1 MUNICIPALITY OF MONROEVILLE PLANNING COMMISSION APRIL 18, 2007 MINUTES The meeting was called to order at 8 p.m. by Vice Chairman Frank Bole. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited and a moment of silence observed. ROLL CALL The Recording Secretary, Sharon McIndoe, called roll and the following were present: Frank Bole, Jack Murray, Bob Kerr, Bill Kelmickis, Lorrain Lewis-Burke, Shelly Kaltenbaugh and Paul Hugus. Messrs. Erb, Humenik and Rosensteel were absent. APPROVAL OF MINUTES There being no corrections, additions or deletions to the minutes of the regular meeting of February 21, 2007, Mr. Murray duly made a motion to approve them, as submitted, and Mr. Kelmickis seconded it. Upon a voice vote, the motion carried unanimously. Mr. Bole welcomed the newest member to the planning commission, P. Lorraine Lewis-Burke from Ward 7. OLD BUSINESS 07-3-SUB CAMBRIDGE SQUARE ASSOCIATES LIMITED PARTNERSHIP The applicant is requesting final subdivision approval combining five lots to create one of 764,591 square feet. The property is located at 120 Cambridge Square Drive and includes the seven multi-family buildings and associated land uses. The property is zoned R-2, Multi-Family Residential. The applicant requested tabling and waived all time limits. There being no further discussion, a motion was duly made by Mr. Kerr to table Application No Z and Mr. Kelmickis seconded it. Upon a voice vote, the motion 07-5-SUB LAVERGNE V. GARNER The applicant is requesting final subdivision approval to combine three lots to create a new two-lot subdivision, Lot 17A of 9,000 square feet and Lot 17-B of 7,930 square feet totaling 16,930 square feet. The property is located on the northerly side of Orange Street at its intersection with Plum Street. It is zoned R-2, One-Family Residential. Mr. Sam Miller came forward representing the applicant. Ms. Kaltenbaugh reported the issues with the size have been resolved, that it was an error in the plan and they are now conforming lots. After a brief discussion, Mr. Kelmickis duly made a motion to approve Application No SUB and Mr. Murray second it. Upon a voice vote, the motion 07-4-Z EARNEST HENDRICKSON The applicant is requesting a one-lot rezoning changing 32.2 acres of property zoned S, Conservancy to C-2, Business/Commercial. The property is located on the southerly side of Route 22 bound to the west by On-Line, Incorporated, Gretchen Karcher Raymond and Judy Klein, Elizabeth Ringer, Kathy Dunn, John and Susan Smith, Yessayi and Oliver Mardirossian, George and Jennifer Maksim, Elmer and Susan Durst, John Doelfel, Alan and Joanne Milford, Margaret Hester and to the south by property belonging to the Municipality of Monroeville, Kevin and Rebecca Haberstroh, Lekar Development, William and Carolyn Zinchini. The applicant requested tabling and waived all time limits. There being no further discussion, a motion was duly made by Mr. Kerr to table Application No Z and Mr. Murray seconded it. 4 Regular Meeting 4 April 18, 2007 NEW BUSINESS 07-7-C HUNTLEY AND HUNTLEY/MICHAEL R. WALKO The applicant is requesting conditional use approval as per Section 401.8, Conditional Uses, Monroeville Zoning Ordinance No. 1443, as amended, allowing for the preparation of an access road and drill site, drilling operation and the extraction of natural gas from one well site. The project is located on the northern side of Forbes Road. The total property area involved equals acres. The property is zoned S, Conservancy. Mr. Michael Hillebrand, Vice President of Huntley and Huntley, came forward to explain the request. He stated this is a continuation of their development in the southern part of Monroeville down by Trafford. He stated it is located across from the old Westinghouse Plants Trafford Commerce Center off of Forbes Road. He indicated it would be accessed from the property owner s access into his home and detoured behind some residences at the top of the hill. He asserted since this is in a residential area they will be obliged to agree to the curfew. Mr. Bole requested the shut down be started by 6 p.m. to be completely down by 7 p.m. Mr. Hillebrand agreed to go from 7 a.m. to 