1 KINGSBURG PLANNING COMMISSION REGULAR MEETING MAY 10, 2007 Call to order At 5:01 P.M. Commissioner Parlier called the meeting of the Kingsburg Planning Commission to order. Commissioners Present Commissioner Henslee, Commissioner Woollard, Commissioner Polyack, Commissioner James, Commissioner Martin and Commissioner Parlier. Commissioners Absent Commissioner Taylor Staff Present Planning and Development Director Terry Schmal, Building Official Daryl Sonksen, City Engineer Dave Peters, Jeremy Schmal, and Planning Secretary Mary Colby. Others Present Jack Sheldon, Larry Cerutti, Sandra Staats, Peggy Gibbs, Mike Gibbs, Holly and Louis Olson, Pam Graham, Daniel Graham, Richard Langdon, Paul Lungren, Wes Reeder, Elmo Hays, Warren Nystrom, Karan Cerutti, Glen Morton, Doug Englebright, Michael J. Approval of minutes Commissioner Polyack made a motion, seconded by Commissioner James, to approve the minutes of the April 12, 2007 minutes as presented. The motion carried by unanimous voice vote NEXT RESOLUTION NUMBER Public Comments There were no citizens present who wished to comment at this time. PUBLIC HEARING - ZONING ORDINANCE AMENDMENT TO CHANGE HEIGHT RESTRICTION IN THE IH (HEAVY INDUSTRIAL) ZONING DISTRICT. Planning and Development Director Terry Schmal stated that this item is brought to the Planning Commission in response to the concerns raised to staff by Guardian Industries. The City of Kingsburg is pursuing annexation of a large portion of land in the Industrial Corridor which includes Sun Maid, Guardian Industries, and Vie Del Grape processing plant along with some small parcels in this area. Guardian Industries is concerned with city regulations regarding height of structures in the Heavy Industrial Zone which could affect future construction on their site. He stated that although the structures which are on the site now will be grandfathered in at annexation, future construction planned for this site exceeds the maximum height limit allowed by the current Zoning Ordinance. The height of smoke stacks is regulated by the emission control districts. The Public Hearing was opened at 5:10 P.M. There were no citizens present who wished to speak for or against this item and at 5:11 P.M. the Public Hearing was closed.
2 Commissioner Polyack asked what the county requirements for height are currently. Planning and Development Director Terry Schmal stated that he is not sure what the county s height restrictions are. Commissioner Henslee made a motion, seconded by Commissioner Martin, to recommend to the City Council approval of the proposed modification to the Zoning Ordinance. That the prepared Initial Study and Environmental Checklist satisfy the requirements of the California Environmental Quality Act, and that a Negative Declaration is the proper determination of environmental impact. That it approve the following revision to Paragraph G of Section 1105 (I Property Development Standards), the Industrial zone districts section of the Kingsburg Zoning Ordinance: G. Building Height: No greater than 75 feet, except that a greater height may be approved for tanks, towers, silos and similar facilities under the provisions of Article 17; and except that a height of no greater than 200 feet shall be permitted for a site in the IH (Heavy Industrial) Zone District at least one mile away from the Central Business District. The motion carried by unanimous vote of those Commissioners present. PUBLIC HEARING PLANNED UNIT DEVELOPMENT PUD FOR A MIXED COMMERCIAL AND RESIDENTIAL PROJECT LOCATED AT 252 SIERRA STREET. CONSISTING OF 11 RESIDENTIAL UNITS AND UP TO 8,000 SQUARE FEET OF COMMERCIAL SPACE. APPLICANT LARRY CERUTTI. Planning and Development Director Terry Schmal stated that this project has been presented to the Planning Commission in conceptual form. The primary change to this project is the addition of two living units on the ground floor and the elimination of one entrance on Sierra Street. Mr. Schmal proceeded to describe the other minor changes that have occurred since the Planning Commission last reviewed this project. At 5:22 P.M. the Public Hearing was opened, Doug Englebright, who lives on Cardinal Lane, stated that there is concern over this project because there are a lot of kids that live in this area and what type of tenants will live in the apartments. There were no other citizens present who wished to comment and at 5:25 P.M. the Public Hearing was closed. The color elevations of this project were distributed to the audience to show that this is an upscale project and should not present any tenant problems. Commissioner Polyack made a motion, seconded by Commissioner James, to recommend to the City Council approval of Planned Unit Development PUD for a mixed
