1 KINGS COURT HOMEOWNERS ASSOCIATION, INC. RULES AND REGULATIONS Approved by Board of Directors on 3/13/18 Previously Revised: 6/17/04, 11/18/08 Experience shows that enjoyable living in a cluster housing development, such as Kings Court, is made possible by certain restrictions and covenants, along with reasonable rules and regulations, all of which are intended for the best interest of all residents. Your Board of Directors has the responsibility of protecting these interests and is concerned with safety and improving property values of the community. Accordingly, the Board of Directors, with the help of the Rules Committee and Architectural Review Committee, has consolidated and updated the rules and regulations of our Documents. We need all residents voluntary cooperation in adhering to these rules and regulations. However, violators will be notified, and the Board will assert its rights under the Documents and Florida Statutes to ensure compliance. Remedies for violators include, but are not limited to, suspension of rights to the use of recreational facilities, fines, and initiation of various legal actions. Each owner (often referred to as member), resident, tenant, relative, guest or otherwise, hereinafter, shall, in addition to the obligation and duties as set forth in the Kings Court Homeowners Association, Inc., Article of Incorporation, the By-Laws, the Declaration, or any amendments thereto, be governed by the following regulations: 1. CLUBHOUSE RESERVATIONS: For private resident use (no outside rental permitted) Rental Forms available at the office. 2. LEASING OF TOWNHOUSES: Refer to governing documents for further specifics and for minimum lease terms, Exhibit C to the declaration, Article XIV, effective 9/1/12: No owner may lease or rent his/her/its property/unit until he/she/it shall have been the owner of record of the property/unit for at least one (1) year. For purposes of this provision, any guest," friend, or invitee residing in the unit for more than sixty (60) days shall be considered a renter by the Association. The Homeowner shall therefore be in violation, and the occupant will be required to forthwith vacate the premises or be subject to eviction. After the expiration of one (1) year, an owner may lease or rent his/her/its townhouse unit in accordance with and subject to the terms and conditions of the Declaration of Covenants, Conditions and Restrictions for Kings Court, the By Laws of Kings Court Homeowners Association, Inc., and the Association s leasing policy dated April 22, 1983, as amended. 3. ENTRANCE TO KINGS COURT: Gate access cards and/or remote gate openers are available for a charge to each resident, (Owners must transfer to tenants or new buyers.) If needed, extra cards are available for a charge. It is intended that residents enter with access cards and not on a basis of recognition by security guards. 4. GARBAGE: Disposition of garbage, trash, and recyclable materials shall only be placed in Miami-Dade County-distributed containers specifically designed for this purpose. Such container shall be put out along the street only on the night before the day of pick up, and they must be removed by the end of the day of pickup. All other trash shall be taken promptly to a county facility (located on 107 th Ave. and 80 th St.) and may not remain on any lot or common area. A. Garbage Pick Up Days: Mondays & Thursdays B. Recycle Pick Up Days: Every other Thursday Page 1 of 8
2 C. Leave the can(s) out with lid(s) closed the night before (after 6pm). Can(s) must be stored away (not visible from the street) on the same day of pick up before midnight. 5. SIGNS: No signs, advertising, or notices of any kind or type whatsoever, except For Rent or For Sale signs shall be (a) permitted on the exterior of any unit or (b) posted or displayed in such manner as to be visible from the exterior of any unit. One square-inch For Rent or For Sale sign may be placed on a 5-foot stake in the front yard of any unit. An Open House sign of the same size (35-40 sq. in.) may be displayed on the stake when the owner or a realtor is holding an Open House. For security reasons, the owner or realtor must notify the management office or the entrance security guard when scheduling an open house. 6. CONSTRUCTION SCHEDULE: Construction work inside/outside the home, lawn/landscaping work is allowed Monday-Saturday 8:00 a.m. - 7:00 p.m. and Sundays from 10:00 a.m. 6:00 p.m. 7. MOVING (IN/OUT) AND DELIVERY SCHEDULE: Moving (in/out) and/or any deliveries (furniture, appliance, movers) is allowed only Monday-Saturday 8:00 a.m. - 7:00 p.m. and Sundays from 10:00 a.m. 6:00 p.m. 8. EXTERIOR CHANGES: No alteration to the exterior of any unit may be made without written approval of the Association s Architectural Review Board (ARB). Any changes to the exterior of a unit must be consistent with the original design concept of the community. Refer to the ARB Guidelines for detailed information and requirements. 9. EXTERIOR DECORATIONS: Only the American Flag may be displayed; no other flags or decorative flags are permitted. Holiday decorations are permitted but must be removed within 10 days after the holiday has ended. 