7 p.m. Monday through Friday. Mr. Bole also requested a fence around the property and Mr. Hillebrand agreed to do so. Mr. Bole inquired whether it would be approximately three weeks to complete the drilling and Mr. Hillebrand disagreed. He explained it would take approximately five days to drill the well unless there were unforeseen circumstances. Mr. Murray inquired whether that would be for the complete well or just the drilling and Mr. Hillebrand answered that is just the drilling phase. He explained the whole operation should take approximately 45 to 50 days. Mr. Murray questioned whether there is a development period after the drilling and Mr. Hillebrand answered affirmatively. Mr. Hugus requested a copy of the DEP well permit and the fire code application. There being no further discussion, Mr. Murray duly made a motion to approve Application No C and Mr. Kelmickis seconded it. Upon a voice vote, the motion 07-8-C HUNTLEY AND HUNTLEY/SUSAN R. WEISS The applicant is requesting conditional use approval as per Section 401.8, Conditional Uses, Monroeville Zoning Ordinance No. 1443, as amended, allowing of the preparation of an access road and drill site, drilling operation and the extraction of natural gas for two well sites. The project is located at 155 Monticello Drive and east of Ramsey Road. The total property area involved equals 26 acres. The property is zoned R-1, One- Family Residential and S, Conservancy.
5 Regular Meeting 5 April 18, 2007 Mr. Michael Hillebrand, Vice President of Huntley and Huntley, came forward to explain the request. He indicated this well is located close to the previously discussed well and access will be made off of Ramsey Road and Monticello Drive. Mr. Hugus inquired whether access would be made coming off of the Weiss Driveway and Mr. Hillebrand answered affirmatively. He stated there are two wells; one behind the house and the second is across the ravine below the houses by the streambed and the access would be obtained along that streambed. He explained the construction would take a little longer, approximately one week for the first well and another one for the second well. He indicated since it is located in a residential area, they would observe the 7 a.m. to 7 p.m. work hours. Mr. Bole inquired whether they would observe the same work hours of start to shut down at 6 p.m. with complete shut down at 7 p.m. and no Saturdays or Sundays; Mr. Hillebrand agreed. Mr. Bole questioned whether the trucks would be cleaned before leaving the site and Mr. Hillebrand answered all of the sites will have wash down stations. Mr. Murray questioned the distance between the wells and Mr. Hillebrand answered he tries to get them 1,250 feet apart from well to well. Mr. Murray inquired whether the road has to be bonded and Mr. Hugus explained municipal roads are bonded at $20,000 per mile. Mr. Hillebrand asserted that he could make his plan subsequent to what is preferred. Mr. Bole questioned whether there was any possibility that the access would be different than what is proposed and Mr. Hugus answered it would be different if it came out of Forbes Road because he would not use any municipal roads. Mr. Hillebrand asserted they would go up Old Ramsey Road where there is less residential travel in that direction. Mr. Bole questioned whether a change in the plans regarding access could be dealt with before the council meeting and Ms. Kaltenbaugh answered affirmatively. Mr. Hugus added that he would calculate the distances to see which is better. There being no further discussion, Mr. Kerr duly made a motion to approve Application No C and Mr. Kelmickis seconded it. Upon a voice vote, the motion 07-9-C HUNTLEY AND HUNTLEY/JAMES S. MARKEL The applicant is requesting conditional use as per Section 401.8, Conditional Uses, Monroeville Zoning Ordinance No. 1443, as amended, allowing for the preparation of an access road and drill site drilling operation and the extraction of natural gas from one well site. The project is located at the southern end of James Avenue, east of Thomas Street. The total property area involved equals 1.5 acres. The property is zoned R-2, One-Family Residential.