3 commercial and residential project located at 252 Sierra Street consisting of 11 residential units and up to 8,000 square feet of Commercial Space. That the enclosed Initial Study and Environmental Checklist satisfy the requirements of the California Environmental Quality Act, and that a Negative Declaration is the proper determination of environmental impact. That it make the findings in Part E of Section 1907 of Article 19 of the Kingsburg Zoning Ordinance (Planned Unit Developments), and conditionally approve Planned Unit Development PUD for a mixed-use development at the southeast corner of Sierra Street and Rafer Johnson Drive, subject to the following conditions proposed by the City Engineer: General: 1. That all conditions of the applicant be conditions of approval, except as further modified below, and subject to modifications to conform to applicable City Standards. 2. That the conditions of approval contained herein are in addition to those in Section 18 of the City of Kingsburg Improvement Standards. 3. That the applicant pays all fees as required by existing ordinances and schedules. 4. That the developer coordinate with and obtain Encroachment Permits from other agencies (Caltrans, CID, Fresno County, etc.) for any work within other jurisdictions. 5. That a detailed grading & site improvement plan be submitted for review and approval by the City Engineer indicating provisions for the following facilities: a) Water & sewer service to the trailer b) Temporary parking lot lighting c) Parking lot drainage details d) Pedestrian trailer ramp details 6. That the garage access at the southeast corner of the project be modified such that a standard turning radius is established for each garage. 7. That direct vehicular access be taken from Rafer Johnson Drive and Sierra Street as approved by the City Engineer. The motion carried by unanimous voice vote of those Commissioners present.
4 PUBLIC HEARING - CUP FOR A TEMPORARY SALES AND CONSTRUCTION TRAILER LOCATED ON TRACT 5609 BOB SCHOETTLER Planning and Development Director Terry Schmal stated that there was slight confusion with the location; this project is actually proposed to be placed on Tract 5609 which is at the corner of Kamm and 10 th Avenue. He stated that before the trailer can be placed on this site the parcel must be annexed into the City of Kingsburg. At 5:24 P.M. the Public Hearing was opened. Bob Schoettler stated that he would like to clarify that this is a self contained trailer, with its own water and septic tank. He stated that this is a temporary location and once the improvements are in place it will be relocated. There were no other citizens present who wished to comment and at 5:26 P.M. the Public Hearing was closed. Commissioner Parlier stated that it would be better to move the proposed sales trailer further back onto the property in order to allow trucks to drive straight out to Kamm Ave. Building Official Daryl Sonksen stated that there are issues that will be addressed when the plans are submitted for a building permit. Commissioner Polyack made a motion, seconded by Commissioner Henslee, to approve CUP for a temporary sales and construction trailer to be placed on Tract 5609 located at the corner of Kamm and 10 th Avenue with the following conditions of approval: 1. That a final tract map is first approved and recorded for Tract 5609 and the property is annexed to the City before the trailer is installed. 2. That the trailer be located so that trucks are able to turn around and drive straight onto Kamm Avenue. 3. All of the conditions contained in Section 1402 of the Zoning Ordinance. The motion carried by unanimous vote of those Commissioners present. PUBLIC HEARING TENTATIVE TRACT MAP TTM 5839, 64 SINGLE-FAMILY LOTS AND AN OUTLOT FOR APPROXIMATELY 37 CONDOMINIUMS. APPLICANT WEST STAR CONSTRUCTION. Planning and Development Director Terry Schmal presented an overhead showing the layout of this proposed subdivision. He gave a brief background of this project stating that a General Plan Amendment was presented for this parcel at the last meeting and tabled to see if the Tentative Map would progress as proposed without a General Plan Amendment. Planning and Development Director Terry Schmal stated that this project is too dense to proceed even with a Planned Unit Designation and comply with the General Plan. Sandra Staats, West Star Construction, Zediker, Kingsburg, stated that after reviewing the staff report and correspondence included in the packet they would like to continue this
