1 The following packet is being distributed to all owners and residents of the Terracina community to familiarize them with the rules and regulations of the Association. The booklet is a digest of and elaboration on the provisions of the Covenants, Conditions and Restrictions (CC&R's) pertaining to the Properties. The booklet is not a complete or authoritative listing or compendium of all the restrictions on your property and must not be construed to be such by the reader. Only the CC&R's and Rules and Regulations enacted by the Board of Directors constitute the complete body of rules and regulations pertaining to the Properties. This packet should be retained and kept with your other Association documents for future reference! If your unit is a rental property, please provide a copy of these Rules & Regulations as well as the CC&Rs, if you have not done so already, to your tenant. Keystone Pacific Property Management is the management company for your Association. We are here to be of service to you. If you have a service call regarding maintenance of your common area, please call our Customer Service Department at (949) between the hours of 9:00 a.m. and 5:00 p.m., Monday through Friday. Animal Control 8.7 a) The Board will take action against any owner or resident whose pet becomes a nuisance, such as allowing a dog or cat to run loose or roam free, regular and/or loud barking, or failure to clean up pet waste. b) Animals belonging to owners, occupants or their licensees, tenants or guests within the Property must either be kept within an enclosed area, or on a leash held by a person capable of controlling the animal. c) Pet owners must immediately remove and properly dispose of any pet waste in the common area and patio areas. d) No animal shall be kept, bred, or maintained for any commercial purpose. Household pets (except fish) are limited to a reasonable number. A reasonable number is considered to be two pets per residence, unless an application is submitted to the Board for additional pets prior to acquisition of additional pets. e) Cost for any damage to the common areas caused by the conduct of a pet will be assessed to the homeowner or resident after notice and opportunity for hearing. Business and Commercial Activity 8.8 a) Professional or administrative occupations may be conducted in any residence as long as there is no external evidence of such activity. The occupation must comply with all governmental ordinances and be incidental to the use of the dwelling as a residential home. Common Area 8.6 a) The common areas, belonging to the association, include the pool, landscape (excluding individual patios), driveways, streets, sidewalks and stairs. b) No personal property, such as bicycles, toys, sports equipment, barbecues, potted plants, stepping-stones, trashcans, etc. are to be stored in the common areas. 1
2 Nuisance 8.3 a) No noxious, offensive or loud activities shall be conducted within the community, which may cause a serious annoyance or nuisance, or might interfere with the quiet enjoyment of each owner's respective home. Parking and Vehicular Restrictions 8.2 a) The speed limit in the community is 10 miles per hour. b) All unassigned, open parking is for guests only and is not to be used by residents at any time. c) No vehicle repairs may be conducted on the property and are not permitted anywhere except inside the garage with the door closed. Washing of vehicles is permitted in front of the garage, but is recommended in the car wash area and is subject to any governmental requirements for controlling water run off. d) Commercial and recreational vehicles are prohibited from the community, except for temporary loading or unloading of less than twenty-four hours. e) Parking in front of driveways, mailboxes, or any painted curb areas restricting parking is strictly prohibited. All streets are fire lanes. f) Garages must be maintained to accommodate two (2) full-sized vehicles at all times. The garage may not be used for storage if such storage would prevent the parking of two (2) full-sized vehicles within the garage. g) Homeowners must keep driveway and driveway apron clean and free of vehicle fluid or any other types of stains. h) The driveways and driveway aprons throughout the community are common area and are maintained by the Association. i) Driveways, which are not of an acceptable length to accommodate vehicles, are considered fire lanes and vehicles parked in these areas are subject to immediate tow without prior parking notice. j) The Board has determined that owners may utilize their driveway for parking of their respective vehicles under the following conditions, if the residence has an extended driveway: The Board has determined that there are six (6) residences within the community which have extended driveways which are for the exclusive use of residents at these addresses: 190 Via Vicini 147 Via Vicini 61 Via Vicini 192 Via Vicini 149 Via Vicini 194 Via Vicini 151 Via Vicini k) The garage must be utilized for the parking of the resident s respective vehicles and third or fourth vehicles which are owned by the resident, or an over-sized vehicle owned by the resident (which cannot be accommodated within the garage) may be parked on a driveway. l) Garages may not be used for storage while driveways are used for the parking of the resident s respective vehicles. m) Vehicles may not be parked sideways (parallel to the garage door), at any angled degree. n) Vehicles may not extend over any sidewalk or the curbing of the driveway in any amount. 2
3 o) Residents must keep driveways and driveway aprons clean and free of vehicle fluid stains and must be kept clean at all times. Drip pans, absorbent material, cardboard and other items may not be kept in the driveway to catch vehicle fluids. p) The Board reserves the right to amend or revoke these parking privileges at any time; violations can result in the immediate towing of vehicles. q) Towing. Vehicles in violation will be cited two times, and towed on the third within a sixty day period. Signs 8.4 a) Subject to Civil Code Sections 712 and 713, no sign, poster, billboard, balloon advertising device or other display of any kind shall be displayed within the Property or on any public street within or abutting the Property except for the following signs, so long as they comply with applicable City or County ordinances: a. Entry monuments, community identification signs, or traffic or parking control signs maintained by the Corporation. b. One nameplate or similar Owner name or address identification sign for each Unit that complies with Architectural Committee Rules. c. One sign which may be displayed on each Condominium advertising