6 Regular Meeting 6 April 18, 2007 Mr. Michael Hillebrand, Vice President of Huntley and Huntley, came forward to explain the request. He stated it is located in the western end of their field by Patton Street and Route 130 past Pitcairn. He indicated it would be accessed off of Patton Street up Jefferson to Fourth and down to James. He stated this is most proximal to unassociated homeowners and it is located 210 feet from the closest homeowner in the area. He asserted the DEP regulations require 200 feet. He further explained this is located the closest to any home and they have done it as close as 80 feet in other municipalities with DEP permit approval. He asserted it could be done within 200 feet of a residence with the consent of the owners. He stated they would comply with all the conditions of bonding the roads and the restricted hours from 7 a.m. to 7 p.m. He indicated they would place a safety fence around the perimeter of the entire site with no trespassing signs and it will be monitored by a security guard. Mr. Bole inquired whether the safety fence would be in place during the drilling phase and Mr. Hollebrand answered affirmatively. Mr. Bole questioned whether the fence would be located around the well only and Mr. Hollebrand answered affirmatively. Mr. Bole inquired what was meant by directing everything toward Route 130 and Mr. Hollebrand answered the noise would be directed toward the valley. Mr. Bole inquired whether the time frame for the drilling would be five days and Mr. Hollebrand answered affirmatively. Mr. Bole questioned whether the reclamation would be done to the area after completion of the job and Mr. Hollebrand answered they would have a gravel access into the site. He added it would be seeded and mulched with a grass seed blend. Mr. Bole inquired about what area would be disturbed. Mr. Hollebrand explained it is a wooded site with perimeters being encroached with grass from the neighbors and he pointed out a rectangular area. Mr. Bole questioned why the area opposite to the road would be disturbed and Mr. Hollebrand answered that would be a temporary truck rest area. Mr. Bole inquired what area would be disturbed after the construction is complete. Mr. Hollebrand answered the well would be located in the corner and there will be a 30 by 25 foot galvanized area around it with an access road. Mr. Bole questioned what type of noise the neighbors could expect from the completed well. Mr. Hollebrand answered there is more noise in the winter than in the summer. Mr. Kerr inquired about the location of the closest house and Mr. Hollebrand pointed it out. Mr. Kerr questioned whether the well was moved to the furthest corner in order to get more than 200 feet from the resident; Mr. Hollebrand answered affirmatively. Mr. Bole questioned whether they have had any conversations with the homeowners and Mr. Hollebrand answered affirmatively. He explained they explained the access but more educational conversations would take place. Mr. Bole inquired whether some scrubery or trees could be put in place to buffer the neighbor from the well and Mr. Hollebrand answered it would be done in the operating phase. He explained since there is very little slope they were going to try to
7 Regular Meeting 7 April 18, 2007 place a barrier wall along the edge. He indicated pine trees could be placed on the backside of the property line. Mr. Kerr questioned whether the house is abutting the property. Mr. Hollebrand answered the house with the shed is encroaching and some of the yard is actually on the property. Mr. Bole inquired whether a buffer could be placed between him and the neighbor; Mr. Hollebrand pointed out an area where it could be done. Mr. Kerr inquired whether there is a required setback to the property line from the well; Mr. Hollebrand answered negatively. Mr. Kerr questioned whether the well could be placed on the property line and Mr. Hollebrand answered affirmatively. He explained the right of capture from the commonwealth states that all royalties go to the point of capture so the well could be placed right on the property line. Mr. Kerr asserted they would be close on this one and Mr. Hollebrand agreed. Mr. Kerr questioned what would spill over onto the next property owner and Mr. Hollebrand answered that all of the construction would be done within the safety fence. Mr. Kelmickis inquired whether the residents in the house would be able to hear the noise from this well once it is operating even though it is 200 feet away; Mr. Hollebrand answered negatively. Mr. Murray requested two different kinds of trees be planted in the area. Mr. Bole requested the same operating restrictions be observed with this well and Mr. Hollebrand agreed. There being no further discussion, Mr. Kelmickis duly made a motion to approve Application No C and Mr. Murray seconded it. Upon a voice vote, the motion ADJOURNMENT There being no further business to come before the planning commission, at this time, a motion was duly made by Mr. Murray to adjourn the meeting at 8:30 p.m. and Mr. Kelmickis seconded it.