5 item and work with staff to determine how the subdivision can be reworked to conform to the General Plan. At 5:50 P.M. the Public Hearing was opened, Commissioner Parlier asked for comments from the citizens present. Erwin Ohannesian, 1880 Nelson Way, Kingsburg, stated that a lot of time was spent on the North Kingsburg Specific Plan and something very different than this proposal was envisioned for this area. He stated that 12,000 square foot lots were to be placed here not small lots. He stated that maps with this density belong in an urbanized area. Mr. Ohannesian stated that this is a prime piece of property and if built to this density the trip generation would be greatly increased. He stated that as a resident of this community he is opposed to this project and would like to see larger lots in this area. This is not what the committee working on the NKSP planned for this area. Pamela Graham, 2461 Harold Street, asked that the Planning Commission reject this proposal for Tract 5839, because it does not meet the General Plan for North Kingsburg. Ms. Graham thanked the Commission for all the work done to adopt such a beautiful plan. Peggy Gibbs, 239 Vista DeCierra, Los Gatos, executor of Holly and Louis Olson s estate stated that she is proud of the NKSP and feels it is a testament to what Kingsburg is good at, which is preserving the heritage and charm of Kingsburg. She stated that the Commissioners with the plan in front of them should ask the applicant to bring back their original plan which was a low density project. Ms. Gibbs asked the Planning Commission to reject TTM 5839 submitted by West Star Construction because of the negative impact it will have on the town. Mike Gibbs 239 Vista DeCierra, Los Gatos, executor of Holly and Luis Olson s estate stated that he also attended the meeting on the NKSP. He asked that the Planning Commissioners reject TTM Mr. Gibbs stated that it was interesting that they sat in meetings with Mr. Crinklaw and that his first presentation of this property met the requirements of the North Kingsburg Specific Plan. This proposal does not. He stated that he loves coming to Kingsburg where everyone is friendly. He also pointed out that the Mission Statement is to preserve the charm and heritage for the citizens of Kingsburg and stated that he is sure the gentlemen on the Planning Commission are committed to this statement. Commissioner Polyack left the dais at 6:00 P.M. Paul Lungren presented his concerns and stated that the other areas of town with small lot sizes look like there is a party all the time, Kingsburg does not need this type of density. Elmo Hays who lives two properties down from parcel in review, stated that he is in agreement with what Erwin Ohannesian and the Olson s have to say. Justin Tuttle, who lives in the Gateway Subdivision, and is an attorney living in Kingsburg for 4 ½ years, stated that he moved here because of the quality of life and to raise his children. He stated that the entrance to town is fantastic and feels this is a wonderful town and community. Mr. Tuttle stated that his main concern is the added density in this area he
6 feels that this will completely change the dynamics of this area. He stated that he loves living in Kingsburg and asks that the Planning Commission reject this tract map and not put this type of housing in this area. He stated that there are other areas to put infill development and higher density housing. Mrs. Fattah stated that she has lived in Kingsburg for 25 years. She stated that she now lives on Kamm Avenue in a very nice neighborhood and does not want to see apartments behind her house. Paul Kaley th avenue, stated that his home is not too far away from this proposed project, the General Plan call for less density. He stated that they are more concerned about the density than the lot size. If higher density is proposed it would lower the property value in this area. Please take this into consideration. Commissioner Parlier stated that this hearing will be continued to the next regular meeting when the modified map is brought back.
