5 SOLERA AT STALLION MOUNTAIN UNIT OWNERS ASSOCIATION ASSOCIATION RULES & REGULATIONS (Adopted by the Board of Directors 5 August 2015) ARTICLE 1 PURPOSE, ORGANIZATION AND FINANCE 1.1 Governing Documents. The Solera at Stallion Mountain Unit Owners Association (the Association ) was established 6 May 2005, as a Nevada nonprofit corporation for the purpose of providing management, maintenance and care of the Common Elements and any other Areas of Common Responsibility placed under its jurisdiction. The duties and powers of the Association are defined in the Governing Documents, which are as follows: (a) Declaration of Covenants, Conditions and Restrictions for Solera at Stallion Mountain, as may be amended from time to time (the Declaration ); (b) Any Supplemental Declaration recorded from time to time pursuant to Section 2.9 of the Declaration; (c) Articles of Incorporation of Solera at Stallion Mountain Unit Owners' Association; (d) Solera at Stallion Mountain Unit Owners' Association Bylaws; (e) Solera at Stallion Mountain Unit Owners' Association Rules (the Rules ); (f) Design Guidelines of Solera at Stallion Mountain Unit Owners Association; (g) Declaration of Easements and Covenant to Share Costs (defined in Subsection 2.1.1); and, (h) Declaration of Covenants, Conditions, Restrictions, Easements and Servitudes (defined in Subsection 2.1.1). Each Unit Owner in Solera at Stallion Mountain is provided with a copy of all Governing Documents. By taking title to a Unit within Solera at Stallion Mountain, a Unit Owner agrees to comply with the provisions of the Governing Documents as they pertain to the Unit Owners and Members. Capitalized words used in these Rules will have the same meanings as described in Article I of the Declaration unless they are defined otherwise in this document. These Rules are only a part of the Governing Documents; Unit Owners should read all Governing Documents to gain an understanding of how the Association operates and what restrictions are placed upon their property and the Common Elements. 1.2 Management. The Board of Directors of the Association ( Board ) is responsible for the administration of the Association and is authorized to hire personnel necessary for the daily operation of the Association and its Common Elements. The Board has contracted with a property management company. The Community Manager, an employee of the property management company oversees the daily operation of the Association. The Community Manager works closely with the Board President to assure the Association is operated in a manner that will enhance and preserve the Community. The Community Manager's name, telephone number and address is provided Buyer at time of Unit purchase. 1.3 Finance. The funds necessary to operate the Association and its facilities are provided by the Assessments levied by the Association against each Unit within Solera at Stallion Mountain. The Board, subject to the provisions of the Declaration and Nevada law, has the authority to levy the following: Common Expense Assessments to pr ovide for the oper ation and management of the Association, Special Assessments for the cost of any constr uction, r econstr uction, r epair or r eplacement of facilities upon the Common Elements and, Rules and Regulations 5

6 1.3.3 Neighborhood Assessments for the cost of maintaining any Limited Common Element allocated to less than all Units or special services provided to less than all Units. The financial stability of the Association depends on the timely payment of all Assessments. The following rules shall apply to the payment of Common Expense Assessments and Neighborhood Assessments (if any): 1 st day of month in which payment is due: Assessment is due and payable to the Solera at Stallion Mountain Unit Owners' Association at the address provided to you by the Community Manager 15 th day of month in which payment is due: If payment is not received by the Community Manager or its assigns by the 15th day of the month in which it became due, a $25.00 charge for late payment is automatically assessed (charges for late payment will be applied on every account showing one full Assessment due with no notice to Unit Owner), and interest will be charged from the due date at the rate of 18% per annum. For more detailed information, please refer to the Solera at Stallion Mountains Collection Policy, sections D for Late Fees, F for Interests and G for 60 th Day after Due Date. Returned checks: There will be a $25 charge for checks not paid by a Unit Owner's bank. The fiscal year for the Association is the calendar year. The amount of the Common Expense Assessment and any Neighborhood Assessments will be determined each year by the Board; all Unit Owners will be notified and asked to ratify the budget at an Association meeting called for that purpose. Subsections and of the Declaration set forth the details of the budget approval process. 6 Solera at Stallion Mountain

7 ARTICLE 2 ASSOCIATION RELATIONSHIP TO ADJACENT PROPERTY OWNERS 2.1 Community Relationships. Solera at Stallion Mountain is adjacent to Stallion Mountain Country Club (the Golf Course ), The Estates at Stallion Mountain ( The Estates), and Stallion Mountain. 2.2 Shared Improvements. Monetary responsibility for maintenance of roads, guard station, fencing, landscaping as outlined in the Declaration of Easements and Covenant to Share Costs for the Solera and Estates Communities of Stallion Mountain recorded 18 May 2005 is shared on a percentage of use basis. 2.3 Golf Course. The Golf Course is a separate entity and is not affiliated with Solera at Stallion Mountain HOA other than as outlined in 2.1 above. Neither ownership nor occupancy of a Unit within the Community grants any ownership in, or right to use the Golf Course. Rules and Regulations 7