10. NUISANCE: Members shall not use or permit the use of their premises in any matter which would be disturbing or be a nuisance to other members, or in such a way as to be injurious to the reputation of the Association. Included, but not limited, are: A. Use of a home to conduct a business is considered a violation. B. Use of a garage as a warehouse to receive, store, and trans-ship boxes of materials is a violation. C. Playing of loud music or allowing a dog to continually bark loudly over a long period. If this occurs after 11:00 P.M., it is a violation of Miami-Dade County s ordinances and will be referred to the county police for corrective action. D. Burglar Alarms: It is recommended that it be monitored by the company and arrangements are made with a neighbor or any other local person to be able to silence the alarm should it go off and become a nuisance. E. Noisy vehicles (cars, trucks, motorcycles) which may become a nuisance to other residents. 11. TEMPORARY BUILDINGS: No tents, shacks, gazebos, oversized umbrellas, retractable awnings, awnings, temporary accessory buildings or structures shall be erected or permitted to remain on any lot. Storage units are permitted in the back yard area as long as they are below the fence line. 12. LAWN CARE AND WEEDS: No long grass, weeds, underbrush, or other unsightly objects shall be allowed to be placed or to remain on any lot. The Association has the right to take action to have your grass, weeds, underbrush, or other unsightly objects removed or cut and charge the unit owner s account per occurrence. 13. EXTERIOR MAINTENANCE: Members must maintain their lots in a manner satisfactory to the Association so as not to impair the visual appearance of Kings Court. Page 2 of 8
3 A. Exterior painting: Periodically, to maintain the appearance and uniformity of all townhouses, Kings Court will arrange for the painting of the exterior of all townhouses and fences, and assess each owner for the cost of the painting of the unit. Refer to governing documents for further specifics. B. As provided for by Kings Court Declaration of Covenants, Article V, individual homeowners should arrange, in-between paintings to maintain the appearance or uniformity items such as fences, garage doors, walls, and any other areas where paint has been peeled, stained, and/or damaged with Kings Court approved paint colors. 14. ANIMALS: Unless they are on a leash in the care of a person, animals (dogs/cats) are not allowed to roam freely outside an owner s unit on the streets or on common area grass. When walking your dog(s) outside, owners are requested to use pooper scoopers to avoid soiling common areas and all private properties. Violators will be fined per occurrence. 15. USE OF COMMON AREAS: Areas of grass outside owners yards and houses, particularly those of the recreation site, and the walkway to the clubhouse, are common areas maintained by the Association. No wheeled vehicles are to be used in these areas, except wheelchairs, baby carriages, and baby strollers. 16. PORTABLE TEMPORARY STORAGE CONTAINER OR DUMPSTER: Requirements for temporary use of portable storage containers such as PODS, dumpsters, etc., are as follows: A. Office must be notified prior to scheduling the storage container / dumpster delivery. B. Driveway must be protected from any damages that may occur with the placement of the container. C. Container may not be placed on the lawn, street, or common area. D. Container may not impair visibility for drivers; therefore, must be placed as close to the garage as possible. E. If container is a dumpster, it must not be overflowing and materials must be secured as to not become missiles in case of windy days. F. In the event of a hurricane watch, containers must be immediately removed. G. If container is going to remain for more than 14 consecutive days, then a Storage Container Form must be submitted to the KC office with a $ security deposit, along with a current Miami- Dade County Permit (copy to be submitted to our office). H. Upon receipt of Storage Container Form and security deposit with permit, the container may be approved for no more than 30 days. I. A $25.00 per day penalty will be assessed for each day after the approval. This will be deducted from the deposit. 17. SOLICITING: Soliciting members, either door-to door or by mail box stuffing, is not allowed; however, members may solicit Kings Court Proxies from other members, or members may distribute Association communications door-to-door. Solicitors are not permitted on the Association property at any time except by individual appointment with members. 18. ACCESS BY REALTOR AND/OR REALTORS PROSPECTS: A. Owner must advise Management Office in writing of home for sale or lease with realtor s information, if applicable. B. All realtors requiring access should present security with business card in addition to normal identification. Page 3 of 8
