern regarding lighting installed on the public areas. Mr. Dionne stated that he reviewed the current plan with the modifications and found it to be minimally disruptive and very respectful to the neighbors that face the property. Mr. Dionne stated that he was pleased to see the developer took his concerns into consideration and that the modifications were made. Motion by Zuber, supported by Perkins, to open the public hearing. Ayes all present on a voice vote. Motion by Zuber, supported by Perkins, to close the public hearing. Ayes all present on a voice vote. Commissioner Perkins thanked Mr. Dionne for his comments. Chairman Greene stated that he looks forward to the project and it is a great addition to the area. Motion by Zuber, supported by Perkins, to move to recommend approval of the request to approve the Final Planned Development for Westchester III and Preliminary Site plan for Ridge Creek Site Condominium on tax parcel # , as proposed.