8 ARTICLE 3 ASSOCIATION PROPERTY AND FACILITIES 3.1 Release of Liability. Each person using the recreational facilities on the Association Common Elements does so at his or her own risk and hereby accepts and assumes any and all health and other risks as may now or hereafter be or become associated with such use, and agrees not to assert or make any claim against the Association, the Community Manager. Management Company or any director, officer, employee or agent. 3.2 Activity Cards Private Property. The Common Elements and all facilities located thereon are private and not open to the general public. Activity cards give evidence to Management Company Employees that a person is entitled to use the facilities on the Common Elements. Activity cards must be carried or worn by Residents whenever using the facilities. Persons not possessing an activity card may be asked to leave the facilities. Use of Common Area facilities is on a first-come, first-served ( first come ) basis with Community planned activities taking precedence (R&R 8.4.4) Resident/Unit Owner Activity Cards. Non-transferable activity cards (CC&R 6.9) will be distributed to Unit Owners who are Residents upon visiting the Association office after closing a Unit within Solera at Stallion Mountain. The Association will issue, at no cost to Residents, activity cards for up to two (2) Residents. If a Unit is occupied by more than two (2) Residents and the additional Residents desire to use the recreational facilities, each additional Resident (not to exceed two (2) additional Residents) must purchase an activity card at the cost of one-half the current annual Common Expense Assessment. Such additional activity cards must be purchased on an annual basis only, and no refunds or proration for such additional activity cards will be given. Activity cards will not be issued to Unit Owners who are not Residents, and Residents who are not at least 19 years of age Resident/Renter Activity Cards. If a Unit is being leased, two (2) Residents upon proof of a minimum six (6) month lease agreement and signed owner relinquishment form, will be entitled to use the facilities upon issuance of renter activity cards. Renter activity cards will be issued only after all restrictions governing leasing set forth in Section 4.35 of the Declaration and all rules applicable to renters and leases set forth in Article 7 of these Rules have been satisfied. Outstanding activity cards held by Unit Owners or previous tenants must be relinquished (or will be deactivated by the Association) prior to issuance of new renter activity cards. If a Unit is occupied by more than two (2) Residents and the additional Residents desire to use the recreational facilities, each additional Resident approved for occupancy by the Board (not to exceed two (2)) must purchase an activity card at the cost of onehalf the current annual Common Expense Assessment. Such additional activity cards must be purchased on an annual basis only, notwithstanding a lease term that may be less than an entire year, and no refunds or proration for such additional activity cards will be given Guests of Residents. A Resident holding a valid activity card may have guests and use the facilities in accordance with the following rules: (a) Resident must register any guest at the Front Desk prior to using the facilities and obtain a guest pass; (b) In order to obtain a guest pass, guests will be required to sign a form releasing the Association of any liability resulting from the guest's use of the facilities and pay a fee as follows: (1) $5.00 for one day Community Manager may waive for special event participation. (2) $25.00 for seven (7) days; days do not have to be consecutive, (3) $80.00 for 30 days; days do not have to be consecutive, (4) All guest passes expire within one (1) year after date of issue 8 Solera at Stallion Mountain

9 (c) (d) (e) All guests must be accompanied by Resident host at all times. Residents are responsible for their guests while using Association Common Elements and facilities; At the discretion of the Community Manager, guests may be denied participation in activities if the guest's participation prevents Residents from participating e.g., classes with limited space; and (f) Equipment may be checked out only by Residents with valid activity cards, not by guests Lost or Stolen Activity Cards. There will be a $10.00 charge to replace a lost or stolen activity card. 3.3 Code of Conduct. Persons determined to be violating below stated Codes of Conduct are subject to expulsion from the Community Center by the Community Manager or his / her assigns, from any and all common elements. Persons may forfeit Community privileges and deactivation of their Activity Card All persons must conduct themselves in a civil and courteous manner at all times and must not jeopardize or interfere with the rights and privileges of others Loud, profane, indecent or abusive language is prohibited Harassment or physical abuse of any person by another is prohibited No person's actions shall compromise the safety of another. 3.4 Parking. In addition to the restrictions set forth in Sections 4.19 and 4.20 of the Declaration, the rules in this Section apply to all vehicles parked or operated in or on CCC parking areas Only vehicles with displayed legal handicap parking identification may park in designated handicap parking spaces. Violators will be subject to all rights and remedies of the Association as set forth in the Governing Documents and the enforcements rights of any applicable governmental jurisdiction Parking is prohibited wherever designated by sign, red-painted curb or striped pavement No motorized vehicles may be parked or operated on sidewalks except for low-speed personal transporters (under three (3) mph), Association maintenance vehicles and contractor vehicles when necessary for performance of work Special parking restrictions may be established by the Association for special events. 3.5 Notices and Advertisements. Notices, advertisements or posters of any kind shall not be placed or distributed on Association Common Elements and may be subject to approval by Community Manager. The following rules apply to the Community bulletin board: Fliers may be no larger than 8-1/2 inches x 5-1/2 inches Notices may be posted no longer than 30 consecutive days. 3.6 Smoking Policy. No smoking of any type including electronic cigarettes is permitted in all indoor areas of Association Common Elements and in the outdoor pool areas, CCC front entrance and sports facilities. 3.7 Alcoholic Beverages. Residents consuming alcoholic beverages on Solera at Stallion Mountain Common Area property are solely responsible for their actions and must adhere to Nevada State Law and the Code of Conduct 3.3 of these Rules and Regulations. Failure to do so may result in removal from site and / or loss of Community privileges. Rules and Regulations 9