4 C. In case of an Open House, security will treat sales prospects as a general visitor, requiring a telephone response from the house. 19. GENERAL USE OF RECREATIONAL FACILITIES: A. All persons use the recreational and other common area facilities at his/her own risk and in conformance with all rules and regulations. Any person may be barred from these areas at the discretion of the Board of Directors, property manager for violation of rules and regulations, or for any other reason which in their judgment constitutes a hazard to others or to the association. Refer to the governing documents for additional restrictions. B. No wheeled vehicle shall be allowed in the pool deck area, except wheelchairs, baby carriages, and baby strollers. C. Any person using the recreational facilities must leave the area in a clean condition or shall be responsible for any cleanup cost. D. The hours of operation for the Recreational Building/Clubhouse are as follows: Monday Saturday: 8:00 a.m. 10:00 p.m. and Sunday: 8:00 a.m. 6:00 p.m. E. The Swimming Pools and Pool Decks may be used daily from "Dawn to Dusk." F. The Tennis Courts may be used between the hours of 8:00 a.m. and 10:00 p.m. only, weather permitting. G. The Racquetball Courts may be used when the Recreational Building is open, except during meetings of the Association. H. Playground is closed from Dusk to Dawn. I. No horseplay or profanity is allowed during use of the recreational facilities. J. Pets are not allowed. K. All persons use the recreational and other common area facilities at his or her own risk. L. GUEST USE: The recreational facilities are maintained primarily for the use and enjoyment of resident families in good standing. Guest use is an available privilege for these families. However, the number of guests and their conduct must be controlled so as not to interfere with resident use. 1. Guest Limits: Guest(s) permitted to use any of the recreational facilities at any one time, any day in the week, shall not exceed four (4) per resident family. A. Resident host must be present with guest(s). B. The resident host must conform to the guest limits, must insure that applicable rules and regulations are observed by guest(s), and is financially responsible for any damages caused by guest(s). C. Generally, issuing invitations to guest(s) should be handled by resident owners or by tenants, and not by their children (dependents). Unless parents are present, dependents under 18 may only invite one guest at a time on any day. M. Clubhouse and 2nd Floor Rooms: 1. These rooms are used for the social activities of the residents, membership meetings, and other business of the Association. When not in use for Association affairs, these rooms may be reserved for private use by residents in accordance with established Association policy. Page 4 of 8
5 2. When the upstairs rooms are not being used, they will be kept locked. Access can then be arranged by contacting the office. 3. When the clubhouse is not reserved, access is available freely for quiet usage. 20. POSTED RULES FOR USE OF FACILITIES: A. Playground (The Rosa Brugal Playground): 1. This is not a public playground. 2. The play equipment is designed to serve children between the ages of 3-11 years with adult supervision. 3. It is private property reserved for use by Residents and their guests only. 4. Play at own risk. 5. To avoid slipping, do not use equipment when it is wet. 6. There should be no more than five (5) children on the play set at the same time. 7. Wear proper footwear (no bare/exposed feet). 8. No running, pushing, or shoving. 9. Hold on with both hands when climbing. 10. Slide down feet first, one child at a time. 11. Do not climb on fence. 12. Do not climb on trees. 13. Do not bring food or glass containers into the playground area. 14. Do not tie a pet (dog, cats, etc.) to the fence outside of the playground area. 15. Keep the gate closed at all times. 16. Association is not responsible for injuries or accidents caused while playing on playground. B. Swimming Pools and Pool Decks: 1. All persons use the pools at their own risk. 2. All children under the age of 10 years must be accompanied by an adult. 3. All persons must shower before entering pools. 4. No food allowed in pool area. 5. No glass bottles or glasses allowed in pool area. 6. Pools are for Kings Court residents and their guests only. 7. No cut-offs or tennis shorts; bathing suits only. 8. Small children (babies/toddlers) must wear appropriate pool diaper protection. 9. No pets in pool area. 10. No running, throwing, jumping, shoving in pool area. Page 5 of 8
6 11. No rafts, air pillows, balls, toys, flippers, or dive equipment. 12. No playing with life-saving equipment. 13. Radio use should be at lowest volume level. 14. No smoking or gum chewing in pool or on pool decks. C. Racquetball Courts: 1. No one under the age of 14 years permitted unless supervised by an adult. 2. One hour limit on courts. 3. Protective eye wear is recommended. 4. No black soled tennis shoes. 5. Racquetball racquets and balls only. 6. No food or beverages allowed in courts. 7. No smoking allowed in courts. D. Tennis Courts: 1. Tennis shoes only. 2. No roller skates, bikes, rollerblades allowed. 3. When someone is waiting to play, please limit your play to one (1) hour for singles, two (2) hours for doubles. 4. For use by Kings Court residents and their guest(s) only. 5. No food, glass containers, or chairs allowed on courts. 6. No smoking allowed on courts. E. Fitness Center: 1. No one under the age of 10 years is allowed. 2. Children from the ages of years allowed with adult supervision. 3. Turn off TV, lights, and fan(s) before leaving the gym/weight room. 4. Do not open the windows. 5. Proper clothing must be worn at all times. 6. Proper shoes must be worn at all times. 7. No gym bag allowed. 8. If others are waiting, please limit your time to 30 minutes on the elliptical, bike, and/or treadmill. 9. Bring a towel. Page 6 of 8