the Condominium for sale or lease; provided that such for sale or lease signs comply with the following requirements: i. The sign is not larger than eighteen (18 ) by thirty inches (30 ) in size. ii. The sign is attached to the ground by a conventional, single vertical stake that does not exceed two inches (2 ) by three inches (3 ) in diameter (i.e. posts, pillars, frames or similar arrangements are prohibited). iii. The top of the sign is not more than three feet (3 ) in height above the ground level. iv. The sign is of a color and style authorized by the Architectural Committee. v. Other signs or displays authorized by the Architectural Committee. b) Security/Alarm signs are limited to one (1) sign to be staked in the landscape in the proximity of the front door/window, one (1) on the side gate and one (1) sticker in a front window. c) Political campaign, patriotic, religious signs, seasonal and holiday decorations are permitted inside windows and in patios only, not in common area. Garage planters are considered common area. Trash and Unsightly Items 8.9 a) Appropriate closed trash containers provided by the disposal company shall be used to secure refuse. b) All rubbish, trash, garbage, yard waste, and recyclable material must be removed regularly from your property, and shall not be allowed to accumulate. c) Trash containers must be stored in the garage, not on driveways or in the street. d) Trash containers may not be placed out for pick up prior to dusk on the evening preceding pickup. At this time, trash pick-up day is Tuesday. Therefore, trash containers may not be placed out until Monday evening. Empty trash containers must be returned to the garage by the same evening on trash pick-up day. Therefore, trash containers must be put away Tuesday evening. e) The responsible owner must remove any litter remaining on the ground after trash pick up. 3
4 f) Patios are not to be used for the storage of brooms, mops, bicycles, etc. and may contain only patio furniture, barbecues and other related furnishings appropriate for a patio area. g) Patios must be kept orderly, and all plant material shall be kept healthy and trimmed. Plant material is not allowed to grow on stucco. Trees should be kept to a height not exceeding 20 feet and may not damage any hardscape or building structures. Swimming Pool And Spa Rules a) Hours: Sunday - Thursday 6am-10pm Friday and Saturday 6am-12pm b) All persons using the pool or spa do so at own risk. The Association is not responsible for accidents or injuries. c) Pool or Spa is for private use of members/residents only and others with management permission. d) No glass, animals, running or rough play is allowed in the pool and spa area. e) Pool use is prohibited after hours. f) Shower before entering pool g) Management reserves the right to deny use to anyone at any time. h) Use pool at own risk when lifeguard is not on duty. People with long hair must wear caps. i) Don't use pool while under the influence of alcohol or drugs. Unnecessary noise is not permitted at any time. j) Long exposure in any spa can result in nausea, dizziness or fainting. Max temp 104. k) No Diving at any time. l) Children under 14 are not allowed in the pool, spa or wader unless accompanied by an adult. It is recommended that persons under two (2) years of age not use the spa. Children in diapers must wear swim diapers when using the pool or wader. m) No soap/bath oils/etc. are allowed in pool, spa or wader. n) No running, pushing, boisterous play or diving will be permitted. o) Guests must be accompanied by an owner or tenant. p) Each Residence is permitted to have four (4) guests present at the pool, spa or wader area, except when reservations have been submitted and approved in advance by the association for a large gathering. q) No pets are allowed in the pool, spa or wader area. r) Bikes, skates, skateboards or related recreation equipment are not allowed in the pool, spa or wader areas. s) Proper bathing attire must be worn at all times. No g-strings, cut offs jeans, etc t) Smoking in the pool area is prohibited. Antennae 8.5 Satellite dishes and antenna are permitted within the Association with certain provisions. The following guidelines must be considered for the installation of any satellite dish or antenna. Satellite dishes larger than one meter (@39 ) in diameter are prohibited entirely, and no satellite dish may be installed on any portion of the roof or chimney. 1. An architectural application should be submitted prior to the installation if any or all of the following are true: The satellite dish/antenna will not be mounted to any part of any building. Which is not under the exclusive use of control of the owner. 4
5 The satellite dish/antenna will be located outside of the exclusive use area or other area under the exclusive use or control of the owner: patio area. The satellite dish/antenna will be installed higher than the patio wall. Any cabling required for the satellite dish/antenna will be attached or passed through any building structure. 2. An architectural application is not required if none of the above conditions is true AND either of the following is true: The satellite dish/antenna will be located entirely within the exclusive use area or other area under the exclusive use or control of the owner. The satellite dish/antenna is located inside the unit. The preferred installation location is inside your unit (building) or within your exclusive use area or other area under the exclusive use or control of the owner. You must install in one of these locations if your satellite dish/antenna would adequately receive signals with such an installation. If you are unable to adequately receive signals with a satellite dish/antenna installed within your unit or exclusive use area *, an acceptable location should be determined by the homeowner and the Architectural Committee. Exclusive Use Area is defined in the CC&R s, Article 1, Section 1.28 those portions of the Corporation Property over which exclusive easements are reserved for the benefit of certain Owners including without limitation for patio purposes and internal and external telephone wiring designed to serve a single Unit but located outside the boundaries of that Unit, in accordance with California Civil Code Section 1351(i). For purposes of installation of satellite dishes and antenna, areas that are within an owner s exclusive use or control are also acceptable locations for installation of dishes less than 39 in diameter. 8.6 General a) No electric or motorized scooters, golf carts, ATVs, etc. are to driven within the community at any time, for any purpose by anyone with or without a license to operate the vehicle.