10 3.8 Management Company Employees. All per sons shall r espect the duties and author ity of Management Company Employees. Any directives, verbal or written, from Management Company employees shall stand. If any person disputes an Association employee's actions, then that person shall be entitled to a hearing before the Board, or any committee or individual appointed by the Board for such purpose, to determine the validity or acceptability of any disputed action. Until the Board or its appointee decides otherwise, the action shall be deemed valid and acceptable. Any inattention to duty or lack of courtesy by a Management Company Employee should be reported to the Community Manager or the Regional Manager of the Management Company. Management Company Employees shall be permitted to use the facilities on the Association Common Elements during normal hours of operation. 3.9 Pets. Pets shall not be allowed inside the Community Center or in the outdoor pool areas or sports facilities of the Association Common Elements except for leashed assistive animals certified to assist handicapped persons Violations. Any per son who r efuses to comply with these Rules may be asked to leave an Association Common Element by Association employees. The Association shall take all actions available to it pursuant to the Governing Documents with respect to chronic offenders Lost and Found. Lost and found items will be r etained at the Association office for a 30-day period of time and then discarded if not claimed. The Association will not be responsible for any misplaced or lost items left on Association Common Elements Private Community Streets. The speed limit on the private streets of the Community is 25 miles per hour. Speeds above this limit create hazards and may be dangerous to the Residents. Radar and cameras may be used from time to time to monitor speeds. Stop signs are used to prevent possible collisions. Drivers must come to a complete, full stop at all stop signs. Violators may be subject to fines Rules Applicable to the Community Center Days/Hours of Operation. Operating hours are 7:00 AM to 9:00 PM, Monday through Saturday, and 7:00 AM to 8:00 PM on Sunday. The Community Center will be closed on Thanksgiving Day, from noon on Christmas Eve through Christmas Day and from noon on New Year s Eve through 1 January. The days and hours of operation may vary from time to time at the discretion of the Board Health Concerns. All persons using the facilities for sports and exercise activities (especially persons with known medical problems or persons unsure of their physical condition) are advised to obtain independent advice regarding the status of their health and specific recommendations for exercise before using any equipment or taking part in any sport. Activities are not supervised. Therefore, all persons using fitness or any other type of equipment do so entirely at their own risk Appropriate Dress. All individuals must wear appropriate attire such as upper and lower body garments and footwear inside the Community Center. In the swimming pool and spa areas, proper swimming attire is required to be worn by all. No wet swimwear is permitted except in the swimming pool, spa and locker room areas Rental of Facilities. Certain areas of the Community Center may be rented to Members or other persons or entities for meetings or special occasions at the discretion of and subject to terms and conditions established by the Board. Inquiries should be directed to the Community Manager Locker Rooms. Locker rooms are available for use only in conjunction with the use of the Community Center facilities. The following rules shall apply to the locker rooms: (a) Lockers are available on a first-come daily basis. Locks must be provided by Residents and removed prior to closing each day. Any locks remaining after closing will be 10 Solera at Stallion Mountain