7 10. Return all equipment to its proper place. 11. Room will be kept locked except when in use. 12. No food or beverages allowed in gym/weight room. 13. No smoking allowed in gym/weight room. 21. OPERATION OF VEHICLES: The posted speed limit is 15 mph. Adhere to the speed limit, as there are many children playing and people walking here! A. Vehicles must be operated strictly in accordance with the State of Florida traffic laws. B. All vehicles must have current license plates (tags). C. Bicycles ridden at night must have lights in front and reflectors in back and sides. D. Traffic signs must be obeyed by all drivers. E. Go-carts and golf cars are prohibited. F. Unlicensed operators may not drive any motorized vehicles. 22. PARKING POLICY: Parking Rules are necessary to prevent Kings Court from being overrun with vehicles, improve safety for residents (especially children), preserve guest spaces for guests, minimized traffic hazards for emergency vehicles, and maintain the visual appearance of the community at a high level. A. All vehicles kept outdoors in Kings Court by Residents: 1. Must have up-to-date (current year) license tag. 2. Must be owned by a resident of Kings Court or a guest of a Kings Court resident. 3. Must be registered with the Kings Court office. B. The following activities are prohibited: 1. Parking in the streets or in driveways with any part of the vehicles extending into the street as this presents fire and safety hazards. 2. Parking on the grass (PRIVATE or COMMON PROPERTY). It is the responsibility of the resident host to pay for damage to common area grass resulting from the parking of guest cars. 3. It is the responsibility of the resident family to see that they or their guests do not park in unauthorized areas or for unauthorized purposes. All costs of enforcement shall be borne by the owner/resident family in case of non-compliance with the Parking Rules. 4. Any mechanical work, except for those of an emergency nature, such as a flat tire, battery charge/change, shall be restricted to the resident s driveway. 5. Washing of vehicles on common areas. 6. Noisy vehicles (cars, trucks, motorcycles) which may become a nuisance to other residents. Page 7 of 8
8 C. The following vehicles which shall not be parked or stored outdoors in Kings Court: 1. Inoperative motor vehicles or parts thereof, or vehicles which need repair. 2. Any vehicle larger than a full size car, pickup truck, or van (9 passenger, mini, or conversion). 3. No commercial trailers or commercial vehicles shall be permitted to remain overnight on any private lot. No use of clubhouse parking lot and/or guest parking spaces without the written consent of the Association. 4. Any vehicle with signs which are visible from the outside of the vehicle. 5. Any vehicle with equipment or cargo on the outside of the vehicle. 6. Any new or used vehicle temporarily held for resale (with For Sale sign on it) by a resident or a non-resident). 7. Recreational vehicles, campers, boats, and boat/jet ski trailers, unless written permission has been obtained in advance from the property manager. With permission, vehicles may be parked in the Clubhouse parking lot or homeowner s driveway for a limited time not to exceed 7 days. D. Violation of parking rules shall be handled as follows: 1. The Association will warn resident in person of violations, if possible. 2. Warning notices will be placed on vehicles which continue to be in violation or recurring violations after the initial warning. 3. After a warning sticker has been placed on a vehicle for continuing or recurring violation of Parking Rules, the Association will arrange to have the vehicle TOWED AWAY AT ITS OWNER'S EXPENSE. 4. If a vehicle is parked in a resident s driveway without the resident s permission, that resident may arrange to have the vehicle towed at its owner s expense. E. REQUIREMENTS FOR HANDLING GUEST PARKING AND FOR USE OF GUEST SPACES: 1. The Clubhouse parking lot should be used whenever possible. 2. The guard at the front entrance shall be provided with a written list of guests by the Kings Court resident when a large group of guests are expected. 3. A resident with a visitor staying for more than seven (7) days shall notify Kings Court property manager to report the continuing use of a guest space. 4. Residents are not entitled to long term (more than 60 days), continuous use of guest spaces unless a valid property manager s approval and documentation is issued. 5. Each unit has at least 3 parking spaces (1 garage and 2 driveway). These spaces must be utilized for continuous resident parking. Page 8 of 8