11 (b) removed and discarded by employees. Children of the opposite sex over the age of seven (7) are not to be taken into locker rooms. Residents accompanying children should use assisted changing rooms Aerobics and Fitness Rooms ( Fitness Facilities ). Fitness Facilities are available on a first-come basis. The following rules shall apply to Fitness Facilities: (a) (b) (c) (d) (e) (f) (g) No children under the age of 19 will be permitted in Fitness Facilities. No glass containers of any kind are permitted in Fitness Facilities. Beverages are permitted in non-breakable / non-spill containers. Appropriate exercise attire is required at all times. Shirts, shorts, sweatpants / sweatshirts, leotards, tights and closed toed shoes are acceptable attire. Upper body garments are required. No heels or hard-soled shoes are permitted in Fitness Facilities. All persons using exercise equipment must use provided sanitary wipes to wipe down equipment when finished. The Community Manager may establish and post time limits for use of the fitness equipment if deemed necessary. No personal trainers are allowed to train persons using the Fitness Facilities unless such personal trainers have prior written approval from the Board of Directors. Equipment in Fitness Facilities may not be removed from Fitness Facilities, but all equipment is available for use if not being used in a class Swimming Pool and Spa. Pool and spa open 1 April and close 31 October. The following rules shall apply to both swimming pool and spa: (a) NO LIFEGUARDS ARE ON DUTY. PERSONS USING POOL AND SPA DO SO AT THEIR OWN RISK. It is recommended that no person use these facilities alone. (b) Hours of operation are posted in pool and spa areas. (c) Anyone entering pool and spa facilities must use the Community Center shower before entering. (d) Only water-based sunscreen may be used. Persons using oil-based tanning lotions will not be permitted to use pool or spa. (e) A full-length towel must be placed over lounge cushions for protection. (f) Persons with infectious skin diseases, including open sores, eye, fungus, nasal or ear discharge are not allowed in pool or spa. (g) All dressings (bandages) must be removed before entering pool or spa. (h) Appropriate swimwear is required in pool and spa. Cut-offs are not allowed. Aqua shoes are allowed but not if worn in from outside. (g) No diving, jumping, boisterous play or excessive splashing is allowed. Running on pool deck is prohibited. (j) Personal audio or video playback devices may be used only with earphones except for approved Community activities. (k) No food or drink is allowed within four (4) feet of pool or spa areas. Gum is prohibited. (l) No glass containers of any kind are permitted in pool or spa areas. All beverages must be in non-breakable containers. (m) Chemicals are used in pool and spa water that may, at times, cause damage to swimwear. The Association will not be responsible for any such damage. (n) Pool and / or spa may be closed by Management Company Employees at any time, without notice, for performing maintenance, for special events or due to safety reasons. (o) Additional rules for swimming pool and / or spa may be established at any time by the Board. The following rules shall apply to only swimming pool and surrounding area: (p) Pool may be heated on a seasonal basis at such times and at such temperatures as deter- Rules and Regulations 11

12 (q) (r) (s) mined by the Board. No flotation or other aquatic devices are allowed in pool, except for noodles and water weights, or any devices required by an organized aquatic activity or as required by a physician's statement. Coast Guard approved life vests are acceptable. Lap lanes are reserved for continuous swimming only and must be shared if multiple lap swimmers are present. Children under age 19 must be accompanied in water by a responsible adult and are allowed in pool and pool area only during the hours of 3:00 PM to 5:00 PM daily. These hours will be strictly enforced. The following rules shall apply to only the spa and surrounding area: (t) (u) (v) Residents and their guests must use caution when using spa. Spa will be maintained by the pool maintenance company and in compliance with the Southern Nevada Health District at a temperature between 102 and 104 F. No more than 10 to 15 minutes use at one time is recommended. Flotation devices are not permitted in spa. Children under age 19 are not permitted in spa Tennis and Pickleball Courts. Except for Tennis, Pickleball Club and Association events, no reservations are necessary. Courts will be available on a first-come basis. The following rules shall apply to courts: (a) (b) (c) (d) (e) Children under age 13 are not permitted on courts. Hours of operation will be posted in court area. Appropriate attire and court shoes are required. Food and gum are not allowed in court enclosures. Beverages are permitted in non-glass, unbreakable, covered containers. Time limit for singles play is one (1) hour; time limit for doubles play is one and one-half (1.5) hours if all courts are in use and players are waiting. Time limits on courts do not apply to a Club on assigned day and time Bocce Courts. Except for Bocce Club and Association events, bocce cour ts will be available on a first-come basis. The following rules shall apply to bocce courts: (a) Children under the age of 13 are not permitted on the bocce courts. (b) Court play is limited to one and one-half (1.5) hours if all courts are in use and players are waiting. Time limits on courts do not apply to a Club on assigned day and time. (c) Appropriate attire and court shoes are required. (d) Bocce equipment is available for check-out at the Front Desk. When checking out equipment, Resident must leave their activity card; card will be returned when equipment is returned Billiard Room. The Billiard table is available on a first-come basis and cannot be reserved except for events sponsored by the Association. The following rules shall apply to billiard play: (a) (b) (c) (d) (e) (f) No children under age 13 may use billiard table. A one (1) hour time limit applies if others are waiting to play. Players shall not sit on billiard table and must keep at least one foot on floor when making shots. Association will provide house cues, balls and chalk. Balls are available for check-out at Front Desk where an activity card will be retained until balls are returned. Cues are to be returned to rack upon completion of play. Masse shots (shooting straight down on the ball) and jump shots are prohibited. Beverages in non-breakable, covered containers and food are allowed in the Billiard Room but may not be on or near the billiard table. 12 Solera at Stallion Mountain

13 Arts and Crafts Room. Association sponsored clubs will have priority for use of Arts and Crafts room. When room is not scheduled for use, walk-ins are welcome. The following rules apply to scheduled and walk-in use: (a) (b) Each person must clean area worked in before leaving. Any articles left in room are subject to immediate disposal by Management Company Employees or will be added to the lost and found. Association will not be responsible for any materials left unattended Gallery. Gallery is intended as a table game area. Game players have first priority for tables and may use tables on a first-come basis. Play time is limited to two (2) hours when other game players are waiting. Time limits on tables do not apply to a Club on assigned day and time Kitchen. The kitchen is available only by reservation. Deposits and/or additional fees may be required as determined by the Community Manager. Parties using kitchen are responsible for cleanup Social Hall. The social hall is available unless otherwise reserved for a Community function. Association sponsored events and club events have priority. Rules and Regulations 13

14 ARTICLE 4 USE OF MOTOR VEHICLES 4.1 Private Streets. All streets within the Community are private. In addition to the restrictions set forth in Subsection of the Declaration, the regulations set forth in this Article 4 apply to the operation of motor vehicles in the Community. The Board of Directors shall adopt and, except as otherwise provided in the bylaws, may amend bylaws and may adopt and amend rules and regulations. (NRS a). 4.2 Parking Common Area Parking Is Limited to Operable Vehicles, Licensed, Street Legal, and Owned by Guests Only (No Owner/Resident Parking On Streets): Unit Owners and Residents may not park in common areas streets. Only operable, properly licensed, street-legal vehicles may be parked on any street within the Association. No recreational vehicle, trailer, wave runner, jet-ski, boat, or similar personal vehicle/property may be parked or stored on any street within the community, with the exception of the owner's recreational vehicle, trailer, wave runner, jet-ski, boat, or similar personal vehicle/property parked for the sole purpose of unloading/loading for no more than 48 hours. [NRS , NRS ; CC&R 4.202, , ] Blocking Driveways is Prohibited: No parking is allowed in front of or protruding into another resident's driveway. [NRS , NRS ; CC&R ]. Parking Permitted in Designated Areas Only: Vehicles shall be parked within the garage, driveway, or designated/assigned parking areas on the street only. Note: Parking for residents and unit owners is further restricted as set forth herein. [NRS , NRS ; CC&R ]. Towing Without Notice: Towing With Notice: 14 Solera at Stallion Mountain

15 Additional Conditions: Inoperable vehicles must be parked only in garage No Unit Owner or Tenant automobile or other motor vehicle shall be parked on any street. Only motor vehicles of a guest of the Unit Owner or Tenant may be parked on street. Guests parking on street overnight must obtain a parking pass from Front Desk and display on dashboard No vehicle shall be constructed, reconstructed, repaired or painted on any Lot. This includes garages when the door is open Vehicles parked on driveway may not exceed the driveway length nor seven (7) feet in height. 4.4 Motorcycles, Unlicensed / Off-Road Vehicles are prohibited. Operation and / or use of motorcycles, unlicensed and / or off-road vehicles are prohibited on common areas and streets within the Community, with the exception of golf carts. Unlicensed and / or off-road vehicles, include, but are not limited to, vehicles without a current state license plate, go-karts, UTV's, mini-bikes, aircraft, three and four wheeler / quads, dirt bikes, all-terrain vehicles, any vehicle the operation of which is prohibited on public streets, and any motorized vehicle of a nature similar to the those mentioned herein. [NRS , NRS ; CC&R , , , ] All motorcycles, motorbikes, all-terrain vehicles, off-road vehicles, motor scooters or any similar vehicle shall not be parked, maintained or operated on any portion of the Community except in a garage All motorcycles, motorbikes or motor scooters shall not be parked, maintained or stored on any street. Motorcycles, motorbikes or motor scooters shall be operated quietly at all times. 4.5 Unlicensed / Inoperable Vehicles (Including Golf Carts) may be parked only within enclosed garage. No motor vehicle which is not licensed and in an operating condition, including golf carts, shall be parked or left on any part of the property, including units/lots, other than within the enclosed garage. The Board shall have the absolute authority to determine from time to time, after notice and a hearing in compliance with the Association's fine policy, whether a motor vehicle is operable and otherwise in compliance with the provisions of this section. Upon an adverse determination by the Board, the motor vehicle shall be removed by the owner or otherwise brought into compliance with this section. [NRS , NRS ; CC&R , , , ]. Vehicle Maintenance Activities in Common Areas i s prohibited. No dismantling, assembling, overhauling, refurbishing, repairs, or maintenance (other than emergency maintenance) of motor vehicles, boats, trailers, recreational vehicles, or other types of similar equipment shall be permitted on any street within the community. Leaks from vehicles in the street and on driveways must be cleaned up immediately. Homeowners are responsible for any clean up on the street or reimbursement to the association for said clean up. 16 4.7 Commercial Vehicles. Commercial vehicles may not be parked on the street or on or near any Lot. [NRS , NRS , NRS ; CC&R 4.17, 4.19, ] with the exception of parking a utility service vehicle that has a gross vehicle weight rating of 20,000 pounds or less pursuant to his or her employment with an entity which owns the vehicle for the purpose of responding to emergency requests for public utility services or parking a law enforcement vehicle or emergency service vehicle while the person is engaged in his or her official duties. The Association may require that person to provide written confirmation from his or her employer that the person is qualified to park his or her vehicle within the community. Per NRS subsection 5, utility service vehicle includes without limitation, the furnishing of electricity, gas, water, sanitary sewer, telephone, cable or community antenna service, without regard to whether the motor vehicle is owned, leased or rented by the utility. 4.8 Recreational Vehicles / Property must be stored out of view of street. No recreational vehicle, trailer, wave runner, jet-ski, or boat may be stored within the owner's property unless stored within the garage, or located behind a side yard block wall, or gate; and otherwise screened from view of the street, subject to the approval of the board or architecture committee pursuant to the terms hereof. Exception: Motorhomes, trailers, or recreational vehicles may be parked in front of an Owner's home for the purpose of loading / unloading for a period not to exceed twenty-four (24) 4.9 Golf Carts Licensing. All golf carts operated, parked or maintained within the Community shall have a valid permit issued by the State of Nevada, and drivers of golf carts must have a valid driver s license for automobiles. Prior to driving a golf cart on the private streets within the Community, a Unit Owner or Resident shall register the golf cart with the Association by providing to the Association a copy of the permit for the golf cart issued by the State of Nevada Insurance. Drivers of golf carts are responsible for any damage or injury caused by negligence or willful misconduct. Prior to driving a golf cart on the private streets within the Community, a Unit Owner or Resident shall provide to the Association a certificate from the Unit Owner's or Resident's insurer evidencing that the Unit Owner/Resident has obtained liability Insurance for the golf cart and showing the Association as an additional insured on the policy. So long as a Unit Owner or Resident desires to operate a golf cart on the private streets of the Community, it is the Unit Owner's or Resident's responsibility to provide the Association with updated certificates upon the renewal of any liability insurance policies Vehicle Restrictions Apply. Golf carts shall be considered motor vehicles, as such term is defined in the Declaration and may not be driven or parked on any property within the Community except (i) streets, (ii) parking lots, and (iii) concrete driveways and garages. Golf carts driven or parked in violation of this rule or the Declaration shall be subject to the remedies provided in the Declaration, including the towing of vehicles. Golf carts driven on the streets shall be operated in the same manner as other motor vehicles and drivers shall comply with all laws. Drivers must observe all traffic regulations and use proper signals. Golf carts being driven on the streets shall yield to other motor vehicles Seat Belts. Seat belts are required to be installed in golf carts and used by any Resident or guest of Resident while in the Community. The Association will not be responsible for injuries to persons resulting from the use of golf carts on the private streets. Each person traveling on the private streets in a golf cart does so at his or her own risk Golf Course Use Not Authorized. Unit Owners and Residents shall not drive golf carts onto any cart paths or other areas of the Golf Course for any purpose except as a customer/patron of the Golf Course (if Golf Course Owner permits the use of private golf carts), subject to all rules, regulations, policies and fees established by the Golf Course Owner Garages. or converted for living areas. 16 Solera at Stallion Mountain

18 ARTICLE 5 USE OF LIMITED ACCESS GATES 5.1 Methods of Access. The gated entrances to the Community have three (3) access methods: Radio Frequency Identification (RFID) card or sticker pr ovides automatic access for Residents. Upon approaching the gate, the horizontal RFID card is recognized by the reader, activating the gate to open. Two RFID cards are issued per Unit Replacement Cards. When an RFID card ceases to operate (opening gates), the card must be returned to the Front Desk by Resident to whom the card is assigned. A new RFID card will be issued at no additional cost to Resident. The nonworking card will be deactivated Lost and/or Damaged Card. Card will be replaced (and deactivated) for Resident to whom the card is assigned for a $25 fee to cover the cost of the card and administrative fees Nontransferable. The Association recommends RFID cards not be given to friends, guests or service providers such as landscapers or housekeepers. If a card is improperly used, it may be subject to deactivation Obligation of Unit Owners to Relinquish RFID Cards Upon Resale of Unit. The RFID cards are a part of the gate system and are owned by the Association. Upon the sale of a Unit to a new purchaser, each Unit Owner shall relinquish RFID cards. Failure to do so will result in the new Unit Owner having to purchase new RFID cards at a cost determined by the Board. If new RFID cards are issued, the old RFID card code will be deactivated. New RFID cards and codes will not be issued unless a Unit Owner can show proof of ownership of a Unit in the Community Personal Code. Entering a personal code on the small keypad in front of the gate by a Resident will gain access. Residents are encouraged not to allow guests and visitors to have the personal code. The code may be changed for a fee that covers the administration cost Dial Up. Guests or vendors may use the large keypad in front of gate to contact a Resident by looking up name or dialing the Resident's assigned number, name is electronically displayed. By pressing the call button, the Resident's telephone number is automatically dialed. When phone is answered, the Resident may remotely open the gate by pressing 9 on the telephone. If the Resident cannot be contacted by telephone, the visitor will not be granted access. 5.2 Code and / or Phone Number Changes. A $15 administrative fee will be charged for each code change. Requests to change a code must be made in person at the Front Desk, a form requesting change filled out and a current Solera ID presented to complete gate code changes. 18 Solera at Stallion Mountain

19 ARTICLE 6 USE OF UNITS 6.1 Trash Containers and Collection. Trash containers may be left at the curb for pickup no earlier than 5:00 PM on the day before the scheduled pickup is to occur and may remain at the curb until no later than 5:00 AM on the day after the scheduled pickup is to occur. Per ARC Guidelines, black, drawstring, heavy duty style trash bags may also be used Solid Waste / Recyclable Materials. A homeowner may store containers for the collection of nonhazardous solid waste or recyclable materials outside any building or garage on the premise of the unit during the time the containers are not within the collection area. The containers may be stored in the rear or side yard of the home in such manner that the containers are screened from view from the street, a sidewalk or any adjacent property. (NRS ) 6.2 Garage Sales. Garage sales by individual Unit Owners and Residents are prohibited. One or more community garage sales may be organized and conducted by the Association each calendar year. 6.3 Open House. See ARC Guidelines. 6.4 Fireworks. Fireworks are prohibited for use or storage on Units or elsewhere within the confines of the Community. 6.5 Clothes Drying. In addition to restrictions set forth in the Declaration, no clothing, towels, carpets or other items may be draped over walls, landscape, clotheslines, fences or gates for cleaning or drying purposes. 6.6 Business Enterprises. See CC&Rs 4.2. Rules and Regulations 19

20 ARTICLE 7 OCCUPANCY RESTRICTIONS 7.1 Purpose. The Community is intended and operated for occupancy by persons 55 years of age or older. 7.2 Occupancy Requirements Age Restrictions. Except as provided for in this Rule and the Declaration, at least one Resident of each occupied Dwelling must be 55 years of age or older and no person under 19 years of age may occupy or reside in a Dwelling. The Board, in its sole discretion, determines when a person occupies or resides in the Dwelling Approval Required for Exceptions. Under the Declaration, the Board, in its sole discretion, may permit persons, all of whom are under the age of 55, to occupy a Dwelling unless such permission would result in fewer than 80% of the Dwellings being occupied by one person 55 years of age or older or otherwise jeopardize the Community s status as housing for older persons under applicable law. Proposed Residents desiring to reside in a Dwelling where at least one proposed Resident is not 55 years of age or older (or where any proposed Resident is under 19 years of age) shall submit a written request for approval of occupancy to the Board and are not allowed to take occupancy until written approval is granted by the Board Verification of Occupancy Requirements upon Sale of a Dwelling. At the time a prospective purchaser enters into a purchase agreement, the purchaser is required to certify as to compliance with the 55 and older occupancy requirement. The certification attached hereto as Exhibit 1 shall be completed by the prospective purchaser and submitted to the Association for approval. Upon receipt of the certification containing all required information, the Board will determine whether the proposed occupancy of the Dwelling is in compliance with the Declaration and either grant or disapprove the proposed occupancy. The prospective Residents may not take occupancy until written approval of the proposed occupancy is granted by the Board Verification of Occupancy Requirements for Leasing. Each Unit Owner shall comply with Section 4.35 of the Declaration and the following Rules with respect to any lease or rental agreement for a Unit: (a) (b) Unit Owners desiring to lease their Dwellings shall submit a written request to the Board for approval of the proposed tenants. The request must include (a) a completed Age Verification for Renters in the form attached hereto as Exhibit 2, (b) a copy of the lease or rental agreement signed by the proposed tenant (subject to Board approval), which lease or rental agreement complies with all the provisions of Section 4.35 of the Declaration and this Subsection 7.2.4, and (c) the address and telephone number of the Unit Owner. Upon receipt of the written request containing all required information, the Board will determine whether the proposed leasing of a Dwelling is in compliance with the Declaration and either grant or disapprove such request. The proposed tenant may not take occupancy until written approval of the lease is granted by the Board; and A copy of the lease or rental agreement signed by the Unit Owner and tenant must be delivered to the Association for further delivery to the Board Exceptions for Visiting Children. A person under 19 years of age may temporarily reside in a Dwelling as the guest of the Unit Owner(s) or Resident(s) of such Dwelling for a period of not more than 60 days in any 12 month period as set forth in the Declaration. 7.3 Age Verification. At least once ever y two (2) year s, an age ver ification sur vey for m shall be completed to verify occupancy of each Dwelling in the Community. Pursuant to the Age Certification Survey, one adult Resident of each Dwelling shall certify to the Association whether such Dwelling is occupied by at least one person 55 years of age or older. Such certification shall be supported by reliable official documentation of 20 Solera at Stallion Mountain

21 the age of the Resident(s) of such Dwelling. The following documents are acceptable as proof of age: (a) (b) (c) (d) (e) (f) Valid driver's license; Birth certificate; Passport; Immigration card; Military identification; or State, local, national or international official documents containing a birth date of comparable reliability. In the event there is a change in the occupancy of a Dwelling, the Resident shall immediately notify the Board in writing of such change. 7.4 Incorporation of Provisions in Declaration. The provisions of Section 4.3 of the Declaration, as they may be amended from time to time, are incorporated herein. Each Unit Owner and Resident of a Dwelling should read and understand the restrictions in the Declaration and these Rules with respect to the status of the Community as housing for older persons. Rules and Regulations 21

22 ARTICLE 8 ASSOCIATION CLUBS 8.1 Introduction. Association Clubs are established by the Solera at Stallion Mountain Unit Owners Association. Clubs are the operational nucleus for the Association s recreation program by promoting recreational pursuits among the Association s members. They provide both structure and vitality to the program s mission. Clubs function as non-profit entities within the organizational purview of the Association. The purpose of the guidelines is to provide direction and structure to the club system and enable the membership to fully enjoy the Association facilities and programs offered. These guidelines are approved by the Board of Directors and subject to change from time to time. 8.2 Establishing Clubs. Club applications ar e available thr ough the Community Manager. Completed applications will then be reviewed by Lifestyle Committee for further assessment and discussion before submission to the Board of Directors for formal approval. Approval will not be granted to groups who: Require membership in affiliated national, state or regional organizations as a precondition for membership Clubs must be open to all members of the Association without any discrimination Is a duplication of existing club Need amenities the Association does not have. The Association may approve groups that use Association facilities for meetings, but use off-site locations for recreational pursuits such as hiking, bowling, skiing, racquetball, etc. 8.3 Club Requirements A minimum of five (5) members is required to form a Club A minimum of five (5) regularly attending / participating club members are required to reserve space in the Community Center A stated specific purpose of the group is required Clubs shall not limit the number of its members. 8.4 Allocation of Space Space allocation is dependent upon membership interest in the Club s activities and the availability of Association space, subject to maximum occupancy restrictions. As space allows, Clubs are provided with regular meeting and activity space, without charge. Regular is defined as consistently scheduled on the same day and time of the week / month / quarter throughout the calendar year. Regular facility use will be scheduled through the Lifestyle Committee. All disputes will be resolved by the Board of Directors Depending on the nature and size of the activity, the Lifestyle Committee will determine the space to be allocated. In all cases, the decision will be based on maximizing the utilization of space. Temporary assignment changes may be made by the Community Manager; permanent reassignment will be made by the Lifestyle Committee, as conditions require Clubs will lose their reserved space in the Center if membership falls below the established minimum to use the facility. If reserved space is consistently underutilized, the Lifestyle Committee has the right to reassign the space Space in the Community Center shall be allocated in the following priority order: (a) Board of Directors meetings, including Executive Sessions 22 Solera at Stallion Mountain

23 (b) (c) (d) (e) (f) (g) (h) (i) Any other Association business (e.g., Annual Homeowners Meeting, Budget Ratification Meeting, Town Hall, etc.) Committee Meetings Activities produced by the Lifestyle Committee Regular Club Activities Special Club Activities (e.g. a club s holiday potluck or other special event) Non-Club Activities Rentals by homeowners (if a policy is adopted by the Board of Directors allowing such rentals) Rentals by non-homeowners (if a policy is adopted by the Board of Directors allowing such rentals) The Association reserves the right to preempt Club space at any time due to Association Business. The Community Manager will notify the Club as soon as possible after it is known that the preemption is to occur. Any special onsite events a club wishes to hold outside their regular meeting time must be submitted to Lifestyle for space allocation and preapproval. 8.5 Appeal. Any group shall have the right to appeal to the Board of Directors a decision made by the Lifestyle Committee or Community Manager, regarding club status or allocation of space in the Community Center. The Board must receive a written request at least ten days prior to the Board meeting, outlining the nature of the appeal and requesting the matter be placed on the Board s agenda. 8.6 Club Membership and Operation Club membership is open to any Association Member in good standing Club membership rosters are intended for use solely for the conduct of club business. Club rosters may not be used for personal or commercial purposes. Care should be taken to protect the privacy of members Board recognized Clubs are groups whose members meet regularly on an informal basis. These Clubs must have a designated officer who is responsible for the organization and cleanup after each Club activity If the Club wishes to charge dues or conduct financial transactions, a treasurer must be elected All Clubs are required to file an annual financial statement. The financial statement must be submitted to the Board of Directors no later than 31 December of each calendar year. Clubs are responsible for ensuring that all required taxes are paid and properly reported. All financial information shall be submitted to the Board of Directors. Submission of financial information from Clubs in no way obligates either the Board of Directors or the Association as to the accuracy of said documents. If the Club does not collect dues and does not have funds, this is to be noted in the annual financial statement. All Clubs are required to follow the appropriate financial controls and procedures as deemed necessary by the Association Management and the Board of Directors The facility and all Association equipment, including Club equipment and materials housed in the Community Center are the property of the Association. Clubs that have special equipment, used exclusively for the purpose of the Club, will be responsible for the maintenance, replacement, and/or repair of those items. Storage space, as determined by the Community Manager is limited for Club equipment and supplies Club Small Barbeque Use (a) Use of the small barbeque (grill) is permitted by Clubs on regular Club meeting day and time or for special events.
